DISABILITYLAWSINPOSTSECONDARYEDUCATIONIndividualswithdisabilitiesareentitledbylawtoequalaccesstopostsecondaryprograms.Therearetwolawsthatprotectpersonswithdisabilitiesinpostsecondaryeducation:TheRehabilitationActof1973(Pub.L.No.93-112,asamended)andthe1990AmericanswithDisabilitiesAct(Pub.L.No.1001-336).AccordingtotheRehabilitationActof1973andtheAmericanswithDisabilitiesAct(ADA,1990),astudentwithadisabilityissomeonewhohasaphysicalormentalimpairment,hasahistoryofimpairment,orisbelievedtohaveadisabilitythatsubstantiallylimitsamajorlifeactivitysuchaslearning,speaking,seeing,hearing,breathing,walking,caringforoneself,orperformingmanualtasks.TheRehabilitationActTitleVofTheRehabilitationActof1973isgenerallyregardedasthefirstcivilrightslegislationonthenationallevelforpeoplewithdisabilities.Section504oftheRehabilitationActisaprogramaccessstatute.Itprohibitsdiscriminationonthebasisofdisabilityinanyprogramoractivityofferedbyanentityorinstitutionreceivingfederalfunds.Section504states(asamended):

NootherwisequalifiedpersonwithadisabilityintheUnitedStates…shall,solelyonthebasisofdisability,bedeniedaccessto,orthebenefitsof,orbesubjectedtodiscriminationunderanyprogramoractivityprovidedbyanyinstitutionreceivingfederalfinancialassistance.

UnderSection504,institutionswererequiredtoappointandmaintainatleastonepersontocoordinateitseffortstocomplywiththerequirementsofSection504.Individualsworkinginthisofficehavetheongoingresponsibilityofassuringthattheinstitution/agency/organizationpracticesnondiscriminationonthebasisofdisabilityandshouldbeincludedinanygrievanceproceduresdevelopedtoaddresspossibleinstancesofdiscriminationbroughtagainsttheinstitution.AtINSTITUTION,theestablishedofficeisOFFICE.TheAmericanswithDisabilityAct(ADA)TheAmericanswithDisabilitiesAct(ADA)isafederalcivilrightsstatutethatprohibitsdiscriminationagainstpeoplewithdisabilities.Therearefourmainsectionsofthelaw:employment,government,publicaccommodations,andtelecommunications.TheADAprovidesadditionalprotectionforpersonswithdisabilitiesinconjunctionwiththeRehabilitationActof1973.TheADAisdesignedtoremovebarrierswhichpreventqualifiedindividualswithdisabilitiesfromenjoyingthesameopportunitiesthatareavailabletopersonswithoutdisabilities.PostsecondaryinstitutionsarecoveredinmanywaysundertheADA.EmploymentisaddressedbyTitleI,andTitleIIaddressesaccessibilityprovidedbypublicentities.AccessibilityprovidedbyprivateentitiesisaddressedinTitleIII,andTitleIVaddressestelecommunications.MiscellaneousitemsareincludedinTitleV.AmendmentstotheADA,whichtookeffectJanuary1,2009,clarifywhoiscoveredbythelaw’sprotection.TheADAAArevisesthedefinitionof“disability”tomorebroadlyincludeimpairmentsthatsubstantiallylimitamajorlifeactivity.Theamendmentalsostatesthatmitigatingmeasures,including

assistivedevices,auxiliaryaids,accommodations,medicaltherapies,andsupplieshavenobearingindeterminingwhetheradisabilityqualifiesunderthelaw.TheADAinRelationtoSection504oftheRehabilitationActInstitutionsthatreceivefederalfunds(suchasINSTITUTION)arecoveredunderSection504.TheADAdoesnotsupplantSection504buttheADAstandardsapplyinthosesituationswheretheADAprovidesgreaterprotection.Therefore,postsecondaryinstitutionsmustadheretoboththeRehabilitationActandtheAmericanswithDisabilitiesAct.DocumentationofDisabilityINSTITUTIONrequeststhatstudentsnotifyOFFICEofanyspecialaccommodationneeds.Thisnotificationwillhelpensurethequalityandavailabilityofservicesneeded.StudentsareresponsibleforsupplyingtheappropriatedocumentationtoOFFICEpriortoarrangementsforspecialaccommodations.Aletter,writtenreport,ormedicalrecordfromaprofessional(suchasaphysicianoranaudiologist)statingthestudent’sdisabilityandrecommendedaccommodationsisacceptable.Thisinformationisconfidential.AllaccommodationsarediscussedwithOFFICEdisabilityspecialistandthestudent.Priortothestartoftheterm,facultymembersarenotifiedthataccessserviceswillbeprovidedinaspecificclasstoastudentwithadisability.

OVERVIEWOFNOTETAKINGSERVICESNotetakingservicesprovideequalaccessandcancontributetothesuccessofdeafstudentsorstudentswhohaveotherdisabilities.Watchinganinterpreterorspeechreadinganinstructordoesnotallowthestudenttimetotakenotes.Byusinganotetaker,deafstudentscandevotetheirfullattentiontothelecture,classdiscussionsordemonstrations,orotherlearningactivities.Someinstructorsmaychoosetooffercompletenotestoallstudentsintheirclasses,thusfollowingaUniversalDesignapproach.Thesemaybeinstructornotes(orthosepreparedbyateachingassistant)thatarepostedonline.Onestrategyforreducingtheneedfornotetakingasanaccommodationforstudentswithdisabilitiesisforinstructorstoposttheirownnotesonanaccessiblecoursewebsite.Increasingnumbersofinstructorsrecognizethatmakingcompletenotesforeachclassavailableon-lineisavaluableteachingtoolforavarietyofstudents.Instructorscan:

• Posttheirowncompletenotes;• Postthecompletenotesofacourseteachingassistant;or• Assignstudentstoteamsandrotateresponsibilityforeachteamtocreateacompletesetof

notesforpostingeachweek.Thisapproachhastheaddedbenefitofhavingstudentsworkinteamsandshareresponsibilityforeachother’slearning.

Ifaninstructorchoosesnottopostopennotesforallstudents,notetakingservicescanbeprovided.OVERVIEWOFROLESANDRESPONSIBILITIESNoteTakerCoordinatorTheNoteTakerCoordinatorisastaffmemberintheOFFICE.Thisstaffmemberservesasthecontactpersonforthenotetakers,students,faculty,andadministrators.ThemaindutiesofthenotetakerCoordinatorinclude:

• Recruiting,hiring,andtrainingstudentnotetakers;• SchedulingtoteTakersinclasseswheretheyareneeded;• Managingtheday-to-dayoperationsandtrouble-shooting,whennecessary;and• Evaluatingthequalityofnotesprovidedtostudents.

OFFICEResponsibilities

1. Determineeligibilityfornotetakingservices.2. Providestudentwithclassannouncementforinstructor,notetakingagreementfornotetaker,

andcarbonlessnotetakingpaperoraccesstoacopymachine.3. Orientstudenttonotetakingprocessandnotetakingoptions.4. Troubleshootproblemswithnotetakingreportedbystudentsorinstructor.5. Conductoutreachtoinstructorswhohavealargeenrollmentofstudentswhohavenotetaking

approvedasanaccommodation.6. Assistinstructorsinlocatingavolunteerclassmatetotakenotesoridentifyingoptionsfor

makingnotesavailableviaotherchannels,forexample:a. Postnotesoncoursewebsites,b. Sharecopiesofinstructor’sorteachingassistant’snotes.c. Identifyonenotetakerforallstudentswhorequirethataccommodationandcopying

notesatdepartmentoffice.7. Forvolunteernotetakerprograms,preparelettersofvolunteerserviceforstudentvolunteer

NoteTakersbytheendofeachsemester.8. Hiringapaidnotetaker,ifappropriate.

NoteTakerNotetakersmaybevolunteerswhoarealreadyenrolledinthesameclassasthedeafstudent.Insomesituations,OFFICEmaydeterminethatitwouldeffectivetoprovideanotetakerwhoisnotamemberoftheclass.Ingeneral,thenotetaker’sdutiesinclude:

• Attendingalltheclassesforwhichs/heisassigned;• Producingclear,thorough,andlegiblenotesbythespecifieddeadline;and• Sharingthenoteswiththestudentand/orOFFICEaccordingtoguidelines.

Additionalinformationaboutthenotetakingprocessandexpectationsisdescribedinothersectionsofthishandbook.NoteTakerResponsibilities

1. Attendclassonaregularbasisandtakecomprehensive,legiblenotes.Notetakersshouldconveytheinformationaccurately,givingthecontentandthespiritofthespeaker,tothebestoftheirability.

2. Arrangeasystemofexchangingnoteswiththestudentwithadisability:a. Usecarbonlesscopypaper(providedbythestudent)andexchangenotesafterclass;b. Emailnotestothestudent;c. MakecopiesatDisabilityResourceCenter;ord. Suggestanothersystemtothestudenttoseeifitworksforbothofyou.

3. Exchangenoteswithstudentonaregularbasis.Getfeedbackonthenotesfromtheinstructorandthestudent,ifpossible.

4. TurnintheVolunteerNoteTakerServicesAgreementtoOFFICEatthestartofthesemester.Doingthiswillensurethatyoureceivealetteracknowledgingyourvolunteerservicecontributions.

4. Makeanefforttoarrangefornotestobeavailabletothestudentwhenyouareunabletoattendclass.Findingsomeoneintheclassmaybehelpfulsinceheorshewillbefamiliarwiththesubjectmatterandavailablewithoutnotice.Discussarrangementsforsubstitutenoteswiththestudentforwhomyou'retakingnotes.

5. Notetakersshouldnottakenotesintheabsenceofstudents,unlesstheyareaskedtodosobyOFFICE.

6. Notetakingisaconfidentialservice.Youmayormaynotknowwhowillbereceivingthenotes.Ifyouareawareofthestudentforwhomyouareprovidingnotes,donotdisclosetoanyonethenameofthestudentoranyinformationaboutthatstudent.

7. Ifyouknowwhothestudentsarewhoarereceivingthenotes,talkwiththemaboutthenotes,yourrole,oranyquestionsyoumighthave.ConcernsthatcannotbeaddressedbythestudentshouldbebroughttotheattentionofOFFICE.

8. FollowethicalguidelinesasestablishedbyINSTITUTION.Notetakersonlytakenotes.Theyarenotexpectedtoactastutors,explaincourseinformation,sharepersonalopinions,oradvisestudents.

StudentStudentsareresponsibleforrequestingnotetakingservicesinatimelymannerforclassesorotheractivities.Ingeneral,studentsareexpectedtoattendalloftheirclassesandarriveontime.Ifit’snecessarytomissaclasssession,studentsareadvisedtonotifytheOFFICEassoonaspossible.Fornotetakerrequestsoutsideoftheregularlyscheduledclasstimes,studentsshouldcompletetheNoteTakerRequestFormatleastoneweekbeforetheevent(orassoonastheyareawareoftheneed).Wheneverpossible,studentsshouldtaketheirownnotestosupplementthenotesprovidedbythenotetaker.StudentResponsibilities

1. RequestnotetakingasareasonableaccommodationduringmeetingwithOFFICE.2. Independentlylocateaclassmatewhoiswillingtoserveasavolunteernotetaker,orbringa

classannouncementtotheinstructorandrequestthatheorshereaditatthebeginningofthefirsttwoclassperiods.

3. Meetwiththeclassmatewhovolunteerstoserveasanotetakertodiscussarrangementstosharenotesonaregularbasis:

a. Receivenotesoncarbonlesscopypaperatendofclass;b. Receivenotesviae-mailfromthenotetaker;orc. MakeacopyofthenotesatOFFICEoranotherlocationoncampus.Gowithnotetaker

orpickupnotesbeforenextclass.4. GivenotetakertheVolunteerNoteTakerServicesAgreementform.5. Iftherearenostudentvolunteers,contactOFFICEanddiscussoptionswithinstructor.6. Providefeedbackaboutthequalityandconsistencyofthenotestothenotetaker.Consultwith

theinstructorforadditionalfeedbackifthereisaproblemwiththenotes.Ifaresolutionisnotfound,discussoptionsforrecruitinganewstudentvolunteernotetakerwithOFFICE.

7. Attendclassonregularbasis.Notesarenotasubstituteforattendingclass.

ReportanydifficultiestoOFFICE.FacultyFacultymembersmaybeaskedtoassistinrecruitingnotetakersforaparticularclassorrecommendstudentswhomightbeeffectivenotetakers.Throughouttheterm,facultymaybeaskedforassistanceinreviewingnotestoensurethattheyareofhighqualityandaccuratelyreflectthelecturecontent.Ifthenotetakerisnotamemberoftheclass,handoutsandothermaterialsshouldbesharedwiththenotetaker.FacultyResponsibilities

EqualAccessAlldeafstudentshavetherighttoequalaccessofinformationthatispresentedtothem.Equalaccessalsoincludesthestudent’srighttonotpayattentioninclass,forgetassignments,forgettestdates,failcourses,andmissclasses.Deafstudentsshouldnothaveanyadvantagesgiventothemthathearingstudentsintheclassroomdonothave.

APPENDIXJNoteTaker’sCodeofEthicsandGuidelines

1. Notetakersshallkeepallassignment-relatedinformationstrictlyconfidential.Notetakersshallusediscretionwhendiscussingaclassorstudentsinthatclass.Seeminglyunimportantinformation,innocentlydivulged,mayprovedamagingincertainsituations.Ifproblemsshouldariseamonganyofthepersonsinvolved,Notetakersshallreferthesepersonstothenotetakers’immediatesupervisor.

2. Notetakersshalltranscribelecturesasfaithfullyandcompletelyaspossible.Notetakersmustlearntostore

informationastheylisteninordertorecordallofthemajorpointsofthelecture.CorrectEnglishisrequiredatalltimes.Diagrams,examples,studentquestionsandanswers,andstudentcommentsshallbeincludedinthenotestoprovideacompletepictureofclassroomactivities.Itisbettertoprovideinformationstudentsdonotneedthantotakethechancethattheywillmisssomethingimportant.Whenindoubt,notetakersshouldwrite.Mostinstructorsprovideclueseitherdirectlyorindirectlyaboutwhatwillappearontests.Anythingwhichisstressedintheclassroomshouldbestressedinnotes.Teachercommentsabouttheimportantitemsshouldberecorded.

3. Notetakersshallnotadvise,interjectpersonalopinion,orcounselthestudent.Justasnotetakersmaynot

omitimportantinformation,theymaynotaddpersonalopinionstorecordednotes.Notetakersshouldrememberthattheyarenotresponsibleforwhatissaidandshouldnotpermittheirownfeelingstointerferewithoraddtothelecture.Paidnotetakersarenottoparticipateinclassotherthantoaskquestionsforclarificationorspelling.Notetakersandstudentsfrequentlybecomefriends,butthatpersonalrelationshipmustnotbeallowedtointerferewiththeserviceforwhichthenotetakerispaid.

4. Notetakersshallnotcounseloradvice.Thenotetaker’sprimaryresponsibilityistorecordthelecture.Ifa

professorseeksadviceonhowtointeractwithastudent,thenotetakermustreferhimorhertoacounselorortothenotetaker’ssupervisor.Likewise,thenotetakermustreferstudentsseekingcounselingtotheircounselors.

5. Notetakersshallchooseassignmentsappropriatetotheirexperienceorskillinthesubjectarea.Familiarity

withasubjectpromotesbetternotetaking.Someclassesaremoredifficultthanothers;eitherbecauseofthenatureoftheclassitselforbecauseoftheinstructor’steachingstyle.Ifthenotetakerfindsaparticularassignmentbeyondhisorhercapabilities,thesupervisormustbeinformed.

6. Notetakersshallcomportthemselvesinamannerappropriatetothesituation.Notetakersshallconduct

themselvesinawaythatbringsrespecttothemselves,thestudents,andtheirdepartment.Theterm“appropriatemanner”refersto:

a. Appropriatedress;b. Professionalconduct;c. Wearingofanamebadgetodenotethenotetaker’sroleintheclassroom.
