INTRODUCTION

DrugsandCosmeticsAct1940andRulesthereunderprovideforappointmentofInspectorsofAyurveda,Siddha&Unani(ASU)systemsofmedicineswhoplaysignificantroleinimplementationof Drugs & Cosmetics (D&C)Act 1940 and Rules thereunder. One of the important tasks ofInspectorsworkingunder theStateLicensingAuthorityofASUsystems is inspectionofASUDrug manufacturing Units before issuing license to manufacture ASU drugs under the provisions oftheD&CActandRulesthereunder.

TraininglevelandexperienceofInspectorsforthepurposeofregulatoryimplementationvariesbecausequalificationsprescribedforDrugInspectorsofASUdrugsvary.TheInspectormaybeagraduateinPharmacy/PharmaceuticalChemistry/Medicine(withspecializationinClinicalpharmacology or Microbiology) having undergone practical training in the manufacture ofASUdrugsorhavingaDegree/DiplomainA/S/UsystemsofmedicinesorpossessingDegreein Ayurveda Pharmacy as per the provisions of the Act and Rules thereunder. Under suchcircumstanceswhenthequalificationsandexperience levelsof inspectorsvary, it is importanttoimpartcomprehensiveknowledgeoftheD&CActandRulesthereundertotheinspectorsforfacilitatinguniformimplementationoftheAct.Thisisallmoreimportantasthereisnoinductiontrainingwhenthepersonwithrequisitequalificationisassignedthejobofaninspector.Inmanyof the States, due to lack of dedicated manpower for enforcement of provisions of Drugs & CosmeticsAct,ASUdoctorsworkingintheHospitals/Dispensariesaredesignatedasinspectorsusuallywithoutanyadditional capacitybuilding training specificallyonanalytical aspects. Insuch a situation this manual becomes even more essential.

Thisinspectionmanualcoveringvariousaspectsaboutthequalifications,dutiesandresponsibilitiesof inspectors will be a much needed helpful guide for orientation of ASU inspectors for proper dischargeof theirdutiesunderD&CActandRules thereunder.TheGuidelines for InspectionofGMPcompliancebyASUdrugindustryareespeciallyexplainedindetailfordevelopmentofinsightoftheinspectorsregardinginterpretationandimplementationoftheRules.ThismanualisexpectedtoassistStateLicensingAuthoritiestoaugmenttheregulatorycapacitiesofinspectorsand develop master trainers as well.

Chapter I

GMP: An Overview

1. GMP

Good Manufacturing Practice (GMP)isaproductionandtestingpracticethathelpstoensurea quality product. GMP guidelines are not prescriptive instructions on how to manufactureproducts.Theseareaseriesofgeneralprinciplesthatmustbeobservedduringmanufacturing.When a company is setting up its quality program and manufacturing process, there may be manywaysitcanfulfillGMPrequirements.Itisthecompany’sresponsibilitytodeterminethemosteffectiveandefficientqualityprocess.

TheGoodManufacturingPracticesforASUDrugsasdescribedinRule157ofDrugs&CosmeticsRules1945withconditionsasspecifiedinScheduleT/GMParetoensurethat:

(I) Rawmaterialsusedinthemanufactureofdrugsareauthentic,ofprescribedqualityand are free from contamination

(II) Themanufacturingprocessisashasbeenprescribedtomaintainthestandards

(III) Adequatequalitycontrolmeasuresareadopted

(IV) Themanufactureddrugwhichisreleasedforsaleisofacceptablequality

(V) Toachievetheobjectives listedabove,each licenseeshallevolvemethodologyandprocedures for following the prescribed process of manufacture of drugs which should be documented as a manual and kept for reference and inspection. However, under IMCCAct,1970registeredVaidyas,SiddhasandHakeemswhopreparemedicineson their own to dispense to their patients and not selling such drugs in the market are exemptedfromthepurviewofGoodmanufacturingPractice(GMP)

2. Importance of GMP

Unlike conventional pharmaceutical products, which are usually produced from synthetic materials by means of reproducible manufacturing techniques and procedures, ASU medicines are mainly prepared from materials of herbal origin, which are often obtained from varied geographicaland/orcommercialsources.Asaresultitmaynotalwaysbepossibletoascertain

theconditionstowhichtheymayhavebeensubjected.Inaddition,theymayvaryincompositionand properties. Furthermore, the procedures and techniques used in the manufacture and quality control of ASU medicines are often substantially different from those employed for conventional pharmaceutical products.

Becauseoftheinherentcomplexityofnaturallygrownmedicinalplantsandtheoftenvariablenatureof cultivatedones, the examplesof contaminationwith toxicmedicinalplants and/orplant parts and the number and small quantity of defined active ingredients, the productionandprimaryprocessinghasadirectinfluenceonthequalityofASUmedicines.Forthisreason,applicationofGMPs in themanufactureofASUmedicines is an essential tool to assure theirquality.

3. Basic Principles of GMP

Many countries have legislated that pharmaceutical and medical device companies must followGMPprocedures,andhavecreatedtheirownGMPguidelinesthatcorrespondwiththeirlegislation.Basicconceptsofalloftheseguidelinesremainmoreorlesssimilartotheultimate goals of safeguarding the health of the patient as well as producing good quality medicine.

Althoughthereareanumberofthem,allguidelinesfollowafewbasicprinciples:

● Manufacturingprocessesareclearlydefinedandcontrolled.Allcriticalprocessesarevalidatedtoensureconsistencyandcompliancewithspecifications.

● Manufacturingprocessesarecontrolled,andanychangestotheprocessareevaluated.Changesthathaveanimpactonthequalityofthedrugarevalidatedasnecessary.

● Instructionsandproceduresarewritteninclearandunambiguouslanguage.

● Operatorsaretrainedtocarryoutanddocumentprocedures.

● Recordsaremademanuallyorbyinstrumentsduringmanufacturethatdemonstratethatall the steps requiredby thedefinedproceduresand instructionswere in facttakenandthatthequantityandqualityofthedrugwasasexpected.Deviationsareinvestigated and documented.

● Recordsofmanufacture(includingdistribution)thatenablethecompletehistoryofabatch to be traced are retained in a comprehensible and accessible form.

● Asystemisavailableforrecallinganybatchofdrugfromsaleorsupply.

● Complaints aboutmarketeddrugs are examined, the causes of qualitydefects areinvestigated, and appropriate measures are taken with respect to the defective drugs and to prevent recurrence.

Theremaybemanyways for a company to fulfil theGMP requirementswhile settingup itsqualityprogramandmanufacturingprocess.Itisthecompany’sresponsibilitytodeterminethemosteffectiveandefficientqualityprocess.

4. Legal provisions for GMP

ThelegalprovisionsrelatedtoGMParedescribedunderDrugsandCosmeticsRules1945,particularlyRule151to160andScheduleT.

5. Roles and responsibilities of Inspectors conducting GMP inspection

The powers which may be exercised by an Inspector and the duties which may beperformedbyhimand the conditions, limitations, or restrictions subject towhich suchpowersanddutiesmaybeexercisedorperformedshallbesuchasmaybeprescribedinDrugs&CosmeticsAct1940andRulesthereunder.

In relation toAyurvedic, SiddhaorUnanidrug, an inspectorappointedby theCentralGovernmentoraStateGovernmentundersection33GofDrugs&CosmeticsAct1940iscalled as Inspector.

ApersonwithanyofthefollowingqualificationscanbeappointedasanInspector:

(a) Degree in Pharmacy/ Pharmaceutical Sciences/ Medicine with specialization inClinical pharmacology orMicrobiology from aUniversity established in India bylaw and shall have undergone practical training in the manufacture of Ayurvedic (includingSiddha)orUnanidrug,asthecasemaybe;or

(b) DegreeinAyurvedicorSiddhaorUnaniSystemoradegreeinAyurvedaPharmacy,as the case may be, conferred by a University or State Government or a Statutory Faculty,CouncilorBoardofIndianSystemsofMedicinerecognizedbytheCentralGovernmentortheStateGovernmentforthispurpose;or

(c) DiplomainAyurveda,SiddhaorUnaniSystems,as thecasemaybe,grantedbyaStateGovernmentoranInstitutionrecognizedbytheCentralGovernmentoraStateGovernment for this purpose.

Drugs&CosmeticsRule167and49maybeseenfordetails.

Anypersonhavinganyfinancialinterestinthemanufactureorsaleofanydrugcannotbeappointed as Inspector in spite of meeting above requirements.

Duties regarding regulation of manufacture for sale of ASU drugs

Subjecttotheprovisionsofsection23andofanyrulesmadebytheCentralGovernmentinthis behalf, an Inspector may, within the local limits of the area for which he is appointed—

Inspect,

(i) anypremiseswhereinanyASUdrugsisbeingmanufacturedandthemeansemployedforstandardizingandtestingtheASUdrugs;

(ii) anypremiseswhereinanyASUdrugsisbeingsold,orstockedorexhibitedorofferedfor sale, or distributed .

TakesamplesofanyASUdrug,

(i) whichisbeingmanufacturedorbeingsoldorisstockedorexhibitedorofferedforsale,orisbeingdistributed;

(ii) fromanypersonwhoisinthecourseofconveying,deliveringorpreparingtodeliversuch ASU drugs to a purchaser or a consignee.

At all reasonable times, with such assistance, if any, as he considers necessary,

(i) searchanyperson,who,hehasreasontobelieve,hassecretedabouthisperson,anyASUdrugsinrespectofwhichanoffenceunderChapterIV-AofD&CActhasbeen,orisbeing,committed;or

(ii) enterandsearchanyplaceinwhichhehasreasontobelievethatanoffenceunderChapterIV-AofD&CActhasbeen,orisbeingcommitted;or

(iii) stop and search any vehicle, vessel, or other conveyancewhich, he has reason tobelieve, is being used for carrying any ASU drug in respect of which an offence under ChapterIV-AofD&CActhasbeen,orisbeing,committed,andorderinwritingtheperson in possession of the ASU drugs in respect of which the offence has been, or is being,committed,nottodisposeofanystockofsuchASUdrugsforaspecifiedperiod

notexceedingtwentydays,or,unlesstheallegedoffenceissuchthatthedefectmayberemovedbythepossessoroftheASUdrugs,seizethestockofsuchASUdrugsand any substance or article by means of which the offence has been ,or is being, committed or which may be employed for the commission of such offence. (Clause c of Section 22 of D&C Act 1940)

Examineanyrecord,register,documentoranyothermaterialobjectfoundwithanyperson,orinplace,vehicle,vesselorotherconveyancereferredasaboveandseizethesame if he has reason to believe that it may furnish evidence of the commission of an offencepunishableunderthisActortheRulesmadethereunder.

A receipt by an Inspector for the stock of any ASU drugs or any record, register, documentoranyothermaterialobjectseizedbyhimshallbeinForm16ofDrugs&CosmeticsRules1945.

Requireanypersontoproduceanyrecord,register,orother documentrelatingtothemanufactureforsaleorfordistribution,stocking,exhibitionforsale,offerforsaleor distribution of any ASU drugs in respect of which he has reason to believe that an offenceunderChapterIV-AofD&CActhasbeen,orisbeing,committed.

Exercise such other powers asmay be necessary for carrying out the purposes ofChapterIV-AofD&CActoranyrulesmadethereunder.

TheprovisionsoftheCodeofCriminalProcedure,1973shall,sofarasmaybe,applytoanysearchorseizureunderChapterIV-AofD&CActastheyapplytoanysearchorseizuremadeundertheauthorityofawarrantissuedundersection94ofthesaidCode.

Everyrecord,registerorotherdocumentseizedorproducedasaboveshallbereturnedtotheperson,fromwhomtheywereseizedorwhoproducethesame,withinaperiodof twentydaysof thedateofsuchseizureorproduction,as thecasemaybe,aftercopiesthereoforextractstherefromcertifiedbythatperson,insuchmannerasmaybe prescribed, have been taken.

IfanypersonwilfullyobstructsanInspectorintheexerciseofthepowersconferreduponhimbyorunderChapterIV-AofD&CActorrefusestoproduceanyrecord,register or other document when so required as mentioned above, he shall be punishablewithimprisonmentwhichmayextendtothreeyears,orwithfine,orwithboth.

Subjecttotheinstructionsofthecontrollingauthority,itshallbethedutyofanInspectorauthorizedtoinspectthemanufactureofAyurvedic(includingSiddha)orUnanidrugs—

(i) to inspect not less than twice a year, all premises licensed for manufacture ofAyurvedic(includingSiddha)orUnanidrugswithintheareaallottedtohimandtosatisfy himself that the conditions of the license and the provisions of the Act and the Rulesmadethereunderarebeingobserved;

(ii) tosendforthwithtothecontrollingauthorityaftereachinspectionadetailedreportindicating whether or not the conditions of the license and the provisions of the Act andrulesmadethereunderarebeingobserved;

(iii) totakesamplesofthedrugsmanufacturedonthepremisesandsendthemfortestoranalysisinaccordancewiththeseRules;

(iv) to institute prosecutions in respect of violation of the Act and the Rules madethereunder.

Every inspector shall be deemed to be a public servant within the meaning of section 21oftheIndianpenalCodeandshallbeofficiallysub-ordinatetosuchauthorityastheGovernment appointing him may specify in this behalf.

TheCentralGovernmentoraStateGovernmentmay,bynotificationintheOfficialGazette,appointsuchpersonsasitthinkfit,havingtheprescribedqualifications,tobeInspectorsforsuchareasasmaybeassignedtothembytheCentralGovernmentortheStateGovernment,as the case may be.

Standard procedure for drug sample collection by a Drug Inspector

WhereanInspectortakesanysampleofanASUdrugsunderChapterIV-AofD&CAct, he shall tender the fair price thereof and may require a written acknowledgement therefor.

Wherethepricetenderedisrefused,orwheretheInspectorseizesthestockofanyASUdrugs,heshalltenderareceiptthereforeintheForm17AofDrugs&CosmeticsRules1945.

Where an Inspector takes a sample of a ASU drugs for the purpose of test or analysis, heshallintimatesuchpurposeinwritingintheForm17ofDrugs&CosmeticsRules1945, to the person from whom he takes it and, in the presence of such person unless he wilfully absents himself, shall divide the sample into four portions and effectively

seal and suitably mark the same and permit such person to add his own seal and mark toalloranyoftheportionssosealedandmarked:

Provided thatwhere the sample is taken frompremiseswhereon theASUdrug isbeing manufactured, it shall be necessary to divide the sample into three portions only:

ProvidedfurtherthatwheretheASUdrugsismadeupincontainersofsmallvolume,instead of dividing a sample as aforesaid, the Inspector may, and if the ASU drugs be suchthatitislikelytodeteriorateorbeotherwisedamagedbyexposureshall,takethree or four, as the case may be, of the said containers after suitably marking the same and, where necessary, sealing them.

TheInspectorshallrestoreoneportionofasamplesodividedoronecontainer,asthecase may be, to the person from whom he takes it, and shall retain the remainder and disposeofthesameasfollows:

(i) oneportionorcontainerheshallforthwithsendtotheGovernmentAnalystfortestoranalysis.

(TheSamplefortestoranalysistobesenttotheGovernmentAnalystshallbesentbyregistered post or by hand in a sealed package, enclosed together with a memorandum inForm18-AofDrugs&CosmeticsRules1945,inanouteraddressedtotheGovernmentAnalyst.Thepackageaswellastheoutercovershallbemarkedwithadistinguishingnumber. A copy of the memorandum and a specimen impression of the seal used to seal the package shall be sent by registered post or by hand to the Government Analyst.OnthereceiptofthepackagefromanInspector,theGovernmentAnalystoranOfficerauthorizedbyhiminwritinginhisbehalfshallopenthepackageandshallalsorecordtheconditionsofthesealsonthepackage).

(ii) the second he shall produce to the Court before which proceedings, if any, areinstitutedinrespectoftheASUdrugs;

(iii) thethird,wheretaken,heshallsendtotheperson,ifany,whosename,addressandother particulars have been disclosed under section 18A.

(Section18A– “Everyperson,notbeing themanufacturerof aASUdrugs orhisagent for the distribution thereof, shall, if so required, disclose to the Inspector the name, address and other particulars of the person from whom he acquired the drug orcosmetic.”)

Where an Inspector takes any action under clause (c) of section 22,

(i) heshallusealldespatchinascertainingwhetherornottheASUdrugscontravenesanyoftheprovisionsofthesection33EECand,ifitisascertainedthattheASUdrugsdoes not so contravene, forthwith revoke the order passed under the said clause or, as the case may be take , such action as may be necessary for the return of the stock seized;

(ii) ifheseizesthestockoftheASUdrugs,heshallassoonasmaybe,informaJudicialMagistrateandtakehisordersastothecustodythereof;

(iii) withoutprejudicetotheinstitutionofanyprosecution,iftheallegedcontraventionbesuch that the defect may be remedied by the possessor of the ASU drugs, he shall, on beingsatisfiedthatthedefecthasbeensoremedied,forthwithrevokehisorderunderthe said clause.

WhereanInspectorseizesanyrecord,register,documentoranyothermaterialobject,heshall,assoonasmaybe,informaJudicialMagistrateandtakehisordersastothecustody thereof.

Duties Regarding Joint Inspection for Approval of Drug Testing laboratories under Rule 160A-J

Beforeanapproval inForm48 isgranted, theapprovingauthority shall cause thelaboratory at which the testing of Ayurvedic, Siddha and Unani drugs as the case may be,isproposedtobecarriedouttobeinspectedjointlybytheInspectorsappointedordesignatedby theCentralGovernmentandStateGovernment for thispurpose,whoshallexaminethepremisesandtheequipmentintendedtobeusedfortestingofdrugsandverifyintotheprofessionalqualificationsoftheexpertstaffwhoareormaybe employed by the laboratory.

Reportofinspection.-TheInspectorsappointedbytheCentralGovernmentasstatedinRule160-Eshallforwardtotheapprovingauthorityadetailedreportoftheresultsof the inspection.

Chapter II

Legal provisions for GMP certification

Rules as in Drugs & Cosmetics Rules 1945 regarding

Manufacture for Sale of Ayurvedic (including Siddha) or Unani Drugs

(Part XVI of D&C Rules 1945)

151. Manufacture on more than one set of premises

IfAyurvedic(includingSiddha)orUnanidrugsaremanufacturedonmorethanonesetofpremises, a separate application shall be made and a separate licence shall be obtained in respect of each such set of premises.

152. Licensing Authorities

ForthispurposeofthisParttheStateGovernmentshall appointsuchLicensingAuthoritiesandforsuchareasasmaybespecifiedinthisbehalfbynotificationintheOfficialGazette.

153. Application for licence to manufacture Ayurvedic (including Siddha) or Unani drugs.

(1) An application for the grant or renewal of a licence to manufacture for sale any Ayurvedic (including Siddha) orUnani drugs shall bemade in Form 24-D to theLicensingAuthorityalongwithafeeofrupeesonethousand:

Providedthatinthecaseofrenewaltheapplicantmayapplyfortherenewalofthelicencebeforeitsexpiryorwithinonemonthofsuchexpiry:

Provided further that the applicantmayapply for renewal after the expiryof onemonthbutwithinthreemonthsofsuchexpiryinwhichcasethefeepayableforrenewalof such licence shall be rupees one thousand and two hundred plus an additional fee ofrupeessixhundred..

(2) Afeeofrupeesthreehundredshallbepayableforaduplicatecopyofalicenceissuedunder this rule, if the original licence is defaced, damaged or lost.

153-A Loan Licence

(i) AnapplicationforthegrantorrenewalofaloanlicencetomanufactureforsaleofanyAyurvedic(includingSiddha)orUnanidrugsshallbemadeinForm24-EtotheLicensingAuthorityalongwithafeeofrupeessixhundred.

Explanation—For the purpose of this rule, a loan licence means a licence which a LicensingAuthoritymayissuetoanapplicantwhodoesnothavehisownarrangementsfor manufacture but intends to avail himself of the manufacturing facilities owned by alicenceinForm25-D:

PROVIDEDthatinthecaseofrenewaltheapplicantmayapplyfortherenewalofthelicencebeforeitsexpiryorwithinonemonthofsuchexpiry:

PROVIDEDfurtherthattheapplicantmayapplyforrenewalaftertheexpiryofonemonth, butwithin threemonths of such expiry inwhich case the fee payable forrenewalofsuchlicenceshallberupeessixhundredplusanadditionalfeeofrupeesthree hundred.

(ii) Afeeofrupeesonehundredandfiftyshallbepayableforaduplicatecopyofalicenceissued under this rule, if the original licence is defaced, damaged or lost.

154. Form of licence to manufacture Ayurvedic (including Siddha) or Unani drugs

(1) Subjecttotheconditionsofrule157beingfulfilled,alicencetomanufactureforsaleanyAyurvedic(includingSiddha)orUnanidrugsshallbeissuedinForm25-D.Thelicence shall be issued within a period of three months from the date of receipt of the application.

(2) AlicenceunderthisruleshallbegrantedbythelicensingauthorityafterconsultingsuchexpertinAyurvedic(includingSiddha)orUnaniSystemsofmedicineasthecasemay be, which the State Government may approve in this behalf.

154-A Form of loan licence to manufacture for sale of Ayurvedic (including Siddha) or Unani drugs

(i) AloanlicencetomanufactureforsaleofanyAyurvedic(includingSiddha)orUnanidrugs shall be issued in Form 25E.

(ii) AlicenceunderthisruleshallbegrantedbytheLicensingAuthorityafterconsultingsuchexpert inAyurvedic (includingSiddha)orUnanisystemsofmedicine,as thecase may be, which the State Government may approve in this behalf.

(iii) TheLicensingAuthorityshall,beforethegrantofaloanlicence,satisfyhimselfthatthe manufacturing unit has adequate equipment, staff, capacity for manufacture and facilities for testing, to undertake the manufacture on behalf of the applicant for a loan licence.

155. Certificate of renewal

155-B Certificate of award of G.M.P. of Ayurveda, Siddha and Unani Drugs

(i) The certificate of Good Manufacturing Practices to manufacturers of Ayurveda,SiddhaorUnanidrugs shall be issued for a period of five years to licenseeswhocomplywiththerequirementsofGoodManufacturingPractices(GMP)ofAyurveda,SiddhaandUnanidrugsaslaiddowninScheduleT.

(ii) Thecertificatereferredtoinsubrule(1)shallbeissuedforaperiodoffiveyearsfromthe date of issuance of the license.

156. Duration of licence

An original licence in Form 25-D or a renewed license in Form 26-D, unless sooner suspended orcancelledshallbevalidforaperiodoffiveyearsfromthedateofitsissueorrenewed.

PROVIDEDthat if theapplicationfor therenewalofa licence ismadebefore itsexpiryorwithinonemonthofitsexpiry,oriftheapplicationismadewithinthreemonthsofitsexpiryafterpaymentoftheadditionalfeeofrupeesfivehundred,thelicenceshallcontinuetobeinforceuntilordersarepassedontheapplication.Thelicenceshallbedeemedtohaveexpired,iftheapplicationforitsrenewalisnotmadewithinthreemonthsofitsexpiry.

156-A Duration of loan licence

An original loan licence in Form 25-E or a renewed loan licence in Form 26-E, unless sooner suspendedorcancelled,shallbevalidforaperiodoffiveyearsfromthedateofitsissueorrenewed:

PROVIDEDthatiftheapplicationfortherenewalofaloanlicenceismadeinaccordancewith rule 153-A, the loan licence shall continue to be in force until orders are passed on the application.Thelicenceshallbedeemedtohaveexpired,iftheapplicationforitsrenewalisnotmadewithinthreemonthsofitsexpiry.

157. Conditions for the grant or renewal of a licence in Form 25-D

BeforealicenceinForm25-DisgrantedorrenewedinForm26-Dthefollowingconditionsshall be complied with by the applicant, namely—

(1) ThemanufactureofAyurvedic(includingSiddha)orUnanidrugsshallbecarriedoutinsuchpremisesandundersuchhygienicconditionsasarespecifiedinScheduleT.

(a) ForissuingofthecertificateofGoodManufacturingPractices,theLicensingAuthorityshallverifytherequirementsasperScheduleTandissuetheGoodManufacturingPractices certificate inForm26E-I, simultaneouslyalongwithgrantor renewalofLicenseinForm25-D.

(2) ThemanufactureofAyurvedic(includingSiddha)orUnanidrugsshallbeconductedunder the direction and supervision of competent technical staff consisting at least one person,whoisawholetimeemployeeandwhopossessesthefollowingqualifications,namely—

(a) AdegreeinAyurvedaorAyurvedicPharmacy,SiddhaorUnanisystemofmedicine,as the case may be, conferred by a University, a State Government or Statutory

Faculties, Councils and Boards of Indian Systems ofmedicines recognized by theCentralGovernmentoraStateGovernmentforthispurpose,or

(b) A diploma inAyurveda, Siddha orUnani system ofmedicine granted by a StateGovernmentoranInstitutionrecognisedbytheCentralGovernmentforthispurpose,or

(c) AgraduateinPharmacyorPharmaceuticalChemistryorChemistryorBotanyofaUniversity recognized by theCentralGovernmentwith experience of at least twoyears in the manufacture of drugs pertaining to the Ayurvedic or Siddha or Unani systems of medicines, or

(d) AVaidorHakimregisteredinaStateRegisterofPractitionersofindigenoussystemsofmedicineshavingexperienceofatleastfouryearsinthemanufactureofAyurvedicor Siddha or Unani drugs, or

(e) AqualificationasPharmacistinAyurvedic(includingSiddha)orUnanisystemsofmedicine,possessingexperienceofnot less thaneightyears in themanufactureofAyurvedicorSiddhaorUnanidrugsasmayberecognizedbytheCentralGovernment.

(3) ThecompetenttechnicalstafftodirectandsupervisethemanufactureofAyurvedicdrugs shall have qualifications in Ayurveda and the competent technical staff todirect and supervise the manufacture if Siddha drugs and Unani drugs shall have qualificationinSiddhaorUnani,asthecasemaybe.

157-A Maintaining of records of raw material used by licensed manufacturing unit of Ayurveda, Siddha and Unani drugs in the preceding financial year

Each licensed manufacturing unit of Ayurveda or Siddha or Unani drugs shall keep a record of raw material used by each licensed manufacturing unit of Ayurveda, Siddha or Unanidrugs,asthecasemaybeintheproformagiveninScheduleTAinrespectofallrawmaterialsutilizedbythatunitinthemanufactureofAyurvedaorSiddhaorUnanidrugsintheprecedingfinancialyear,andshallsubmitthesamebythe30thdayofJuneofthesucceedingfinancialyeartotheStateDrugLicensingAuthorityofAyurveda,SiddhaandUnanidrugsandtotheNationalMedicinalPlantsBoardoranyagencynominatedbytheNationalMedicinalPlantsBoardforthispurpose.

158. Conditions of licence

AlicenceinForm25-Dshallbesubjecttotheconditionsstatedthereinandtothefollowingfurther conditions, namely —

(a) Thelicenseeshallmaintainproperrecordsofthedetailsofmanufactureandofthetests, if any, carried out by him, or by any other person on his behalf, of the raw materialandfinishedproducts.

(b) ThelicenseeshallallowanInspectorappointedundertheActtoenteranypremiseswhere the manufacture of a substance in respect of which the licence is issued is carried on, to inspect the premises, to take samples of the raw material as well as finishedproducts,andtoinspecttherecordsmaintainedundertheserules.

(c) ThelicenseeshallmaintainanInspectionBookinForm35toenableanInspectortorecord his impressions and the defects noticed.

158-A Conditions of loan licence

AlicenceinForm25-Eshallbesubjecttothefollowingfurtherconditions,namely:

(i) ThelicenceinForm25-Eshallbedeemedtobecancelledorsuspended,ifthelicenceowned by the licensee in Form 25-D whose manufacturing facilities have been availed of by the licensee is cancelled or suspended, as the case may be, under these rules.

(ii) ThelicenseeshallcomplywiththeprovisionsoftheActandoftheRulesandwithsuchfurtherrequirementsifany,asmaybespecifiedinanyRulessubsequentlymadeunderChapterIV-AoftheAct,providedthatwheresuchfurther,requirementsarespecifiedintheRules;thesewouldcomeintoforcefourmonthsafterpublicationintheOfficialGazette.

(iii) Thelicenseeshallmaintainproperrecordsofthedetailsofmanufactureandofthetests, if any, carried out by him, or any other person on his behalf, of the raw materials andfinishedproducts.

(iv) ThelicenseeshallallowanInspectorappointedundertheActtoinspectallregistersand records maintained under these rules and shall supply to the Inspector such information as he may require for the purpose of ascertaining whether the provisions oftheActandtheRuleshavebeenobserved.

158-B Guidelines for issue of license with respect to Ayurveda, Siddha or Unani drugs

I. (A) Ayurveda, Siddha Unani Medicines under section 3 (a):-

Ayurveda, Siddha or Unani drugs includes all medicines intended for internal or externalusefororinthediagnosis,treatment,mitigationorpreventionofdiseaseordisorder inhumanbeingsoranimals,andmanufacturedexclusivelyinaccordancewith the formulae described in the authoritative books of Ayurvedic, Siddha and UnaniTibbsystemofmedicine,asspecificintheFirstSchedule;

(B). Patent or Proprietary medicine under section 3(h);

(i) In relation to Ayurvedic, Siddha and Unani Tibb system of medicine of allformulations containing only such ingredients mentioned in the formulae described in the authoritative booksofAyurveda,SiddhaorUnaniTibbsystemofmedicinesspecifiedintheFirstSchedule,butdoesnotincludeamedicinewhichisadministratedby parenteral route and also a formulation included in the authoritative books as specifiedinclause(a);

(ii) Balya/Poshak/Muqawi/Unavuporutkal/positive health promoter formulations having ingredientsmentionedinbooksofFirstScheduleoftheDrugsandCosmeticsActandrecommended for promotional and preventive health.

(iii) Saundarya Prasadak (Husane afza)/Azhag-sadhan formulations having ingredients mentionedinBooksofFirstScheduleoftheDrugsandCosmeticsActandrecommendedfor oral,skin, hair and body care.

(iv) Aushadh Ghana (medicinal Plant extracts – dry/wet) extract obtained fromplantmentioned in books of First Schedule of the Act including Aqueous or hydro-alcohol.

II. (A) For issue of license to the medicine with respect to Ayurvedic, Siddha or Unani, the conditions relating to safety study and the experience or evidence of effectiveness shall be such as specified in columns (5) and (6) of the Table given below:-

159. Cancellation suspension of licences

(1) TheLicensingAuthoritymay,aftergivingthelicenseeanopportunitytoshowcausewithinaperiodwhichshallnotbelessthanfifteendaysfromthedateofreceiptofsuch notice, why such an order should not be passed, by an order in writing stating thereasonstherefore,cancelalicenceissuedunderthisPartorsuspenditforsuchperiodashethinksfit,eitherwhollyorinrespectofsomeofthedrugstowhichitrelates, if in his opinion, the licensee has failed to comply with any of the conditions ofthelicenceorwithanyprovisionsoftheActandtheRulesmadethereunder.

(2) Alicenseewhose licencehasbeensuspendedorcancelledmayappeal to theStateGovernment within a period of three months from the date of receipt of the order which shall, after considering the appeal, decide the same.

160. Identification of raw materials

RawmaterialsusedinthepreparationofAyurvedic(includingSiddha)orUnanidrugsshallbeidentifiedandtested,wherevertestareavailablefortheirgenuineness,andrecordsof such tests as are carried out for the purpose and the methods thereof shall be maintained.

Good manufacturing practices for ayurvedic, siddha and unani medicines

TheGoodManufacturingPractices(GMP)areprescribedasfollowsinPartIandPartIItoensurethat:

(i) Rawmaterialsusedinthemanufactureofdrugsareauthentic,ofprescribedqualityandare free from contamination.

(ii) Themanufacturingprocessisashasbeenprescribedtomaintainthestandards.

(iii) Adequatequalitycontrolmeasuresareadopted.

(iv) Themanufactureddrugwhichisreleasedforsaleisofacceptablequality.

(v) To achieve the objectives listed above, each licensee shall evolve methodology andprocedures for following the prescribed process of manufacture of drugs which should bedocumentedasamanualandkeptforreferenceandinspection.However,underIMCCAct1970registeredVaidyas,SiddhasandHakeemswhopreparemedicinesontheirowntodispensetotheirpatientsandnotsellingsuchdrugsinthemarketareexemptedfromthepurviewofG.M.P.

1.1 General Requirements:

1.1(A)Locationand surroundings-The factorybuilding formanufactureofAyurveda,Siddhaand Unani medicines shall be so situated and shall have such construction as to avoid contamination from open sewerage, drain, public lavatory or any factory which produces disagreeableorobnoxiousodourorfumesorexcessivesoot,dustorsmoke.

1.1(B) Buildings-Thebuildingusedforfactoryshallbesuchastopermitproductionofdrugsunderhygienicconditionsandshouldbefreefromcobwebsandinsects/rodents. Itshouldhave adequate provision of light and ventilation. Thefloorandthewallsshouldnotbedampormoist.Thepremisesusedformanufacturing,processing,packagingandlabellingwillbeinconformitywiththeprovisionsoftheFactoryAct.Itshallbelocatedsoastobe:

(i) Compatible with other manufacturing operations that may be carried out in thesameoradjacentpremises.

(ii) Adequately providedwithworking space to allow orderly and logical placementofequipmentandmaterialstoavoidtheriskofmix-upbetweendifferentdrugsorcomponents thereof and control the possibility of cross- contamination by other drugs or substances and avoid the risk of omission of any manufacturing or control step.

(iii)Designed,constructedandmaintainedtoprevententryofinsectsandrodents.Interiorsurface(walls,floorsandceilings)shallbesmoothandfreefromcracksandpermiteasycleaninganddisinfection.Thewallsof the roominwhich themanufacturingoperations are carried out shall be impervious to and be capable of being kept clean. Theflooringshallbesmoothandevenandshallbesuchasnottopermitretentionoraccumulation of dust or waste products.

(iv) Providedwithproperdrainagesystemin theprocessingarea.Thesanitaryfittingsandelectricalfixturesinthemanufacturingareashallbeproperandsafe.

(v) Furnace/Bhatti section could be coveredwith tin roof andproper ventilation, butsufficientcareshouldbetakentopreventfliesanddust.

(vi) Thereshouldbefiresafetymeasuresandproperexitsshouldbethere.

(vii) Dryingspace-Thereshouldbeseparatespacefordryingofrawmaterial,inprocessmedicine or medicines which require drying before packing. This space will beprotected from flies/insects/dusts, etc., by proper flooring, wire-mash window,glass pans or other material.

1.1(C) Water Supply- The water used in manufacture shall be pure and of potable quality.Adequate provision of water for washing the premises shall be made.

1.1(D)Disposal of Waste- From the manufacturing sections and laboratories the waste water and theresidueswhichmightbeprejudicialtotheworkersorpublichealthshallbedisposedoff after suitable treatment as per guidelines of pollution control authorities to render them harmless.

1.1(E) Containers’ Cleaning- In factories where operations involving the use of containers such as glass bottles, vials and jars are conducted, there shall be adequate arrangementseparated from the manufacturing operations for washing, cleaning and drying of such containers.

1.1(F)Stores- Storage should have proper ventilation and shall be free from dampness. It should provide independent adequate space for storage of different types of material, such as raw material,packagingmaterialandfinishedproducts.

1.1(F)(A) Raw Materials- All raw materials procured for manufacturing will be stored in the rawmaterialsstore.Themanufacturebasedontheexperienceandthecharacteristicsofthe particular raw material used in Ayurveda, Siddha and Unani system shall decide the use of appropriate containers which would protect the quality of the raw material as well as prevent it from damage due to dampness, microbiological contamination or rodent and insect infestation, etc. If certain raw materials require such controlled environmental conditions, the raw materials stores may be sub-divided with proper enclosures to provide suchconditionsbysuitablecabinization.Whiledesigningsuchcontainers,cabinsorareasin the raw materials store, care may be taken to handle the following different categories ofrawmaterials:-

Each container used for raw material storage shall be properly identified with the label which indicates name of the raw material, source of supply and will also clearly state the statusofrawmaterialsuchas‘UNDERTEST’or‘APPROVED’or‘REJECTED’.Thelabelsshall further indicate the identityof theparticular supplyin the form of Batch No. orLot. No. and the date of receipt of consignment.

All the raw materials shall be sampled and got tested either by the in-house Ayurvedic, Siddha and Unani experts (Quality control technical person) or by the laboratoriesapprovedbyGovernmentandshallbeusedonlyonapprovalafterverifying.Therejectedraw material should be removed from other raw materials store and should be kept in a separate room. Procedure of ‘First in first out’shouldbeadoptedforrawmaterialswherevernecessary.Recordsof the receipt, testingandapprovalorrejectionanduseofraw material shall be maintained.

1.1(F)(B)Packaging Materials- All packaging materials such as bottles, jars, capsules, etc.shall be stored properly. All containers and closures shall be adequately cleaned and dried before packing the products.

1.1(F)(C)Finished Goods Stores- The finished goods transferred from the productionareaafter proper packaging shall be stored in the finished goods stores within an area marked “Quarantine”. After the quality control laboratory and the expertshave checked thecorrectnessoffinishedgoodswithreferencetoitspacking/labellingaswellasthefinishedproduct quality as prescribed,, then it will be moved to ‘Approved Finished Goods Stock”

area. Only approved finishedgoodsshallbedispatchedaspermarketingrequirements.Distribution records shall be maintained as required. If any Ayurvedic, Siddha and Unani drug needs special storage conditions, finished goods store shall provide necessary environmental requirements.

1.1(G)Working Space- Themanufacturingareashallprovideadequatespace(manufactureandquality control) for orderly placement of equipment andmaterial used in any of theoperations for which these are employed so as to facilitate easy and safe working and tominimize or to eliminate any risk ofmix-up betweendifferentdrugs, rawmaterialsand to prevent the possibility of cross-contamination of one drug by another drug that is manufactured, stored or handled in the same premises.

1.1(H)Health, Clothing, Sanitation and Hygiene of Workers- All workers employed in the Factoryshallbefreefromcontagiousdiseases.Theclothingof theworkersshallconsistof proper uniform suitable to the nature of work and the climate and shall be clean. The uniform shall also include cloth or synthetic covering forhands,feetandheadwherever required. Adequate facilities for personal cleanliness such as clean towels, soap and scrubbing brushes shall be provided. Separate provision shall be made for lavatories to be used by men and women, and such lavatories shall be located at places separated from the processing rooms. Workers will also be provided facilities for changing their clothes and to keep their personal belongings.

1.1(I) Medical Services- Themanufacturershallalsoprovide:-

(i) Adequatefacilitiesforfirstaid;

(ii) Medical examination of workers at the time of employment and periodical checkup thereafter by a physician once a year, with particular attention being devotedtofreedomfrominfections.Recordsthereofshallbemaintained.

1.1(J) Machinery and Equipments- For carryingoutmanufacturingdependingon thesizeofoperation and the nature of product manufactured, suitable equipment either manually operated or operated semi-automatically (electrical or team based) or fully automaticmachineryshallbemadeavailable.Thesemayincludemachines for use in the processof manufacture such as crushing, grinding, powdering, boiling, mashing, burning, roasting,filtering,drying,filling,labellingandpacking,etc.Toensureeaseinmovementofworkers and orderliness in operations a suitably adequate space will be ensured between two machines or rows of machines. These machinery and equipments and machineryrecommended is indicated inPart II-A. Proper standardoperationalprocedures (SOPs)for cleaning maintaining and performance of every machine should be laid down.

1.1(K)Batch Manufacturing Records- The licensee shallmaintainbatchmanufacturing recordof each batch of Ayurvedic, Siddha and Unani drugs manufactured irrespective of the typeofproductmanufactured(classicalpreparationorpatentandproprietarymedicines).Manufacturing records are required to provide and account of the list of raw materials and their quantities obtained from the store, tests conducted during the various stages of manufacture like taste, colour, physical characteristics and chemical tests as may be necessary or indicated in the approved books of Ayurveda, Siddha and Unani mentioned intheFirstScheduleoftheDrugsandCosmeticsAct,1940(23of1940).Thesetestsmayinclude any in-house or pharmacopoeial test adopted by the manufacturer in the raw material or in the processmaterial and in the finishedproduct. These records shall bedulysignedbyProductionandQualityControlPersonnelrespectively.Detailsoftransferofmanufactureddrugtothefinishedproductsstoreincludingdatesandquantityofdrugstransferred alongwith record of testing of the finished product, if any, and packaging,records shall bemaintained.Only after themanufactureddrugshavebeenverifiedandaccepted quality shall be allowed to be cleared for sale. It should be essential to maintain the record of date, manpower, machine and equipments used and to keep in process record of variousshodhana,bhavana,burninginfireandspecificgrindingsintermsofinternaluse.

1.1(L) Distribution Records- RecordsofsaleanddistributionofeachbatchofAyurveda, Siddhaand Unani Drugs shall be maintained in order to facilitate prompt and complete recall of thebatch, ifnecessary.The duration of record keeping shouldbe the date of expiryof thebatch,CertaincategoriesofAyurvedic,SiddhaandUnanimedicineslikeBhasma,Rasa,Kupi-pakva,Parpati,Sindura,Karpu/Uppu/Puram,Kushta,Asava-arista,etc.donothaveexpirydate,incontrasttheirefficacyincreaseswiththepassageoftime.Hence,recordsneedtobemaintainedupto5yearsoftheexhaustingofstock.

1.1(M)Record of Market Complaints- Manufacturers shall maintain a register to record all reports ofmarket complaintsreceivedregardingtheproductssoldinthemarket.Themanufacturershall enter all data received on such market complaints, investigations carried out by the manufacturers regarding the complaint as well as any corrective action initiated to prevent recurrenceofsuchmarketcomplaintsshallalsoberecorded.OnceinaperiodofsixmonthsthemanufacturershallsubmittherecordsuchcomplaintstotheLicensingAuthority.TheRegistershallalsobeavailableforinspectionduringanyinspectionofthepremises.

Reportsof anyadverse reaction resulting fromtheuseofAyurvedic,SiddhaandUnanidrugs shall also be maintained in a separate register by eachmanufacturer.Themanufacturer shall investigate any of the adverse reaction to find if the same is due to any defect in the product, and whether such reactions are already reported in the literature or it is a new observation.

1.1(N)Quality Control- Every licensee is required to provide facility for quality control section inhisownpremisesorthroughGovernment-approvedtestinglaboratory.Thetestshallbeas per the Ayurveda, Siddha and Unani pharmacopoeial standard. Where the tests are not available, the testshouldbeperformedaccordingto themanufacturer’s specificationorotherinformationavailable.Thequalitycontrolsectionshallverifyalltherawmaterials,monitor in process, quality checks and control the quality of finished product being releasedto finishedgoodsstore/warehouse.Preferablyforsuchqualitycontroltherewillbeaseparateexpert.Thequalitycontrolsectionshallhavethefollowingfacilities:

(a) Thereshouldbe150sqfeetareaforqualitycontrolsection.

(b) Foridentificationofrawdrugs,referencebooksandreferencesamplesshouldbe maintained.

(c) Manufacturingrecordshouldbemaintainedforthevariousprocesses.

(d) To verify the finished products, controlled samples of finished products ofeach batchwillbekepttilltheexpirydateofproduct.

(e) Tosuperviseandmonitoradequacyofconditionsunderwhichrawmaterials,semi- finished products and finished products are stored.

(f) Keeprecordinestablishingshelflifeandstoragerequirementsforthedrugs.

(g) ManufacturerswhoaremanufacturingpatentproprietaryAyurveda,Siddhaand Unani medicines shall provide their own specification and control references in respect of such formulated drugs.

(h) The recordof specificmethod andprocedure of preparation, that is, “Bhavana”, “Mardana” and “Puta” and the record of every process carried out by the manufacturer shall be maintained.

(i) Thestandardsforidentity,purityandstrengthasgiveninrespectivepharmacopoeias of Ayurveda, Siddha and Unani systems of medicines published by Government of India Shall be complied with.

(j) Allrawmaterialswillbemonitoredforfungal,bacterialcontaminationwithaview tominimizesuchcontamination.

(k) Qualitycontrolsectionwillhaveaminimumof-

(i) (a) ExpertinAyurvedaorSiddhaorUnaniwhopossessadegreequalification recognizedunderScheduleIIofIndianMedicineCentralCouncilAct,1970.

(b) Chemist, who shall possess at least a Bachelor Degree in Science or PharmacyorPharmacy(Ayurveda)awrdedbyarecognizedUniversity;and

(c) ABotanist(Pharmacognosist)whoshallpossessatleastaBachelorDegree in Science (Medical) orPharmacyorPharmacy (Ayurveda) awardedby a recognizedUniversity.

(ii) The manufacturing unit shall have a quality control section as explainedunderSection35(ii).Alternatively, thesequalitycontrolprovisionswillbemetby gettingtesting, etc., froma recognized laboratory forAyurveda, SiddhaandUnanidrugs;underRule160-AoftheDrugsandCosmeticsAct.Themanufacturingcompanywillmaintainalltherecordofvarioustestsgotdonefromoutsiderecognizedlaboratory.

(iii) ListofequipmentrecommendedisindicatedinPartII-C.

1.2 Requirement for Sterile Product:

(A) Manufacturing Areas– For the manufacture of sterile Ayurvedic, Unani and Siddha drugs, separate enclosed areas specifically designed for the purpose shall be provided. Theseareasshallbeprovidedwithairlocksforentryandshallbeessentiallydustfree and ventilated with an air supply. For all areas where aseptic manufacture has tobecarriedout,airsupplyshallbefilteredthroughbacteriaretainingfilters(HEPAFilters)andshallbeatapressurehigherthanintheadjacentareas.Thefiltersshallbe checked for performance on installation and periodically thereafter the record of checks shall be maintained. All the surfaces in sterile manufacturing areas shall be designed to facilitate cleaning and disinfection. For sterile manufacturing routine microbial counts of all Ayurvedic, Siddha and Unani drug manufacturing areas shall be carried out during operations. Results of such count shall be checked againstestablished in-house standards and record maintained. Access to manufacturing areas shallberestrictedtominimumnumberofauthorizedpersonnel.Specialproceduretobe followed for entering and leaving the manufacturing areas shall be written down and displayed. For the manufacturing of Ayurvedic, Siddha and Unani drug that canbe sterilizedin theirfinalcontainers, thedesignof theareasshallpreclude the

possibilityoftheproductsintendedforsterilizationbeingmixedwithortakentobeproductsalreadysterilized.Incaseofterminallysterilizedproducts,thedesignoftheareasshallprecludethepossibilityofmix-upbetweennon-sterileproducts.

(B) Precautions against contamination and mix:

a) Carrying outmanufacturing operations in a separate block of adequatelyisolatedbuilding or operating in an isolated enclosure within the building,

(b) Usingappropriatepressuredifferentialintheprocessarea.

Providingasuitableexhaustsystem.

(d) Designinglaminarflowsterileairsystemforsterileproducts.

(e) ThegermicidalefficiencyofUVlampsshallbecheckedandrecordedindicatingtheburning hours or checked using intensity.

(f) Individualcontainersofliquidsandophthalmicsolutionsshallbeexaminedagainstblack-white background fitted with diffused light after filling to ensure freedom from contamination with foreign suspended matter.

(g) ExperttechnicalstaffapprovedbytheLicensingAuthorityshallcheckandcompareactual yield against theoretical yield before final distribution of the batch.

All process controls as required under master formula including room temperature, relative humidity, volume filled, leakage and clarity shall be checked and recorded.

process validation quality control parameters to ensure that these formulations are processedandpreparedinaccordancewithclassicaltextsandforwhichsafetymeasuresarecomplied.OnlythosemanufacturingunitswhichhaveGoodManufacturingPracticesforASUDrugsandsupplementarycertificateforRasaushadhiesorRasamaraunthukulandKushtajatformulationsshallbeallowedtomanufacturethesame.SupplementaryGoodManufacturingPracticescertificateforRasaushadhiesshallbeissuedbytheStateLicensingAuthorityonlyafterthoroughinspectionbyanexpertteamincludingRasashastraexpertsnominated by the Department of AYUSH.

2. Manufacturing Process Areas

FortheManufacturingofBhasmaandKupipakawaandRasaaushadhipreparationsmadefrommetals andminerals the following specific areas shall beprovided,which shouldbe completely segregated from the production areas used for preparations of plants and animals by product based formulations to avoid cross contamination. The followingexclusiveareasarerequiredforRasaushadhiesorRasamaraunthukulandKushtajat.

2.2 (a)BhattiorHeatingDeviseSectionforBhasmaandRasaaushadhi:-100sq.feetforheating,burning,puttaandanyheatrelatedworkwithproperventilation,exhaustandchimney.Thiscouldbetinshedalso.

(b) Grinding,DryingandProcessingSectionforBhasmaandRasaaushadhi:-10sq.feet(Manualormechanical,ovenetc.).Dryingmaybedoneinaspacewhichiscoveredbyglassorothertransparent material to allow entry of sunrays on the material to keep for the purpose. If dryingisbeinginoventhetemperatureofthesamemaybeselectedspecifictemperature.

(c) RasaushadhisRelatedStore:- 100 sq. ft.

ThesizeandDimensionsofeachBhattisectionwouldbesodesignedtisuitthebatchsizeor quantity of materials to be processed, keeping in mind the processed, keeping in mind theprocessingisdoneaspertheconditionsofDrugsandCosmeticsActmentionedundeScheduleIofficialbooks.

In additions to the fuelprescribed in the schedulebooksnamely coal, firewoods, cowdungcakesetc.,useofotherheatingdevicese.g.electricalheating,oilorgasfiredfurnaceand other may be employed so as to provide the required temperature as per the nature ofmaterial and object of heating. Depending on the formulation beingmanufactured,manufacturersmayadoptaerobicoranaerobicprocess.Properlybakedandcleanearthenpots of other crucibles and glass containers or appropriate design shall be used.

ThemanufacturingareasshouldbedesignedwithspecialattentiontoprocesstheproductsthatgeneratetoxicfumeslikeSO2,arsenicandmercuryvapour,etc.Whenheatingandboiling is necessary, suitable ventilation and air exhaust flow mechanism should beprovided to prevent accumulation of unintended fumes and vapours. Such areas may beprovidedwithproperlydesignedchimneysorductsfittedwithexhaustsystemsandsuitable scrubbing system to remove fumes and smokes, so that safety of personnel and environment is taken care of.

Sinceprocessing ofRasaaushadhimay introduceheavymetal contamination and crosscontamination etc., therefore, cleaning of equipment is particularly important after every process by using appropriate cleaning agent which should not react with material of equipment and must be free unwanted properties e.g. corrosiveness.

2.3 RecordsshallbemaintainedspeciallyfortemperaturesattainedduringtheentireprocessofBhasmikaran,whileemployingdifferentkindsofclassicalputa,furnaceusingoil,gasor electricity. Appropriate temperature measuring instrument should be employed such as pyrometer and, pyrograph for manual reading or recording by heat sensors, connected to computer, as the case may be.

In order to handle large quantities, appropriate technology like use of hand operated extruders formaking chakrikas or pelletsmay be adopted. However, such equipmentmade of aluminium or its alloys should not be used.

Access to manufacturing areas shall be restricted to minimum number of authorised personal only.

B. Product Quality Control

Thespecifications forfinishedRasaushadhiareprimarily intendedtodefinethequalityrather than to establish full characterization, and should focus on those characteristicsfoundtobeusefulinensuringthequality.ConsistentqualityforRasaushadhicanonlybeassured if the starting material-metals and minerals are used of pharmacopoeial standards. Insomecasesmoredetailedinformationmaybeneededonaspectsoftheirprocess.Themanufacture will ensure in-house standards for the uniform quality of products.

QualitytestingwillbecarriedoutasperofficialPharmacopoeiaorSchedulebooksfortextsnamely,colour,taste,varitaratwa,Rekhapurnatwa,Laghutva,Nirudhumatwa,Dntagreekachakacha, Niruttha, Apunarbhava and Nischandratwa.

TheParticlesizeofproductsshouldbetestedadoptingmicroscopicfittedwithmicrometreofparticlesizeanalyseroranyappropriateother techniques.Requiredphysio-chemicalcharacterizationoftheproductshouldbeundertakenbyappropriateanalyticalequipment.TheStandardManufacturingProcessof theproduct shouldbeevolved/followup.Thedisintegration time of pills-vati and tablets should also be recorded.

4. Product recalls

Literature inserted inside the products package should indicate the name, address ofthe manufacturing unit or email or telephone number for reporting of any adverse drug reactionbyphysiciansorpatients.OnreceiptofsuchAdverseDrugReactionreport,itwillbe the responsibility of the manufacturer to ensure the recall the product from the market.

Standard operating procedures (SOP) should be included for storage of recalledRasaushadhiesinasecuresegregatedarea,complyingwiththerequirementsspecifiedforstorage,tilltheirfinaldisposal.

5. Medical Examination of the employees

Employeesengagedinmanufacturingshouldbemedicallyexaminedperiodicallyatleastonce a year for any adverse effect of thedrugduringmanufacturingprocessfirwhichnecessary investigations may be carried out for ensuring that there is no effect of material onthevitalorgansoftheemployees.AnnualexaminationreportsoftheemployeesshallbemadeavailabletostatuaryinspectorsduringGoodManufacturingPracticesinspections

6. Self- Inspection

ThereleaseofRasaushadhisshouldbeunderthecontrolofapersonwhohasbeentrainedinthespecificfeaturesoftheprocessingandqualityassuranceofRasaushadhisPersonneldealingwiththeproductionandqualityassuranceofRasaushadhismanufacturingsectionshouldhaveanadequatetraininginthespecificsubjectofRasaushadhismanufacturing.HewillbeatleastadegreeholderinAyurveda/Siddha/UnanimedicineorB.PharmadegreeholderinAyurveda/Siddha/Unanimedicine.

7. Dosage form of Rasaushadhis

TheRasaushadhismaybemadeintoanacceptabledosageformssuchas,churna,vati,guti,tablet,capsuleetc.afteraddingsuitablepermissiblefillersorbindingagentsaspermissibleundertheAyurvedicPharmacopoeiaofIndiaorIndianPharmacopoeiaasupdatedfromtimetotime.InsuchcasesthelabelmustindicatetheAyurveda/Siddha/Unanimedicinein one Tablet or Pill or Capsule in addition to the filters. The crystalline productmaybe grinded before packing in the individual dispensing size.All the Rasaushadhies orRasamaraunthukul andKushtajat shall be packed in adosage formwhich is ready foruse for the consumer. Grinding and weighting of individual dose of potentially poisonous productswillnotbepermissibleinpatientconsumerpack.ThisarrangementmayreducetheAdverseDrugReaction of Rasaushadhieswhich takes place due to dose variation.However for hospital bulk pack, it will not be applicable and label will not be applicable andlabelwillclearlyindicatethe“HospitalPack”.

Modalities for issuance of WHO GMP Site Certificate and CoPP for Herbal Products.

Many importing countries ask for Certificate of Pharmaceuticals Product (CoPP) during import of Herbal products.

1) ThosewhowanttotakeWHO-GMPcertificateforherbalmedicinehavetosubmitapplicationtoDrugsControllerGeneral(India),givingfollowinginformationforeachproduct:

i) Nameandaddressofmanufacturingfacility.

ii) Nameofthecontactpersonofproductlicenseholder.

iii) Nameanddosageformofproduct.

iv) Nameandamountofactiveingredient(s)perunitdose(InternationalNon-proprietary Name(s)wheresuchexist(s).

v) Formula (complete composition including all excipients; also particularly when no productlicenseexistsorwhentheformulationdiffersfromthatofthelicensedproduct)

vi) Product information for health professionals and for the public (patient information leaflets)asapprovedintheexportingcountry.

2) A“SiteMasterFile”hastobesubmittedasrecommendedintheWHOtechnicalreportseries.

3) TheDrugsControllerGeneral(India),inconsultationwithDepartmentofAYUSHwillfixthe date of inspection.

4) DrugsControllerGeneral(India)willconstituteinspectionteam/Committeecomprising:
