Senate Democratic Job Agenda

By U.S. Senator Robert Menendez

Democrats have been working to make our economy strong

again and have successfully passed the first piece of a robust jobs package that will improve the lives of all families. This

week the Senate passed and the President signed the final

version of the HIRE Act, which strengthens small businesses

and has the potential to create or save a million jobs this

year. In addition, after beating back a filibuster attempt last

week by a Republican Senator, the Senate cleared the way for

enactment of the American Workers Act to provide a one year

extension of unemployment insurance and health care

assistance for laid-off workers. A successful filibuster would

have been devastating to Hispanics, who like all Americans,

are struggling to keep their jobs and survive in these dire

economic times.

Assisting Hispanic-Owned Small Businesses. In

this time of economic uncertainty, it is critical we

provide much-needed tax relief for small businesses,

more than 1.6 million of which are owned by Latinos.

This funding is critical to Latino and Minority-owned

businesses, which employ 60 percent minorities on

average. The American Worker's Act provided an

extension of certain SBA loan programs and other tax

provisions that expired at the end of 2009. The HIRE

Act provides a tax holiday for businesses to encourage

hiring, as well as Section 179 expensing to help small

businesses expand. [AP, March 7, 2010]

Creating Jobs through Infrastructure Spending.

Latino workers were disproportionately hit by

unemployment because they are more likely to be in

industries like construction, which have taken a big hit

during this recession. To help unemployed Latinos,

Senate Democrats passed the HIRE Act which extends

the Highway Trust Fund allowing for billions in

infrastructure investment, which will put Latinos to work

building roads, bridges, rail lines and ports. The bill alsosaved one million jobs that were in jeopardy of being

lost.

Extending Unemployment Insurance. With our

economy having already lost more than 7.2 million jobs

since the recession began in 2007 -- including about 1.5

million jobs held by Latinos -- the need to help Latinos

get back to work has never been higher. In fact, the

Hispanic unemployment rate continues to be one of the

highest of all groups at 12.4 percent, compared to 9.7

percent for the general population. That is why Senate

Democrats defeated a filibuster attempt by a Republican

Senator and passed the American Workers Act to ensureunemployed Americans continue to receive the benefits

they need to make ends meet. [Center for American

Providing Health Coverage for Laid-Off Workers.

The American Workers Act that passed the Senate last

week provides unemployed Americans continued health

care assistance through COBRA. Given that Latinos are

more likely to go without health care because they

cannot afford it, such economic safety-net provisions

are very critical. Today, one in three or 32 percent of 

uninsured people in the U.S. are Hispanic, and Hispanic

women have an uninsured rate of over 37 percent.

Although Latino children comprise less than one-fifth of 

children in the country, they represent more than

one-third of uninsured children. [NCLR, 7/2009; NLIRH;

Kaiser Family Foundation, 7/2009; Health Care for

America Now!, 7/2009]

Senate Democrats understand that there are still major

economic issues to be addressed, and are aware that job

losses continue and unemployment remains high due to the

recession. That is why Democrats have been fighting against

Republican obstructionism to continue working on a jobs

package that will put people back to work and get our

economy on track for Hispanics and all American families.

I was saddened to hear about the passing of Jaime Escalante

today. While most of us got to know him through the movie

that depicted his work teaching inner-city students calculus,

the students whose lives he changed remain the true

testament to his life's work. Throughout his career Jaime

opened the doors of success and higher education for his

students one by one, and proved that where a person camefrom did not have to determine how far they could go. He

instilled knowledge in his students, but more importantly he

helped them find the passion and the will to fulfill their

potential. Jaime's story became famous. But he represented

countless, valiant teachers throughout our country whose

great works are known only to the young people whose lives

they change.Michelle and I offer our condolences to Jaime's

family, and to all those who knew him and whose lives he

touched.

Supreme Court Decision Protects Right toImmigration Advice

The American Immigration Council applauds yesterday's Supreme Court

decision on the right to counsel for noncitizens charged with committing

a crime. The Court held that criminal defense lawyers must advise their 

noncitizen clients about the risk of deportation if they accept a guilty

plea. The Court recognized that current immigration laws impose harsh

and mandatory deportation consequences onto criminal convictions,

and that Congress eliminated from these laws the Attorney General's

The study details through

discretionary authority to cancel removal in meritorious cases. The

Court said, "These changes to our immigration law have dramatically

raised the stakes of a noncitizen's criminal conviction. The importance

of accurate legal advice for noncitizens accused of crimes has never 

been more important."

 

The case, Padilla v. Kentucky, involved a Vietnam War veteran who has

resided lawfully in the U.S. for over 40 years. His criminal defenselawyer told him not to worry about the immigration consequences of 

pleading guilty to a crime, but that advice was wrong. In fact, the guilty

plea made Mr. Padilla subject to mandatory deportation from the United

States. The state of Kentucky said that Mr. Padilla had no right to

withdraw his plea when he learned of the deportation consequence.

Today's decision reverses the Kentucky court. It also rejected the

federal government's position (which had been adopted by several

courts) that a noncitizen is protected only from "affirmative misadvice"

and not from a lawyer's failure to provide any advice about the

immigration consequences of a plea.

"The right to counsel is at the very core of our criminal justice system.The Court affirms that immigrants should not be held accountable when

they rely on incorrect advice from their lawyers or where counsel fails to

provide any immigration advice at all," said Beth Werlin, an attorney at

the American Immigration Council's Legal Action Center. "Today's

decision also reminds us that ultimately, the increased criminalization of 

immigration law and lack of flexibility has resulted in harsh results.

Congress should do its part to restore immigration judges' discretion to

consider the particular circumstances in a person's case, thus affording

each person facing deportation an individualized and fair opportunity to

be heard."

Renteria has partnered with Smarter Comics™, a new

company owned by Franco Arda based in Silicon Valley that

creates comic books by taking popular non-fictions books,summarizing them and illustrating them into a comic. "Little

Barrio" is the biographical story in comic form of Renteria's

life that has taken him from the ghetto of East LA to being a

successful businessman and now civic leader. Round Table

the comic book with Creative Director Nathan Brown. Brown

will collaborate on the illustrations of the 50 page book with

artist Shane Clester, who has drawn for leading comic book

aggressive mission to pull people from the barrios and

ghettos by teaching them that anything is possible when one

makes the right choices. "Working with Smarter Comics™, we

have a great opportunity to play a bigger part in changing the

landscape of our youth across America. As we continue to

grow in the educational area through our curriculum From the

Barrio to the Classroom, 'Little Barrio' will play the role of a

champion for younger kids who have lived and are currently

models, too, and this comic book will be instrumental in

opening doors for them."

 

The comic book developed as a result of a presentation of the

From the Barrio to the Classroom curriculum at the Chicago

Principal and Administrators Annual Conference in February,

where Renteria, Chief Executive Officer of From the Barrio

Foundation Corey Blake, and Executive Vice President of the

Foundation Cheryl Maraffio received numerous requests for a

medium to deliver Renteria's story to younger children. "From

the Barrio to the Board Room" is suited for youth in seventh

grade and above. "Little Barrio" will be geared toward fourth-
