Environmental Management Associates Inc. (EMA) was retained by Simbol, Inc. to undertake a preliminary assessment of available compiled agency database records for the purpose of determining if the proposed Sm Calipatria Plant II Project would be located on a site which is included on a list of hazardous materials sites compiled pursuant to California Government Code Section 65962.5. If the proposed project is determined to be located on a site included on the list of hazardous materials sites compiled pursuant to California Government Code Section 65962.5, would the project create a significant hazard to the public or the environment?

The proposed Sm Calipatria Plant II Project would be located near the community of Niland, in the north half of Section 19, Township 11 South, Range 14 East, San Bernardino Base and Meridian (SBB&M), in Imperial County, California (see Figure 1).

Agency Database Search Methodology

A search of agency listings was conducted by a third-party database research service, Environmental Data Resources, Inc. (EDR) for a large area that included the subject Property. Descriptions of the lists reviewed and the results of the regulatory agency database record search are provided in Appendix A. The following is a Site Distribution Summary of the principal agency database records searched by EDR. The databases were all searched for a distance of 2 miles as measured from the approximate geographic center of the identified Project area (coordinates: Latitude 33.2027000°; Longitude -115.5558000°). These search distances meet or exceed the search distances prescribed by ASTM Standard 1527-05 for all portions of the Project area. In addition, the record search identified four “orphan” sites in the agency database records with uncertain locations (see Appendix B). An effort was made to map the “orphan” sites relative to the Project area, and the locations of those “orphan” sites that could be reasonably determined are also summarized in the following table. The identified database occurrences, including the located “orphan” sites, are evaluated in the findings of this assessment.

Findings

The Sm Calipatria Plant II plant site is located about 3 miles west-southwest of the community of Niland, in Imperial County, California. The Property has historically been used for irrigated agriculture, and continues in this use.

The agency database record search for listings of records of hazardous substance related properties revealed 10 listed sites within two miles of the Property (see the map findings summary provided in pages 7-39 of Appendix A). The “orphan” sites, for which locations could be determined by the agency database search, were independently evaluated by EMA and determined not to be located within the 2 mile radius record search area (see the mapped location figures provided in Appendix B). An assessment of the listed sites is provided in the following table.

Site Mitigation and Brownfields Reuse Program Facility Sites with Deed Restrictions & Hazardous Waste ManagementProgram Facility Sites with Deed / Land Use Restriction. The DTSC Site Mitigation and Brownfields Reuse Program(SMBRP) list includes sites cleaned up under the program’s oversight and generally does not include currentor former hazardous waste facilities that required a hazardous waste facility permit. The list represents deedrestrictions that are active. Some sites have multiple deed restrictions. The DTSC Hazardous Waste ManagementProgram (HWMP) has developed a list of current or former hazardous waste facilities that have a recorded landuse restriction at the local county recorder’s office. The land use restrictions on this list were required bythe DTSC HWMP as a result of the presence of hazardous substances that remain on site after the facility (orpart of the facility) has been closed or cleaned up. UMTRA: Uranium Mill Tailings SitesUranium ore was mined by private companies for federal government use in national defense programs. When the millsshut down, large piles of the sand-like material (mill tailings) remain after uranium has been extracted fromthe ore. Manufactured gas sites were used in the United States from the 1800’s to 1950’sto produce a gas that could be distributed and used as fuel. These plants used whale oil, rosin, coal, or a mixtureof coal, oil, and water that also produced a significant amount of waste. Many of the byproducts of the gas production,such as coal tar (oily waste containing volatile and non-volatile chemicals), sludges, oils and other compoundsare potentially hazardous to human health and the environment. The byproduct from this process was frequentlydisposed of directly at the plant site and can remain or spread slowly, serving as a continuous source of soiland groundwater contamination.
