As per the provisions of Notification No. S.O. 1533 dated 14/09/2006 and its amendment S.O. 3067 (E) dated 01/12/2009, Ministry of Environment and Forests, Government of India, New Delhi, Public hearing is conducted for the proposal of mining activity of M/s. GHCL Limited, for Bhimdeval Limestone Mine, survey no. 88(part), Area-56.3517 hectare (Production expansion- lime stone-from 42,000 to 1,50,000 MTlYear) at village: Bhimdeval, Tal:Talala, Dist.: Junagadh, which is covered under Category 'A', which was held on dated 25/09/2012 at 11:00 hrs at Chora of Village, Village: Bhimdeval,Tal: Talala,Dist.: Junagadh as mentioned in their request application.

A copy of the draft Environment Impact Assessment Report and the Summary of E,nvironment Impact Assessment Report was sent to the following' authorities or offices to make available the draft EIA report for inspection to the public during normal office hours, till the Public Hearing is over.

The Public Hearing was scheduled on 24/07/2012 and an advertisement in English was published in "The Times of India" dated 23/06/2012 and in Gujarati in "Divya Bhaskar" dated 23/06/2012, which is rescheduled on 25/09/2012 & re- advertisement in English was published in "The Times of India" dated 23/08/2012 and in Gujarati in "Divya Bhaskar" dated 23/08/2012.

As per the provrsrons of Notification No. S.O. 1533 dated 14/09/2006 and its amendment S.O. 3067 (E) dated 01/12/2009 issued by Ministry of Environment and Forests, Government of India, New Delhi, public hearing is conducted for the project covered under Category lA' of the said notification for the proposal of mining activity of M/s, GHCL Limited for Bhimdeval Limestone Mine, at survey no. 88(part), Area-56.3517 hectare (Production expansion- lime stone-from 42,000 to 1,50,000 MT/Year) at village' Bhimdeval, Tal:Talala, Dist.: Junagadh under the supervision of Shri K.R.Vasava, Deputy Collector & Sub-Divisional Magistrate, Veraval and Chairman of public hearing committee.

Shri A. M. Gadhiya, Regional Officer, Gujarat Pollution Control Board, Junagadh & representative of the Member Secretary, GPCB. after due permission from the Deputy Collector & Sub-Divisional Magistrate, Veraval and Chairman of public hearing committee started the public hearing proceedings and welcomed all present to the public hearing. He outlined the various provisions of the Notification and briefed the procedural details for conducting this public hearing including actions taken by Gujarat Pollution Control Board for wide publicity of this public hearing and the advertisement given earlier in the local dailies. He announced that as per the provision of notification, only locally affected persons will be allowed to make their representation in the public hearing while others having plausible stake may give their representation in writing which would be included in the proceedings.

He also informed the forum, that written representations received prior to the public . hearing, would be included in the proceedings.

'He invited the project proponent to give their introduction and to make the presentation of their project. .

Shri J.H.Shaikh, representative of project, welcomed the gathering and started presentation in Gujarati language covering introduction of the mining project, technical information, details of project, Environmental Management System, its impact on environment along with proposed mitigation measures and mining activities towards Social Responsibilities was presented.

After the presentation by the project proponent Shri K.R.Vasava ,Deputy Collector & Sub-Divisional Magistrate, Veraval and Chairman of public hearing committee opened the forum for representations/suggestion/objection from the locally affected people.

Mining is going since 2 % years. Company has made fodder godown, repaired the roads, repairing cause way over river. Four numbers of stitching machines are provided to the village. School has been started for children of the mines labour and two lady teachers have been employed as teacher in this school. Assistance of Rs. 4000 has been provided for constructing bathrooms and sanitation. People from Bhimdeval village have been qiven employment. No misbehaviour from the company employees is noticed and no damage to environment is observed.' It ts recommended to approve this project.

Development work has been done by the company. Mining is going on since two years. There is no damage to environment. It is recommended to increase the production capacity.

We have no objection if production capacity of this company is increased. There is no damage to the environment due to this project. '

6 Jaswantbhai It is good that if production increases than Pratapbhai employment also increases which in turn Parmar, Amrapur increases the prosperity of the' village.

Company has made fodder godown. School has been made for children to study without any fees. Two lady teachers have been employed. Causeway over the river has been repaired. Village development takes place due to development of infrastructures. No impact on environment is observed. It is recommended for approval of this project.

7 Yogesh Nearby villagers are getting employment Bavanjibhai Vadi, due to mining project because of which, Bhimdeval they are able to provide education to their

children. Company has done development work like , godown, causeway repair, stitching classes, cattle camp etc. There is benefit to the agriculture due to storage of water in the mining pits. More employment will be generated due to more production. I recommended for approval of this project.

8 Jethva Rajshibhai Our village is 8 Kms away, nearby Shri N.N. Radia, Devsi, Amrapur villagers are benefited but outsiders are representative of

not benefited. Gir area is situated near GHCL Limited and wild animals are staying there. There assured at the end are chances that these wild animals may of public hearing migrate due to blasting. Movement of to put all efforts to vehicles is not as per rules. Roads are carry out the getting damage. ·We have objection development work. against this project.

9 Dodiya Mansing There is common village boundary -of Devabhai, Anida Bhimdeval and Anida. Damage to

environment due to blasting is not observed and wild animals are migrating is also never observed. Anida village should also get benefit by the development work from the company. Their village is recommending for increasing the production capacity.

GHCL Limited There should be proper demand of assured at the end development work from the company. Jf of public hearing company do not fulfil the requirements to put all efforts to then as mediator I will get the carry out the requirement fulfilled. He also informed development work about the social work done by the GHCL. GHCL supports for the public work. He emphasised participating freely in public hearing and as MLA it has not come to his knowledge about any damage being done to environment due to mining and any loss of agriculture due to mining. He informed about development work through consensus.

More employment will be generated due this mining project. There will be overall development of the village, taluka, district and state. There is increase in direct and indirect employment due to this company. Education level is improved. There is no any pollution due to mining project. Wild animals from Gir forest are coming to this area but there is no harm to these animals. Keeping the development in mind, it is recommended for increasing the production. .

Surrounding villages are developed due Bhagwanbhai Mer. to mining industry. I recommend this Jamalpur project.

Jignesh Mensibhai My village is away from mining area but I Shri N.N. Radia, Gadhe, Amlash wish that such company should come in representative of

my village also and do the development GHCL Limited work. Good education and more assured at the end employment are generated due to such of public hearing industry. Company has made fodder to put all efforts to godown. More employment will be carry out the generated due to more production. development work. Ground water .table will be raised due to storage of water in mining pits. There will be agriculture on the land after removing limestone and levelling. I invite this project.

My land is situated near Nakhada mines. Company takes care of nearby land during mining operation. There is no land pollution due to mining. Company has done development work In Bhimdeval. After rernovinq limestone the land is given back to farmers and levelled. Education level is improved due to this company. I recommend for this project.

Opportunity of employment will increase due to increase in production from 42000 MT to 150000 MT. Because of this the education level of the children will also improve. No accidental damage to the wild animals has been observed. I recommend for this project.

Everybody gets opportunity to represent his view during public hearing. GHCL has made arrangement-for roads, water etc. There is no impact on environment due to manual mining. Village people have not to go far away for earning. Local employment is ,generated due to this project. I recommend for this project.

So many labours are benefited due to this project. Company has made school and fodder godown. Land can be made fertile by filling pits which will benefit to farmers. I recommend for the project.

I have received employment as guard in the mines. Development work in the village like, school, roads, stitching work, fodder godown etc.'. have been done by the company. If production increases, then more development of the' villaqe takes place. I recommend for this project.

My land is situated near the mines area. Shri N.N. Radia, Dust particles generated due to blasting. representative of Company is not spraying water on roads GHCL Limited after making the roads. Drinking water is assured at the end not arranged. Big pits are not filled. He has submitted the list of labours working in mines as per Annexure C-4 and informed that employment is available due to mining project. Living standard is improved and education is also improved. Arrangement of drinking water and labour quarters has been provided by the company. Other development work are also done by the company.

He informed that company employees will definitely speak good for the company.

Mango trees are planted in the reclaimed area of the mines situated in other villages. Education level has been improved due to English Medium school of the company. Because of this children of the local people are becoming engineers, doctors etc .. Limestone will be needed for industries and then only industries will be developed. I recommend to this project.

There is village development due to mines. I have also got employment. This year there is drought. There is no any other alternative employment.' More production will generate more employment. He'nce I recommend this project.

Mining is going on since 2 'Y.! years and company has done lot of development work. I recommend for this project for increasing production and employment.

More pits will be developed due to more Shri N.N. Radia, production. Wild animals of the nearby representative of Gir forest will be affected. There may be GHCL Limited migration of wild animals. Roads are assured at the end damaged due to 'vehicular movement. of public hearing Pollution will be increased and animals to put all efforts to will be affected. Shri N.N. Radia representative of the ~HCL Limited, first of all praised the Bhimdeval village for conducting the smooth proceeding of public hearing. There are advantages and disadvantages of every project. Company is working after fulfilling of all the statutory requirements. Lot off people have praised the company and other people have

. made suggestions for betterment. I, as In charge of the company, assure that whatever is shortfall for the development of the village will be completed and instruct my 'colleagues accordingly.

GHCL Limited is working since last 25 years. Earlier in the company there was a practice to carry out the social work by the people but now company has started Corporate Social Responsibility (CSR) under which we go to the people and know their requirements/difficulties so that the work can be done in better way. Accordingly our CSR team approached the village people and made the list of their requirements. All these required jobs will be carried out on priority basis and shortfall, if any, will be fulfilled.

We will consider your various suggestions and put efforts to complete the development work along with better mining operation, less trouble to the people and simultaneously becoming helpful to the village people.

Sub.- Regarding demands of Bhimdeval villagers.Sir,

It is the request to you from the villagers of Bhimdeval village that an agreement with theGHCL Company on following points should be made and implemented accordingly.

01 – School - Company should start a good Gujarati medium school in the village from Std.1 to 12from June,2013 with appointing qualified teachers and constructing a good school building.

02 – Health Services – Company should start a Mobile Dispensary twice in a week with oneM.B.B.S.doctor and two qualified nurse and provide required medicines and services free of cost. ( For your information that such type of service is provided by Ambuja Cement in its area )

03 – Scholarship – Company should provide scholarship to meritorious and needy students of std.10 or12, who can not study in Science due to poor economical condition of their parents.

04 – Festival Prize - Navaratri and other festivals are celebrated in our village in which children areparticipating. Company should encourage and contribute some kind of prizes so that children wouldhave good feeling towards the company and also company would earn the name.

05 – Regarding Agriculture – Agriculture is the main business in our village. Hence company shouldarrange for providing guidance& latest technology / exhibition about agriculture by experts of this fieldalong with training.( Ambuja Cement has made such type of arrangement )

06 – Animals/ Kitchen garden / Dairy for Women – It is a request to the company to do somethingfor the women of our village towards guidance, training for maintaining animals, kitchen garden andmaking team of women for dairy business in the organised way.

07 – Village Gate – Our village is situated on the highway. A good beautiful gate at the entrane bemade by the company.

08 – Cattle Health Camp – Company should organised cattle health camp once or twice in a year sothat middle class farmers are benefited for their cattle at their door step.

Above referred eight demands are put before you by the villagers so that an agreement with thecompany is made for the overall development of the village and work is can be started at the earliest.

It is again a request to you from the villagers that looking to the above demands and development ofthe village, an order to the company is issued and a copy of such order is made available to us. Thanking you,

Sub. - Regarding protest of the public hearing of GHCL at village Bhimdeval.

Name – Ukabhai Chaganbhai Trada ( Ex-Sarpanch of Bhimdeval Gram Panchayat )

Respected sir, We present here the following points as a protest against the public hearing of GHCL – Sutrapada heldtoday under your presence.

01- Company has shown the area as 56.35.17 hect. in demanded survey number while in governmentrevenue record like 7/12, 8-A and No.6, it is 54.36.28 hect. Which record is true, company's EIA reportor Government record ? In survey no.88-1 paiki 13 report, it is government wasteland. Hence whethercompany report is true or government report is true.

02 – EIA report of Bhimdeval along with EMP report has been prepared by M/s Udaipur Mintech.Pvt.Ltd. Whether this company is of Gujarat or outside Gujarat ?

03 – If Udaipur Mintech.Pvt.Ltd. is not from Gujarat then it has no knowledge of geographical andother condition of this area.

04 – Goucher land can not be allotted other than goucher purpose. Revenue department of the Stategovernment has issued a circular vide letter dated 1st.June-2012 and also considering Supreme courtverdict referring C A.no.1132-2011 dated 28 January,2011, Goucher land can not be allotted other thanGoucher purpose not even for Gamtal.

05- Company in its report has divided the area in five blocks and stated that there is encroachment bythe farmers. Farmers have made the land cultivable by putting efforts and are earning from it.About 300 families are earning through this while company in its report states that there is possibility of145 families for employment. In fact company is not providing work to workers of Bhimdeval villageand instead outside workers are given the job of limestone breaking. Sufficient care is not being takenby the company for their health. Drinking water facility at site is not done. Wild animals like Lion,Tigers etc. are found roaming in the mine area against which there is no proper shelter for them duringnight hours which is total carelessness of the company.

06- Drilling and blasting will be there as per report due to which surrounding people and their animalswill be highly affected due to blasting. This is true as per our knowledge.

07- Air pollution takes place due to drilling and blasting.

08- Noise pollution takes place due to drilling, blasting and loading and there are chances of deafness tosurrounding people and workers working in the mines area.

09- Company in its report states that there is no Water pollution due to mining while in report 4(a)watermay be polluted. So how the report is considerable.

10- Regarding solid waste disposal, company states that greenbelt will be developed. We want to knowhow much green belt has been developed in company's mines like Rangpur, Harnasa,Khambha ofSutrapada taluka. During previous hearing, company had told that after completion of the mining, thearea would be filled-back & levelled and plantation would be done on such area so as to conserve theenvironment. Company has not done any plantation or green belt.

11- Limestone is the formation of water conservation. Because of mining and blasting, ground waterlevel will be reduced and water storage capacity will be affected. Due to disturbance in ground watertable, there is possibility of sea water ingress and fertile land may become barren which in turn forcethe nearby farmers to migrate and question of rehabilitation may arise.

12- Company in its report has stated that 10,000 ltrs.of water is required for sprinkling. There is nowater sprinkling in the mines area. There is no water source of the company. Company has no waterarrangement and green belt development is only talked about.

13- Effect on Flora & Fauna report is false. Asiatic lions are moving in this area and kill farmer'sanimals. After starting of the mining work, Talala Forest department has paid compensation to 33 casesof such killings during 2009 to 2012. Trees like Saag,Limda,Vadla,Bawar etc.are found in the area.

14- As per company's report there is no human settlement around mining lease area. In fact farmersalong with their animals are residing around this area and doing agriculture work.

15- Company in its report has shown yearly expenses of rupees five lacs. towards measures being takenfor environment protection and social work. Company has not done any such expenses and is doingsuch work at its own without taking Gram Panchayat into confidence.

16- Regarding plantation, there is reverse situation than as stated in the report. Company has not doneany plantation. Air pollution will increase. Safety is not provided to workers during mining.

17- There is river Nariaro in the lease area granted by the government. Lease area is on both sides ofthis river. If limestone is extracted from both the river banks then there is possibility of river flowenlargement which, in turn, may wash the land of Bhimdeval farmers and river water may enter theneayby area of village Khambha of Sutrapada taluka. If it happens so then it is beyond imagination.

18- About 1000 years old ancient Bhim Temple is situated in the lease area. The temple is underArchaeological department. During previous hearing, company had stated that about 200 mtrs. areaaround the temple would be left but at present mining is done within 200 mtrs. Company should explainthis and needful to be done.

19- There is electrical line in the mines area. During blasting, live wires are falling down due to flyingstones and fire takes place on farmer's standing crops. Animals are killed if live wires fall on them. Thisis negligence by the company which needs explanation.

20- Company in its report states that village Bhimdeval is 500 mtrs.away from mines area. Cracksdeveloped in the houses due to ground vibrations during blasting. Farmer's assets are damaged.

It is our request that above points may be considered and needful may be done.

Sub: - Against public hearing in Bhimdeval Limestone mine of M/S GHCL Ltd.

1-EIA and EMP report of Bhimdeval Limestone Mine has been prepared by M/S Udaipur MinTech Pvt.Limited. Whether this company is from Gujarat or from Outside of Gujarat?.

2-If M/S Udaipur MinTech Pvt. Limited is from outside of the Gujarat State than the company has noidea about the Geographical position of the area.

3-The lease area of the company is 56.3517 Hects in EIA report. But in Govt. Record i.e. in form7/12,8A and 6 number form it is shown as 54.6328 hects. Also Survey no. 88/1A/P-13 is aGrampanchayat Gochar land. Company in his EIA report states that it is a Government Waste land.Tell whether the Company report is true or Government Form 7/12, 8A?.

4-Company in his report has divided the whole area in 5 blocks in which a number of farmers hasencroached the area and converted the land into agricultural land. At present about 300 families aregetting employments from this agricultural land.Company in his report states that about 146 peopleshall get employment by this project. We do not accept this.

5-Company in his report writes that recovery is 90%.In actual recovery percentage is 60 to 70% and 30to 40 % is undersize which is of no use to company. How much true is the Company report?

6-Company in the report writes that mining shall be carried out by drilling and Blasting. Farmers andtheir cattle of the near by area may get injury by drilling and Blasting. Human life has been put indanger by blasting and labours are also in danger by drilling.

7-There is pollution in mining area. Dust generated by Drilling and Blasting is polluting the airenvironment.

8-There is noise pollution in mining area. Noise produce during drilling, blasting and loading maycause deafness to the people living around the mining area, Children of nearby Sarswati School andpeople of Hospital.

9-Company in his reports states that there is no Water pollution by the mining; whereas in EIA report4(a) again writes that water get polluted by the mining. Tell which is correct?

10-Company in his report writes that we shall develop green belt for the disposal of Solid waste.Tellhow many plant so far company has planted in Harnasa,Rangpur and Sutrapada villages?

11-A nala, River sarswati is passing from lease area and a temple of Archaeological importance is lyingin the lease area. Also 132 K.V. high voltage line is passing from the leases area. No lease shall begranted in such area.

12-Company in his report states that no human settlement is required in lease area. In fact BPL cardholders of Bhimdeval village do not have land for making house. We demand that Mining lease whichis 500 mts from village shall be kept reserve for BPL card holders.

13-Limestone formation act as water reservoir and by doing mining water level may go down andstorage capacity get reduce. Blasting may also disturb water storage capacity of the area.

14-Company in his report writes that the temperature in December 2011 was 22.6 degree Celsius butdue to blasting it may go upto 24.70 degree Celsius.

15-Wind speed is more in mining area because of the river flowing near the lease area. Therefore dustparticle may spread in the mining area and cause diseases.

16-Company in his report states that Noise level is within permissible limit. Noise level increasesduring drilling, blasting and loading. Hence Company’s report is false.

17-Company in his report states that 10,000 litre water shall be required for dust suppression. Companydo not sprinkle water for dust suppression and only talks for green belt development.

18-Report that no impact on flora and fauna is false. Asiatic lion comes in the area. Trees of neem, sal,desi babool etc. also found in the area.

19-Company in his report sates that there is no human settlement in the lease area. Farmers along withtheir cattle have settled in their agricultural land near to lease area.

20-Company has not done plantation as per the report. Pollution may increase. There is no safety oflabours working in the mine.

21-Company in his report has shown an expenditure of Rs. 5 lacs per annum for environmentalprotection. Company has not spent this amount on environment.

Keeping in view the above points we request not to grant production enhancement permission.

Point wise reply of the query raised by you on dated 25.9.2012.

1. We have got lease deed execution from Collector office, Junagadh for 56.3517 heets.

2'udaipur min Tech Company is not from Gujarat.

j.Udaipur Mintech Company is a recognised finn for preparation of ElA report and have working area mostly in Gujarat and Rajasthan. The company is fully equipped with all latest instruments to carry out the environmental monitoring and is well aware of the Geography ofGujarat.

4. This lease has been granted by the Government in 2008.

5. Some part of the lease area is encroached. After completion of mining the area will be surrendered to Government Housing and water arrangement is being done for labours. Mining is being done during day time only.

6 We are not doing drilling mechanically. Hand holes are being done and blasted by using controlled blasting technique with all neeessary safety precautions. Hence there is no any danger to surrounding people.

7.Air pollution is very negligible in our method of mining. Wet drilling is being done by making hand hole and eontrolled mulled blasting technique is done to minimise air pollution.

8.There is no noise pollution due to drilling as it is done manually by making hand hole. Loading doesn't produce any noise pollution. Noise pollution due to blasting is momentary and last for a fraction of a seeond.

9. The report is true. Water may get polluted by Wash off from dump and by Pumping of mine water into surface water bodies. In our case of mining there is no any such reason hence it has been written that there is no water pollution during mining operation.

10. We are doing plantation as per approved mining plan. At present, in Rangpur more than 6900, in Hamasa more than 2500 and in Sutrapada 4900 plants are existing. Rate of survival rate is 60 to 65%.

II By mining there would be no adverse effeet on ground water level. Rather rain water stored in mining pits, inereases ground water level of the area.

12. We are sprinkling water as and when required. As our mmmg is in very small scale hence daily sprinkling is not required. With increase in production capacity the same shall be carried out daily. Plantation is being done as per approved mining plan.

13. The lease area is barren QDd rocky. Scrubby vegetation is seen in the area with occasional patches of common plants. As Gir sanctuary is about 10.5 Kms from the area, stray incidence of coming of lion may not be ruled out.

14. ln lease area there is no any bumen settlement. People from surrounding area passes from lease area. Utmost care is being taken for the safety ofsuch passer-by during mining and blasting.

15. Social work is being done through GHCL Foundation trust.

16. Company is doing plantation as per approved mining plan. As the lease area is new hence density of plantation is low and will increase in due course oftime.

17. Lease is granted by the Government. Wc shall take care of electric wiring. temple, nala, river during mining operation.

18. Mining work will be carried out by leaving required distance as per rule, from Bhlmdeval temple.

19. Necessary safety precautions shall be taken during blasting near electric tine etc.

20. Ground vibration during blasting is being monitored and is within permissible limit..

5 Usually the recovery is around 90%. However it varies on the type of rock formation and method of mining.

6 We are not doing drilling mechanically. Hand holes are being done and blasted by using controlled blasting technique with all necessary safety precautions. Hence there is no any danger to surrounding people.

This is to inform that there is no forest land in and around Bhimdeval mines area. Blasting in the mines is carried-out during day time only and that too at the fixed time. All necessary safety measures are taken during blasting. Hence there is no danger to any wildlife. Transportation of limestone is carried-out as per rules and so there is no any damage to the public roads and surrounding people.
