The pace of these negotiations is not as quick as it was in past years. However, we are working just as diligently to come to an agreement that is fair for our members. The Affordable Care Act is very complex and unfortunately at this juncture poses more questions than answers. Just as important is the fact that we must also address pension funding and negotiate wage increases.
In the meantime, please remember that your current contract and its pro-tections and provisions remain in place and all wage increases negotiated in the new contract will be retroactive to October 19, 2013.
Two things must be stressed during these negotiations:
We must be patient. There are many complex issues involved in the current negotiations mainly related to the Affordable Care Act. Local 1262 is working with the employers and health fund professionals to ensure that we implement all the legal requirements of this Act, while at the same time making sure all of our members – both full- and part-time – have the best cover-age available.
We must avoid the rumor mill. Don’t believe anything you hear regarding negotiations unless it is issued directly from Local 1262. I urge you to regularly check our web site or our hotline for the most current and accurate information on the status of our negotiations. From time to time we will also issue updates that will be posted in your stores or mailed to your home, especially as we draw closer to concluding negotiations.
We must stick together, be patient and stay focused
on the end-goal: comprehensive health care coverage, a secure pension and good wages.
As we move forward, Local 1262 will continue to keep our Stop & Shop of New Jersey and ShopRite members apprised of our progress. With that in mind, it is more important than ever for you to check our Information Hotline (1-888-GET-1262) or our website (www.ufcw1262.org) on a regular basis, as they provide us with the quickest way to disseminate news to our members. We also urge you to stay in touch with your Shop Stewards and the Report Committee members for your store (see page 6).
As 2013 draws to a close, I want to take the opportunity to thank ALL of our members for your support and solidarity this past year.
Whether you work in ShopRite, Stop & Shop, Pathmark, Foodtown, Fairway Market, The Fresh Grocer, Morton & Williams, Milford Farms or are part of the
Hudson City Foodservice Workers, you all have at least on very important thing in common: solid contracts that pro-vide you with job protections that non-union workers do not have as a safety net.
One of the greatest privileges I have had is to be a member of Local 1262 since my teens, and I consider it an even greater privilege and honor to represent you as your President these many years.

n egotiations with Stop & Shop of New Jersey and ShopRite officially began on Friday, October 11, 2013. The main topic of discussion as of this writ-
ing (December 6, 2013) has been implementation of the Affordable Care Act and the impact it will have on our con-tracts which cover nearly 24,000 members.

Because these workers do not belong to a union – and therefore do not have collective bargaining agree-ments (commonly referred to as contracts) – they are at the mercy of their employer not only in terms of what the employer will pay them or what benefits they choose to provide (if any at all) but they also lack many of the job protections that we, as union members, often take for granted.
Unlike Local 1262 and other union members, these workers have no rights when it comes to seniority, job security, workplace grievances and a host of other things that are clearly and legally outlined – and fiercely negotiated and defended – in your collective bargaining agreement with your employer.
For example, your contract provides guidelines that your employers must fol-low in terms of seniority. Seniority, as you know, comes into play when schedul-ing workers, for vacation, for those who want to apply for new positions on the bid sheets, etc. But seniority provisions in your contracts also play an important role in your job security, especially during store closings and/or reductions in the workforce.
The seniority provisions in your contract are what helped our long-term members at Pathmark maintain their jobs as the company closed stores. Although these members had to move to another location, they did so with their seniority and other job protections intact. Similarly, these provisions did the same for Foodtown members employed in the stores that closed this past year due to Sandy.
Without your contract and these provisions, these people – your Local 1262 brothers and sisters -- would have been at the whim of their employers who would be free to simply layoff anyone they wanted – regard-less of length of employment, experience, etc.
Another job protection found in your contracts is the grievance process which outlines in no uncer-tain terms the steps your employer must follow when
disciplining you – or dismissing you – for on-the-job actions.
On a daily basis, Local 1262’s Union Representatives work with our members and represent them in discus-sions with their employers. Many times, intervention by your Union Representative can solve the issue at hand
without a formal grievance being filed. However, if the issue cannot be resolved at that juncture, a formal grievance is filed and the issue investigated and negotiated by your Union Rep until a fair outcome is obtained. Taking that one step further, if the grievance cannot be worked out to the everyone’s satisfaction, you as a member have the right to appeal to our Grievance Review Committee (GRC) where your case is heard and you can ask them to intervene on your behalf. Finally, even if the GRC reviews the case and feels it has no merit and that the employer was within their rights, the member can appeal that deci-sion to our Executive Board.
As of this writing (December 6, 2013) we are involved in Contract Negotiations on behalf of some 24,000 members employed by ShopRite or in New Jersey Stop & Shop stores. During negotiations we often talk about the “core” issues to be addressed regarding contracts: comprehensive affordable health care coverage, pension security and good living wages.
There is no doubt that these issues are extremely important (as President Whille points out in his mes-sage), however I want to remind our members that our contracts do a lot more.
Why not take a few minutes to review your contract and familiarize yourself with its many protections. A few other helpful reminders:
If you are having on-the-job issues – whether it be scheduling, wages, etc. – speak to you Union Representative as soon as possible. They can be reached at 1-800-562-6913 (if calling from New Jersey)

I would like to take this opportunity to thank the members of our Contract Negotiation Committee and our Report Committee.
The Negotiation Committee is comprised of some 60 rank-and-file Local 1262 members employed by Stop & Shop of New Jersey or ShopRite.
The Negotiation Committee, along with Local 1262’s officers, meets regularly with the employ-ers during negotiations to ensure that the issues being discussed are in keeping with those reflect-ed by the membership at the Contract Proposal Meetings. This is a select group of individuals who are typically long-time members who serve as Shop Stewards or have served on other Local 1262 committees.
The Contract Report Committee is comprised of nearly 900 of our most dedicated and out-
standing members who work for Stop & Shop of New Jersey or ShopRite. These members play one of the most important roles in the Negotiation Process by serving as the voice of the Union in the store and ensuring that all of our brothers and sisters receive accurate information regard-ing negotiations.
Please take a minute to familiarize yourself with our Negotiation Committee members and to review the names of your co-workers who have volunteered to serve on the Report Committee in your store. Signs have also been placed in your store listing that store’s Report Committee members.

n Check your store’s break room or bulletin boards for Contract Negotiation Updates issued by the Local as the process unfolds.

“Our Shop Stewards are the heart and soul of this union,” said President Harvey Whille in addressing the group gathered at the Woodbridge Hilton. “They are the people who really put their all into their work on behalf of this Local. They are the go-to people our members know they can rely on no matter what.”
As part of the day’s activities the Shop Stewards attended an educational pro-gram in the morning which was opened by Msgr. John Gilchrist, better known as “Labor’s Priest” and a life-long honorary member of the UFCW.
Presentations were also provided by President Whille, Secretary-Treasurer Matthew Molinaro and Field Director
John Colella. International Secretary-Treasurer Marc Perrone made the trip from Washington, DC, to provide an overview of the political landscape includ-ing an update on the Affordable Care Act. Dave Guadioso, Esq., an attorney who represents Local 1262 and its mem-bers in many arbitration hearings, pro-vided a study of recent cases and Local 1262’s Membership Assistance Program Coordinator Nancy Miller provided an update on the MAP program and the ser-vices it provides Local 1262’s members.

“Local 1262 has always been a supporter of edu-
cation, no matter what form that may take,” said
President Whille. “I’m pleased that we have been
able to continue this tradition which, to date, has
provided more than $800,000 to more than 3,000
students since we began this program.”

is now in his junior year at Stevens Institute of
Technology where he is pursuing a bachelors
degree in Computer Engineering and a Computer
Science Masters Degree.

employer regarding an on-the-job issue or conflict, it is important that you remember that you have the right – not only under our contract but also under the Weingarten Act – to have your shop steward, another union member or your union representative present at that meeting. If any of those people cannot be present, you have the right to ask that the meeting be stopped and resumed only when you have representation.
ALL unions face many challenges today. We are being attacked from all angles – from those government leaders who are anti-union to greedy corporations who don’t value the role their workers play in their success.
It is time that we – as union members – stand up for our fellow working class members like those employed at Walmart, McDonalds, etc. and support them.
In the “old days” they used to say the fastest way to share information was “telegraph, telephone, tell a neigh-bor.” Today that would translate to “text, tweet, blog.”
No matter which of these formats you use, the “tell a neighbor” part is still the vital link.
So I urge you to tell your family, friends and neighbors about the benefits of belonging to a union and how your union – by negotiating contracts on your behalf and stand-ing up for your rights – helps you earn a decent living, respect and fairness.
I am convinced that if every union member in this coun-try spoke out about being “Union Proud” then the big guys – the corporations, anti-union politicians – would eventually have to stand up and take notice.
