11.1 DURATION OF REGISTRATION CONTRACT
This programme registration contract, concluded between Prestige Academy (Pty) Ltd (hereafter "Prestige Academy") and the Student/Principal Payer/Co-Payer
(hereafter "the Student"), applies only to the 1st academic year. The Student will be required to register for every new academic year and the annual registration
fees apply to such annual registration.
11.2 ACCREDITATION STATUS OF PRESTIGE ACADEMY (PTY) LTD
Prestige Academy is registered with the Department of Higher Education and Training as a Private Higher Education Institution under the Higher Education Act of
1997 (Registration Certificate No. 2001/HE07/005). All qualifications are registered with the South African Qualifications Authority (SAQA).
11.3.1 QUALIFICATION REGISTERED FOR
The official prospectus of Prestige Academy contains the particulars of each programme offered by Prestige Academy. The Student is advised and encouraged to
peruse and study the prospectus in consultation with the marketing executive of Prestige Academy and his/her guardian in order to ensure that the student
registers for the correct programme. The importance of such correct application is stressed in light of the mentioned cancellation penalty applicable to
cancellations. Prestige Academy reserves the right to alter timetables and programme commencement dates. Written notice to the Student and/or on its website
will be given.
11.3.2 CHANGES TO SYLLABUS
Prestige Academy has the right to make changes to the syllabus and content of a programme at any time, without prior notification and without furnishing reasons
therefore. Changes will be communicated on Prestige Academy's website or through written communication to the Student as soon as the changes have been
approved by institutional structures.
11.4.1 APPLICATION DATE
The closing date for applying and registering is 30 November 2017.
11.4.2 APPLICATION REGISTRATION FEE PAYABLE (Non Refundable)
The application and registration fee for the programme is R2000.00 and is payable when applying. No approval of the Student's application will take place unless
the application and registration fee of R2000 has been paid. By paying this fee does not automatically mean that the Student's application has been approved as
several admission criteria must first be met. This fee is non-refundable.
11.4.3 LATE APPLICATION FEE / ARRIVING LATE (Non Refundable)
An additional fee of R500.00 will be charged for late applications as from 1 December 2017. In the event of a student arriving after commencement of classes, and
the student requires additional tuition other than official classes, an additional R300.00 per hour will be charged.
11.5 PROGRAMME FEES & DEPOSIT
The programme fees for 2018 are fixed. Prestige Academy reserves the right to make changes to these fees only in the case where an additional module is added to
the existing syllabus. The programme deposit of R7000 applies to all programmes and is payable by no later than 30 November 2017.
11.6.1 EARLY ENROLMENT DISCOUNT
If the Student enrols before 31 July 2017 and pays the R2000 application and registration fee and R7000 programme deposit, the Student will qualify to pay 2017
programme fees for the programme applied for, instead of the 2018 fees.
11.6.2 EARLY PAYMENT DISCOUNT
Discount as per fees list applies (last pages of this contract). No discount will apply after 25 January 2018, even where a student loan and/or external bursary is paid
out after 25 January 2018.
11.7.1 TEXTBOOKS – Only applicable to Diploma in Information Technology Network Integration Specialist, or the Higher Certificate in Internetwork System
Specialist
Certain textbooks are included for the above two qualifications only. Prestige Academy reserves the right to make changes to tuition fees for 2018 in respect of
these programmes, should there be an increase in supplier fees. In some instances, the textbooks become the property of the students and in other instances the
textbooks are borrowed from Prestige Academy to the student or notes are given for study purposes. Textbooks may be given electronically or in hard copy. The
above mentioned information will be clearly communicated in the study guides. If any book that is the property of Prestige Academy is stolen/lost and/or not
returned on the final examination date, the student's account will be invoiced and the principal payer/co-payer will be kept liable for the replacement value and
courier fee thereof. No textbooks will be issued unless the programme deposit has been paid.
11.7.2 TEXTBOOKS: ALL OTHER PROGRAMMES
No textbooks are included in the programme fees except for the qualifications mentioned in clause 11.7.1. The student will receive the booklist prior to programme
commencement. Estimated textbook amounts are quoted on the last page of this document. It is the Student's responsibility to purchase these books in advance
prior to programme commencement and to ensure that he/she purchases the correct textbook and the correct version.
11.8 ADDITIONAL FEES: International recognition, examinations and external bodies
IT related examinations such as CompTia A+, MCSA and MCSE, etc. is not included in the tuition fee. All other assessment fees are included in the tuition fee.
11.9 ADDITIONAL FEES: Student Pack
The first year student pack fee of R1700 includes: Student card, branded winter top and bag, 1st year teambuilding camp (compulsory) and 2018 diary. This fee is
payable by 1 January 2018. No refunds are given if a student does not attend these events.
11.10 ADDITIONAL FEES: Kits & Stationery
As part of the Visual Communication Design, Photography and Make-up qualifications, a separate kit price (products) is charged. The first part of the kit is payable
on 1 January 2018 and the second part on 1 June 2018. No kit will be issued without these fees being paid. If a student enrolled for the make-up qualification before
30 November 2017, and paid his/her registration fee and deposit, the student will receive the make-up kits free. It is the Student's responsibility to make sure of
stationery requirements for the specific programme enrolled for.

11.11 ADDITIONAL FEES: Transport, excursion & entrance fees
No transport, accommodation, food or entrance fees relating to any official excursions or social events are included in the fees.
11.12.1 TRANSFER: To another programme
If the Student wishes to transfer from one qualification to another, he/she must apply in writing to do so within the first 7 days after commencement of
classes. This transfer cannot be guaranteed as many factors have to be taken into consideration. It could include:
• availability of space in the classroom where the student wants to be transferred to (the new qualification)
• the amount of teaching time and work the student has missed out on
• portfolio requirements to be adhered to prior to commencement of course i.e. BA (Visual Arts) (Visual Communication Design), BA (Applied Arts) (3D
Animation) and Dip (3-D Design and Digital Animation).
A minimum administration fee of R200.00 is payable irrespective of the programme the student is transferring to. The Student will also be required to
purchase textbooks for the programme he/she is transferring to. No copies of textbooks are handed out due to a student not having the correct textbook on
time. If textbooks have been ordered and purchased for the original programme the student enrolled for, no refunds will be given on returns. In the case of
the Dip (Information Technology Network Integration Specialist) or the HCert (Internetwork Systems Specialist) additional textbook courier fees are charged
and payable to Prestige Academy before the transfer can take place. Additional fees for notes to be printed will be charged. In the case where a student will
need extra classes a fee of R300.00 per hour will be levied.
11.12.2 TRANSFER: One level to another level programme
The Student agrees that where he/she was conditionally approved for a degree programme based on his/her grade 12 results (not the final results) and the
Student no longer meets the criteria to study towards a degree (after final grade 12 results are available), the Student will be transferred to a diploma or
higher certificate programme in the same field of study. The Student may also select another field of study that meets the entry criteria.
11.13.1 REDUCTION IN FEES
The Student accept that he/she shall not be entitled to any reduction of fees whatsoever in the case of not attending classes.
11.13.2 NON-PAYMENT IN FEES: Barring from classes
The Student accepts that should payments according to this contract not be made for a period of two consecutive months, the Student will be barred from
attending lectures (receive tuition). Late interest will be charged. Prestige Academy reserves the right to bar the Student from class for more than once in an
academic year due to no or insufficient payments received. The Student remains responsible for the full year's tuition fees.
11.13.3 NON-PAYMENT IN FEES: Disciplinary steps
The undersigned parties accept that Prestige Academy reserves the right to bar the Student from writing an examination, receiving his/her qualification or
attend classes due to outstanding accounts. If the Student has been barred from lectures due to non-payment or disciplinary steps taken, the actual amount
due will not be reduced.
11.14 RIGHTS TO CANCEL/TERMINATE THIS CONTRACT
11.14.1 The Student is granted a 7 day cooling-off period, from the date of application to cancel the registration. If the registration takes place after 15
January 2018 the registration is final and no cooling off period is valid. The full academic year's fees are payable in case of no show or cancellation.

11.14.2 The programme deposit must be paid by 30 November 2017. The undersigned parties accept that this is a formal application/registration contract
and not only an application form. Should the student cancel this contract after 30 November 2017, the application/registration fee of R2000.00 will be
forfeited and 10% of the deposit (R700) as cancellation penalty will be charged and becomes payable immediately. This applies even if the deposit has not

11.14.3 Only in the case of a student failing grade 12/senior certificate, the Student and Prestige Academy agrees that the cancellation after 30 November
2017 will be accepted. The grade 12 final results (obtainable early in January 2018 at your school) must be submitted together with a cancellation letter at
the latest by 15 January 2018. Only in this case the full deposit of programme fees less 10% cancellation penalty will be refunded. In the case where the full
balance of programme fee was also paid, this balance is refundable. Refunds may take place up to 60 days after cancellation date.
11.14.4 The undersigned parties accept that they will be kept liable for the full programme fee should the applicant cancel his or her enrolment after
15 January 2018. This means that even if no monies were paid over to Prestige Academy, and the Student did not cancel on time, the undersigned parties
will be kept liable for the full annual tuition fees as this is the damages suffered by Prestige Academy. The Student is herewith notified that no verbal
agreement with any employee of Prestige Academy will be enforced, unless the Student has cancelled in writing and acceptance in writing has been given by

11.14.5 If the Student has enrolled for a two/three year qualification but only completed part of the programme (e.g. only one year of study), no qualification
will be issued. The undersigned parties agree that the student and payer(s) will be held liable for the full annual tuition fee in the event of the student not
completing the entire academic year, irrespective of the amount of days/weeks/months in class. It is agreed by the parties that this clause will only be waived
in the case of the student passing away in which case the pro-rata fee based on semester fees will apply.
11.14.6 The Student may view the campus premises on the official Open Days/Winter Workshop. During these sessions the student can obtain more
information on the particular qualification and the campus. It is the responsibility of the Student to make sure that he/she is enrolled for the correct
programme.

11.15 INCIDENTAL CREDIT ARRANGEMENT, INTEREST & ADMINISTRATION CHARGES
All fees are payable in full by 15 January 2018. If the fees can not be settled by 15 January 2018, the Student may approach Prestige Academy in order to negotiate
in respect of the provision of credit and the terms of such incidental credit arrangement. The usual preferred terms of such an arrangement would be based on
payment in 10 (ten) monthly instalments as quoted on the fees list. In the event that instalments are not paid on due date, late interest in terms of the Prescribed
Rate of interest Act, will be applicable. In this regard, the Student is requested to apply for a student loan, immediately on receipt of the acceptance letter from
Prestige Academy, as late payment of such student loans to Prestige Academy is not an excuse/defence against interest charged.
Administration fees such as warning/suspension letters, debit orders/cheques returned unpaid from the bank, telephone/cell phone and SMS charges will be
charged and will vary between rates of R10.00 to R100.00 depending on the cost involved.
11.16 METHOD OF PAYMENT & CASH DEPOSIT FEES
It is advisable to all students paying their account in instalments over a period of 10 months at Prestige Academy, to make use of the debit order system. No cash
over the counter at the bank or the Academy will be accepted due to large cash deposit fees. Fees must be paid via EFT, or per cheque at the bank counter. A debit
order system (see page 9) is available for clients who do not have electronic banking or cheque book facilities. Cash deposit fees will be charged at ABSA’s cash
handling fee.
11.17 ACADEMIC CREDIT: EXEMPTION AND TRANSFER
Exemption for Academic Credits is the process of formally recognising knowledge acquired previously based on recognition of prior learning (RPL). Students may
apply for credit accumulation transfers when changing from one qualification to another, or transferring from another institution to Prestige Academy. Credit
exemption will be considered only per successfully completed module (offered by an accredited higher education institution) that is on the same NQF level as the
equivalent module offered at Prestige Academy. Approximately 80% similarity in outcomes and content will be sufficient to approve exemption and/or transfer. A
fee of R650.00 administration fee is payable before the assessment process can start. Thereafter a fee of R400.00 is payable per module that credit exemption is
applied for. Credit exemption is not automatic and will only be considered if assessment has been conducted by an accredited public or private institution. (Further
information is obtainable at the Academic Manager's office.)
11.18 INSUFFICIENT DEMAND/ENROLMENTS
Prestige Academy has the right in its sole discretion, to postpone or cancel tuition in any programme advertised and offered, on the basis of insufficient
demand/enrolment. All fees will be refunded except the programme registration/administration fees which are non-refundable. The student will have the option to
register for any other programme offered at Prestige Academy. Prestige Academy will be entitled to combine classes of similar modules academic levels and
content. Insufficient enrolments will be communicated timeously to the Student in such a case.
11.19 EXTRAORDINARY EVENT
In the case of any circumstance or an extraordinary event beyond Prestige Academy’s control, such as war, strike, riot, crime or act of God (e.g. floods, etc.) Prestige
Academy is entitled to suspend lectures and temporarily close the campus affected thereby. In this event the student shall not by reason of such suspension or
closure be entitled to terminate this agreement or claim a refund, fees paid or a reduction on fees payable or any compensation from Prestige Academy. Prestige
Academy will as soon as possible transfer students to another building or repair damages in the current building(s) to continue with tuition. To catch up for lost
time, lectures can also take place during evenings and/or weekends or on-line.
11.20 INDEMNITY: IMPORTANT NOTICE:
The student/parent/guardian acknowledges that the student may be exposed to risks in the event of orientation workshops, training, field trips, camps, physical
sport activities, travelling, etc. The student and the undersigned payer(s) hereby waive all claims against Prestige Academy owners and employees for any damages
or loss suffered while the student is, or as the result of being, a student of this institution resulting in death, mental harm or arising from physical injury, or illness
suffered by the student or any other person. Such consequences include any loss, destruction of or damage to any property belonging to the student or any other
person howsoever the damage or loss is caused by, but is not limited to, the negligence of Prestige Academy or any official employee or representative of this
institution.
11.21 ORIENTATION
The student has the right to voluntarily take part in the orientation and induction at Prestige Academy/Hostel. Orientation takes place in an orderly manner for
example, academic orientation, braai, dances, teambuilding camp, concerts, etc.

11.22 DECLARATION
IMPORTANT NOTICE
The student and undersigned payer(s) understand, accept and agree:

11.22.1 that Prestige Academy shall have the right to summarily terminate the student’s programme and expel him/her from Prestige Academy should the
undersigned breach any aforesaid undertakings or by reason of disciplinary actions taken. The Student understand that he/she will be kept liable for the full annual
programme fee even if the Student has been expelled;

11.22.2 that the Student further give permission to Prestige Academy officials to do the necessary credit checks for credit arrangements;

11.22.4 that the Student undertake to comply with all the rules and regulations, including the disciplinary rules and any amendments thereof as published from
time to time and to acquaint the undersigned with all the provisions thereof.
The student, sponsor/account payer and co-account payer declares by signing hereunder that they have studied the tuition fees and accept these fees, the terms
and conditions thereof.
The student, sponsor/principal payer(s) declare that they have studied the student pack and kit pricelist as well as fees not included in the tuition fees, and accept
these additional fees.
11.23 SURETY AND CO-PRINCIPAL PAYERS
The Student binds him/her to Prestige Academy, jointly and severally, as co-sureties and co-payers for the payment of all fees and other charges due by them to
Prestige Academy in terms of this contract.
The parties consent to the jurisdiction of the Magistrate's Courts, in respect of any legal proceedings that may be instituted arising from or in respect of contract,
notwithstanding the fact that the amount in dispute may exceed the jurisdiction of the Magistrates Court. In this regard the parties choose as their domicilium
citandi et executandi for all purposes their physical addresses included in this contract.
GENERAL
No concession, relaxation or indulgence granted by either of the parties to the other party shall be deemed to be a waiver of any of that party's rights in terms
hereof, nor shall any relaxation or indulgence be deemed to be a notation of any of the terms and conditions of this registration contract. This contract shall
constitute the whole agreement between the parties, and no amendment or agreed upon cancellation thereof shall bind the parties unless put in writing and
signed by both parties. Legal costs to be awarded to any party to this contract in the event of legal proceedings in respect of a cause of action arising from this
contract, will be calculated on the attorney and client scale of fees and will include collection and tracing charges in enforcing the obligations of any of the parties to
this agreement.
