CHAPTER I-PRELIMINARY

1. Short t it le, extent andcommencement. - (1) This Act may becalled The Madhya Pradesh LandRevenue Code, 1959.

1 [(2) It extends to the whole of MadhyaPradesh but nothing contained in thisCode except the provisions relating toliability of land for payment of landrevenue, the assessment of land revenuewith reference to the use of land,realisation of land revenue and allprovisions ancillary thereto shall applyto such areas as may, from time to time,be constituted as reserved or protectedforest under the Indian Forest Act, 1927(XVI of 1927) :

Provided that the aforesaidprovisions of the Code shall apply withreference to the use of land in suchareas for one or more of the purposesspecified in Section 59.]

(3) This Code shall come into forceon such date as the State Governmentmay, by notification, appoint.

2.Definitions: — (1) In this Code,unless there is anything repugnant tothe subject or context,—

(e) “bonafide agriculturist” means aperson who cult ivates landpersonally or who may reasonablybe expected to cultivate personally;

(f) “co-operative society” means asociety registered as such underany law relating to Co-operativeSocieties in force for the time beingin any region of the State;

CHAPTER IIBOARD OF REVENUE

3. Constitution of Board of Revenue- (1)There shall be a Board of Revenue forMadhya Pradesh consis ting of aPresident and two or more other membersas the State Government may, from timeto time, think fit to appoint.

(2) The Board of Revenue asconstituted and functioning for theseveral regions of this State immediatelybefore the coming into force of this Code,hereinafter in this chapter referred to asthe existing Board, shall with effect fromthe date of coming into force of thisCode, be deemed to be the Board ofRevenue for Madhya Pradeshconstituted under this section.

(3) The President and members of theexisting Board shall be the first Presidentand members respectively of the Boardof Revenue for Madhya Pradesh.4. Principal seat and other places ofsittings of Board of Revenue. - (1) Theprincipal seat of the Board shall be atsuch place as the State Government may,by notified order, appoint.

(2) Except as expressly provided bythis Code, the terms and conditions ofservice of the President and members ofthe Board shall be such as may beprescribed and the terms and conditionslaid down by the State Government forthe President and members of theexisting Board shall continue in forceuntil modified or superseded under thissection.

(3) A person shall not be qualified forappointment as a member of the Boardunless he —

(a) is eligible for appointment as aJudge of the High Court; or

(b) has been a Revenue Officer, andhas held, for at least five years, anoffice not lower in rank than thatof a Collector.

6. Salaries and allowances.-There shallbe paid to the members of the Board suchsalaries and allowances as the StateGovernment may determine and thosesalaries and allowances shall be chargedon the consolidated fund of the State.

8. Powers of Superintendence of Board.-The Board shall, in respect of all matterssubject to its appellate or revisionaljurisdiction, have superinten- denceover all authorities in so far as suchauthorities deal with such matters andmay call for returns.

9. Exercise of jurisdiction by singlemembers and benches.-The Board maymake rules for the exercise of powers andfunctions of the Board by benchesconstituted of one or more membersthereof, and all decisions given by suchbenches in exercise of such powers orfunctions shall be deemed to be thedecisions of the Board.

10. Cases pending at commencement ofCode. - All appeals, applications forrevision and other proceedings pendingbefore the existing Board immediatelybefore the coming into force of this Codeshall be heard and decided by the Board.

15. Power to appoint AdditionalCommissioner . — (1) The Sta teGovernment may appoint an Additional

more divisions.

(2) A Commissioner, a Collector, a Sub-Divisional Officer, or a Tahsildar maymake over for inquiry and report any caseor class of cases arising under theprovisions of this Code or any otherenactment for the time being in force fromhis own file to any Revenue Officersubordinate to him.

31. Conferral of Status of Courts onBoard and Revenue Officers.-The Boardor a Revenue Officer, while exercisingpower under this Code or any otherenactment for the time being in force toenquire into or to decide any questionarising for determination between theState Government and any person orbetween parties to any proceedings, shallbe a Revenue Court.

32. Inherent power of Revenue Courts.-Nothing in this Code shall be deemed tolimit or otherwise affect the inherentpower of the Revenue Court to make suchorders as may be necessary for the endsof justice or to prevent the abuse of theprocess of the Court.

33.Powers of Revenue Officers torequire attendance of persons andproduction of documents and to receiveevidence.- (1) Subject to the provisionsof Sections 132 and 133 of the Code ofCivil Procedure, 1908 (V of 1908) and torules made under Section 258, everyRevenue Officer acting as a Revenue
