FOR THE CORONER'S FUND.

WHEREAS the funds in the above mentioned office have been exhausted and

WHEREAS the expenditures have been a necessary expense and the expenditure .thereof has

'.been mandatory, the overpayment having been made to juries and witnesses in Coroner's In-

guests, THEREFOR it is hereby declared that an emergency does exist and that the above

ematgehd*ebe •Bid by the Auditor issuing warrants on the Current Expense Fund and that the •

Treasurer shell pay said warrants from any monies in said current expense fund, to the

amount of $141.98.

OFF, AND AN APPROPRIATION THEREFOR.

WHEREAS rthe Sheriff has made expenditures in excess of the amount set up in his

Budget for 1936, and

Whereas such expenditures were necessary and the public was not pre judiced thereby, and

WHEREAS such expenditures could not reasonably been fore seen at the time of setting •

the Budget; THEREFOR it is declared by each mamber of the Board of Commissioners that an

emergency does exist And that there be appropriated to said Sheriff's Fund the amount of

$266.84, and that the Auditor is hereby directed to issue warrants in payments of said

amount and that the Treasurer ahall pay said warrants from any monies in the Current Ex-

pense Fund.

WHEREAS the expenditure of the funds set up in the budget for election expenses 1

has been in excess of the budget, and WHEREAS said expenditures were a necessary expense

and that the public was not prejudices thereby, and WHEREAS this expenditure was mandatory 1

THE;RFOR it is hereby declared that an emergency exists and that $907.87 be appropriated to

this fund and that the Auditor be and hereby is directed to pay said emergency by •ssuing

purpose on the 9th day of January, 1937, is reasonably necessary for the present use of

the district,

NOW, THEREFORE, it-is hereby resolved that said bond issue be and the same is hereby

IN THE MATTER OF THE

DECLARATION OF WEED DISTRICT.

In compliance 1/ith Sec. 22-1702 of the Idaho Code, Commissioner C.W. Peterson moved t hat

Bonneville County be declared as a Noxious Weed District and that the followi ng specified

weeds be declared to be Noxious, and that they and each of them be destroyed in one of

the following ways: by poison treatment, by clean cultivation or by cutting and burning,

any of such ways named to be completed before said Noxiou Weeds go to seed, said weeds

Aproposition having been made by the Board of Commissioners to the City 6f Idaho Falls

wherein th'e County would' buy their intereht in the snow plow and tractor and said proposi-

tipn having been accepted by the City of Idaho Falls, the Auditor was directed by the

Board to draw a warrant in favor of the City of Idaho Falls for the sum of $700.00 this

being in Tull.for any and all interest that the City of Idaho Falls may have br have had

in said tractor and plow.

604. and 605; on Road and. Bridge fund claims mmbering 2976 to 3019 inclusive. in the amount

of $3754.15 and pohted in the allowance b9ok on pages 266 and267. inclusive; on County-State

- Highway fund claims numbering 64 for $750.00 and posted in. the allowance book·on.page 47;

a period Bf three years, from May 1, 1937, the.premium.therefoB being $600.00, the insurance

The claims which had been filed were presented to the Board and after con-

sidering the same the following were ordered paid: On Current Expense Fund numbers 7719 to

7814 inclusive totaling $4,751.29 and posted on pages 606, 607 and 608 of the Allowance

Book. On Road and Bridge fund numbers 3020 to 3064·inclusive totaling $4;323.53 And posted

on page 268 of the Allowance Book. On the Charity·Fund numbers 7811 to 7833 inclusive and

totaling •2,219.57 posted on page 247 of the Allowance Book. The following claims were

laid over for the reason stated; Freds Cafe $5.00,·no signed orders attached.' John Rees

Harry Wilkinson, being first duly sworn, deposes and says:

That for more than six years past he has not received tax notice

covering the property described hereinaffer, and that he has on one occasion

written the Tax Collector for such statement with no reply. Further, that

because of such absence of notice of taxes due he naturally assumed that some

situation had developed, as is the case in some few localities, whereby no

taxes have been assessed for the past several years.

Affiant further states the first indication he had that there might be

taxes delinquent on such property was a communication from a person in the

county offices desiring to purchase such property and stating that there

were certain taxes delinquent and that the property was going to tax sale.

n Affiant further states that payment has always been made over a long

period of years on the property in question on the basis of tax notices

received.

• WHEREAS, there have been so many deaths caused by exceisive speeding of

motor vehicles it is hereby ordered that the sheriff have signs made showing that the

maximum speed of all motor vehicles being driven in Bonneville county, be and hereby is

fifty miles per hour, and to place said signs in conspicuous places in said Bonneville

county.

AT this time the Board deliberated relative to the rate of tax levies

which would be necessary -for the purpose of raising an amount of money sufficient to pay

• The various School Districts of Bonneville County having filed their certt-

ificates and estimates of the probable amount of money that will be required by each of

said School Districts for the purpose of maintaining school during the School year

1937-1938, and the County Treasurer having filed her certificate of the amount that will

be necessary for each of said school districts which are now bonded, for the purpose of

creating a fund for the payment of interest and retiring of bonds, as they become due.

IN THE MATTER OF LEVY FOR

AMERICAN FALLS RESEVOIR DISTRICT.

A statement having been filed with the Board of County Commissioners by the

- .,County Auditor as required by Section #42-727 Idaho Code Annotated 1932, showing the

amount of interest .which will fall due during the next ensuing year on the outstanding

bohds of the American Falls Reservoir District, and the bonds maturing on October 1, 1938,

and April 1, 1939, and the board being fully advised in the premises, it is ordered that a tax

equal to eleven and seven-tenths ( 11.7 ) per cent of the apportioned cost of· construction

as the same appears upon the list and apportionment of benefits approved by the court and'

on file with the County Auditor of Bonneville County, State of Idaho, shall be, and the

same is hereby levied on the lands within the said American Falls Reservoir District

located in Bonneville County, State of Idaho, for the year 1937;· the proceeds of said :

bax to be•'utilized to pay interest an the outstanding bonds of the American Falls Reservoir

District which will fall due April 1, 1939, Julyl, 1939, October 1, 1939 and January 1, 1940,

and to pay bonds maturing October 1, 1938 and April 1, 1939.

And further that the assessment roll which has been extended and prepared by

the Secretary of the American Falls Reservoir District and filed with the County Auditor

of this County, be accepted as a full, true and correct assessment roll of the lands

affected by this levy and as containing the correct amounts due as taxes under this levy,

and said roll shall be, and remain a permanent tax record of this county.

DEPARTMENT OF PUBLIC WORKS.

The claim of the above named department in the amo•nt of $4,377.00 was sub-

mittad to the Board and the Clerk was directed to write to Elmer W. Fox director of the

Special Highway Fund Audit and advise him that this Board has no knowledge of any indebt-

edness of this County to the State in the amount of #4,377.00 or any other amount.

That in October 1935 a claim for $4,136.50 was presented to the Board and wa s denied

for the reson that any expenditures made amounting to said sum of $4,136.50 were not

authorized by the Board.

The claims which have been filed were presented to the Board by the Clerk

and after considering the same the Board ordered that there be paid on Current Expense

fund claims numbering from 8106 to 8204 in the total amount of $5,095.68 and posted on

pages 617 and 618 of the Allowance Book; on Road and Bridge fund claims numbering from

3210 to 3253 in the total amount of $3828.69 and posted on page 274; on Charity fund

claims numbering from 7898 to 7927 in the total amount of #3,869.75 posted on page 251;

on Fair fund claim number 37 for $200.00 posted on page 10 of the Allowance book.

The gravel pit in section 10, Twp. 2 N. R 42 E. B. M. belonging to Bonneville

County and not being of further use to said County and the sale thereof being beneficial

to said County and no one predjudiced thereby it is hereby ordered that the same be sold.

The Board met on this date there being present chairman N. E. George,

commissioner, S. H. Price and the Clerk, W. L. Brewrink, Commissioner C. W. Pbterson being

out of the State, when the following proceedings were had, to wit:

better inspection and a method of showing ownership. General discussion was had being from

the stock growers, manager of the Commission Sales Yard, the Brand Inspector and members

of the Board. After thoroughly discussing the matter it was generally agreed upon by those

present that the inspector and his deputies and the sale yards maintain a more thorough

system.

in regard to equalizing valuations set up on the Subsequent Personal Roll, and to

hear any ob Jections to the amount set up on said Roll.

IN THE MATTER OF CANCELLATION OF

SPECIAL IMPROVEMENT ASSESSMENTS.

WHEREAS more than five years have elapsed since the last installment on

Special Assessments for improvements in the Improvement Districts in Idaho Falls, was

due and payable, and

WHEREAS some of the lots in the said Improvement Districts were deeded

to the county for delinquent taxes, and thereafter sold by the county, and by issuance

of said deed and the sale of said property, said improvement taxes were cancelled,

IT IS HEREBY ORDERED that the Treasurer of Bonneville County cancel on the Rolls, all

of the Special Improvement Tax6s, not paid, which have been entered against the lots

as aforesaid. And

WHEREAS there are remaining on the records of Bonneville County, uncancelled

Special Improvement Taxes, the Collection thereof being barred by the statute of limita-

tions, mgore than five years having ulapsed since the last installment of said Improve-

ment taxes was due and payable,

NOW,THEREFOR, IT IS HEREBY ORDERED that all of said/Improvement taxes, as above des-

cribed, be cancelled by the Treasurer of Bonneville County where said taxes appear on

the City Property Roll.

A majority of the Board having signed an order calling for a Special Meeting ,

Notices of said Call,were duly made and posted in conformity with the law portaigiAgrto

Special Meetings of the Board, and the Board met on this date and passed the following .

Resolution, which was set- forth in the notices heretofor mentioned:

RESOLVED that the Board of Commissioners try to secure a crossing over the U.P.

R.R., Yellowstone Branch,,northeasterly from where the present crossing is located at the

north boundary line of the City of Idaho Falls, thereby procuring a straight north and

south road;

, FURTHER, to maintain the present crossing and improve the road east of aaid cross-

ing and connect with the Sugar Factory road and Yellowstone Highway, thus maintaining a

straight east and west Poad .

No objections were offered to said resolution and it was adopted unanimously.
