AN ACT making appropriations of public money out of theTreasury in accordance with section fifty-one, article VI of theConstitution.

Be it enacted by the Legislature of West Virginia:

TITLE I — GENERAL PROVISIONS.

Section 1. General policy. — The purpose of this bill is1to appropriate money necessary for the economical and2efficient discharge of the duties and responsibilities of the3state and its agencies during the fiscal year two thousand ten.4

Sec. 2. Definitions. — For the purpose of this bill:1“Governor" shall mean the Governor of the State of West2Virginia.3

"Code" shall mean the Code of West Virginia, one4thousand nine hundred thirty-one, as amended.5

"Spending unit" shall mean the department, bureau,6division, office, board, commission, agency or institution to7which an appropriation is made.8

The "fiscal year two thousand ten" shall mean the period9from July 1, 2009, through June 30, 2010.10

"General revenue fund" shall mean the general operating11fund of the state and includes all moneys received or12collected by the state except as provided in section two,13article two, chapter twelve of the code or as otherwise14provided.15

"Special revenue funds" shall mean specific revenue16sources which by legislative enactments are not required to17be accounted for as general revenue, including federal funds.18

"From collections" shall mean that part of the total19appropriation which must be collected by the spending unit20to be available for expenditure. If the authorized amount of21collections is not collected, the total appropriation for the22spending unit shall be reduced automatically by the amount23of the deficiency in the collections. If the amount collected24exceeds the amount designated "from collections,” the excess25shall be set aside in a special surplus fund and may be26expended for the purpose of the spending unit as provided by27article two, chapter eleven-b of the code.28

Sec. 3. Classification of appropriations. — An1appropriation for:2

"Personal services" shall mean salaries, wages and other3compensation paid to full-time, part-time and temporary4

employees of the spending unit but shall not include fees or5contractual payments paid to consultants or to independent6contractors engaged by the spending unit.7

Unless otherwise specified, appropriations for "personal8services" shall include salaries of heads of spending units.9

"Annual increment" shall mean funds appropriated for10"eligible employees" and shall be disbursed only in11accordance with article five, chapter five of the code.12

Funds appropriated for "annual increment" shall be13transferred to "personal services" or other designated items14only as required.15

"Employee benefits" shall mean social security matching,16workers' compensation, unemployment compensation,17pension and retirement contributions, public employees18insurance matching, personnel fees or any other benefit19normally paid by the employer as a direct cost of20employment. Should the appropriation be insufficient to21cover such costs, the remainder of such cost shall be22transferred by each spending unit from its "personal services"23line item or its "unclassified" line item or other appropriate24line item to its "employee benefits" line item. If there is no25appropriation for "employee benefits," such costs shall be26paid by each spending unit from its "personal services" line27item, its "unclassified" line item or other appropriate line28item. Each spending unit is hereby authorized and required to29make such payments in accordance with the provisions of30article two, chapter eleven-b of the code.31

Each spending unit shall be responsible for all32contributions, payments or other costs related to coverage33and claims of its employees for unemployment34compensation. Such expenditures shall be considered an35employee benefit.36


"BRIM Premiums" shall mean the amount charged as37consideration for insurance protection and includes the38present value of projected losses and administrative expenses.39Premiums are assessed for coverages, as defined in the40applicable policies, for claims arising from, inter alia, general41liability, wrongful acts, property, professional liability and42automobile exposures.43

Should the appropriation for "BRIM Premiums" be44insufficient to cover such cost, the remainder of such costs45shall be transferred by each spending unit from its "personal46services" line item, its "employee benefit" line item, its47"unclassified" line item or any other appropriate line item to48"BRIM Premiums" for payment to the Board of Risk and49Insurance Management. Each spending unit is hereby50authorized and required to make such payments.51

"Current expenses" shall mean operating costs other than52personal services and shall not include equipment, repairs53and alterations, buildings or lands.54

Each spending unit shall be responsible for and charged55monthly for all postage meter service and shall reimburse the56appropriate revolving fund monthly for all such amounts.57Such expenditures shall be considered a current expense.58

"Equipment" shall mean equipment items which have an59appreciable and calculable period of usefulness in excess of60one year.61

"Repairs and alterations" shall mean routine maintenance62and repairs to structures and minor improvements to property63which do not increase the capital assets.64

"Buildings" shall include new construction and major65alteration of existing structures and the improvement of lands66


and shall include shelter, support, storage, protection or the67improvement of a natural condition.68

"Lands" shall mean the purchase of real property or69interest in real property.70

"Capital outlay" shall mean and include buildings, lands71or buildings and lands, with such category or item of72appropriation to remain in effect as provided by section73twelve, article three, chapter twelve of the code.74

From appropriations made to the spending units of state75government, upon approval of the governor there may be76transferred to a special account an amount sufficient to match77federal funds under any federal act.78

Appropriations classified in any of the above categories79shall be expended only for the purposes as defined above and80only for the spending units herein designated: Provided, That81the secretary of each department shall have the authority to82transfer within the department those general revenue funds83appropriated to the various agencies of the department:84Provided, however, That no more than five percent of the85general revenue funds appropriated to any one agency or86board may be transferred to other agencies or boards within87the department: and no funds may be transferred to a88“personal services” line unless the source funds are also89wholly from a “personal services” line, or unless the source90funds are from another activity that has exclusively funded91employment expenses (any of object codes 001 through 016,92160 and 163) for at least twelve consecutive months prior to93the time of transfer and the position(s) supported by the94transferred funds are also permanently transferred to the95receiving agency or board within the department: Provided96further, That the secretary of each department and the97director, commissioner, executive secretary, superintendent,98


chairman or any other agency head not governed by a99departmental secretary as established by chapter five-f of the100code shall have the authority to transfer funds appropriated to101"personal services" and "employee benefits" to other lines102within the same account and no funds from other lines shall be103transferred to the "personal services" line: And provided104further, That the secretary of each department and the director,105commissioner, executive secretary, superintendent, chairman106or any other agency head not governed by a departmental107secretary as established by chapter five-f of the code shall108have the authority to transfer general revenue funds109appropriated to “annual increment” to other general revenue110accounts within the same department, bureau or commission111for the purpose of providing an annual increment in112accordance with article five, chapter five of the code: And113provided further, That no authority exists hereunder to transfer114funds into line-items to which no funds are legislatively115appropriated: And provided further, That if the Legislature by116subsequent enactment consolidates agencies, boards or117functions, the secretary or other appropriate agency head may118transfer the funds formerly appropriated to such agency, board119or function in order to implement such consolidation. No120funds may be transferred from a Special Revenue Account,121dedicated account, capital expenditure account or any other122account or fund specifically exempted by the Legislature from123transfer, except that the use of the appropriations from the124State Road Fund for the office of the Secretary of the125Department of Transportation is not a use other than the126purpose for which such funds were dedicated and is permitted.127

Appropriations otherwise classified shall be expended128only where the distribution of expenditures for different129purposes cannot well be determined in advance or it is130necessary or desirable to permit the spending unit the131freedom to spend an appropriation for more than one of the132above classifications.


Sec. 4. Method of expenditure. — Money appropriated1by this bill, unless otherwise specifically directed, shall be2appropriated and expended according to the provisions of3article three, chapter twelve of the code or according to any4law detailing a procedure specifically limiting that article.5

Sec. 5. Maximum expenditures. — No authority or1requirement of law shall be interpreted as requiring or2permitting an expenditure in excess of the appropriations set3out in this bill.4

The appropriations for the senate for the fiscal year 200914are to remain in full force and effect and are hereby15reappropriated to June 30, 2010. Any balances so16reappropriated may be transferred and credited to the fiscal17year 2010 accounts.18

Upon the written request of the Clerk of the Senate, the19auditor shall transfer amounts between items of the total20appropriation in order to protect or increase the efficiency of21the service.22

The Clerk of the Senate, with the approval of the23president, is authorized to draw his or her requisitions upon24the auditor, payable out of the Current Expenses and25Contingent Fund of the senate, for any bills for supplies and26services that may have been incurred by the senate and not27


included in the appropriation bill, for supplies and services28incurred in preparation for the opening, the conduct of the29business and after adjournment of any regular or30extraordinary session, and for the necessary operation of the31senate offices, the requisitions for which are to be32accompanied by bills to be filed with the auditor.33

The Clerk of the Senate, with the written approval of the34president, or the President of the Senate shall have authority35to employ such staff personnel during any session of the36Legislature as shall be needed in addition to staff personnel37authorized by the senate resolution adopted during any such38session. The Clerk of the Senate, with the written approval of39the president, or the President of the Senate shall have40authority to employ such staff personnel between sessions of41the Legislature as shall be needed, the compensation of all42staff personnel during and between sessions of the43Legislature, notwithstanding any such senate resolution, to be44fixed by the President of the Senate. The clerk is hereby45authorized to draw his or her requisitions upon the auditor for46the payment of all such staff personnel for such services,47payable out of the appropriation for Compensation and Per48Diem of Officers and Employees or Current Expenses and49Contingent Fund of the senate.50

For duties imposed by law and by the senate, the Clerk of51the Senate shall be paid a monthly salary as provided by the52senate resolution, unless increased between sessions under53the authority of the president, payable out of the54appropriation for Compensation and Per Diem of Officers55and Employees or Current Expenses and Contingent Fund of56the senate.57

The distribution of the blue book shall be by the office of58the Clerk of the Senate and shall include seventy-five copies59for each member of the Legislature and two copies for each60


classified and approved high school and junior high or61middle school and one copy for each elementary school62within the state.63

The appropriations for the house of delegates for the fiscal9year 2009 are to remain in full force and effect and are10hereby reappropriated to June 30, 2010. Any balances so11reappropriated may be transferred and credited to the fiscal12year 2010 accounts.13

Upon the written request of the Clerk of the House of14Delegates, the auditor shall transfer amounts between items15of the total appropriation in order to protect or increase the16efficiency of the service.17

The Clerk of the House of Delegates, with the approval of18the speaker, is authorized to draw his or her requisitions upon19


the auditor, payable out of the Current Expenses and20Contingent Fund of the house of delegates, for any bills for21supplies and services that may have been incurred by the22house of delegates and not included in the appropriation bill,23for bills for services and supplies incurred in preparation for24the opening of the session and after adjournment, and for the25necessary operation of the house of delegates' offices, the26requisitions for which are to be accompanied by bills to be27filed with the auditor.28

The Speaker of the House of Delegates, upon approval of29the house committee on rules, shall have authority to employ30such staff personnel during and between sessions of the31Legislature as shall be needed, in addition to personnel32designated in the house resolution, and the compensation of33all personnel shall be as fixed in such house resolution for the34session, or fixed by the speaker, with the approval of the35house committee on rules, during and between sessions of the36Legislature, notwithstanding such house resolution. The37Clerk of the House of Delegates is hereby authorized to draw38requisitions upon the auditor for such services, payable out of39the appropriation for the Compensation and Per Diem of40Officers and Employees or Current Expenses and Contingent41Fund of the house of delegates.42

For duties imposed by law and by the house of delegates,43including salary allowed by law as keeper of the rolls, the44Clerk of the House of Delegates shall be paid a monthly45salary as provided in the house resolution, unless increased46between sessions under the authority of the speaker, with the47approval of the house committee on rules, and payable out of48the appropriation for Compensation and Per Diem of Officers49and Employees or Current Expenses and Contingent Fund of50the house of delegates.51

The appropriations to the supreme court of appeals for the11fiscal years 2008 and 2009 are to remain in full force and12effect and are hereby reappropriated to June 30, 2010. Any13balances so reappropriated may be transferred and credited to14the fiscal year 2010 accounts.15

This appropriation shall be administered by the16Administrative Director of the Supreme Court of Appeals,17who shall draw requisitions for warrants in payment in the18form of payrolls, making deductions therefrom as required by19law for taxes and other items.20

Notwithstanding the provisions of Title I, section three of56this bill, the secretary of the department of health and human57resources shall have the authority to transfer funds within the58above account: Provided, That no more than five percent of59the funds appropriated to one line item may be transferred to60other line items: Provided, however, That no funds from61other line items shall be transferred to the personal services62line item.63

From the above appropriation for Child Support64Enforcement (fund 0403, activity 705) an amount not to65exceed $300,000 may be transferred to a local banking66depository to be utilized to offset funds determined to be67uncollectible.68

From the above appropriation for the Grants for Licensed69Domestic Violence Programs and Statewide Prevention70(activity 750), $500,000 shall be divided equally and71distributed among the fourteen (14) licensed programs and72the West Virginia Coalition Against Domestic Violence73(WVCADV).74

Any unexpended balance remaining in the appropriation75for Grants for Licensed Domestic Violence Programs and76Statewide Prevention (activity 750), shall be distributed77according to the formula established by the Family Protection78Services Board.79

The secretary shall have authority to expend funds for the80educational costs of those children residing in out-of-state81placements, excluding the costs of special education82programs.83

The above appropriation for Children’s Trust Fund -84Transfer (activity 951) shall be transferred to the Children’s85Fund (fund 5469, org 0511).86

The above appropriations are to be expended in16accordance with the provisions of chapters seventeen and17seventeen-c of the code.18

The commissioner of highways shall have the authority to19operate revolving funds within the state road fund for the20operation and purchase of various types of equipment used21directly and indirectly in the construction and maintenance of22roads and for the purchase of inventories and materials and23supplies.24

There is hereby appropriated within the above items25sufficient money for the payment of claims, accrued or26arising during this budgetary period, to be paid in accordance27with sections seventeen and eighteen, article two, chapter28fourteen of the code.29

It is the intent of the Legislature to capture and match all30federal funds available for expenditure on the Appalachian31highway system at the earliest possible time. The total amount of this appropriation shall be paid from16the hospital services revenue account special fund created by17section thirteen, article one, chapter sixteen of the code, and18shall be used for operating expenses and for improvements in19connection with existing facilities and bond payments.20


The secretary of the department of health and human21resources is authorized to utilize up to ten percent of the22funds from the appropriation for Institutional Facilities23Operations line to facilitate cost effective and cost saving24services at the community level.25

Necessary funds from the above appropriation may be26used for medical facilities operations, either in connection27with this account or in connection with the line item28designated Institutional Facilities Operations in the29consolidated medical service fund (fund 0525, fiscal year302010, organization 0506).31

After first satisfying the requirements for Fund 2252, Fund73963, and Fund 4908 pursuant to section eighteen, article8twenty-two, chapter twenty-nine of the code, the director of9the lottery shall make available from the remaining net10profits of the lottery any amounts needed to pay debt service11for which an appropriation is made for Fund 9065, Fund124297, and Fund 3514 and is authorized to transfer any such13amounts to Fund 9065, Fund 4297, and Fund 3514 for that14purpose. Upon receipt of reimbursement of amounts so15transferred, the director of the lottery shall deposit the16reimbursement amounts to the following accounts as required17by this section.18

Sec. 8. Awards for claims against the state. – There are1hereby appropriated for fiscal year 2010, from the fund as2designated, in the amounts as specified, general revenue3funds in the amount of $80,942, special revenue funds in the4amount of $305,999 and state road funds in the amount of5$508,746 for payment of claims against the state.6

Sec. 9. Special revenue appropriations. - There are1hereby appropriated for expenditure during the fiscal year2two thousand ten appropriations made by general law from3special revenues which are not paid into the state fund as4general revenue under the provisions of section two, article5


two, chapter twelve of the code: Provided, That none of the6money so appropriated by this section shall be available for7expenditure except in compliance with and in conformity to8the provisions of articles two and three, chapter twelve and9article two, chapter eleven-b of the code, unless the spending10unit has filed with the director of the budget and the11legislative auditor prior to the beginning of each fiscal year:12

(a) An estimate of the amount and sources of all revenues13accruing to such fund;14

(b) A detailed expenditure schedule showing for what15purposes the fund is to be expended.16

Sec. 10. State improvement fund appropriations. -1Bequests or donations of nonpublic funds, received by the2governor on behalf of the state during the fiscal year two3thousand ten, for the purpose of making studies and4recommendations relative to improvements of the5administration and management of spending units in the6executive branch of state government, shall be deposited in7the state treasury in a separate account therein designated8state improvement fund.9

There are hereby appropriated all moneys so deposited10during the fiscal year two thousand ten to be expended as11authorized by the governor, for such studies and12recommendations which may encompass any problems of13organization, procedures, systems, functions, powers or14duties of a state spending unit in the executive branch, or the15betterment of the economic, social, educational, health and16general welfare of the state or its citizens.17

Sec. 11. Specific funds and collection accounts. - A1fund or collection account which by law is dedicated to a2specific use is hereby appropriated in sufficient amount to3


meet all lawful demands upon the fund or collection account4and shall be expended according to the provisions of article5three, chapter twelve of the code.6

Sec. 12. Appropriations for refunding erroneous1payment. - Money that has been erroneously paid into the2state treasury is hereby appropriated out of the fund into3which it was paid, for refund to the proper person.4

When the officer authorized by law to collect money for5the state finds that a sum has been erroneously paid, he or she6shall issue his or her requisition upon the auditor for the7refunding of the proper amount. The auditor shall issue his or8her warrant to the treasurer and the treasurer shall pay the9warrant out of the fund into which the amount was originally10paid.11

Sec. 13. Sinking fund deficiencies. - There is hereby1appropriated to the governor a sufficient amount to meet any2deficiencies that may arise in the mortgage finance bond3insurance fund of the West Virginia housing development4fund which is under the supervision and control of the5municipal bond commission as provided by section twenty-b,6article eighteen, chapter thirty-one of the code, or in the funds7of the municipal bond commission because of the failure of8any state agency for either general obligation or revenue9bonds or any local taxing district for general obligation bonds10to remit funds necessary for the payment of interest and11sinking fund requirements. The governor is authorized to12transfer from time to time such amounts to the municipal13bond commission as may be necessary for these purposes.14

The municipal bond commission shall reimburse the state15of West Virginia through the governor from the first16remittance collected from the West Virginia housing17development fund or from any state agency or local taxing18


district for which the governor advanced funds, with interest19at the rate carried by the bonds for security or payment of20which the advance was made.21

Sec. 14. Appropriations for local governments. - There1are hereby appropriated for payment to counties, districts and2municipal corporations such amounts as will be necessary to3pay taxes due counties, districts and municipal corporations4and which have been paid into the treasury:5

(a) For redemption of lands;6

(b) By public service corporations;7

(c) For tax forfeitures.8

Sec. 15. Total appropriations. - Where only a total sum1is appropriated to a spending unit, the total sum shall include2personal services, annual increment, employee benefits,3current expenses, repairs and alterations, equipment and4capital outlay, where not otherwise specifically provided and5except as otherwise provided in TITLE I - GENERAL6PROVISIONS, Sec. 3.7

Sec. 16. General school fund. - The balance of the1proceeds of the general school fund remaining after the2payment of the appropriations made by this act is3appropriated for expenditure in accordance with section4sixteen, article nine-a, chapter eighteen of the code.5

TITLE III - ADMINISTRATION.

Section 1. Appropriations conditional. - The1expenditure of the appropriations made by this act, except2those appropriations made to the legislative and judicial3branches of the state government, are conditioned upon the4


compliance by the spending unit with the requirements of5article two, chapter eleven-b of the code.6

Where spending units or parts of spending units have7been absorbed by or combined with other spending units, it8is the intent of this act that appropriations and9reappropriations shall be to the succeeding or later spending10unit created, unless otherwise indicated.11

Sec. 2. Constitutionality. - If any part of this act is12declared unconstitutional by a court of competent13jurisdiction, its decision shall not affect any portion of this14act which remains, but the remaining portion shall be in full15force and effect as if the portion declared unconstitutional16had never been a part of the act.17
