Special note for pre- qualification The tender documents are for two separate bids i.e. technical bid (i.e. qualifying bid) and price bids (i.e. commercial bid). Following credentials shall be submitted with the technical bid with the for pre-qualification

Contractors have to submit their technical bid with relevant document in view of following points of this special notes:-

i) Details of Miscellaneous line maintenance works amounting minimum 50 % of ordered value carried out during last 2 years along with documentary evidence from the client. If required company will visit the site of contractor indicated in the tender for verification.

ii) Bank solvency certificates of about 20% value of the estimated cost from Nationalization Bank.

iii) Copy of the latest income tax clearance certificates. iv) Copy of contractor registration in force with PWD/GSECL OR ANY GOVT. /SEMI. GOVT.

DEPTT. Of relevant class. v) Details of partnership dead in case if it is partnership firm. vi) P.F. number.

The Price bid shown in tender documents comprising schedule-B may please submitted in separate self-addressed envelope provided with tender documents. The bid should be clearly subscribe with our reference number due date and title of work. The offer should be valid for acceptance for a minimum period of 6 months from the date of opening of technical bid. No tenders will be considered received without EMD.Demand Drafts towards tender fee &EMD is

1. TENDER SPECIFICATIONS: All technical specification framed out by the Corporation is separately brought out in the tender documents. No deviation in specification shall be allowed and Corporation’s decision shall be final. The technical scrutiny committee of the Corporation shall evaluate the techno-commercial view of the tender. Tender should be in two bids. a) Techno – Commercial Bid and b) Price Bid.

IMPORTANT: Both the bids technical and price bid should be submitted simultaneously along with EMD cover in the respective envelopes and super scribed accordingly (duly sealed), so as to reach this office not later than 14.00 P.M. on due Date as specified in the tender notice through RPAD only. Please note, that any bid, technical or price bid and Telegraphic or short offers / bids received after the due date and time will not be accepted and the offer will be ignored out rightly. LATE / DELYAED TENDER SHALL NOT BE CONSIDERED. Incomplete bids and amendments and additions to bids after opening of the bids will be ignored out rightly. The price bid of those who are techno-commercially qualified shall be opened. After technical bid is opened, for modification, if any, all shall be given equal chance.

2. The Tenderer must give in his offer, the full name and address with phone, Fax & mobile numbers of the Representative who has been authorized by the Tenderer to do work with the Corporation on their behalf.

3. The tenderers should invariably write the name and address of the Company, both on sealed

covers of EMD, Technical & Price Bids. Otherwise the tender covers without the name and address will not be opened which may please be noted.

4. THE TENDER SHOULD BE SENT BY R.P.A.D. ONLY AND ADDRESSED TO The E.E. (TR.) GETCO, Chorania, DIVISION Office National highway no-8A, Chorania, Limbdi–363421 P.O.Box - 17. (NO COURIER SERVICE WILL BE ACCEPTED). HAND DELIVERY OF TENDERS WILL NOT BE ACCEPTED.

5. Tender fee (Non-refundable) as notified in the tender notices should invariably be paid by the tenderers in D.D. (at Chorania D.O, Chorania) and encloses the original Money receipt in the EMD cover. Tender fee Original Money fee receipt must be kept in the cover of EMD; otherwise supplier’s offer is liable to be rejected.

6. EARNEST MONEY DEPOSIT:

E.M.D. at the rate of 1% of the value of the Tender is payable. The EMD is payable by Demand Draft in favor of the Gujarat Energy Transmission Corporation Ltd. Drawn on any Scheduled / Nationalized Banks payable at Limbdi.

7. SECURITY DEPOSIT: Security Deposit should be paid within 10 days after receipt of LOI or work order.

The successful tenderers will be required to pay an amount equivalent to 5% of the value of the order as a Security Deposit for satisfactory execution of the contract. Such Security Deposit will be payable in Cash / D.D. If the full Security Deposit amount is not paid within 3 days after the receipt of the order, then the order will be cancelled at the risk & cost of the Tenderer (at the discretion of the Corporation) and without entering into any correspondences and this will be binding on the Tenderer.

8. PRICES:

Prices quoted should be FIRM and exclusive of all taxes, taxes as per Govt. rules and

reimbursed on production of proof. Nothing will be paid extra.

9. VALIDITY OF THE OFFER: The offer will have to be kept valid for a period of 180 days from the date of opening of technical bids. In case of finalization of the tender is likely to be delayed, the tenderers will be asked to extend the same without change in the prices or any

terms and conditions of the offer. If any change is made, original or during the extended validity period, the offer will be liable for outright rejection without entering into further correspondence in this regard and no reference will also be made.

10. PRICE EVALUATION:

No price preference shall be given on any account. All tenders will be evaluated on firm price basis. Corporation may go for the price L-2 depending upon the exigency. If Corporation feels that there is lack of serious competition or any other reasons, Corporation may negotiates with the L-1 party. Corporation’s decision shall be final and binding to all the parties.

11. QUANTITY DISTRIBUTION:

As per current practice, in case where the quantity is to be distributed to more than one supplier, 100% quantity shall be given to the parties who are techno-commercially qualified and the L-1 prices.

12. If the Tenderer fails to pay the Security Deposit or defaults in execution of the orders placed

or if Corporation suffers any financial loss due to this, then Corporation will be at liberty to adjust the amount from other orders of the same firm or by encashing the Bank Guarantee.

13. PAYMENT TERMS:

Payment shall be made by the Chorania Transmission DIVISION Office on completion of the job and production of work completion certificate of the Sub-Station In charge, after following the procedures of GETCO.100% Payment will be made after successful completion of the work. The payment will be made within 30 days after submission of bills.

14. REPEAT/ADDITIONAL ORDERS: The Corporation reserves the right to place repeat orders / additional orders on the successful tenderer up to 50% of the original quantity of the A/T at the same prices terms and conditions stipulated in the original order mutually agreed upon.

15. Execution of the Work: The party will have to complete the job within 12 Months from the date of issue of Commencement order. Penalty will be levied at ½ % of the order value on delays portion of the work

Any correspondence or enquiry subsequent to opening of Technical and Commercial bids is not desirable, if the same is indulged into, it will be considered for disqualifying the tender. The Tenderer will be required to abstain from pursuing / canvassing the matter, directly or indirectly with any Officers of the Corporation, as otherwise the same would also amount to disqualification of the tender.

17. Tenderer must submit offers / bids along with requisite descriptive literature etc. 18. Site visit:

(i) The bidder is advised to visit the site and examine the site condition.

Where in the work is proposed to be carried out and to get himself fully Acquainted at his own responsibility for all information that may be necessary. All cash and Liabilities arising out of the site visit shall be at bidder account.

(ii) The contractor shall be deemed to have carefully examined the work & site Conditions, the general conditions, the special conditions, specifications, Schedules, drawings shall be deemed to have visited the site of the works & to have fully informed himself regarding the local conditions. Copy of Appendix V attached with tender shall have to be filled up before quoting the rate, for confirmation of site visit. (iii) If there shall have any doubts as to the meaning of any portion of these general conditions or

special conditions of the scope of work of the specifications or any other matter concerning the contract, he shall in good time before submitting his tender, send for the particulars thereof & submit them to the Engineer in writing in order that such doubt may be removed.

19. The GETCO shall have the right to make any changes, additions / deletions or modifications

in any terms / conditions of the tender and / or specifications as may be deemed necessary by the Corporation at its sole discretion at any time before the due date of opening of the tender.

name of the party and their order reference to which they have supplied, to be furnished in Annexure- 6. Failure to do this will result on suppliers tender being rejected without any reference. In case of bought out items they should furnish the back up guarantee from their principals.

21. Corporation does not accept the printed conditions of any Tenderer. It will be ignored without

any reference; hence tenderers should withdraw such printed conditions if they have any. 22. If the tenderer desires to quote with any technical deviations they should specifically quote

the deviation & the ISS or BIS Nos. in the body of the tender itself under the respective Annexure of this tender document. If technical deviations furnished by the Tenderer are not agreeable to the Corporation, the offers may be ignored. However it will be solely at Corporation’s discretion to consider the technical deviations OR not for considering the Tenderer. No correspondences of the Tenderer after opening of the bid will be entertained in this matter.

23. Revision of prices or any commercial terms affecting the price after opening of technical bids

shall not be considered and will be ignored. 24. Please give suitable declarations as under: I / We declare that we are Authorized Distributor

OR Dealer for all the tendered items. 25. Tenderer should specifically mention in the offers and should indicate in Block letters the

name of the Partners / Proprietor / Directors who is / are the signing authority. 26. GUARANTEE: You will be responsible for the proper maintenance/performance of the line maintenance work

in Chorania TR. Division jurisdiction for the respective period for 12 months. 27. OTHER CONDITION OF WORKS:

The Corporation’s General Conditions of contract will apply to all contracts and supplier will be deemed to be fully aware of the Corporation’s general conditions of contract for the supply of plant equipment and materials except the conditions modified in this commercial terms and conditions and any ignorance of these Conditions, will not exempt supplier from their liability to abide by the same. Copies are available from the Division Office Chorania.

28. Please note that any additional conditions / deviations, if any, found in the Commercial terms

& conditions, then the Price Bids of such tenderers will not be opened and no further correspondences in the matter will be allowed.

29. If in any company, the interest of any employee of the GETCO or his relative as defined in

Section VI of the Company’s Act. 1956, is 10% or more, GETCO will not deal with such company at all. Tenderer therefore, must specifically disclose this fact in his technical Bid. Non-disclosure of such facts would disqualify the Tenderer for further dealing with GETCO.

30. ARBITRATION:

All questions, disputes or differences whatsoever which may at any time arise between the parties to this agreement touching the agreement or subject matter thereof, arising out of or in relation there to and whether as to construction or otherwise shall be referred to the decision of the Sole Arbitrator, appointed by the Chairman, GETCO, for that purpose, who shall be a retired High Court Judge or retired District and Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties. Reference to the arbitration shall be governed by the provisions of Indian Arbitration & Conciliation Act. 1996 as amended from time to time and the rules made there under.

31. JURISDICTION: All questions, disputes or differences arising under out of or in connection with the Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender / Acceptance of tender is issued, is situated i.e. Limbdi.

32. SUBMISSION OF OFFERS:

The firm having single legal entity and having two or more works / factory and submits offers from two or more different works / factory, in such case Corporation will consider only ONE lowest offer for allocation of quantity. Many of the tenderers are submitting their offers with the conditions of advance payment along with the order; such conditions are not acceptable by the Corporation.

33. The Tenderer if being an agent, who submits its offer to Corporation, will have to give

information and declare the name of the principle from which he will procure the materials and supply to Corporation along with company’s written confirmation about quality and backup performance guarantee. Only on getting complete information from Agent, such offer if found suitable shall be taken in consideration.

without assigning any reasons. Also in case Corporation finds that there is an attempt of cartel in the prices, Corporation reserves the right to consider or reject any or all the parties offers without assigning any reasons thereof.

35. Corporation reserves the right to increase or decrease the quantity against each item/s while

placing the order. 36. Tenderer should invariably fill up all the details of all the Annexure including the prices in the

Price Bid Annexure of this tender document. This is mandatory. Also all the Annexure should be duly signed by authorized signatories with their rubber stamp and along with Company’s Rubber (Round) seal / stamp affixed on each paper.

37. The tenderer are required to furnish the technical information along with company seal and

signature of the Tenderer on each and every page / papers of the tender documents. 38. The following List of Annexure and Documents should be invariably submitted along with the

tender: 1) Schedule–“B” Price Bid to be submitted in the Separate Price Bid cover super scribed

“PRICE BID COVER ONLY” mentioning the TENDER NO. 2) APPENDIX-1 to 3 3) Annexure – 1 TO 4 4) Certificate – “A”. 5) All the above documents should be duly filled in, signed & stamped with company’s

seal should be submitted along with the Technical Bids and Schedule–“B” to be kept in the Price bid cover.

39

1. All the costs of the stamp papers are to be borne by tenderer as per the Govt. Of India’s latest guidelines.

2. The contractor shall make their own arrangements for the necessary approach, road, for transport of their materials, men power and be responsible for the compensation on account of damage to crop etc. & shall till completion of work.

3. All the royalty charges, Octroi and other duties & all taxes will be paid by the contractor and no extra be claimed on this account.

40. All the tenderers must ensure that all the relevant documents / papers submitted with the

tender should be serially numbered, properly bounded / tied together and properly documented. This must be adhered to.

41. All the above points should be complied by the Tenderers. If not, tenders are likely

to be ignored without making any further reference.

42. Experience: Experience of related work is necessary.

(1) The work is to be executed with all tools, equipments required for line maintenance work in

Chorania TR. Division jurisdiction by contractor. (2) Contractor in shall submit the daily report of work done on each day checked and signed by

out supervisor prescribed. Performa shall be brought by the contractor at his own cost for such reports.

(3) Contractor shall be responsible for any accident or damage or any inconvenience caused by contractor for which the necessary compensation shall be paid by the contractor or else the same shall be recovered from the bill.

(4) It is the responsibility of the contractor to get the work done satisfactorily failing which the reduced rates shall be paid and necessary action shall be taken as per Company’s rules.

(5) The contractor or his authorized representative and his supervisor shall remain present during as & when required.

(6) If work is not carried out by contractor , it will be get done at risk and cost of contractor and amount of rate difference along with 15% Supervision charges will be recovered from the next R.A. Bill.

(7) Necessary Labor License should be obtained by the contractor, if required. (8) You shall be responsible for safety and security of your staff, tools, plants, etc. throughout the

tenure of contract without any financial implications. (9) All royalties, Sales Tax, Toll Tax, Local Tax, VAT and any other taxes including works

contract tax in respect of this contract and also any statutory variation in future towards above mentioned taxes shall be payable by the contractor and GETCO will not entertain any claim whatsoever in this respect.

(10) The contractor shall require obtaining labor license from Assistant Labor Commissioner (Control) Ahmedabad to start with the work if applicable.

(11) The contractor shall pay at the rate to his labors as per the minimum wages act as notified by the Regional Labor Commissioner (Control) Ahmedabad from time to time.

(12) The contractor shall have a Provident Fund code allotted to him by the Regional Provident Fund Commissioner and submit a monthly challam copy of PF deposit amount along with list of labors /employees, if applicable.

(13) The Contractor shall require to deposit with Pf authorities the Pf deduction of this labors well in time and submit a copy of Challan to Engineer in charge on monthly basis failing which owner will deduct from his bills the amount equivalent to PF deduction with Penalty Under the Act.

(14) The contractor shall strictly comply with the various provisions of payment of Wages Act, Workman Compensation Act, Minimum Wages Act, contract Labour (Regulation and Abolition) Act 1970, employees State Insurance (ESI) Act 1948 and various other labour legislatures as in existent at present in India and as amended from time to time.

the rate of one day for each 20 days of working shall be provided and paid by the contractor. (16) The contractor shall in the event of his workmen/employee labors sustain any injury of

disablement due to an accident arising out of and in the course of his employment provide necessary medical treatment and pay compensation if any, under Workmen’s Act, 1923.

(17) The contractor shall provide safety items/kits to his employees if any are required under law.

(18) The contractor shall provide necessary insurance coverage to his workmen engaged in the execution of this contract and produce for inspection to Engineer-in-charge.

(19) The labour payment is to be made in presence of Board’s officer. (20) The contractor shall maintain all records/registers required to be maintain by him

under various labour laws & produce the same before the statutory authorities when required mainly Master Roll, Register of Wages.

(21) No children under the age of 18 shall be permitted to employ by the contractor. (22) As per provisions of Income Tax act, Company shall deduct income tax/service tax at

the applicable rate. (23) Payment to contractor shall be made as per standard clauses of “Tender and Contract

for works booklet”. Monthly R.A. bills shall be recorded. Necessary bills shall be submitted for verification.

(24) THE TIME LIMIT FOR COMPLETION OF WORK AS STIPULATED IN TENDER NOTICE WILL BE ADHERED TO.

(25) The company will not pay any kind of advances including mobilization advance. (26) Service tax shall be reimbursed on produce of proof of such payment made by the

contractor to the appropriate department. (27) The successful contractor will give contact numbers of his and representatives to

make immediate contact. (28) All required tools, tackles and safety accessories will be arranged by the contractor at

his cost as per norms of GETCO. (29) The GETCO will not provide any manpower, tools, tackles, vehicles or safety

accessories. (30) Successful contractor has to work on S/C and D/C tower lines. Work may have to be

executed on one circuit of D/C tower line in HOT CONDITION i.e. other circuit of D/C line in live condition.Working in HOT or COLD will be decided by the E.E.(TR) chorania, considering nature and merits of work.

(31) The contractor will observe all measures for safe working and as per standards.

Web site: getcogujarat.com Email: [email protected] (32) The contractor will ensure safe isolation of the line/s to be attended and line clear permits from authentic Board officer of a sub station. (33) The contractor will provide local earthing/s as per requirement. (34) The contractor will remove all man, materials and local earthing provided before declaring work completed. However they have to remain at working site till the line is taken in service satisfactorily.

(35) Work is to be executed to the full satisfaction of Engineer-in-charge.

(36) Material required will be issued from the 400 KV Chorania S/S and or Transmission circle stores as per suitability decided by E.E.(TR) Chorania.

(37) All the materials will be credited to the 400 KV Chorania sub station and/or

Transmission circle stores as decided by E.E (TR) Chorania after completion of work. (38) The line maintenance programme- planning and deviation shall be informed to Contractor well in advance minimum before two days by in charge engineer & if contractor fails to execute the work, the penalty shall be applicable per person Rs. 300/- per days or rules as per GETCO. (39) Approximate man power requirement for shut-down as under.

i) The Tenderer should clearly give certificate along with the Technical Bid: “This is to confirm and certify that the offer submitted by me is strictly in accordance with the Corporation’s Tender specifications. There is no commercial or Technical deviation (except the deviations shown in Annexure of Technical Deviations as per clause no.22 of this tender document) in the offer from the Corporation’s Tender Specification. I undertake to abide by the Corporation’s Technical specification / Guaranteed Technical Particulars / Drawing, I undertake to supply materials strictly as per the Corporation’s Technical specification / Guaranteed Technical Particulars / Drawing, even if any technical deviations are mentioned by me. I also undertake to abide by all commercial conditions of the Corporation, including delivery schedule.”

ii) Any offer without above certificate will not be considered and the tender will be out rightly

ignored in the absence of above certificate.

iii) After opening of the Tender, if it is found that the offer given by the Tenderer is not according to the Corporation’s specifications, Guaranteed Technical Specifications, Drawing and commercial terms and conditions and false certificate is given by the Tenderer, then Corporation will not deal with the firm for the present Tender. It is, therefore requested that the Tenderer should take care in giving their offer and submission of documents, including Type Test certificate.

iv) The conditional tenders will not be accepted.

v) The estimate for work is given as per schedule-B as under and final decision/deviation is decided by EE(TR),GETCO, Chorania or S.E.(TR),GETCO, Chorania
