Dear Sir,

You are requested to please furnish your Tender for the above work as detailed

in the Schedule “B” of Tender.

The Sealed percentage rate tenders are invited in two separate sealed covers

(Super scribed technical bid and price bid) subject to the following terms &

conditions.

1) The work is to be carried out as per general & detailed specifications of

Tender.

2) Estimated cost is Rs. 1, 95,500.00

3) The successful contractor shall have to pay 5% of the value of the work order as

Security deposit in the office of E.E.(TR), GETCO, Godhra.

4) The last date of issue of Tender- Download from website The last date for

receipt of Technical bid & Price bid in this office is 15/07/2010.

5) The time limit is 30 days from the date of issue of instructions.

6) The Sealed percentage rate should be submitted by duly filled in ink in the

attached Schedule-‘B’of price bid and the entire technical bid of Short Time

Tender duly signed, should be submitted in sealed cover super scribed the name

of work. The Tender will be accepted up to 2.00 p.m. of 15/07/10 by R.P.A.D./

Speed post only and the same will be opened immediately i.e. at 4.00 p.m. of

25/06/10 in the presence of those contractors who wish to remain present.

7) All conditions of contract given in the “Tender & Contractor” for works booklet

will be binding to the contractor.

8) Rights are reserved to reject or delete any or all items of Tenders without

assigning any reason thereof.

Special note for pre- qualification

The tender documents are for two separate bids i.e. technical bid (i.e. qualifying bid) and price bids (i.e. commercial bid). Following credentials shall be submitted with the technical bid with the for pre-qualification

1 Contractor should produce evidence of having experience in executing similar nature of jobs in a single contract along with the documentary evidence, preferably photo copy of orders secured from GETCO / Central / State Government / Railway / Semi- Government and satisfactory completion certificate from respective departments.

2 Latest bank solvency certificate from any nationalized bank for a sum of minimum 20% of estimated cost.

3 Separate provident fund code number towards registration of your firm with regional P. F. Commissioner.

4 Contractor should submit evidence as a register contractor in appropriate class With Govt. /Semi. govt.

5 The details of tools and tackles, owned and available for using in this work. 6 Contractor should produce audited copy of the Balance sheet with profit and loss

account of last three Years. 7 Attested copy of Power of Attorney, if any, for signing the bid documents. 8 The contractor has to submit the latest Sales Tax Registration Certificate and service

tax registration copy. 9 Performa showing the details of site visit by agency before quoting the tender. 10 Bar chart indicating how the Tenderer intends to complete the work in the stipulated

time limit. 11 The copy of the Registration of TIN & PAN Number shall be furnished along with

Technical bid. 12 The contractor is requested to put his signature and seal on each page. (Without

signature agreement will not be executed.) The Price bid shown in tender documents comprising schedule-B may please submitted in separate self-addressed envelope provided with tender documents. The bid should be clearly subscribe with our reference number due date and title of work. The offer should be valid for acceptance for a minimum period of 6 months from the date of opening of technical bid. No tenders will be considered received without EMD.

1. TENDER SPECIFICATIONS:

All technical specification should be ISS/ISI/BIS. Specification framed out by the Corporation is separately brought out in the tender documents. No deviation in specification shall be allowed and Corporation’s decision shall be final. The Corporation also desires that all the suppliers should possess high quality ISO 9001 / ISO 9002 certificate within 2 years from 1/1/2001 and other things being equal, suppliers who possess ISO 9001 / ISO 9002 certificate will be given preference in quantity distribution. The technical scrutiny committee of the Corporation shall evaluate the techno-commercial view of the tender. Tender should be in two bids. a) Techno – Commercial Bid and b) Price Bid.

IMPORTANT: Both the bids technical and price bid should be submitted simultaneously along with EMD cover in the respective envelopes and super scribed accordingly (duly sealed), so as to reach this office not later than 14.00 P.M. on due Date as specified in the tender notice through RPAD only. Please note, that any bid, technical or price bid and Telegraphic or short offers / bids received after the due date and time will not be accepted and the offer will be ignored out rightly. LATE / DELYAED TENDER SHALL NOT BE CONSIDERED.

Incomplete bids and amendments and additions to bids after opening of the bids will be ignored out rightly. The price bid of those who are techno-commercially qualified shall be opened. After technical bid is opened, for modification, if any, all shall be given equal chance.

2. The Tenderer must give in his offer, the full name and address with phone, Fax & mobile numbers of the Representative who has been authorized by the Tenderer to do work with the Corporation on their behalf.

3. The tenderers should invariably write the name and address of the Company, both

on sealed covers of EMD, Technical & Price Bids. Otherwise the tender covers without the name and address will not be opened which may please be noted.

4. THE TENDER SHOULD BE SENT BY R.P.A.D. ONLY AND ADDRESSED TO The

Executive Engineer (Tr.) GETCO, Godhra, Division Office, Godhra–389001. (NO COURIER SERVICE WILL BE ACCEPTED). HAND DELIVERY OF TENDERS WILL NOT BE ACCEPTED. DELAYED AND LATE TENDERS: NO TENDER SHALL BE ACCEPTED / OPENED IN ANY CASE WHICH ARE RECEIVED AFTER DUE DATE AND TIME OF THE RECEIPT OF TENDER IRRESPECTIVE OF DELAY DUE TO POSTAL SERVICES OR ANY OTHER REASONS AND Corporation SHALL NOT ASSUME ANY RESPONSIBILITY FOR LATE RECEPIT OF TENDER. ANY CORRESPONDANCE IN THIS MATTER WILL NOT BE ENTERTAINED.



5. Tender fee (Non-refundable) as notified in the tender notice should invariably be paid by the tenderers in CASH (at Godhra D.O, Godhra) and enclose the original Money receipt in the EMD cover. Tender fee Original Money fee receipt must be kept in the cover of EMD; otherwise supplier’s offer is liable to be rejected.

6. EARNEST MONEY DEPOSIT:

E.M.D. at the rate of 1% of the value of the Tender is payable. The EMD is payable either in Cash or by Demand Draft in favour of the Gujarat Energy Transmission Corporation Ltd. Drawn on any Scheduled / Nationalized Banks payable at Godhra

7. SECURITY DEPOSIT: Security Deposit should be paid within 3 days after receipt of the order.

The successful tenderers will be required to pay an amount equivalent to 5% of the value of the order as a Security Deposit for satisfactory execution of the contract. Such Security Deposit will be payable in Cash / D.D.If the full Security Deposit amount is not paid within 3 days after the receipt of the order, then the order will be cancelled at the risk & cost of the Tenderer (at the discretion of the Corporation) and without entering into any correspondences and this will be binding on the Tenderer.

8. PRICES:

Prices quoted should be FIRM and inclusive of all taxes, nothing will be paid extra.

9. VALIDITY OF THE OFFER: The offer will have to be kept valid for a period of 30 days from the date of opening of technical bids. In case of finalization of the tender is likely to be delayed, the tenderer’s will be asked to extend the same without change in the prices or any terms and conditions of the offer. If any change is made, original or during the extended validity period, the offer will be liable for outright rejection without entering into further correspondence in this regard and no reference will also be made.

10. PRICE EVALUATION:

No price preference shall be given on any account. All tenders will be evaluated on firm price basis. Corporation may go for the price L-2 depending upon the exigency. If Corporation feels that there is lack of serious competition or any other reasons, Corporation may negotiates with the L-1 party. Corporation’s decision shall be final and binding to all the parties.

11. QUANTITY DISTRIBUTION:

As per current practice, in case where the quantity is to be distributed to more than one supplier, 100% quantity shall be given to the parties who are techno-commercially qualified and the L-1 prices.



12. If the Tenderer fails to pay the Security Deposit or defaults in execution of the orders placed or if Corporation suffers any financial loss due to this, then Corporation will be at liberty to adjust the amount from other orders of the same firm or by encashing the Bank Guarantee.

13. PAYMENT TERMS:

Payment shall be made by the Godhra Transmission Division on completion of the job and production of work completion certificate of the Sub-Station In charge, after following the procedure’s of GETCO.

14. REPEAT/ADDITIONAL ORDERS:

The Corporation reserves the right to place repeat orders / additional orders on the successful tenderer up to 50% of the original quantity of the A/T at the same prices terms and conditions stipulated in the original order mutually agreed upon.

15. Execution Of The Work: The party will have to complete the job within 30 days on getting information from the field OR Division Office.

16. POST TENDER CORRESPONDENCE / ENQUIRIES:

Any correspondence or enquiry subsequent to opening of Technical and Commercial bids is not desirable, if the same is indulged into, it will be considered for disqualifying the tender. The Tenderer will be required to abstain from pursuing / canvassing the matter, directly or indirectly with any Officers of the Corporation, as otherwise the same would also amount to disqualification of the tender.

17. Tenderer must submit offers / bids along with Bar chart indicating how the Tenderer intends to complete the work in the stipulated time limit. 18. Site visit:

(i) The bidder is advised to visit the site and examine the site condition.

Where in the work is proposed to be carried out and to get himself fully Acquainted at his own responsibility for all information that may be necessary. All cash and Liabilities arising out of the site visit shall be at bidder account.

(ii) The contractor shall be deemed to have carefully examined the work & site Conditions, the general conditions, the special conditions, specifications, Schedules, drawings shall be deemed to have visited the site of the works & to have fully informed himself regarding the local conditions. Copy of Appendix V attached with tender shall have to be filled up before quoting the rate, for confirmation of site visit. (iii) If there shall have any doubts as to the meaning of any portion of these general

conditions or special conditions of the scope of work of the specifications or any other matter concerning the contract, he shall in good time before submitting his tender, send for the particulars thereof & submit them to the Engineer in writing in order that such doubt may be removed.



19. The purchaser (i.e. Corporation) shall have the right to make any changes, additions

/ deletions or modifications in any terms / conditions of the tender and / or specifications as may be deemed necessary by the Corporation at its sole discretion at any time before the due date of opening of the tender.

20. Tenderer should furnish a list of orders for similar items executed by them indicating

the name of the party and their order reference to whom they have supplied, to be furnished in Annexure- 6. Failure to do this will result on suppliers tender being rejected without any reference. In case of bought out items they should furnish the back up guarantee from their principals.

21. Corporation does not accept the printed conditions of any Tenderer. It will be ignored

without any reference; hence tenderers should withdraw such printed conditions if they have any.

22. If the tenderer’s desires to quote with any technical deviations they should

specifically quote the deviation & the ISS or BIS Nos. in the body of the tender itself under the respective Annexure of this tender document. If technical deviations furnished by the Tenderer are not agreeable to the Corporation, the offers may be ignored. However it will be solely at Corporation’s discretion to consider the technical deviations OR not for considering the Tenderer. No correspondences of the Tenderer after opening of the bid will be entertained in this matter.

23. Revision of prices or any commercial terms affecting the price after opening of

technical bids shall not be considered and will be ignored. 24. Please give suitable declarations as under: I / We declare that we are Authorized

Distributor OR Dealer for all the tendered items. 25. Tenderer should specifically mention in the offers and should indicate in Block letters

the name of the Partners / Proprietor / Directors who is / are the signing authority. 26. GUARANTEE: You will be responsible for the proper performance of the equipments / materials for

the respective guarantee period for 12 months. 27. OTHER CONDITION OF WORKS:

The Corporation’s General Conditions of contract will apply to all contracts and supplier will be deemed to be fully aware of the Corporation’s general conditions of contract for the supply of plant equipment and materials except the conditions modified in this commercial terms and conditions and any ignorance of these Conditions, will not exempt supplier from their liability to abide by the same. 28. Please note that any additional conditions / deviations, if any, found in the

Commercial terms & conditions, then the Price Bids of such tenderers will not be opened and no further correspondences in the matter will be allowed.

29. If in any company, the interest of any employee of the GETCO or his relative as

defined in Section VI of the Company’s Act. 1956, is 10% or more, GETCO will not



deal with such company at all. Tenderer therefore, must specifically disclose this fact in his technical Bid. Non-disclosure of such facts would disqualify the Tenderer for further dealing with GETCO.

30. ARBITRATION:

All questions, disputes or differences whatsoever which may at any time arise between the parties to this agreement touching the agreement or subject matter thereof, arising out of or in relation there to and whether as to construction or otherwise shall be referred to the decision of the Sole Arbitrator, appointed by the Chairman, GETCO, for that purpose, who shall be a retired High Court Judge or retired District and Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon the parties. Reference to the arbitration shall be governed by the provisions of Indian Arbitration & Conciliation Act. 1996 as amended from time to time and the rules made there under.

31. JURISDICTION: All questions, disputes or differences arising under out of or in connection with the Tender / Contract if concluded shall be subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender / Acceptance of tender is issued, is situated i.e. Godhra.

32. SUBMISSION OF OFFERS:

The firm having single legal entity and having two or more works / factory and submits offers from two or more different works / factory, in such case Corporation will consider only ONE lowest offer for allocation of quantity. Many of the tenderers are submitting their offers with the conditions of advance payment along with the order; such conditions are not acceptable by the Corporation.

33. The Tenderer if being an agent, who submits its offer to Corporation, will have to give information and declare the name of the principle from which he will procure the materials and supply to Corporation along with company’s written confirmation about quality and backup performance guarantee. Only on getting complete information from Agent, such offer if found suitable shall be taken in consideration.

34. Corporation reserves the right to cancel any or all the offers / bids or to accept any

offer without assigning any reasons. Also in case Corporation finds that there is an attempt of cartel in the prices, Corporation reserves the right to consider or reject any or all the parties offers without assigning any reasons thereof.

35. Corporation reserves the right to increase or decrease the quantity against each item/s while placing the order.

36. Tenderer should invariably fill up all the details of all the Annexure including the

prices in the Price Bid Annexure of this tender document. This is mandatory. Also all the Annexure should be duly signed by authorized signatories with their rubber stamp and along with Company’s Rubber (Round) seal / stamp affixed on each paper.

37. The tenderers are required to furnish the technical information and the guaranteed

technical particulars (GTP) along with company seal and signature of the Tenderer on each and every page / papers of the tender documents.

38. The following List of Annexure and Documents should be invariably submitted along

with the tender:



1) Schedule–“B” Price Bid to be submitted in the Separate Price Bid cover super scribed “PRICE BID COVER ONLY” mentioning the TENDER NO.

2) Technical Specifications with Guaranteed Technical Particulars. 3) Annexure – 1 TO 5 4) APPENDIX-1 to 3

5) All the above documents should be duly filled in, signed & stamped with company’s seal should be submitted along with the Technical Bids and Schedule–“B” to be kept in the Price bid cover.

39.

a. All the costs of the stamp papers are to be borne by you as per the Govt. Of India’s latest guidelines.

b. The contractor shall make their own arrangements for the necessary approach, road, for transport of their materials and be responsible for the compensation on account of damage to crop etc. & shall till completion of work.

c. All the royalty charges, Octroi and other duties & all taxes will be paid by the contractor and no extra be claimed on this account.

40. All the tenderers must ensure that all the relevant documents / papers submitted

with the tender should be serially numbered, properly bounded / tied together and properly documented. This must be adhered to.

41 All the above points should be complied by the Tenderers. If not, tenders are likely

to be ignored without making any further reference.

SPECIAL TERMS AND CONDITIONS:

1 The successful tenderer will have to make his own arrangements to procure the necessary equipment, tools-tackles required for job. No tools and tackles, crane, men, material etc. will be provided by the GETCO

. 2 The work is to be executed in all respect as per the instructions of Engineer-in-

charge by arranging all required materials tools, tackles equipment including labours, transportation etc. GETCO will not pay anything extra on this account.

3 The GETCO reserves the rights of retrenching and dismissing any person employed for the work if there is complaint against his misbehavior, misconduct or disloyalty towards job.

4 Terms and conditions regarding industrial laws and other related matters shall be

complied by the contractor in all respect. 5 No part of the contract nor any share of interest there in shall in any manner of

degree be transferred / assigned or subject by the contractor directly or indirectly to any person/firm or Corporation whatsoever.

6 The contractor shall ensure that all persons are provided with the safety tools,

shoes, etc. as may be required from safety point of view and all his persons shall follow the instructions issued by the GETCO from time to time related with the safety and security to carry out the work.

7 GETCO shall not be liable for any damages or compensation for any injury or for any

accident occurred to any person engaged by the contractor. The contractor shall keep the GETCO indemnified thereof.

8 The contractor shall be liable for making good all damages/losses arising out of

workmanship, breakages, pilferage, etc. to the GETCO. 9 The rates agreed herein shall remain firm till the expiry of contract. The contractor

shall not be entitled to any increase or revision (Statutory or otherwise) or any other right or claim. Whatsoever by way of representation, explanation statement or any undertaking or promise given or alleged to have given by any employee of the company or due to contractor’s own ignorance on account of any difficulties or hardships faced by him. The rates as such are all inclusive of all.

10 The rates should be quoted in percentage in enclosed schedule only, both in words and in figures, as specified therein. In case of any discrepancy between the rates/amount quoted in words & figure, the rates/amount most favorable to the GETCO shall be considered.



11 Conditional tender will not be accepted and likely to be rejected.

12 The GETCO do not bind them selves to accept lowest or any tender.

13 The GETCO reserves all rights to accept or reject any or all tenders without assigning

any reason.

The terms and conditions stated above are carefully read by me/us and are acceptable to me/us.

14 The work shall be carried out within 30 days from the time of intimation from the Godhra division. If the contractor does not carryout the work within stipulated time, GETCO reserves the right to get it done from other agencies at the risk and cost of the contractor. If the contractor fails to execute the work as above, EE (TR) Godhra reserves the right to cancel the Contract on such defaulters.

15. The tenderer has to insure the job undertaken by him on behalf of the GETCO and

necessary charges will be reimbursed.

16. The contractor will be fully responsible for any shortages, breakages or damages to

the transformer and its accessories that may occur during work etc. It is to be

properly work and handed over to GETCO after completion of the job in a

satisfactory manner. The cost of any such shortages, breakages or damages if any

will be recovered from the contractor for which the assessment will be done by our

field officer at his sole discretion and his decision will be binding to the contractor.

17. For any claim lodged by tenderer with Insurance Company towards damage to the

job and claim passed by Insurance Company will be reimbursed to the tenderer.

18. The contractor shall be responsible for any accident or damage to private, public

properties etc. during any of activity for execution of above job.

19. The successful tenderer will have to indemnify the GETCO against any possible

claim of compensation for damage to his equipment or for injury to him, or fatal/non-

fatal accident to human life, his staff or any other person during execution of the

above job. If for any reasons the GETCO is called upon to pay such claim or

compensation, the same will be recovered from him or his bills.



20. The contractor or his experienced authorized person should always be present at

the site during all the activities for execution of the job.

21. The contractor should have minimum two years experience for similar type of work

and have successfully executed the work of dismantling ,erection etc. with GETCO

for 4 Nos. of Power Transformers up to 100/50 MVA.

22. The work shall be carried out within 24 hours from the time of intimation from the

respective division. If the contractor does not carry out the work within stipulated

time, GETCO reserves the right to get it done through other agencies at the risk and

cost of the contractor. If the contractor fails to execute the work as above for three

times, E.E.(TR), Godhra reserves the right to cancel the contract on such defaults.

23. The contractor has to comply all Safety Rules/I.E. Rules/Act, Insurance Laws, RTO

Rules, Labour Laws, Railway/PWD Rules/Laws, Minimum Wages Act, P.F. Act,

Income Tax Act and other rules and Laws of State/Central Government etc. etc.

pertaining to this job at his own cost.

The terms and conditions stated above are carefully read by me/us and are

acceptable to me/us.

IMPORTANT INSTRUCTIONS

1. The Tenderer should clearly give certificate along with the Technical Bid: “This is to confirm and certify that the offer submitted by me is strictly in accordance with the Corporation’s Tender specifications, Guaranteed Technical Particulars and drawing as mentioned in the Tender Specifications. There is no commercial or Technical deviation (except the deviations shown in Annexure of Technical Deviations as per clause no.22 of this tender document) in the offer from the Corporation’s Tender Specification. I undertake to abide by the Corporation’s Technical specification / Guaranteed Technical Particulars / Drawing, I undertake to supply materials strictly as per the Corporation’s Technical specification / Guaranteed Technical Particulars / Drawing, even if any technical deviations are mentioned by me. I also undertake to abide by all commercial conditions of the Corporation, including delivery schedule.”

2. Any offer without above certificate will not be considered and the tender will be out

rightly ignored in the absence of above certificate. 3. After opening of the Tender, if it is found that the offer given by the Tenderer is not

according to the Corporation’s specifications, Guaranteed Technical Specifications, Drawing and commercial terms and conditions and false certificate is given by the Tenderer, then Corporation will not deal with the firm for the present Tender. It is, therefore requested that the Tenderer should take care in giving their offer and submission of documents, including Type Test certificate.

4. The conditional tenders will not be accepted.

5. Instead of giving reference of drawing nos./ IS / literatures etc. actual values / figures must be furnished, where ever required, overwise the said details in G.T.P. of the Technical Bid, will be evaluated accordingly.

1.1 SCOPE:. 1.2. CLIMATIC & ISOCERAUNIC CONDITIONS 1.2.1 The climatic conditions at site under which the equipment shall operate satisfactorily are as follows:

a. Maximum ambient temperature of the air in shade (°C):50

b. Minimum ambient temperature of the air in shade (°C) :4

c. Maximum daily average ambient temperature(°C) :40

d. Minimum yearly average ambient temperature(°C) :30 e. Maximum relative humidity (%) :95

f. Average number of thunder-storm days per annum :15 g. Average annual rainfall (cm) :115 h. Maximum wind pressure (Kg/m2) :150 i. Earthquake acceleration (g) :0.08 x 2 g j. Height above mean Sea level (M) :Not exceeding 1000 1.2.2 The equipment offered shall be suitable for continuous operation at the full rated capacity under the above conditions. 1.3 TECHNICAL AND SYSTEM CONDITIONS 1.3.1 SYSTEM CONDITIONS:

BUSHINGS shall comply with the following system conditions. a. Nominal system voltage (KV): 220KV, & 132KV b. Highest system voltage (KV): 245KV c. Phase to ground Voltage. (in KV) :142 d. Number of phases : 3 e. Rated frequency (Hz) :50 f. Basic insulation level imp. :1050 g. outdoor 1.3.2 TECHNICAL CONDITIONS:

(A) The Name plate details of transformer attached herewith.

(B) Site visit: (i) The bidder is advised to visit the site and examine the site condition. Where in the work is proposed to be carried out and to get himself fully acquainted at his own responsibility for all information that may be necessary. All cash and Liabilities arising out of the site visit shall be at bidder account.

(ii)The contractor shall be deemed to have carefully examined the work & site conditions, the general conditions, the special conditions, specifications,



schedules, drawings shall be deemed to have visited the site of the works & to have fully informed himself regarding the local conditions. Copy of Appendix V attached with tender shall have to be filled up before quoting the rate, for confirmation of site visit.

(iii) If there shall have any doubts as to the meaning of any portion of these general conditions or special conditions of the scope of work of the specifications or any other matter concerning the contract, he shall in good time before submitting his tender, send for the particulars thereof & submit them to the Engineer in writing in order that such doubt may be removed. SPECIAL FEATURES

1. Insurance:-

All work includes dismantling /erection insurance to be arranged by the contractor at his cost.

2. Dismantling:-

Work of dismantling / erection of transformer carried out as per the instruction of our E.I.C.

3. Removed bushings & accessories are to be returned to GETCO.

4. Experience: Experience of erection / dismantling work of bushings and transformers

is necessary.

5. Important:

01. Contractor has to ensure safe shifting / dragging / handling and erection /dismantling of all accessaries comply with labour laws,ie rules etc. 02. All work includes dismantling /erection insurance to be arranged by the contractor at his cost.

03. All dismantling /erection work is to be carried out as per the manual of

original equipment manufacturer and instruction of E.I.C.

04. All required tools, tackles and crane are to be arranged by contractor.
