A. Background

In response to the community wide need for affordable housing in Lane County, Homes for

Good Housing Agency has greatly increased its capacity to build and preserve affordable

housing. Meeting this demand includes numerous complex real estate transactions with

numerous financing sources. It requires development and finance to work closely together to

manage the cash flow in and out of the Agency. This presentation is intended to give the

Board a good basis to understand those needs.

Disposition ConsiderationsExample: 48th and Main Street• Infrastructure – At least 2 of the three local streets which provide

access to the property from the east would need to be improved to City standards through the property which would add significant costs to the project.

• Location – The property is located on Main Street with no nearby access to a grocery store or social services. These factors make pursuing tax credit financing difficult as location is a large part of the application scoring.

• Environmental Hazards – A mill is located just to the north of the property. An Environmental Assessment was conducted for the property just to the east of this property. During that assessment it was discovered that that Mill has materials on-site that could potentially create a blast zone onto this property. This would require mitigation such as limiting outdoor use areas on the site that would add expense and detract from the livability of the site.

 Homes for Good has numerous new construction and preservation affordable housing projects in our pipeline that will need the proceeds from the sale of this property in order to fund these other projects. We will need the proceeds from these sales and support from numerous funding sources (including the local jurisdictions) in order to secure the necessary support to serve the people with low incomes that currently occupy our apartment communities and the people with low incomes who need an affordable home.

and Greenway Application required. Long and very expensive process with likelihood of appeal making outcome and timing of development risky and uncertain.

• Flood Zone - A portion of the property is located within the FEMA 100 year flood zone. HUD discourages developing affordable housing in the flood zone and requires a long and expensive process (which includes looking at viable alternatives) prior to allowing development on such sites.

• Infrastructure –Lombard Street improvement as well as infrastructure to site adds significant cost.

• Location – Does not have nearby access to a grocery store or social services. Does not score well in competitive tax credit process which is primary source of funding.

Commissioners thank the neighbors of the Lombard neighborhood for speaking to the board and voicing their concerns and ideas. Board members identify the difficulties with finding the space for all types of housing in Lane County in relation to the limitations of the current urban growth boundaries. It is difficult to balance both the needs of those seeking housing and the needs of the communities where housing is being constructed. The board will continue to discuss the River Road sale and the concerns the neighbors have raised.

B. Executive Director Report (estimated time 15 minutes)

Jacob Fox reviews the previous month’s activities which include a visit from Housing

Directors from Australia who came to speak in Lane County regarding their approach to

public housing. Homes for Good staff also attended the ground breaking for the new

retail and hotel development on 5th and Oak. Due to the recent snow storm, Homes for

Good is working on improving its emergency preparedness plans.

C. Presentation/2018 Financial Statement Audit Entrance Conference (Jeff Bridgens,

Finance Director) (Jim Lanzarotta, National Practice Leader) (Kevin Mullerleile, Sr.

Manager Moss Adams)

Jim Lanzarotta: Discusses the audit process for 2018. PowerPoint available in the

board packet on the Homes for Good website. Introduces Moss Adams staff that will be

working on the Homes for Good audit. Describes auditing standards that need to be

followed. There are additional requirements for HUD funds. Moss Adams will discuss any

findings in the exit meeting once the audit is complete. With governmental entities in

Oregon, there will be compliance testing and issuance of a report on those areas.

Kevin Mullerleile: Auditing reports are subject to GAAP. There are 3 federally funded

programs to test this year. We will test internal controls and discuss significant audit

areas. Notes receivable is where the most time is often spent. Homes for Good is in a

good spot.

Jay Bozievich: Is there an opportunity to research Homes for Good’s reinvestment of

real property investments to verify any sale of real property is invested into affordable

housing projects.

Jim: We certainly can. There are sometimes barriers on what certain property sales can

be reinvested in but we can document how those funds for the sale of real property can

and are being used.

Michelle Thurston: Do you anticipate any differences in the audit from last year to this

year?

Jim: Audit standards change. We don’t go in with preconceived ideas. If there is are

areas of concern, you can also reach out to us to look into a certain area.

Kevin: The audit will begin in 2 weeks. It will be a 3-month process. The audit is due

June 30th. We would like to get it in before that deadline. We will then meet with this

group and go with the results.

Jim: There will be several accounting standards coming that the Homes for Good staff

will need to be educated on such as Fiduciary Standards. There is not a lot new on the

auditing front. There are some new auditing standards for fiscal distress. It is important

to go through that evaluation.

Pat Farr: Are there controls in place to anticipate stresses?

Jim: There is more work being done to identify areas of stresses in an organization.

Jacob Fox: There is an unprecedented amount of units Homes for Good will be adding

to the community and that the board will be made aware of.

D. Order/19-27-03-01H – In the Matter of Documenting the Executive Director’s Annual

Performance Evaluation and Instructing Human Resources Regarding Revision of the

Employment Agreement (Ela Kubok, Communications Director)

Ela Kubok: The HR director has solicited input regarding Jacob Fox’s job performance

from board members, staff, community partners, and additional boards. 50 people were

surveyed for the report. Outlined the characteristics of the survey and its categories. Ela

reads comments from partners regarding Jacob’s performance.

Michelle: What percentage of people responded to the survey?

Ela: Around 50% of those surveyed

Pat Farr: I appreciate the MLK supportive housing project that Jacob is heading as well

as Jacob’s leadership in coordinating the financing of this project. It will be supportive

housing for the most vulnerable population in the county. This project would not have

been able to move forward without Jacob.

Michelle Thurston: After 20 years in public housing, I have experienced a lot over the

years. When Jacob came aboard, there was more of a shift in the relationship with the

community Homes for Good serves. Jacob has made a positive change in the

organization and the residents appreciate the shift.

Heather Buch: I am impressed with the work Jacob has done during everything he

must deal with.

Jay Bozievich: I appreciate the attention to detail to our housing assets and

improvement. It is very important to the function to the agency.

Housing Agency to MD Commons LLC (Steve Ochs, Development Director) (estimated

Steve Ochs: One of the issues that has come up in due diligence is that Wells Fargo is

requesting Homes for Good to provide a portion of the funds.

Jacob Fox: We have been working with Wells Fargo to not have them require us to put

as much funds forward. All these monies will come back to us.

Steve: Wells Fargo wants to maintain a good relationship with us and vice versa. There

are 15-units for homeless veterans and those with disabilities and units with PBVs.

Michelle Thurston: Could you explain the how you will fill those 15-units?

Steve: We are partnering with area organizations to fill those 15-units being set aside.

I’m excited to report that we have started working with LaneCounty on our communities next Permanent SupportiveHousing project. We are in the early concept phase and weknow that the Oregon Housing and Community ServicesDepartment (OHCS) is gearing up to release a Letter ofInterest solicitation early this Summer so it is time to get moreserious and concrete about the planning effort. Our earlythinking is that this project would be focused on women whoare at risk of losing their children or in the process of reunitingwith their children. It is likely that we would also partner withthe local office of the Oregon Department of Human Services. During the week of March 18th the OHCS monitored ourWeatherization Division. On March 22nd, I attended the exitinterview where the monitor conveyed that overall Steve Joleand his team are doing a great job of complying with federaland state regulations. The one area that we need to improveis the quality control related to final inspections of jobsperformed by contractors working for Homes for Good. Inparticular, we had one project where we installed ductlessheat pump at a multi-family apartment community that weown, where there were a number of items where thecontractor didn’t comply with all of our requirements and wedidn’t catch these issues in our final inspection. We will behaving the contractor come back and fix the issues, and wewill redouble our efforts to ensure that our staff are meetingexpectations related to final inspections. We expect the finalmonitoring report in May, and we’ll make any operationaladjustments necessary to continue to be considered a highperformer per OHCS expectations/regulations.

EXECUTIVE DIRECTOR REPORTA P R I L 2 0 1 9

Another organizational improvement effort is relatedto implementing our new/updated ProcurementPolicies. In 2018 our legal team helped us review andupdate our Procurement Policies with a number ofnew regulations and guidelines that need to beintegrated into our policies. Our legal team alsoreviewed all of the existing policies at the same time. The policies are full of complex regulations anddecisions trees depending on the project and thesource of funding, and we are now in the process ofdeveloping summaries and training materials so thatstaff from all levels of our organization can secure thegoods and contracts they need in an efficient manner.We have a temporary employee, Wesley Lucas, onboard who is working with me and the entire Homesfor Good team to develop the summaries, training,quality control, and compliance componentsnecessary to manage the complex procurementneeds of our organization.

I MOTION It is moved that the Executive Director or Real Estate Development Director is authorized to apply for Renewable Energy Development Grant funding from the Oregon Department of Energy for the new Admin Building.

II ISSUE

Homes for Good Housing Agency intends to renovate the new Admin Building. As a government agency, we must comply with the solar energy technology requirements of ORS 279C.527. This means we need to include the installation of a solar PV system costing up to $100,000 as part of the renovation project.

III DISCUSSION

A. Background/Analysis

In October 2017, Homes for Good purchased the property located at 100 W 13th Avenue in Eugene, Oregon to be used as the agency’s new administrative building. The agency plans to consolidate both the Day Island and Fairview offices into this one facility. The building was constructed in 1959 as the Eugene public library and contains approximately 38,000 gross square feet over 3 levels.

Homes for Good has engaged with PIVOT Architecture and Chambers Construction to develop a plan for renovating the new administrative building. As a government agency, we must comply with the solar energy technology requirements of ORS 279C.527. This means we need to include the installation of a solar PV system costing 1.5% of the total project cost. This equates to a system costing up to $100,000, which will be part of the renovation project.

The Oregon Department of Energy Renewable Energy Development Grant Application is seen as an opportunity to bring grant funding to the project to help pay for the solar PV system.

A. Background

On March 14, 2019, the Department of Housing and Urban Development (HUD) sent out a notice

inviting Public Housing Authorities (PHAs) to show their interest in the Moving to Work Demonstration

Program (MTW). Homes for Good appears to meet the eligibility criteria for participation and plans to

submit a letter of interest.

We are interested in a version of MTW that would simplify our rent calculation process by establishing

income-based tiered rents. Participation in the tiered rent program would also allow us to access other

benefits of the wider MTW program.

Submitting a letter of interest will not obligate the agency to apply or to participate. The deadline for

the letter is June 12, 2019.

What is Moving to Work?

Moving to Work is a HUD program established in 1996 and expanded in 2016. The goals for the

program are to:

• reduce cost and achieve greater cost effectiveness in federal expenditures;

• give incentives to families with children where the head of household is working; is seeking

work; or is preparing for work by participating in job training, educational programs, or

programs that assist people to obtain employment and become economically self-sufficient; and

• increase housing choices for eligible low-income families.

MTW provides PHAs with waivers from some statutes and HUD regulations, allowing more flexibility

in operations and management. The main benefit of MTW is the ability to use funds in a more

flexible way, increasing the agency’s ability to adapt and respond to market needs.

The agency would also be eligible for other waivers including; providing incentives to landlords;

expanding & streamlining opportunities for use of Project-Based Vouchers; and expanding resident

services to better serve agency owned housing other than public housing.

What is Tiered Rent?

The current phase of the MTW expansion is focused on Rent Reform. Of the available methods of

rent reform, the one that Homes for Good is interested in would establish Tiered Rents. These

tiered rents would only apply to households in Public Housing and the Housing Choice Voucher

programs – and all elderly or disabled households would not be subject to the tiered rent system.

Under the current rent structure, residents of public housing and voucher units pay 30% of their

adjusted income toward rent - adjusted income includes various deductions. During the study

period, residents would be randomly assigned to the current or the new rent structure.

Under a tiered rent structure, eligible residents of public housing and voucher units would be

assigned to a rent tier as in the table below. The assignment would continue to be based on the

family’s adjusted income. Rents would not change between recertifications except due to hardship

or if a family with a voucher moved to a different unit.

Income tiers would continue in $2,500 increments up to the area median income, with tiered rents

set at 30% of the mid-point of each income tier.

From an administrative perspective, the biggest difference from the current rent structure is that

households would only need to recertify their income every three years and would keep the same

rent for those three years. We anticipate that this would allow the agency to operate more

efficiently, and free up resources to increase quality and services to residents of our programs.

From a tenant perspective, there would be less need to report to Homes for Good. Households that

gain income between recertifications would pay less rent than under the current system. Families

that lose income or increase certain expenses between recertifications would be eligible for

“hardship,” and could have their incomes re-certified early to move into a lower rent tier.

What is the application process?

March 14, 2019: HUD publishes notice.

June 12, 2019: Deadline for Letter of Interest package

• Submission of the Letter of Interest requires a resolution of the Board of Commissioners.

• Homes for Good is preparing a letter of interest package. Submitting a letter of interest

means that if HUD determines we are eligible, we will be invited to apply.

• Homes for Good is currently in the early stages of studying the potential impact of

participating in Moving to work, including potential IT costs.

Summer 2019: HUD invites eligible PHAs to complete the full Application for MTW

Fall 2019: Deadline for full Application package.

• Applying does not force us to participate in MTW.

Spring 2020: HUD selects PHAs, and starts the process leading to formal participation.

• The flexibilities and requirements of MTW will not take effect until Homes for Good and

HUD execute and implement an amendment to the Annual Contributions Contract.
