greater regulatory controls after independentanalyses of 31 CBD-based products foundvarying levels of active ingredients as well asCBD-related labelling issues.
Tests found products inaccurately labelled withpsychoactive compounds cannabinol (CBN) and/ortetrahydrocannabinol (THC) found in almost half of thesamples with some above the one milligram (mg) legallimit.
“All three of our independent analyses demonstrate anurgent need for greater regulatory control of currentlyavailable CBD products to safeguard consumers,” says MarkTucker, CEO of TTS Pharma, which carried out the tests.
“The implications of such a rapidly growing market cannotbe ignored. Without detailed analysis of CBD products, bymanufacturers and suppliers, consumers cannot be surewhether the product is safe to consume.”

Further findings revealed ten samples contained THCwere above the legal limit with nine of the thirteensamples contained CBN. Four of the nine samplescontaining CBN exceeded this legal limit.
Less than half (13) were within 10% of the stated level ofCBD while four samples contained less than 50% of thelevel stated with five exceeding the level stated.
“This study represents the vast majority of brands, andspans the leading high-street retailers including what webelieve to be the top four selling products currentlyavailable,” Tucker adds.
“Given that these highly popular products on the UK marketwere tested and shown to contain a number of potentiallydangerous contaminants, it is likely that a large number ofpeople in the UK have ingested those illegal and/ordangerous substances.
TTS Pharma’s findings “should be on the radar ofregulators and Government”, according to the CEO of theLondon-based firm, which supplies cannabinoid productsfor the food, cosmetics and nutraceutical markets.
“We hope that this research is enough to accelerate a fullscale assessment using independent and accreditedlaboratories,” says Tucker.

“The EU infrastructure is comparatively sound and welldefined when compared to the North American regulatoryenvironment.
“It is therefore important that products imported into the EUfrom the US (as well as other ex-EU countries) are competingon a level playing field and meeting all EU regulatoryrequirements.
“For example, we have seen products imported from the USAwhich would be legally compliant if they could demonstrateprovenance to an EU approved seed but do not suggestingthat their source material does not comply with EUregulations.
“We have also seen US sourced products which claim to beTHC-free but also clearly contain CBN and othercontaminants. This lack of compliance needs to berecognised and enforced for consumers seeking a safe foodsupplement.”
TTS Pharma currently makes available pharmaceuticalgrade CBD Isolate, for cosmetics in Europe and the UKwith the firm currently compiling a Novel Food Dossier tomake CBD available for a variety of food supplementapplications.
“With the appropriate pre-market authorisation, we willdeliver CBD products that surpass the quality of productsthat we can see (and have proven) unfit to be on themarket,” says Tucker.
“We are members of the Health Food Manufacturers'Association (HFMA) and are keen to help raise awareness ofthe importance of quality and provenance of all consumerproducts containing CBD, with a view to safeguardingconsumers and helping to clean up what is undoubtably anunrestrained market.”

One such area of interest on TTS Pharma’s radar issports nutrition, where CBD use amongst athletes isgaining momentum with links to decreasinginflammation and aiding in sleep and recovery.
However, with athletes wary of using CBD due to thedifferences in product quality, the fear of failing drugtests is all too real and for Tucker the sports nutritionarena can thrive under tighter CBD regulation.
“The World Anti-Doping Agency (WADA) has removed CBDfrom its list of prohibited ingredients,” he explains.
“However, we have observed products pitched towardsrecreational athletes that still contain traces of controlleddrugs.
“This raises obvious issues for elite and professional athletesas they cannot afford to risk failing drugs tests due tocontaminated products.
“Full confidence in the supply chain is therefore essential, with validated analytical methods employed andindependently verified by accredited organisations.
“Any athlete participating in sport and looking to enhancetheir performance through nutrition, should do so byseeking professional advice. Scientific research is very muchunderway, but we are yet to draw specific conclusions
“For any athlete consuming CBD products, they should dotheir homework and check where the product originated(certificate of origin), where it was manufactured andwhether a certificate of analysis is available, before theytrust the label.

CBD and athletes
“For any professional or elite athlete we would recommendonly using products that have been verified and approved byInformed SportInformed Sport or an equivalent body.”
Current UK laws governing CBD use remain complex andsubject to change. According to the Government’s HomeOffice department, CBD is not a controlled substance aslong as it does not contain any level of cannabinoidssuch as THC or CBN.
Pure CBD is difficult to isolate from CBN/THC and shouldthe controlled substance remain in the product, manufacturers are in breach of the law.
Further afield, some cannabinoids, including CBD, areofficially classed as Novel Foods in the EU and shouldonly be sold within the EU following pre-marketingauthorisation.
CBD-based products such as topicals (tinctures, drops, syrups, oils) chewables (gum drops) and chocolate areclassified as novel foods.
Novel foods authorisation would require the products tohave a low/negligible level of THC so that Misuse ofDrugs legislation in the UK does not apply.
Any health and nutritional claims for an individual foodproduct must align with Regulation (EC) No 1924/2006.
