All of the frills, amenities, and gadgets that are so artistically illuminated on television and in magazines arefantastic, but how do you find a home that suits your needs and personality while fitting within your realm ofaffordability? It is possible, but you must be willing to have an open mind, get down to the brass tacks of yourbudget, enlist the help of friends and relatives with a little “vision,” and include shopping for “potential” in yourplan in order to make it happen.
Shop within your price range, period. Consult a REALTOR® to find homes and options which only suit yourprice range. These homes should also have the personality and potential to bear later improvements withoutlooking over-improved. This will help you to focus and be creative and keep you from the temptation of looking
outside your range of affordability.
Don’t “over-amenitize” (if buying new construction). A REALTOR® who understands new construction can help ensure thatyou stick to build packages that fit what you can afford. Always negotiate with the contractor or builder for upgrades that can beincluded within the price you are willing to pay, and don’t haggle over those which cannot. You can always make provisions duringthe build process for those upgrades at a later time.
Take another look at older, revitalized neighborhoods. These areas are usually gems with built-in security systems (your nextdoor neighbors), and they may have abandoned homes or vacant lots ready for new ownership. Most importantly, they alreadyhave their prices set from years of ownership and sales and are usually great deals for the budget-strapped buyer.
Research the Comprehensive Plan to see what is planned for the area. Good buys occur when opportunity is a couple of stepsahead of expansion.

“Potential home buyersshould be encouraged bythe positivemomentum inhome prices, permittingand employment that isincreasingly evident innot just isolated housingmarkets, but a broadeningswath of the country,”added Kurt Pfotenhauer,vice chairman of FirstAmerican Title InsuranceCompany.
The IMI is designed to track housingmarkets throughout the country that areshowing signs of improving economichealth. The index measures three setsof independent monthly data to get amark on the top improving MetropolitanStatistical Areas. The three indicators thatare analyzed are employment growth fromthe Bureau of Labor Statistics, housingprice appreciation from Freddie Macand single-family housing permit growthfrom the U.S. Census Bureau. NAHBuses the latest available data from thesesources to generate a list of improvingmarkets. A metropolitan area must seeimprovement in all three measures for atleast six consecutive months followingthose measures’ respective troughs
before being included on the improvingmarkets list.
A complete list of all 242 metropolitanareas currently on the IMI, and separatebreakouts of metros newly added toor dropped from the list in January, isavailable at www.nahb.org/imi. A state-by-state listing of metro areas on thelist is also available at: www.nahb.org/improvingmarkets.
In addition to Tallahassee, the Floridamarkets on the list are Cape Coral,Deltona, Jacksonville, Lakeland, Miami,Naples, North Port, Ocala, Orlando,Palm Bay, Panama City,Pe n s aco l a , Pun t aGorda, and Tampa.
The Tallahassee-area housing market isofficially “improving” according to the latestNational Association of Home Builders/First American Improving Markets Index(IMI), which rose for a fifth consecutivemonth to 242 housing markets around thenation in January, 2013. This is up from 201markets listed as improving in December,and includes entrants from 48 states andthe District of Columbia.
The IMI identifies metro areas that haveshown improvement from their respectivetroughs in housing permits, employmentand house prices for at least six consecutivemonths.
Including Tallahassee, a total of 47 newmetro areas were added to the list and sixwere dropped from it this month. Newlyaddedmetros include such geographicallydiverse locations as Los Angeles, Calif.;Auburn, Ala.; Des Moines, Iowa; Nashville,Tenn.; Richmond, Va.; and Cleveland, Ohio.
“We created the improving markets list inSeptember of 2011 to spotlight individualmetros where – contrary to the nationalheadlines – housing markets were onthe mend,” noted NAHB Chairman BarryRutenberg, a homebuilder fromGainesville.“Today, 242 out of 361 metros nationwideappear on that list, including representativesfrom almost every state in the country. Thestory is no longer about exceptions to therule, but about the growing breadth ofthe housing recovery even as overly strictmortgage requirements hold back the paceof improvement.”

Tallahassee Joins List of Improving Housing Markets

The Consumer Fi-nance Protection Bureauunveiled its long-antici-pated “qualified mort-gage” regulation this
past week, designed toguarantee that homeloans be given only toborrowers able to repaythem.
Under the new reg-ulation, a lender mustobtain and verify an
applicant’s financialinformation, includingemployment status, in-come, assets, debts andcredit history; the pros-pective borrower musthave enough income orassets to repay the loans,and teaser rates may nolonger hide the true costof a mortgage.
When it was first pro-
posed more than a yearago, the regulation —essentially a redefinitionthat takes effect nextJanuary— created wor-ries among lenders andthe housing industry thatit would effectively closeoff home ownership tomillions of Americansand derail the real estaterecovery.
The version an-nounced Thursday ap-pears to have addressedmany, though not all, ofthe concerns expressedby consumer groups inaddition to the industry.
“We think the rule willhelp consumers avoidbad loans,” said PamelaBanks, senior policycounsel for ConsumersUnion. “We urge (thebureau) to keep the pres-sure on to ensure allmortgages offered toconsumers are fair andappropriate.”
But Mike Calhoun,president of the Centerfor Responsible Lending,said the regulation left a“pivotal” issue unre-solved: how the fee alender pays to a mort-gage broker will becounted when it comes todefining a qualifiedmortgage.
“These fees, known asyield-spread premiums,provided incentives forbrokers to steer borrow-ers into bad mortgagesthat fueled the mortgagecrisis,” Calhoun said. Thebureau should not createa loophole that allowshigh-fee loans to count asqualified mortgages, hesaid.
Barry Rutenberg,chairman of the NationalAssociation of HomeBuilders, noting that theregulation will take ef-fect in 2014, said it wasessential that regulatorsact prudently andthoughtfully to imple-ment it in a sensible man-ner “to avoid disruptionsto the housing financesystem and ensure qual-
ified borrowers can ob-tain affordable credit.”
American BankersAssociation PresidentFrank Keating said thatwhile the regulation cod-ifies many conservativelending standards cur-rently in place, “it iscomplex and technical,presenting an additionalregulatory burden.”
The qualified-mort-gage regulation mustmesh well with othersthat the Consumer Fi-nancial Protection Bu-reau will be crafting thismonth, Keating said,because all “will trans-form our lending prac-tices and could restrictaccess to credit.”
Included in the newregulation, the bureausaid, are protections forborrowers from riskylending practices such asthe no-documentationand interest-only mort-gages that contributed tomany homeowners end-ing up in delinquencyand foreclosure after the2008 collapse of the hous-ing market.
The regulation fea-tures a cap on howmuchhousing income can gotoward debt — debt-to-income ratios less than orequal to 43 percent.
Before the crisis, thebureau said, many con-sumers took on mort-gages that raised theirdebt levels so high that itwas nearly impossiblefor them to repay themortgages, given thetotal of their financialobligations, including carloans and credit-cardbills.

Court Etiquette and Proceduresby Harry A. Heist, Attorney at Law
Most landlords or property managers will at some time in their career end up in court. Despite the best efforts to settle cases, sometimes court isinevitable and unavoidable. The case may be a simple three minute Motion to Dismiss or a complicated and convoluted eviction with a counterclaimand many witnesses. In some cases the judge will take complete control of the proceedings from the start and simply start asking questions. Somejudges closely follow the rules of civil procedure, and court is conducted in a very formal fashion. Some judges do not even hold open court andprefer to deal with the cases in their chambers where the parties all sit around a large conference table. In all cases, the judge is in charge andmust beafforded absolute respect. Even if the judge seems relaxed, joking and casual, the parties should remember that the judge will be making a decision,and all court is a serious matter. Sometime court is like what you may see on the daytime court shows, but most of the time, it is NOT like Judge Judyor the People’s Court. Someone may leave that courtroom very unhappy.Who must go to courtThe parties and witnesses who should or must come to court will depend upon the type of case. In an eviction action for nonpayment of rent, theperson who is most familiar with the rent records and receipts will need to be in court. This is usually just the property manager or the landlord, butit can get far more complicated if the tenant brings up a defense that he did not receive a Three Day Notice, or that he had made an agreement withyour leasing agent, assistant or someone else employed by your company. If other people are involved or had contact with the tenant, bring themto court. You can never have too many witnesses with you in court, but failing to bring a necessary witness can doom a case. In a security depositdispute case, you may have to being in vendors, experts, people who did the work on a unit and all your physical evidence and documentation. Yourattorney will tell you who must come to court, what you need, and witnesses may be subpoenaed to try to make sure they actually come to court.Arriving to courtWe strongly urge you to carefully map out the courthouse and get good directions if you are not familiar with the court location. Many countieshave built new or additional courthouses, and it is quite possible that you are assuming you are going to the same courthouse that was there 5years ago when you last had court. Once you get directions, ARRIVE EARLY. We almost always arrive 30 minutes before court. Many courthouseshave severe parking problems and tight security which could result in you being late. Some small courthouses have one x-ray machine and metaldetector; others have high tech systems that surpass airport security. You don’t want to accidentally go to the wrong courthouse that is a 35 minutedrive from the correct one.What to bring and NOT to bringYour attorney will tell you exactly what to bring to court. Most likely it will be the tenant’s actual file if it is a nonpayment of rent case and copies ofthe lease and notices. You should organize the file so you can easily take out original documents in the event the judge wants to see something inyour file, or if there is a dispute about the authenticity of a copy. There are certain things you should leave at home. Knives, guns, mace, pepperspray and other prohibited items have been brought to court by our clients. They were in a pocket book (or sock) and forgotten. Clear out anythingfrom your pockets, purse or pocketbook before you leave for court and imagine you will be going through an airport screening checkpoint. Leaveyour switchblade and 9MM at home.What to WearDon’t wear shorts! Even if shorts are part of your work uniform, they should NEVER be worn in court. Females can sometimes get away with it,but why take a chance? Some judges are so strict about this that the bailiff, a sheriff’s deputy, will make you leave the courtroom if you dare towear shorts. Dress respectfully. A jacket and tie is not necessary unless you are the attorney, but a well dressed client is nice to have by our side.PreparationMany of our clients expect that we will testify for them and do all the talking. While that would be nice and easy, and we try to keep you from havingto say too much, our client usually must testify. You will need to know the date you gave the Three Day Notice, how it was delivered, who served it,how much rent was on the Three Day Notice, what the amount on the Three Day Notice represents, when the lease was entered into, when it expiresor expired, when you last accepted rent, how much is the total amount owed and just about any other fact regarding the case. If you come across asconfused or uncertain, the judge may get angry FAST. You need to prepare before court. Your attorney can be 100% prepared, but if you don’t knowthe facts of your case, the judge may be unsympathetic or even angry at you. Don’t give the judge an excuse to let the tenant win a case or continueor delay the case to a later date. Your attorney will most likely have a sheet with all the information on it in one place. You should do this as well andcreate your own “cheat sheet” you can look at rather than fumbling through the file. No matter how organized you are, when the judge starts talking,everyone will get nervous, and the most organized person might instantly become disorganized.
Addressing the CourtOne of the first things that will happen at the start of the case will be for the judge to ask all parties who will testify to raise their right hand and “swearto tell the truth, the whole truth and nothing but the truth”. Raise your right hand and clearly say “I will” or whatever the judge asks you to say. There isno need to shout this, but failure to say it loud enough for the judge to hear will sometimes anger the judge. You and any witnesses who might testifyneed to do this, even if you are not sure you will be called as a witness. The judge will often not know whether you are the tenant or the landlord, sowhen asked your name, clearly state “Mary Smith – manager of Mountain View Apartments”. Whenever you speak to the judge, refer to him or her as“your honor”: “Yes, your honor”, “No, your honor”, “I do not know, your honor”. Practice this a bit before you go to court.Behavior during the proceedingSpeak only when you are asked to speak. Even if the tenant says something completely bizarre or tells an outright lie, you must stay quiet, not rollyour eyes, laugh, shake your head or act out in any way. There is a strong tendency to want to respond when someone is lying about you or sayingsomething utterly outrageous. Don’t do it. You or your attorney will address the issue. While the tenant may be lying, never call the tenant a liar. Yourattorney will do that for you in the “attorney sort of way”.Cell phonesDo you want your phone confiscated by the bailiff or really annoy the judge? Then leave your phone on. Despite verbal requests and signs in thecourtroom to put the phones on “vibrate” or “silent”, they end up going off and disturbing the judge. Younever know for sure, but usually your attorney will know how a judge generally will proceed and will prepare you accordingly. After your attorney givesan opening statement, you will usually be the first witness, and your attorney will ask you things like your name, where you are employed and if youare familiar with the rent records and receipts. Short and clear answers are all you need to give. Let your attorney direct the questioning. Speak loudlyenough so the judge can hear you. Never annoy the judge.Cross-examinationJust as your attorney can take testimony from the tenant and cross-examine the tenant, the tenant can cross-examine you. The tenant may questionyou on something you said in response to your attorney’s question to you. This is where a hearing or trial can get completely out of control. This isnot time for a conversation or argument with the tenant. Just answer the tenant’s questions, and if the question is improper, you can pause and yourattorney will object. The judge will then direct you to either answer or ignore the question.Post-Ruling BehaviorIf you win the case, which is frequently the case in eviction actions, do not smile and thank the judge. Just put away your papers and follow yourattorney out the door. The tenant may be angry and make a scene; ignore it all. Your attorney will simply say, “Thank you for your time, your honor“and walk out the door. The judge is not “happy” the tenant is being evicted, although you may be, and the judge does not need you to thank him orher for evicting the tenant. Try to allow the tenant to walk ahead of you, so you do not end up in the elevator with the tenant you just evicted, or end upin an altercation outside of the courtroom. If the Judge gives an adverse ruling, do not argue with the Judge or in any way show disdain for the ruling.Failing to show up for courtAs hard as this may be to believe, sometimes our clients decide not to show up for court. Something comes up at the last minute or for somereason our client decides it is not necessary to come to court. A lesser issue is when our client decides to send someone else in his or her placethat has little to no knowledge about the case. Is this fatal? It sure can be. We often are able to use the tenant’s testimony to win the case, but if thetenant‘s testimony is adverse on a key factual issue, there is often no way for the attorney to refute the tenant’s distortions or lies. If you have a realemergency, call your attorney immediately, and often the case can be re-set. Always take court seriously. A judge can dismiss a case or worse yet,find for the tenant if you do not show up. If the tenant has an attorney, you may and most likely will be liable for the tenant’s attorney’s fees if you lose.CommunicationIt is always advisable for the attorney to have your cell number and for you to have your attorney’s cell number in case there is some reason you willbe late to court. Communication is the key, and the judge will usually be willing to hold the case off or take other cases before you in the event youare having a problem getting to the courthouse.

CallawayGardens, freshoff a frantic year in which itsold 7,000 of its 13,000 acresand reduced the resort’s debtdramatically, is now turningits attention to improving theguest experience.
The tourist destination inPineMountain, Ga., just northof Columbus inHarris Coun-ty, said Friday it has launcheda $2million renovation ofMountain Creek Inn off U.S.Highway 27.
“This is where we thinkweget the biggest improvementin the brand for the dollarspent. It changes a negativeguest experience to a positiveonemore profoundly thananything else we could do,”said Edward Callaway, chair-man and chief executive offi-cer of the resort and grand-son of the 60-year-old resort’sfounders, Cason J. and Vir-ginia Hand Callaway.
The process of “replow-ing”money back into the274-roomMountain Creek Inn– which dates to 1956 and hasseen several renovationsthrough the years – actuallybegan in July.
“We did two rooms to seewhat it would cost and looklike, and thenwe tweaked it,”Edward Callaway said. “Thenwe did 30 rooms that openedonNov. 15 in time for Fantasyin Lights. We did notmarketthese rooms, but people foundout about it and they startedrequesting them. Peopleloved them.”
The enthusiastic feedbacktriggered the full-scale reno-vation of the inn, which istaking place now andwillcontinue into the spring.Some rooms remain open forpreviously scheduled guests,whilemost of the projectshould be completed by April,Callaway said, with work in acouple of common areas pos-sibly being delayed until an-
other guest lull in August.The room interiors are
being stripped to the barewalls and floors, he said, withnew beds being installed. Theinn’s lobby, restaurant, ball-room and pool also are part ofthe project.
The end result should payoff, Callaway said, withgroups who had venturedelsewhere for lodging as thehotel showed signs of agereturning toMountain Creekduring visits to the gardens.
“The inn is themost power-ful cashmargin generator inthe resort. It’s the heart. Itmademoney before. Theproblem is the roomswereold and tired,” he said.
Mountain Creek Innmadeits debut in1956 with 50rooms dubbed “GardensView.” Additions through theyears boosted that to 274rooms. The hotel actuallycarried theHoliday Inn logofrom1962 through1977, al-though the gardens itselfmanaged the property.
Themajor upgrade followsa year in which CallawayGardens had a 4-percent in-crease in annual attendance,with 383,964 people visitingthe home of Robin BeachLake, the Cecil B. Day Butter-fly Center and the John SibleyHorticultural Center. That’sup from 368,964 visitors in2011.
The 6,000-acre naturepreserve, which is wellknown for its colorful burst ofazaleas each spring, also hasgolf courses and paved trails.The holiday-themed “Fantasyin Lights” attraction wasadded 20 years ago and hasproven popular, with ticketsales jumping 20 percent thispast season, Callaway said.
He also believesmakingNational Geographic Travelermagazines’s list of “Top10Places to SeeHoliday Lightsin theWorld” had an impact,as didmentions by CNN andYahoo Travel.
