Authority) is a fully owned Government of Kerala company set up in 2007 for

providing services to the various health care institutions under the Department

of Family Welfare and Health. One of the key objectives of the KMSCL is to

act as the central procurement agency for all essential drugs and equipments

for all health care institutions (hereinafter referred to as user institutions) under

the department. The corporation has also been entrusted with the setting up

and running of all kinds of modern Medical and Paramedical or medical based

ancillary facilities such as hospitals, laboratory services, diagnostic centers,

x-ray/scanning facilities.

1111....2222.... Sabarimala Sree Ayyappa Temple is one of the most ancient and prominent

temples in the country, located in the western ghats mountain ranges of

Pathanamthitta district in Kerala. The season in sabarimala starts from mid

November to mid January and millions of pilgrims from all parts of the

country visits the holy shrine. This year’s Sabarimala season is round the

corners and the improvement of health facilities have started. Every year an

average of 50 pilgrims lose their life due to cardiac failure. Most of the

pilgrims are from other states like Tamilnadu, Karnataka and Andrapradesh.

Last year more than 100 people died in Pullumedu stampede. Since Crores of

pilgrims visit Sabarimala during the season, all kinds of precautions has to be

taken. Hence it was decided to operate around 20 ambulances in 5 districts

such as Pathanamthitta, Kottayam, Idukki, Kollam & Alappuzha to provide

Emergency service in case of any Catastrophe or road accident during the

forthcoming Sabarimala season.

1111....3333.... In this tender, if one tenderer could not provide the entire ambulances

required, orders will be issued to multiple tenderer at a negotiated rate. But at

the same time proven quality in service delivery is a mandatory selection

criteria for selecting the supplier.

1111....4444.... It is also essential while dealing with public money that utmost transparency

has to be maintained in the procurements of the corporation. All decisions will

be published from time to time on our website www.kmscl.kerala.gov.in. The

corporation will not wait for the mandatory 30 days period to provide any

information under Right to Information Act and will provide the information


within the minimum possible time. The Corporation will uphold the

fundamental “right to be heard’ enshrined under the Constitution of India and

will take harsh decisions only after providing opportunity for

hearing/submission of facts. Tenderers could prefer appeal to the government

against all decisions of the corporation.

2.1.1. Government means Government of Kerala, represented by the Secretary to

Health & Family Welfare, who is also the Chairman of the Board of Directors of

KMSCL

2.1.2. Tender Inviting Authority is the Managing Director of the KMSCL, who on behalf

of the Government invite and finalize tenders.

2.1.3. A two bid system – consisting of technical bid and price bid - is adopted in the

invitation of tenders. Those tenderers who are eligible as per prequalification

criteria, submit the requisite information as needed in their bid submission for

hiring ambulance service to the satisfaction of the Tender Inviting Authority will

only be eligible for opening of bids.

2.2.1 Tenders are invited for hiring ambulance service as per the specification

mentioned in Appendix I during the forthcoming Sabarimala season

from 16th November 2011 to 21 January 2012 for various models of

ambulances.

2.2.2 The successful tenderer has to operate ambulances service during the

Sabarimala season from 16/11/2011 to 21/01/2012 in the districts of

Pathanamthitta, Kottayam, Idukki and Alappuzha. The ambulance shall

be parked in a Government hospital as per the schedule provided by

the Tender Inviting Authority. The man power for the ambulances shall

be provided by the successful tenderer and the rates have to be offered

for a month for 1000 kilometers. The additional kilometer travelled will

be paid by the Tender inviting Authority. Each ambulance shall be

provided with a mobile phone connection.

2.2.3 The lowest tenderer (L1) shall be evaluated separately for each models

of ambulances district wise as specified in the price bid form. If one

tenderer cannot supply all the required ambulances, then the

tenderer(s) who matches the L1 rate shall also be selected for award of

contract. If more no of tenderers are willing to match the L1 rate then


the tenderer who offer maximum ambulances will be given priority. The

models selected in the case of matched L1 will be on the sole discretion

of the Tender Inviting Authority.

2.2.4 It was also asked to offer rates for ambulances on daily basis.

Ambulance service in daily basis will be availed only on requirement

basis.

5.2.1 Tenderers should be a registered firm having a place of business in any of

the States of India.

5.2.2 Tenderers should be in the business of ambulance service for the last 2

calendar years.

5.2.3 Tenderers should either own an ambulance or shall have experience in

operating at least one ambulance at the time of offering the tender.

5.2.4 Tenderers who submit all the necessary documents as prescribed for

inclusion in the technical bid without any ambiguity, errors etc and who

submit the requisite cost of the tender document and also the EMD as DD.

5.2.5 Tenderers who have been blacklisted/ debarred by Tender Inviting

Authority or blacklisted / debarred by any State Government or Central

Government department/Organization should not participate in the tender

during the period of blacklisting.

5.3.1 The successful tenderer(s) is required to provide ambulance services from

10th November 2011 to 21st January 2012. The ambulance shall reach

the hospital on 15th November 2011. Additional ambulances shall be

required during the period 01/01/2012 to 21/01/2012.

5.3.2 During the contract period if the vehicles are required for an emergency,

then the tenderer shall provide the required ambulances at the least

possible time in on call basis.

5.3.3 The ambulances shall be provided to the Government hospitals in the

district of Pathanamthitta, Kottayam, Idukki and Alappuzha as per the

schedule given in Appendix I. The list of hospitals may vary based on

actual requirement.

5.3.4 The hospital where the ambulances are to be parked shall be inform by the

Tender Inviting Authority along with the work order.

5.4.1 The payment shall be submitted to the KMSCL Warehouse Managers of

the respective district after every 15 days of satisfactory operation

during the scheduled period. No advance payment will be entertained.

For on call basis the payment will be made at the respective district

office of NRHM.

5.4.2 The successful tenderer shall submit its claim for payment in writing

along with proper invoice including copy of log book as per format in

Annexure VII and consolidated monthly statement as per Annexure VIII

duly signed with date from the Superintendent / Medical Officer in-

charge / Resident Medical officer of the respective hospital / institution

where the ambulance is parked to the Tender Inviting Authority. The

satisfactory performance reports for the ambulances in Pampa and

Nilakkal shall be obtained from the Medical Officer in-charge at Pamba

and Nilakkal / Sabarimala Coordinator appointed by KMSCL.

5.5.1 The ambulance provided under the contract shall be as per the technical

specification in Appendix I.

5.5.2 The ambulance service shall be provided 24x7 basis and shall be parked

and operated from the hospitals designated by the Tender Inviting

Authority. For on call basis the ambulance has to be provided when

ever required on request from any authorized person.

5.5.3 The ambulance service under the contract shall be made available for

accidents, catastrophe, patient transfer, etc. The service shall be made

available on the instructions from the Tender Inviting Authority,

Superintendent / Medical Officer / RMO / Duty doctors of the respective

hospitals, District health authorities like DMO, DPM etc.

5.5.4 Each ambulance shall be provided with a qualified driver and a

qualified paramedical staff / Technician at any point of time during the

contract period. The crew shall be in uniform during the duty hours.

The ALS

5.5.5 Each ambulance shall be provided with an active mobile phone

connection which has a proper coverage under the area of operation.

The driver of the ambulance shall be responsible for attending the

mobile phone. The mobile phone connection shall be made responsive

24x7. The mobile number shall be made available to the Tender

Inviting Authority / respective hospitals. The charges for mobile phone

shall not be paid separately at any instance. The mobile phone number

shall remain the same through the period of contract.

5.5.6 The ambulances provided under the contract shall not be more than five

years old on the date of opening the technical bid and should be road

worthy. The details of ambulances offered shall be submitted as per the

format in Annexure VI the copy of RC book and insurance shall be

submitted for all the ambulances offered.

5.5.7 The exterior of the ambulances on both sides shall have the logo and

design as per the material provided by the Tender Inviting Authority

along with the work order in soft copy. Health awareness messages shall

also be displayed on the ambulance on both sides as per the material

given by the Tender Inviting Authority.


5.5.8 The tenderer shall offer rental charges for the ambulance available with

them as per the models specified in the price bid form (Annexure III).

The rates offered shall be for one month for a minimum of 1000

kilometers. The rate for additional kilometers charges over and above

1000 km shall be specified per kilometer wise. The amount shall not be

taken for arriving at the lowest tenderer, but standard rates as prevalent

in the market shall be made applicable as part of agreement. The lowest

tender (L1) shall be evaluated separately for each models (category) of

ambulances district wise as specified in the price bid form. If one

tenderer cannot supply all the required ambulances, then the

tenderer(s) who matches the L1 rate shall also be selected for award of

contract. If more no of tenderers are willing to match the L1 rate then

the tenderer who offer maximum ambulances will be given priority. The

models selected in the case of matched L1 will be on the sole discretion

of the Tender Inviting Authority. The evaluation for on call basis will be

done separately.

5.5.9 Additional kilometer charges shall be paid only if the average kilometer

travelled by all the ambulances supplied under the contract by the

tenderer exceeds 1000 kilometers.

5.5.10 For the first instance, the kilometer of the ambulance, once after

reaching the designated hospital will be considered for payment. The

kilometers travelled before reaching the designated hospital when the

contract period starts will not be considered. Same condition shall be

applicable towards the end of the contract. The kilometer last travelled

and authorized by the hospital authorities in the log book shall be

considered for payment. The kilometer travelled by the ambulance to

the service center for ambulance will not be taken into account for

payment. The kilometer travelled by the ambulance while arranging

standby will not be considered for payment. The kilometer travelled

which is not authorized or validated by the hospital authorities will not

be paid.

5.5.11 Tenderer shall pay all taxes, duties, fees, due levied on the Ambulances

under any law, rule or regulation.

5.5.12 The tenderer shall be responsible for any damage caused to the

ambulance or the equipments under any circumstances and no claim in

this regard will be entertained.


5.5.13 The tenderer shall maintain a log book in each ambulance which shall

contain details of starting kilometer and time, closing kilometer and time

on every journey, destination place and purpose with details of case

and treatement if any carried out during the journey. These shall be

authorized by the superintendent / Medical officer (i/c) / RMO of the

respective hospitals or such other person authorized by the Tender

Inviting Authority.

5.5.14 The attendance of the ambulance driver, Paramedical staff / Technician

appointed by the tender shall be maintained in the hospital on a day to

day basis.

5.5.15 The successful tenderer shall authorize one person for liasioning with

the tender inviting Authority.

5.5.16 The charges for accommodation for the driver and paramedical staff /

technician shall not be provided. Space shall be provided for the crew in

the hospitals where ever possible and the Tender Inviting Authority shall

not assure to provide space in all the hospitals. However the Tender

inviting Authority will take all possible efforts to provide accommodation

in the respective hospitals for the ambulance crew.

5.5.17 If the contract attracts any statutory deductions, the same will be

deducted while settling the payment.

5.5.18 In case the repair / fault duration is likely to exceed six hours, the

successful tenderer shall arrange a stand-by ambulance of same

specification within next two hours as a stop gap arrangement till the

fault / repair is rectified, failing which a penalty of Rs.500 / hour will be

deducted for the non performing ambulance subject to the maximum of

10% of the contract amount.

5.5.19 The operation of the ambulances shall be monitored continuously on a

24x7 basis by the personnel deployed by the tenderer.

5.5.20 The tenderer shall be responsible for any damage/accidents caused to

the patients / ambulance crew / ambulances / any third party while

operation of ambulance service during the contract period and shall

indemnify the Tender Inviting Authority.

5.5.21 The Security of the ambulances during the whole period at any location

shall be taken care by the tenderer and the Tender Inviting Authority


shall be indemnified of any sort of damages caused whatsoever. The

vehicle shall have insurance coverage in respect of the driver, technician

and passenger and the tenderer shall indemnify the TIA from all

damages that are likely to arise from accidents etc. involving the

ambulance on hire.

5.5.22 The tenderer shall provide appropriate physical and legal protection to all

the staff engaged in the provision of contract, while discharging their

duties.

5.5.23 The hospital designated for an ambulance, if found not appropriate by

the TIA, it shall be relocated to another appropriate hospital as per the

decisions of the TIA.

5.5.24 If the ambulance service under the contract is found to be deviating

from the technical specifications and other tender conditions, the

performance security of the successful tenderer will be forfeited and

penal actions will be initiated.

6.2.1 The purchasers of the tender form shall examine all instructions, forms,

terms and specifications in the Tender Document and verify that all the

contents mentioned under clause 6.1, are contained in the ‘Tender

Document’.

6.2.2 Failure to furnish any information required by the tender documents and

submission of an offer not substantially responsive to it in every respect

shall be at the tenderer’s risk and may result in the rejection of the bids,

without any further notice.

6.3.1 The detailed technical specifications and terms and conditions governing

the hiring of ambulances which is tendered are contained in this “Tender

Document”.

6.3.2 The tender document is to be downloaded from website

Draft as Cost of tender document as per schedule of any


Nationalized/Scheduled Bank in favour of the Managing Director, Kerala

Medical Services Corporation Ltd payable at Thiruvananthapuram along,

failing which the offer will be rejected.

6.3.3 The tender is also available for purchase from the head office of the Tender

Inviting Authority.

6.4.1 The Tenderer shall bear all costs associated with the preparation and

submission of its bid and Kerala Medical Services Corporation Ltd.,

Thiruvananthapuram, hereinafter referred to as “Tender Inviting

Authority”, will in no case be responsible or liable for these costs,

regardless of the conduct or outcome of the bidding process.

6.4.2 It is compulsory to provide a check list as per Annexure V as facing sheet

for the technical bid/offers submitted so as to enable the Tender Inviting

Authority to prima facie verify the compliance of submission of requisite

documents at the time of opening of technical bids.

6.4.3 Language of Bid:- The Bid prepared by the tenderer and all

correspondence and documents relating to the bid exchanged by the

Tenderer and the Tender Inviting Authority, shall be in English language.

Supporting documents and printed literature furnished by the Tenderer

may be written in another language provided they are accompanied by an

authenticated accurate translation of the relevant passages in the English

language in which case, for purposes of interpretation of the Bid, the

English translation shall govern.

6.4.4 The tender once submitted will not be altered in any case and should not

have any scope of ambiguity, cutting or overwriting. In case of overwriting

/cutting if any, it must be authenticated with signature of the tenderer.

6.4.5 The documentary evidence (other than those regarding supply and past

performance) submitted along with the Tender shall be produced duly

attested by the tenderer on every page and serially numbered. Any

interlineations, erasures or over writing shall be valid only if they are

initialed by the person (s) signing the offer.

6.4.6 In the event of documentary proof as required being not enclosed, the

Tender shall be liable to be rejected. All pages of the bid, except for


unamendable printed literature, shall be signed by the authorized person or

persons signing the bid along with the stamp of the tenderer.

6.4.7 A copy of the complete tender document and amendments if any duly

signed on every page by the tenderer or the authorized representative shall

be enclosed as part of the technical bid as a proof of having read and

accepted the terms and conditions of the tender document.

6.4.8 The tender shall be typewritten or written in indelible ink and shall be

signed by the Tenderer or person(s) duly authorized to bind the Tenderer

to the Contract with Tender Inviting Authority. The letter of authorization,

to the satisfaction of the Tender Inviting Authority, shall be submitted as by

written power-of-attorney accompanying the bid/resolution of the board of

directors etc.

6.4.9 An offer submitted in vague /ambiguous financial terms and the like, shall

be termed as non-responsive and shall be summarily rejected.

6.4.10 A prospective Tenderer requiring any clarification of the tender documents

may notify the Tender Inviting Authority in writing by email or fax at the

Tender Inviting Authority’s mailing address/fax number indicated in this

tender document. The Tender Inviting Authority will respond to any

request for clarification of the tender Documents which it receives before 5

days prior to the deadline for submission of bids.

6.4.11 Clarifications to specific requests shall be responded through e-mail and

general clarifications, affecting all the tenderers shall be published in the

official website of the Tender Inviting Authority. However it shall be the

duty of the prospective tenderer to ensure that the clarifications sought for

has been properly received in time by the Tender Inviting Authority.

6.5.1 The tenderers who offer their tender only for on call basis are exempted

from paying tender fees and EMD. The sealed tender cover shall be

mentioned as “ONLY FOR ON CALL BASIS’

6.5.2 Non- submission of sufficient EMD as mentioned shall be one of the

primary reasons for rejection of the bid. EMD not applicable for the

tenderers who offer rates only for ambulance hire service on call basis.


6.5.3 Cheque, Cash payment, Money Order, Fixed deposit etc will not be

accepted as EMD.

6.5.4 Public Sector Units within the State or State micro, small and medium

enterprises registered with Govt. of Kerala are exempted from remittance

of EMD subject to submission of valid documents.

6.5.5 The EMD shall be in one of the following forms :

6.5.5.1 A demand draft in favour of Managing Director, Kerala Medical Services

Corporation Limited, payable at Thiruvananthapuram;

OR

6.5.5.2 A Bank Guarantee issued by a nationalized / scheduled bank located in

India, in the form prescribed in the tender document (Annexure -V).

Bank Guarantee in any other format will not be acceptable and render

the bid non-responsive.

6.5.6 EMD of unsuccessful tenderers will be discharged/returned as promptly

as possible as but not later than 30 days after opening of the bids by the

Tender Inviting Authority....

6.5.7 The successful tenderer's EMD will be converted into performance

security.

6.5.8 No interest will be paid for the EMD submitted....

6.5.9 The EMD will be forfeited, if a tenderer;

6.5.9.1 misrepresents of facts or submitting false/fake documents during the

tender process

6.5.9.2 if the tenderer willfully violates any terms and conditions of the tender

documents

6.5.9.3 withdraws its bid after the opening of bid;

6.5.9.4 a successful tenderer, fails to sign the contract.

6.6.1. Date of pre-tender meeting is mentioned in Section III.


6.6.2. Pre-tender meeting is called by the Tender Inviting Authority to explain

briefly about the requirements as well as the terms and conditions of the

tender document and to get the views of the prospective tenderers, as

part of ensuing transparency in the tender process.

6.6.3. It is an opportunity for the prospective tenderer to obtain all the details

about the tendered items, conditions governing the tenders and also to

get the explanation of any ambiguous condition that may be present in

the tender document.

6.6.4. It is also an opportunity for the Tender Inviting Authority to assess the

market and obtain feedback on the technical specifications/features etc

requested by the User Institution/funding agency, so as to make

amendments in the tender document on the basis of expert advice.

6.6.5. Failure to attend the Pre-tender meeting will not be a disqualification, but

a loss of opportunity for the prospective tenderers to understand about

the ambulance hired and the tender conditions.

6.6.6. Filled up Tenders will be accepted only after the date of pretender

meeting.

6.7.1 At any time prior to the dead line for submission of Tender, the Tender

Inviting Authority may, for any reason, modify the tender document by

amendment.

6.7.2 The amendment shall be notified by fax/email to all prospective tenderers

who have purchased the tender document, for which the email, fax no of

the purchaser of the tender document shall be submitted to the tender

inviting authority and such amendments shall be binding on them

thereafter.

6.7.3 The Tender Inviting Authority shall not be responsible for failure to inform

the prospective tenderers because of technical issues, wrong fax number

or email ID etc. Purchasers of tender documents are requested to browse

the website of the Tender Inviting Authority for information/general

notices/amendments to tender document etc on a day to day basis till the

tender is concluded.

6.11.1 Tenders must be received in the office of the Tender Inviting Authority

at the above address at Thiruvananthapuram not later than the time

and date specified in the Tender Schedule.

6.11.2 In the event of the specified date for submission of tender being

declared holiday, the tender shall be received up to the appointed time

on the next working day.

6.11.3 If the Tender is sent by Registered post or by Courier, it should reach

the above office on or before the time and date stipulated for the

receipt of Tender. The Tender Inviting Authority shall not be held liable

for the delay in transit where the Tender is sent by post or courier.

6.11.4 The Tender Inviting Authority may, at its discretion, extend the

deadline for submission of Tender by amending the Tender Document,

in which case, all rights and obligations of the Tender Inviting Authority

and the tenderers previously subjected to the deadline shall thereafter

be subjected to the same deadline so extended.

6.12.1 The tenderer may modify or withdraw its bid after the bids submission,

provided that written notice of the modification or withdrawal is

received by the Tender Inviting Authority before the date opening of

technical bids.

6.12.2 The tenderers’ modification or withdrawal notice shall be signed by the

tenderer or his/her authorized representatives, who have signed the

original tender documents. A withdrawal notice may also be sent by fax

or email but should necessarily be followed by a signed confirmation

copy to be received at the head office of the Tender Inviting Authority

before the date of opening of the technical bids.

6.12.3 Modification of bids on request from Tender Inviting Authority: No bid

may be modified subsequent to the deadline for opening of bids.

However, if the quantity mentioned in the tender vary beyond 25% of

the quantity indicated under this tender documents as per the directions


of the Government/User Institutions/Funding agencies, then the

following procedure is adopted:

6.12.3.1 All the purchasers of the tender document till the date of amendment

shall be given option to submit revised price bids.

6.12.3.2 In the event the quantity has to be increased after the pre-qualification

of the technical bid evaluation and/or the demonstration, the option for

submitting revised price bids will be limited to the qualified tenderers

(who have been selected after evaluation of the technical bid and/or

demonstration).

6.12.3.3 In such event(s), the Tender Inviting Authority will make a comparison

of the previous prices quoted by the qualified tenderers and if it is found

that the increase in quantity has not made any impact in terms of

reduction in price offered, it may cancel the tender and go for fresh

tenders. However, such decisions of the Tender Inviting Authority will

be taken at its discretion.

6.12.4 No bid may be withdrawn in the interval after the opening of technical

bids and the expiration of the period of bid validity specified in the

tender document. Withdrawal of a bid during this interval will result in

the forfeiture of its EMD and may lead to black listing/debarring the

tenderer.

6.13.1 The opening of the bid shall be done by the Tender Inviting Authority or

his authorized representative in the presence of the prospective tenderers

or his /her representatives who choose to attend at the respective time

and place mentioned in the Tender.

6.13.2 The tenderers or representatives present for the opening of the envelopes

shall sign registers evidencing their attendances.

6.13.3 In the event of the specified date for opening of Tender being declared

holiday, the Tender shall be opened at the appointed time and venue on

the next working day.

6.13.4 The tenderer’s names, the presence or absence of the requisite EMD and

such other details as the Tender Inviting Authority may consider

appropriate, shall be announced at the time of opening of the Tender.


6.13.5 In the event of the tender and claims in the covers are materially missing

or of substantial error or unqualified for want of required qualifications,

shall stand disqualified and rejected. However, minor infirmities in the

submission of documents will be allowed to be rectified so as to ensure

qualification of maximum number of competitive offers to the final

round.

6.13.6 The tenderer shall be responsible for properly super scribing and sealing

the envelopes and the Tender Inviting Authority shall not be held liable

for accidental opening of the envelopes before the time appointed for

opening of the envelopes.

6.13.7 All the tenderers who submit their tenders shall participate in the tender

opening. Since the time is very short the technical evaluation of the

tenders submitted will be held on the same day of tender opening and

the results will be declared. Any minor infirmities pointed out by the

Tender Inviting Authority shall be rectified by the eligible tenderers on

the same day itself. The financial bid will be opened on the same day

whose technical bids are declared qualified.

6.14.1 The commercial terms and documents submitted as part of the bid shall

be scrutinized by a Bid Evaluation Committee constituted by the Tender

Inviting Authority.

6.14.2 The Bid Evaluation Committee may also verify the veracity of claims

represented in the bid, the experience and reputation of tenderer in the

field, the financial solvency etc.

6.14.3 The decisions of the Bid Evaluation Committee on whether the tenders

are responsive or non-responsive will be final.

6.14.4 A tenderer, at any stage of tender process or thereafter, in the event of

being found after verification by the Tender Inviting Authority, to indulge


in concealment or misrepresentation of facts, in respect of the claims of

the offer, shall be debarred/black listed.

6.14.5 Arithmetical errors shall be rectified on the following basis: If there occurs

a discrepancy between words and figures, the amount in words shall

prevail and the offer shall stand corrected to that effect. If the tenderer

does not accept the correction of errors, his offer shall be rejected. The

Tender Inviting Authority may waive any minor infirmity or non-

conformity or irregularity in an offer, which does not constitute a

material deviation, provided that the same shall not prejudicially affect

the interest of the other tenderers.

6.15.1 Only the Price Bids of those firms qualified in the detailed scrutiny and

evaluation of the Technical bid conducted by the Technical

Committee/Tender Inviting Authority shall be opened in the second

round.

6.15.2 The price bid shall be submitted in the format given in this document as

Price Bid Form (Annexure III) The Price bids submitted in any other

formats will be treated as non-responsive and not considered for

tabulation and comparison.

5.5.25 The price offered shall be all inclusive. The tenderer shall offer their price

for the categories mentioned in the price bid form. The rates offered

shall be all inclusive and no other charges will be paid. The Tenderers

can offer the price only for the models for which they offer the rental

services.

6.15.3 The tenders shall offer prices for the hiring of ambulances inclusive of all

the accessories mentioned in the specific conditions under Section V

and under no circumstances offer the rental charges of essential

accessories, without which the ambulance service cannot be provided,

as optional.

6.15.4 Price Offered shall be in Indian Rupees. Price should be quoted for the

supply, installation, successful commissioning and operating of the

display boards.

6.15.5 If the contract attracts any statutory deductions, the same will be

deducted while settling the payment.


6.15.6 There shall also be no hidden costs.

6.15.6.1 Service tax will not be included for the evaluation of price bids and the

service tax mentioned shall be paid if the contract is awarded.

6.15.6.2 The security and insurance cost should be inclusive

6.16.1. The Tender Inviting Authority shall publish the following information

on its website at the appropriate time as part of ensuring

transparency in the tender process;

6.16.2. The tender notices, documents, corrigendum, addendum etc if any.

6.16.3. Amendments to the tender conditions, if any, especially after the

pre-tender meeting.

6.16.4. Provisional rates and provisional list of L1 and matched L1 bidders.

6.16.5. Notice, if any, relating to the contract given by one party to the

other, shall be sent in writing by email or fax and confirmed by post.

The procedure will also provide the sender of the notice, the proof of

receipt of the notice by the receiver. The addresses of the parties for

exchanging such notices will be the addresses as incorporated in the

contract.

6.16.6. The effective date of a notice shall be either the date when delivered

to the recipient or the effective date specifically mentioned in the

notice, whichever is later.

6.17.1 It is also not necessary that that the offer of the firm quoting the lowest

rates shall be accepted. Usually the lowest offers of tenderers qualified

after the bid opening shall be accepted, unless one sided conditions

unacceptable to the Tender Inviting Authority are provided in such bid.

6.17.2 At any point of time, the Tender Inviting Authority reserves the right to

cancel or modify the supply order even after it is awarded to the

successful tenderer in the event the firm deviates from the agreed terms

and conditions.

6.18.1 Criteria:-The contract will be awarded to the lowest evaluated responsive

tenderer.

6.18.2. Variation of Quantities at the Time of Award/ Currency of Contract:-At

the time of awarding the contract, the Tender Inviting Authority reserves

the right to increase or decrease by up to twenty five (25) per cent, the

area of display boards hired (rounded off to next whole number)

without any change in the unit price and other terms & conditions

quoted by the tenderer.

6.19.1 The successful tender shall execute an agreement in the format as given

under Annexure I for providing ambulance service on rental basis.

Agreement shall not be executed for on call basis.

6.19.2 Assignment:-The Successful tenderer shall not assign, either in whole or

in part, its contractual duties, responsibilities and obligations to perform

the contract, except with the Tender Inviting Authority’s prior written

permission.

6.19.3 Sub Contracts:- The Successful tenderer shall not subcontract the

execution of the contract. Such action, if done without the knowledge

of the Tender Inviting Authority prior to the entering of the contract,

shall not relieve the Successful tenderer from any of its liability or

obligation under the terms and conditions of the contract.

6666....19191919.... Performance SecurityPerformance SecurityPerformance SecurityPerformance Security

6.19.1. The EMD of the successful tenderer shall be converted into

performance security deposit with additional 2% of the contract

amount.

6.19.2. Upon receipt of contract and the performance security, the Tender

Inviting Authority shall issue the Supply Orders containing the terms

and conditions for the execution of the order.


6.19.3. Failure of the successful tenderer in providing performance security

mentioned in Section III and/or in returning contract copy duly signed

in time shall make the tenderer liable for forfeiture of its EMD.

6.19.4. In the event of any failure /default of the successful tenderer with or

without any quantifiable loss to the government the amount of the

performance security is liable to be forfeited.

6.19.5. In the event of any amendment regarding enhancement of ordered

quantity, the successful tenderer shall, within ten (10) days of issue of

the amendment, furnish the corresponding Performance Security (as

necessary), rendering the same valid in all respects in terms of the

contract, as amended.

6.19.6. Tender Inviting Authority/User Institution will release the Performance

Security without any interest to the successful tenderer on completion of

the successful tenderer’s all contractual obligations & after receipt of

certificates confirming that all the contractual obligations have been

successfully complied with.

6.19.7. The Bank Guarantee submitted in place of EMD/Security deposit shall

be in the prescribed format; Bank Guarantee in no other form will be

accepted and will lead to rejection of tenders.

6.20.1 The successful tenderer will have to arrange transportation of the

tendered goods as per its own procedure and pay necessary insurance

against loss or damage incidental to manufacture or acquisition,

transportation, storage and delivery and pay all necessary charges

incidental till the hired display boards are delivered and installed at

identified places of Sabarimala. The insurance of the display board

during the display period shall be the responsibility of the successful

tenderer.

6.21.1 For purposes of this clause, Force Majeure means an event beyond the

control of the successful tenderer and not involving the successful

tenderer’s fault or negligence and which is not foreseeable and not


brought about at the instance of , the party claiming to be affected by

such event and which has caused the non – performance or delay in

performance. Such events may include, but are not restricted to, acts of

the Tender Inviting Authority/User Institution either in its sovereign or

contractual capacity, wars or revolutions, hostility, acts of public enemy,

civil commotion, sabotage, fires, floods, explosions, epidemics,

quarantine restrictions, strikes excluding by its employees , lockouts

excluding by its management, and freight embargoes.

6.22.1 If dispute or difference of any kind shall arise between the Tender

Inviting Authority/User Institution and the successful tenderer in

connection with or relating to the contract, the parties shall make every

effort to resolve the same amicably by mutual consultations.

6.22.2 In the case of a dispute or difference arising between the Tender Inviting

Authority/User Institution and a domestic Successful tenderer relating to

any matter arising out of or connected with the contract, such dispute or

difference Shall be referred to the sole arbitration of Secretary to Health,

Govt. of Kerala whose decision shall be final.

6.22.3 Venue of Arbitration: The venue of arbitration shall be the place from

where the contract has been issued, i.e., Thiruvananthapuram, India.

6.25.1 Termination for default:- The Tender Inviting Authority, without prejudice

to any other contractual rights and remedies available to it (the Tender

Inviting Authority, may, by written notice of default sent to the successful

tenderer, terminate the contract in whole or in part, if the successful

tenderer fails to perform any contractual obligation(s) within the time

period specified in the contract, or within any extension thereof granted

by the Tender Inviting Authority.

6.25.2 In the event of the Tender Inviting Authority/User Institution terminates

the contract in whole or in part, the Tender Inviting Authority may hire

services similar to those cancelled, with such terms and conditions and in

such manner as it deems fit and the successful tenderer shall be liable to

the Tender Inviting Authority for the extra expenditure, if any, incurred by

the Tender Inviting Authority for arranging such alternate arrangement.

6.25.3 Unless otherwise instructed by the Tender Inviting Authority, the

successful tenderer shall continue to perform the contract to the extent not

terminated.
