Exhaust System changes submitted by TJD Engineering Associates, Inc.

A. General: This Addendum Number 1 modifies and supplements the requirements of the Drawings and Specifications (Contract Documents) for the Highland Park Housing Authority Samuel Kronman Apts. Bathroom Exhaust Modifications Project. The drawings that are modified are dated February 14, 2018. The Specifications that are modified and supplemented are dated for delivery of bids on March 9, 2018.

B. Drawings: The following changes will apply to the referenced drawings:

a. Drawing M101 Mechanical Floor Plans:

i. Added Note Number 13. b. Refer to the revised bid form to add unit pricing for 1-hour dampers.

GENERAL CONDITIONS

PART 1 PROJECT REQUIREMENTS

1.01 GENERAL

A. Work under this division includes the furnishing of all labor, materials,

equipment, and all incidental items necessary or reasonably implied for the

completion of the Work in accordance with the Specifications.

B. Before submitting a Proposal, the Contractor shall carefully examine the

Specifications, visit the site of the Work; and become thoroughly familiar with

all existing conditions and limitations. The submission of a Proposal will be construed as evidence that such an examination has been made, and later

claims for labor, equipment, or materials required or for difficulties

encountered which could have been foreseen had such an examination been made, will not be recognized.

C. The Contractor shall note the limits of the space within which all activities

must be confined. Space for storage of materials is available only as approved

by the Housing Authority.

1.02 INDEMNIFICATION

A. The Contractor shall indemnify and save harmless the Owner, and its respective agents, officers, employees and Architect/Engineer (A/E), herein collectively called the

"indemnities", from and against any and all liability, loss, damages, interest, judgments

and liens growing out of, and any and all costs and expenses (including, but not limited

to, counsel fees and disbursements) arising out of, or incurred in connection with, any and all claims, demands, suits, actions, or proceedings which may be made or brought

against any of the indemnities for or in relation to any violation of this Contract, the

laws, statutes, ordinances, rules, regulations, executive orders and agreements herein provided here or any injuries, including death at any time resulting there-from,

sustained by any person or persons, or on account of any damage to property, arising

out of or in consequence of the performance of or the failure to perform the contract, whether or not such injuries to persons or damage to property are due or claimed to be

due to any negligence of the Contractor or its employees, agents, subcontractors or

material-men, the indemnities or any other person.

1.03 WARRANTIES

A. The Contractor shall correct defective work at the Contractor's expense which appears within one year's time from final acceptance of work. Failure of Contractor to correct

such defects within a reasonable time after being notified to do so shall permit the

Owner to cause such defects to be corrected and charge the Contractor the cost of corrections.

B. The Contractor shall submit to the Housing Authority all material warranties supplied

by manufacturers.

1.04 GENERAL QUALITY ASSURANCE

A. References and Standards: The Contractor shall comply with all rules, regulations,

laws and ordinances of all Authorities having jurisdiction. All labor, materials,

equipment, and services necessary to make the work comply with such requirements shall be provided without additional cost. All Standards shall be the latest edition and

revisions.

B. The Contractor shall deliver material to the site, in the approved Manufacturer's original and unopened containers and packaging, bearing labels as to type of material,

brand name and manufacturer's name. Delivered materials shall be identical to

approved samples. Certifications for materials shall be included with the shipment.

C. The Contractor shall store material under cover (if appropriate) in a clean, dry, above-

ground location, and remove materials which are damaged or otherwise not suitable for

installation from the job site and replace with acceptable materials.

1.05 SECURITY

A. Protect work, existing premises Housing Authority’s operations from theft, vandalism,

and unauthorized entry.

B. Initiate and maintain security program throughout construction period until Housing

Authority’s acceptance precludes the need for Contractor security.

C. Restrict entrance of persons and vehicles into project site and existing facilities. Allow entrance only to authorized persons with proper identification. Maintain log of

workers and visitors, make available to Housing Authority on request.

1.06 SAFETY PROVISIONS:

A. Site safety is entirely the responsibility of the Contractor. The Contractor is hereby

made aware that the A/E does not have the authority to stop the work on the grounds of

unsafe work practices.

1.07 SUBMITTALS:

A. The Contractor shall submit to the A/E sufficient documentation from the manufacturers that all material and products used by the Contractor meet the required

specifications. Such documentation shall be submitted no less than 72 hours prior to

the delivery of the material.

This documentation shall include shop drawings, vendor drawings, manufacturer's

specifications and catalog cuts. The shop drawings shall include plans, elevations,

sections and details of the work showing in detail the methods of installations and all data and assumptions considered in the design.

B. The A/E will review and approve appropriate documentation for general compliance to the specifications prior to delivery. The A/E’s review will be made on a timely basis.

C. The approval of the A/E or failure to review shall not be constructed as permitting any departure from Contract requirements, or as relieving the Contractor of responsibility

for any errors, including details, dimensions or materials. If submittals show variations

from Contract requirements, the A/E may approve such variations, subject to a proper

adjustment in the Contract. If the Contractor fails to describe such variations, he shall not be relieved of the responsibility for executing work in accordance with the Contract

documents even though such submittals identifying other variations have been

approved.

D. All submittals required by specifications shall be submitted, unless otherwise stated

herein, as follows:

1. Specifications - Four copies of material specifications will be submitted to the

A/E unless agreed that less copies will be sufficient.

2. Shop Drawings - A reproducible and three copies will be submitted to the A/E.

E. The work shall not begin until all required submittals for each segment of work have been approved.

1.08 PROJECT COORDINATION

A. Cooperate with the Housing Authority in allocation of mobilization areas of site; for

field offices and storage, for access, traffic, and parking facilities.

B. Comply with A/E’s procedures for intra-project communications; submittals, reports

and records, schedules, coordination drawings, and recommendations; and resolution

of ambiguities and conflicts.

C. Comply with instructions of the Housing Authority for use of temporary utilities and

construction facilities.

D. Coordinate field engineering and layout work per the Documents.

E. Submit preliminary progress schedule and coordinate with project construction schedule.

F. Provide information required by A/E for preparation of coordination drawings.

1.09 PROGRESS SCHEDULE

A. Prepare project schedule using the critical path method. Use a sequence of listings corresponding to the Table of Contents of this Project Manual or the chronological

order of the start of each item of work.

B. Progress schedule to have a minimum 22 x 17 inches sheet size.

C. Progress schedule shall indicate the following:

1. Show complete sequence of construction by activity, with dates for beginning

and completion of each element of construction.

2. Identify each item by specification section number.

3. Identify work of separate stages and other logically grouped activities.

4. Provide sub-schedule to define critical portions of the entire schedule.

5. Show accumulated percentage of completion of each item, and total percentage of work completed, as of the first day of each month.

1.10 PERMIT APPLICATIONS AND COMPLIANCE

A. The Contractor is responsible for obtaining permits as well as all other outstanding

permits (such as local construction, plumbing, electrical, etc) relating to the full completion of the project at his/her own expense.

B. The Contractor shall carefully plan and coordinate his/her work so as to comply with

all criteria, conditions and the intent of all project permits.

1.11 ENVIRONMENTAL PROTECTION

A. It is the Contractor's responsibility to assure themselves that all applicable Federal,

State and local laws, concerning pollution and environmental protection are being

complied with by his personnel and subcontractors.

B. When Contractor is in, or it is anticipated that any part of the work may become in

non-compliance with applicable Federal, State, and local laws or regulations, A/E will

notify the Housing Authority who may issue an order stopping all or part of the work until satisfactory corrective actions have been taken, or may order supplemental

actions to be taken to stay in, or come into, compliance. No part of the time lost due to

any such stop order shall be made subject of a claim for extensions of time, or for extra compensation or damages by the Contractor.

C. In particular, the Contractor shall not allow the discharge of concrete, mortar, grout, gasoline, diesel, or the washing from vessels containing these materials, or other

construction materials, into public areas or the sewage systems.

D. Contractor shall provide and maintain all facilities necessary for pollution control under this Contract as long as construction operations continue.

1.12 CONTRACTOR'S REPRESENTATIVES

A. The Contractor shall provide and maintain a capable and experienced field person to

oversee all contract operations. The representative shall be on-site during all operating hours of the project.

B. As appropriate, the Contractor or his subcontractors shall provide qualified supervisory

personnel for specialist aspects of the work, such as for electrical, concrete, landscaping, and rigging.

1.13 JOB OFFICE

A. The Contractor may provide and maintain a suitable job office for the use of his

supervising personnel at a location approved by the Housing Authority.

If used, the offices shall be equipped with telephones listed in the Contractor's name

and other appropriate facilities. If used, the cost for maintaining and servicing the

office facilities shall be paid for by the Contractor for the duration of the project.

B. The Contractor shall provide and maintain in a neat and sanitary condition such

temporary sanitary conveniences and accommodations for the use of their employees as may be necessary to comply with the requirements and regulations of the

Department of Health and other governing agencies having legal jurisdiction.

1.14 SITE ACCESS

A. No unauthorized personnel shall be permitted access to the site area. The Contractor’s

access to the building will be per arrangement with Housing Authority.

B. Parking for construction vehicles shall be designated by the Housing Authority. All

other parking, un-loading, etc is the responsibility of the Contractor, without further cost to the project. Traffic, other than construction traffic necessary to accomplish the

work, shall be limited to areas outside of the site.

C. Off-site roadways which are soiled by construction traffic shall be immediately swept clean of spoil/debris.

1.15 EXISTING UTILITIES AND STRUCTURES

A. Verify Locations: Locations of existing underground utilities and structures as shown

on the Plans are approximate and may not necessarily be complete. These locations

must be verified by the Contractor.

B. Avoid Damage: The Contractor shall exercise care to avoid damage to all existing

structures, poles, utilities, pipes, etc. which are scheduled to remain. In locations

where the excavation is carried beneath or adjacent to such facilities, the Contractor shall adequately support such structures, utilities or pipes as necessary to maintain

them in operation and their original position. The Contractor shall be responsible for

any damage caused to any utilities by this work, without charge to the Owner.

1.16 MAINTENANCE OF RECORD DOCUMENTS AND SAMPLES

A. Contractor shall maintain at the site one record copy which will be kept available for

review by the A/E and Housing Authority of:

1. Design Drawings 2. Technical Specifications

3. Addenda and Modifications to Drawings and Specifications

4. Progress Schedule and Critical Path Diagram 5. Change Orders and other modifications to the Contract

B. The Contractor shall also maintain on-site copy of other documents: manufacturer's

certifications, inspection certifications, field test records required by individual Specification Sections.

C. Record Documents are to be kept in a clean, dry, and legible conditions, and are not to be used for construction purposes.

1.17 TEMPORARY ELECTRIC POWER (At contractor’s option)

A. The Contractor may use portable generator(s) to provide temporary power.

B. Contractor may install a temporary electrical service at locations approved by the Housing Authority and PSE&G, as appropriate. Temporary light and power

installations, wiring, and miscellaneous electrical hardware must meet the National

Electric Code.

C. The Contractor shall provide and pay for all maintenance, servicing, operation and

supervision of the service and distribution facilities. He shall also connect, maintain, and service any electrical equipment installed which may be necessary for maintaining

heat whenever heat is required in the job office whether from the temporary or

permanent system.

1.18 CONSTRUCTION WATER CONTROL

A. The Contractor shall dispose of all water with due care and shall not infringe on the right of others on the site, of adjacent property owners and of the public. All cost in

connection with the removal of such water shall be paid by the Contractor.

1.19 FIRE PREVENTION CONTROL

A. Comply with the safety provisions of the National Fire Protection Association’s

“National Fire Codes” pertaining to the work and, particularly, in connection with any cutting or welding performed as part of the work.

1.20 DEBRIS & RUBBISH REMOVAL

A. The Contractor shall:

1. Keep the work area free from rubbish at all times.

2. Remove rubbish from the site at least once a week.

B. The Contractor shall conform with the following:

1. Burning of rubbish shall not be permitted.

2. Remove from the site all surplus materials as the work progresses.

C. All materials, fixtures and equipment, etc, removed in the process of the work shall become the property of the City, with the exceptions that Housing Authority may

direct that certain elements may be stockpiled onsite to be retained for its ownership

and re-use.

1.21 AS-BUILT DOCUMENTS

A. As-built documents are required for all proposed improvements outlined in the

drawings.

B. The Contractor shall provide and maintain, at his own expense, one set of black and white prints of the Contract Drawings on the Site. The Contractor shall maintain an

up-to-date record on these prints showing all demolished, relocated and/or installed

utilities or related facilities as the work progresses. Such recording of the installation shall include final and actual sizes as well as location and elevation thereof by figures

and off-set distances in feet and inches to permanent surface improvements such as

buildings, retaining walls or curbs. Upon completion of the work, the information on these drawings shall be incorporated into a set of As-Built Drawings prepared by the

Contractor. The number, titles, and scales of these As-Built Drawings shall equal the

Contract Drawings. These As-Built Drawings shall be accurate reductions of the

existing conditions in the scale indicated in the Contract Drawings.

C. The Contractor shall include the following on the final hard copy As-Built Drawings:

- Company names, address, and telephone number, project title, contract number and drawing date.

- The words "As-Built".

- The statement, "I hereby certify that this As-Built Drawing is correct, complete, and accurate."

- Contractor's signature.

D. The As-Built Drawings and Autocad diskette must be submitted to the A/E within ten (10) days of the issuance of the Certificate of Substantial Completion for verification

by the Housing Authority. Acceptance of the As-Built Drawings is subject to

verification. (Percentage of retention monies will be withheld pending receipt and approval of the As-Built Drawings.)

1.22 PROJECT CLOSEOUT

A. Notify A/E when work is considered ready for substantial completion. Accompany

A/E on preliminary inspection to determine items to be listed for completion or

correction in Contractor's Notice of Substantial Completion and punchlist.

B. Notify A/E when work is considered finally complete. Accompany A/E on final

inspection.

C. Comply with A/E's instructions to correct items of work listed in punchlist and A/E's

final inspection..

D. Remove all temporary facilities, temporary erosion and sediment controls, and all

construction waste, for legal disposal in an off-site location.

E. Leave site in a tidy, orderly condition.

PART 2 MATERIALS

2.01 GENERAL

A. Use materials appropriate to the work, and meeting with the Housing Authority’s and

/or A/E's approval.

PART 3 EXECUTION

3.01 GENERAL

A. Execute general measures as appropriate, and meeting with the Housing Authority’s

On 2/23/18 a meeting took place at 242 South 6th Avenue Highland Park, New Jersey to

discuss the Samuel Kronman Apartments Bathroom Exhaust Modifications Project. The

following is a list of the key issues and decisions that transpired at this meeting.

NEW BUSINESS

1. The purpose of the meeting was to discuss the Bathroom Exhaust

Modifications Project.

2. A general discussion was had concerning the following project facets:

• The existing bathroom exhaust risers are not connected

to the grilles in the bathrooms and the systems are not

performing properly.

• the Bathroom Exhaust Modifications Project will be

performed in conjunction with the Proposed Shower

Stalls (Bathtub Replacement) Project.

• The contractor was directed to note the Alternate 1 Bid

requirements in the bid form as well as the Unit Pricing

Requirements.

3. 2 sample apartments were inspected. They were Apartments 2-B & 2-

M.

We believe the foregoing to be an accurate summary of the decisions and related

discussions. Please provide any exceptions to these minutes within five business days to

TJD Engineering Associates (via fax or email to the attention of T. Tamayne). Failing

such notification, we will consider these minutes a matter of record. Corrections to the

minutes will be addressed at the next meeting and incorporated in the next set of minutes.

If the contractor receives written notice of the acceptance of this bid within 90 days after the opening thereof, or at any time thereafter before this bid is withdrawn, the undersigned agrees to execute and deliver a Contract in prescribed form within 7 days following receipt of a written Notice to Proceed. Time of Completion: The Contractor agrees to complete all work as specified within (ninety) 90 days of receipt of a written Notice to Proceed or receipt of applicable permits, if any. If the Contractor fails to complete the work within 90 days, the Contractor shall pay the Authority as liquidated damages, the sum of $150.00 for each day of delay as outlined in form HUD-5370. To the extent that the Contractor’s delay or nonperformance is excused, liquidated damages shall not be due to the Authority. The Contractor remains liable for damages caused other than by delay.
