Present were: Supervisor: Mark C. Crocker Town Council Members: Paul W. Attorney Various Recreation Agreements Attorney Seaman brought several agreements to the Town Board that were composed for the Recreation Commission events and programs. A regularly scheduled work session of the Lockport Town Board was conductedat 1: 00 p. m. on Wednesday, February 19, 2020 at the Town Hall, 6560 DysingerRoad, Lockport, New York.

Supervisor Crocker welcomed everyone and began the work session as follows:

1. Town Clerk

The Town Clerk reported she has received a request for a waiver of the

standardized" 30-day advance notice" for an" on premise license" to serve wine,beer and cider in a tavern from Mighty Taco, Inc. dba Mighty Taco.

MOTION (2020- 047) was made by Councilmember Siejak, seconded byCouncilmember Keough to approve a 30- day waiver for a notification ofapplication for a New York State on premise license to serve wine, beer and

cider in a tavern for Mighty Taco, Inc. dba Mighty Taco, 5691 South TransitRoad, Lockport, NY. The motion was APPROVED: AYES— 5, NAYS— 0.

Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.

2. Attorney

Various Recreation Agreements

Attorney Seaman brought several agreements to the Town Board that werecomposed for the Recreation Commission events and programs.

Barge Canal Optimist Agreement— 5th& 61h Grade Girls Basketball

MOTION ( 2020-048) to authorize the Supervisor to enter into an agreement with

the Barge Canal Optimist Club to provide a51h& 61h grade basketball program

from February through April 2020 at a cost of$ 300. 00 was made byCouncilmember DiCarlo, seconded by Councilmember Keough. The motion wasAPPROVED. AYES— 5, NAYS— 0. Voting AYE: Crocker, Siejak, Dufour,Keough and DiCarlo.

Barge Canal Optimist Agreement— Bike Rodeo

MOTION ( 2020-049) to authorize the Supervisor to enter into an agreement with the

Historic Palace Theatre Contract

MOTION ( 2020-053) to authorize the Supervisor to enter into a contract with

Historic Palace Theatre, Inc. to offer discount coupons to residents for admission

and concessions at events was made by Councilmember DiCarlo, seconded byCouncilmember Dufour. The motion was APPROVED: AYES— 5, NAYS— 0.

Hartland Carriage, Ltd. ( Winterfest)

MOTION ( 2020-054) to approve an agreement with Hartland Carriage, Ltd., Gasport,

NY to provide hay rides for the Cookies and Cocoa event at a cost of$ 300. 00 for thefirst hour and $ 100.00 for each additional hour from 12: 00- 3: 00 p. m. on November29, 2020 and authorize the Supervisor to sign was made by CouncilmemberDiCarlo, seconded by Councilmember Dufour. Authorization for Contract with Lockport Locks& Erie Canal Cruises, Inc.

MOTION ( 2020-056) to authorize the Supervisor to enter an agreement with

Lockport Locks& Erie Canal Cruises, Inc. to provide discount passes to Town of

Lockport residents for the 2020 season for$ 3. 50 off an adult admission and

2. 00 off a child' s admission, was made by Councilmember Keough andseconded by Councilmember DiCarlo. The motion was CARRIED: AYES- 5,NAYS- 0. Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.

Ross Rental— Bounce House Community DayMOTION (2020- 057) to approve an agreement with J. C. Ross, Inc. dba/ Ross

MOTION ( 2020-058) to approve an agreement with J. C. Ross, Inc. dba/ Ross Rental

Station to provide a bounce house for the Fall Festival celebration on Sunday,October 18, 2020 from 1- 3 p. m. at a cost of$ 240.00 and authorize the Supervisor tosign was made by Councilmember Keough, seconded by Councilmember Dufour.The motion was APPROVED. 3. Engineer

Contract 17- 1) Utility Repair Contract— Change order# 3

Rob Klavoon presented a summary of the utility repair contract with Mark

AUTHORIZE CHANGE ORDER# 3

CONTRACT 17- 1

WHEREAS, the Town of Lockport awarded a bid to Mark Cerrone, Inc. by way ofContract No. 17- 1, for the Utility Repair Contract, and

WHEREAS, provisions in the contract allow for Mark Cerrone, Inc and the Town

of Lockport to mutually agree to extend the contract for an additional year, nowtherefore be it

RESOLVED, that this Board authorizes Change Order No. 3 which changes the

contract completion date to December 31, 2020, and be it further

RESOLVED, that the work be performed on an as needed basis as authorized bythe Town Board.

Contract 18- 1) Annual Generator Maintenance— Change order# 2

Rob Klavoon then briefed the Town Board regarding the annual generatormaintenance contract with Kinsley Power Systems that was awarded in 2017.This contract was composed for maintenance services and was bid in 2016. He

broke down the monies spent to date. He recommended the contract be

renewed for one additional year extending to 12/ 31/ 2020. This contractauthorizes quarterly service to each of the 24 generators that were purchased forthe lift stations during the 2018 sewer project.

MOTION ( 2020-060) on a motion by Councilmember Dufour and seconded byCouncilmember DiCarlo, the following resolution was duly ADOPTED: AYES- 5,NAYS-0. Voting AYE: Crocker, Siejak, Dufour, Keough and DiCarlo.

RESOLUTION

AUTHORIZE CHANGE ORDER# 2

CONTRACT NO. 18- 1

WHEREAS, the Town of Lockport awarded a bid to Kinsley Power Systems byway of Contract No. 18- 1, for the Annual Generator Maintenance Contract, and

Contract 18-2) Annual Pump Station Maintenance— Change order# 2

Rob explained this contract was bid to stabilize the rates for maintenance. The

original bid amount was$ 96, 858. 00; receipts were received for$ 54, 832. 00 in

2018 and$ 102, 828. 00 in 2019. The company is called in on a time and expensebasis. He recommended the contract be renewed for one additional year

extending to 12/ 31/ 2020 with an additional$ 100, 000.00 added to the contractfunds for this year.

DEDUCT CHANGE ORDER NO. 1

TOWN OF LOCKPORT

TRANSIT ROAD TELEVISING AND FLUSHING

WHEREAS, the Town of Lockport awarded a bid to National Water Main

Cleaning Company in the amount of$ 15, 807. 50, for the Transit Road Televisingand Flushing project, and

WHEREAS, Wendel and National Water Main Cleaning Company have mutuallyagreed on an adjustment for final close out and balancing quantities for actualitems installed for the project,

NOW THEREFORE BE IT RESOLVED, that this Board authorizes deduct

Change Order No. 1 in the amount of$ 839.22 for a final Contract Price of

14, 968. 28.

WHEREAS, the Town of Lockport awarded a bid to National Water Main

Cleaning Co. in the amount of$ 15, 807. 50, for the Transit Road Televising andFlushing project, and

WHEREAS, this Board previously authorized deduct Change Order No. 1 in theamount of$ 839. 22 for a final Contract Price of$ 14, 968. 28, and

WHEREAS, Wendel, the Town' s Engineers have reviewed the project and find

that all matters required under the Contract have been satisfactorily completed,

NOW THERFORE BE IT RESOLVED that this Board authorizes the payment of

14, 968. 282 which represents the remaining balance owed under the Contractand be it further

4. Economic Development

Thomas Sy reported he attended a meeting of the Erie County IndustrialDevelopment Agency and briefed the Town Board on some of the possiblenegative impacts resulting from projects that would minimize canal navigation.After some discussion Supervisor Crocker asked Tom to keep the Town Boardinformed on this issue.

He also reported on the status of the former Bon Ton building on South TransitRoad. He stated the new business has not opened as of this time but he stated

that about 70% of the space is storage units. The Veterans Administration Clinic

is to the left of the building and there will be room for professional offices to theright of the building. Councilmember Dufour added the owner is allocatinganother 10 to 12 thousand square feet for professional offices. Councilmember

Keough has visited the Veterans Administration and was impressed by the setupand amount of room available.

5. Highway Superintendent

Grinder Pump- Raymond Road residence

Highway Superintendent Dave Miller discussed a service call need for a grinderpump on a resident' s property before transfer from the Town of Lockport to theproperty owner. Rob Klavoon added some electrical work will need to be doneon this grinder pump as well.

He discussed an agreement from 2000 that was set up between the Town ofLockport and the NYS Department of Transportation for installation of a light to

moderate traffic on South Transit Road near the Home Depot Plaza.

He discussed the replacement policy and costs allotted for town residents'mailboxes that are damaged by Town plows. He then distributed a picture of amailbox that was installed in the Town of Lockport that does not meet the town

code encroachment rules. This issue will be forwarded to Brian Belson, BuildingInspector to address.

He then distributed and discussed a draft of the paving list for 2020 for TownBoard review. He also discussed some of his plans for 2021 paving as well.

He reported the Wisterman Bridge will be closed by Niagara County around the24th of February and should be finished by the end of July. Also, the TonawandaCreek Road closure and construction traffic path has been altered. There will be

a single lane with a light to address traffic movement. Councilmember Dufour

added that she has viewed the project and it is quite extensive.

6. Town Board

Councilmember Siejak informed the Town Board he plans to host a Citizen

Preparedness Event in conjunction with Rick Abbott, City Alderman on March23rd at 7: 00 p. m. This event is sponsored by the Homeland Security Department.It is a two- hour session that requires registration to learn the tools for survival

during a disaster. He will share more details with the Town Board and theresidents as they become available.

Councilmember Dufour stated she was astounded by the number of couponsthat are used by the town residents for the recreation programs. She viewed 794coupons during her last perusal of the town vouchers for payment.

7. Supervisor

Street Light Acquisition and LED Conversion

Supervisor Crocker stated that three responses were received for the Street Light

Acquisition and LED Conversion Project; he asked the Town Board to review the

data for discussion at a later meeting.
