2. Summary 2.1 The proposed primary expansion programme for September 2016

(PEP 5)is set out in this report , and endorsement is sought to the Director of Children’s Services intention to start consultation where appropriate.

2.2 Approval is also sought to funding for temporary accommodation for

September 2015 and additional accommodation at Ardeley St. Lawrence School.

3. Recommendations 3.1 Panel is to requested to comment on the report and make the

following recommendations to Cabinet:

(i) To approve the list of proposed permanent school expansions relating to 2016 (as set out in paragraph 4.4) and to endorse the Director of Children’s Services’s intention to consult on them.

(ii) To approve £1.8m additional funds for temporary expansions for

September 2015, where required; (iii) To approve the allocation of £0.286m to provide additional

accommodation at Ardeley St. Lawrence Primary School; and (iv) To approve in principle the application of S106 funds as identified

in appendix A, subject to confirmation by Legal and Development Services .

4. Background 4.1 This report seeks Panel’s support for formal consultation on proposals

for the expansion of school premises by the Director of Children’s Services, where such consultation is required.

4.2 The need for additional primary school reception places is articulated in an updated ‘Meeting the Rising Demand’ document which can be located at http://www.hertsdirect.org/docs/pdf/m/mrdseptpri14.pdf

4.3 Work has been undertaken to identify where expansions are required

for 2016. Options within the areas of need have been assessed using the Director of Children’s Services’ four tests:

Does it provide the right number of places in the right location?

Does it support and not undermine school effectiveness?

Are the implications for buildings, environment and cost feasible and affordable?

Transitional implications. 4.4 Having considered the above four tests a proposed programme of

permanent primary school expansions is shown in the table in below.

4.5 In addition, Ardeley St.Lawrence CoE primary school does not have

sufficient accommodation to house all children within its Published Admissions Number (PAN). This has not been an issue until now but a rising roll means that additional accommodation will be required. Approval is therefore sought for a capital allocation to enable the school to procure, via the St. Alban’s Diocesan framework, the additional accommodation required at a cost of c. £286,000.

4.6 The requirement for permanent expansions has fallen (from

14 f.e. for September 2014 and 6.5 f.e. for September 2015). Additional funding is likely to be required to meet a number of temporary expansions for September 2015, based on latest forecasts, where the need for permanent expansion cannot be evidenced.

Next steps

4.7 Panel is asked to endorse the Director of Children’s Services’ intention to consult where necessary on the expansion of the schools listed above, which will form the first stage of any statutory processes for the permanent expansion of school premises where required. The schools are aware of their potential inclusion in the proposed programme. Local Members have also been informed and offered involvement in the formulation of specific proposals.

4.8 The timetable of future action in relation to proposals on which the

County Council is consulting would be:

5. Financial implications

Revenue funding

5.1 Revenue funding has been made available to support the feasibility work for the school expansion programme.

Capital funding

5.2 The total estimated cost of the PEP5 permanent expansion programme

at this stage is £13.41m. These early cost estimates, which are based on the value engineered tender costs within PEP4 but reflect an anticipated market position, will be confirmed in May when Cabinet is asked to consider the outcome of public consultation and approve the publication of statutory notices, where necessary. During that time scheme designs and estimates will have progressed further.

5.3 Approval is sought at this stage for £1.8m for temporary

accommodation which may be required for September 2015 and £0.286m for additional accommodation at Ardeley St. Lawrence School.

5.4 Additional funds are available to support the provision of new school

places in relation to the pupil yield from new housing, via developers’ contributions under S106 of the Town and Country Planning Act 1990 as amended. Now that the previous primary expansion programme is fully approved through both school organisation and town planning statutory processes it is possible to apply appropriate S106 funds to those and other projects, as identified in appendix A, to a value of c. £3.8m which will be confirmed to Cabinet following further legal checks.

5.5 The updated summary financial position, reviewing funds available

from grants received to date, approved section 106, less existing commitments, and the proposed primary proposals above is:

5.6 This remaining allocation will be amended following confirmation to Cabinet of the final amount available from S106 funds.

5.7 The allocation remaining will need to be used for any newly emerging

primary needs for 2016/17 and for 2017/18 and a second secondary expansion programme to start from 2017/18, which will be the subject of a report later in the year. At this point we anticipate the overall cost of a secondary programme to be at least £20m.

5.8 The government is due to announce basic need allocations for 2017/18

early in 2015. 5.9 It should be noted that there are early signs of market recovery and

tender returns may reflect this. 5.10 Approval is therefore sought to additional funds for temporary

accommodation for September 2015; the Ardeley St. Lawrence scheme; the application of s106 funds as set out in Appendix A (t.b.c.); and to the scale of the overall permanent PEP5 programme only at this point.

6. Equalities 6.1 When considering proposals placed before Members it is important that

they are fully aware of, and have themselves rigorously considered the Equality implications of the decision that they are making.

6.2 Rigorous consideration will ensure that proper appreciation of any

potential impact of that decision on the County Council’s statutory obligations under the Public Sector Equality Duty. As a minimum this requires decision makers to read and carefully consider the content of any Equalities Impact Assessment (EQiA) produced by officers.

6.3 The Equality Act 2010 requires the County Council when exercising its

functions to have due regard to the need to (a) eliminate discrimination, harassment, victimisation and other conduct prohibited under the Act; (b) advance equality of opportunity between persons who share a relevant protected characteristic and persons who do not share it and (c) foster good relations between persons who share a relevant protected characteristic and persons who do not share it. The protected characteristics under the Equality Act 2010 are age; disability; gender reassignment; marriage and civil partnership; pregnancy and maternity; race; religion and belief, sex and sexual orientation.

6.4 Equalities Impact Assessments (EIAs) have been carried out and

updated where necessary on all proposed school expansions contained within this report. They will be made available in the Members’ Lounge prior to, and at the Panel meeting in order that its members are fully aware of any equality issues arising from the

proposals. The EIAs will be reviewed and updated as part of any future public consultation. Consideration has been given to the likely impact of the proposals, and current assessments conclude that it is not anticipated that people with protected characteristics will be affected disproportionately.

6.5 The Local Authority is bound by the Admissions Code and Regulations

and this does not allow for any discrimination in this respect. 6.6 The expansion of school premises will enable additional school places

to be made available as close as possible to the demand for them. In that way they will improve access to school places to all sectors of the communities in which they are located, and avoid very young children having to travel longer distances to access education.

6.7 The expansion of existing schools provides for enhanced education

opportunities and an enriched curriculum offer which has a positive impact on the whole school community.

6.8 School expansion schemes provide positive impacts, offering the

opportunity for improved facilities for disabled access in new buildings.
