VACCINATION FORM

Vaccinations against Meningococcal Meningitis and Hepatitis B are recommended but not required by Florida Keys Community College. Florida law (10006-69 FS) requires all students who reside in campus housing to provide documentation of vaccinations received or to pro-vide the College with a signed waiver declining the vaccines.

If you have already received the vaccinations, please complete section A on this form. If you decline the vaccines, then you must sign the waiver in section B. If you are under 18 years of age, you and your parent or guardian must sign this waiver.

Section A: Documentation of Vaccination Meningitis and Hepatitis B All students must present documented proof of vaccination/immunity to Meningococcal Meningitis and Hepatitis B as described below: Acceptable Proof of Immunity consists of: 1. doses of hepatitis B vaccines2. Proof of immunity by way of a blood test lab result

LAGOON LANDING HOUSING CONTRACT

1. Parties & Agreement

This Lagoon Landing Housing Contract (this “Contract”), dated as of the

date noted below, represents a binding agreement between the student

and the Florida Keys College Campus Foundation (hereinafter

“FKCCF”), with Florida Keys Community College acting as manager

(hereinafter “College”) for the term noted on the cover page of this

Contract or until terminated as provided herein.

If the student is under 18 years of age, this contract is also an agreement

among the FKCCF, the College and the student’s parents, guardian, or

other guarantor. This contract must also be executed by the parent,

guardian, or guarantor if the student is under 18 years of age..

2. Terms of Occupancy

This Contract grants a conditional and temporary occupancy license and

not a right of possession. This Agreement shall not be deemed to

constitute a lease and may not be re-assigned, transferred, or sublet.

The College grants the student the right to occupy the assigned space of

Lagoon Landing on the terms and conditions of this Contract and the

Community Guide. This Contract is conditioned on the student

observing the Rules and Regulations in the Community Guide, Student

Handbook, College policies and procedures, and local, state and federal

laws. The College reserves the right to make other rules and regulations

as in its judgment may be necessary for the safety, care, and cleanliness

of the residence hall and for the preservation of order. The student agrees

to abide by all additional rules and regulations that are adopted.

The College reserves the right to terminate this contract if the student

violates any College policies, rules, regulations, or procedures as set

forth in the Community Guide, Student Handbook, College policies and

procedures, and local, state and federal laws. The College may

immediately remove a student from the residence halls if there are

grounds to believe the continued residence of the student presents a clear

and present danger to life or property. No refund of housing fees will be

given to individuals removed from the residence hall.

3. Duration of Occupancy

This contract is for the selected term(s) and covers the student’s

residency from the Published Move-in Date for Lagoon Landing for the

semester (including, A, B and/or C) in which the student is enrolled,

through 24 hours after the student’s last final exam of the term. The

College considers the student to be occupying the assigned room when

the student receives a room key at check-in and not occupying when

keys are returned at checkout. The Published Move-in Date will be

available on the Lagoon Landing calendar and the College’s student

academic calendar.

The contract does not provide for housing space during the

Thanksgiving holiday, periods between terms, and spring break.

Students will be notified in advance as to the dates when Lagoon

Landing will be closed and the times that they must vacate.

During breaks between semesters, students may be required to remove

their personal belongings. During breaks between semesters or other

designated vacation periods during the academic year, the College may

authorize students to store personal property in the room to which they

are assigned, unless the College needs to have the room emptied.

However, the College does not accept responsibility for personal

possessions left in student rooms during said periods.

Residents must vacate institutional housing within 24 hours after

withdrawal, dismissal from housing, or when no longer actively

participating in classes.

Depending on residence hall availability, the College may modify

housing contract dates to accommodate residents who are participating

in or assisting with graduation ceremonies.

4. Eligibility

Only fulltime students enrolled at the College may occupy a room.

Students must be enrolled in a minimum of 12 on-site credits per

semester to reside in Lagoon Landing unless granted an exemption from

the College. Failure to adhere to this eligibility requirement will result in

termination of this Contract.

5. Check-in, Check-out

The College and the student will, prior to the occupation of assigned

space, complete and sign an inventory of the number and condition of

furnishings, and the condition of the premises assigned to the student.

This inventory will be completed again at the end of the student’s

occupancy, and will serve as the basis for determining billable damages

to the room and furnishings. The College may require an interim

inventory to be completed prior to the end of the student’s occupancy if

the College has reason to believe that substantial damage to the premises

or property has occurred.

Students withdrawing from the College or who are at the end of their

occupancy period must schedule a check-out time and follow proper

check-out procedures. Personal property remaining in Lagoon Landing

after the term of this Contract has expired or has been terminated, shall

become the property of the College, unless the property has been left in

a designated area for which storage has been authorized in advance by

the College.

Failure to check out properly and/or return all keys by the check-out

deadline will result in College account holds and disciplinary fines and/

or charges. Improper check-out fee is $500 and lost key fee is $200.

Temporary keys may be issued for a limited amount of time. The key

replacement charges are non-refundable.

6. Room AssignmentsThe College reserves the sole right to make all suite and room assignments and to make any subsequent changes the College deems advisable or necessary. Students are assigned to rooms based on available space and the information submitted on the Housing Application. While every effort is made to honor preference and match roommates, no guarantees can be made. The residence hall is co-

educational; however, the College does not permit co-ed suites or rooms. Housing assignments are made regardless of race, color, religion, creed, national origin, or sexual orientation in compliance with the federal laws requiring nondiscriminatory practices and the Civil Rights Act of 1964.

Suites and rooms shall not be occupied by fewer or more than the

number of students stipulated by the College. If during the term of

occupancy, this Contract is terminated by one of the residents in a given

room, the remaining residents shall accept such other housing, or a new

roommate, as assigned by the College.

The College reserves the right to consolidate available spaces or conduct

room reassignments. Temporary, expanded occupancy is occasionally

necessary during reassignment and/or consolidation processes. All

decisions regarding the designated use of space and assignments will be

determined by the College and shall be final.

Students can request room changes according to the procedure

announced by the College. Changes are granted priority by request type

in the order they are received and to the extent practicable as determined

solely by the College. A charge of $50.00 will be assessed to any student

who changes his/her room or suite assignment without prior approval of

the College.

A resident must complete the institutional check in/registration process

on the designated move-in date but no later than the first day of classes

in order to secure their housing space. The College reserves the right to

reassign unclaimed space.

7. Care of Space, Room, Suite and BuildingThe student is responsible for the condition of the room/suite and all

furnishings that are assigned to the student, and the student shall

reimburse the College for all damages to the room or suite and damages

to, or loss of, the furnishings, except those that are caused by ordinary

wear and tear.

The student is also responsible for damage caused by the student’s guest

(s).

The student is responsible for maintaining the cleanliness of the

student’s room or suite, and the student shall reimburse the College for

all cleaning costs in excess of normal cleaning costs if staff is required,

at the College’s sole discretion, to clean the room/suite. The student will

also be required to share equally with other suite residents the cost of

repair or replacement of any College property in common areas of the

suite, including, but not limited to, hallways and lounges, when the

College determines that it is unable to assign liability for such damage or

loss. The College, at its sole discretion, shall determine the amount of

any such loss or damage. The College shall notify the student of any

such charges, and payment is due upon such notification. The student

also agrees to refrain from modifying the space in any way.

8. Drugs, Tobacco, and Alcohol: Zero Tolerance PolicyIn accordance with State statute and College policy, drugs and alcohol

are strictly prohibited in Lagoon Landing and the College campus.

Lagoon Landing is also a tobacco-free building.

ALL students found in violation of the College’s drug/alcohol policy,

as described in the community guide, student handbook and College

policies and procedures, will be evicted, terminating their privileges

to reside or visit anyone living in the residence halls.

In addition, all sanctions as listed in the Student Handbook may be

imposed in the College’s discretion.

9. Visitation PolicyThe College strictly upholds Lagoon Landing’s Visitor and Overnight

Guest policies as stated in the Community Guide. Violations of these

policies and/or the unauthorized visitation of a guest or other student of

the College not assigned to the room is prohibited and shall result in a

disciplinary action and/or removal from Lagoon Landing.

Any unauthorized persons found in Lagoon Landing are subject to

removal for trespassing.

10. Entry of Student RoomsThe College reserves the right to enter the student’s suite and room to

inspect, verify occupancy, make improvements or repairs, claim College

property or control the room in the event of an epidemic or emergency,

or if there is reasonable belief that college policy or local, state, or

federal law is being violated, or any other reason stated in the

Community Guide or Student Handbook.

Inspection of Rooms: The College conducts monthly room inspections

and typically publicizes those dates on the College web site. Student

rooms are also checked after closing for breaks and holidays and for

maintenance, safety, and security reasons. These inspections do not

involve intrusion into the student’s personal belongings. Prohibited

items (pets, firearms, oversized and unauthorized appliances, etc.) may

be removed at the student’s expense by the College personnel

conducting the inspections. Students are notified in writing if any item is

removed. College officials are legally obligated to report evidence of

unlawful acts in “Plain View.” This means that if illegal items such as

marijuana plants, weapons, etc. are found during a normal inspection

(for maintenance reasons, or due to an emergency situation, or for health

and safety reasons), the evidence can be seized and used against the

student in a disciplinary determination.

11. Safety & SecurityThe College is committed to maintaining a safe environment and will

work with students to promote effective security of person and property

in the residence halls. As such, the College reserves the right to

coordinate with law enforcement officials and drug-detecting canines to

conduct health and safety inspections of Lagoon Landing. Said law

enforcement officials and drug-detecting canines are authorized to

search for and seize items related to suspected illegal activity or

violation of College policy, local, state, and/or federal laws (See the

Room Entry Policy in the Community Guide). Students found to be

engaging in illegal activity or violating College policy, local, state, and/

or federal laws, are subject to College disciplinary action and/or arrest.

The College also reserves the right to contact a student’s emergency

contact in the event of serious illness, injury, or concern for the student’s

health or safety.

12. Limitation of LiabilityAlthough precautions are taken to maintain security of the College

campus, the College does not assume any legal obligation to pay for

injury to person (including death) or loss of or damage to items of

personal property that may occur in its buildings or on its grounds prior

to, during, or subsequent to the contract period. The temporary failure or

interruption of water, heat, air conditioning or other utilities will not give

a resident a claim for damages or reduction of room charges. The

student, his/her parent, guardian, or guarantor is encouraged to carry

appropriate insurance to cover such losses.

13. Meningitis and Hepatitis B VaccinationsFlorida law requires all students who attend a Florida college and reside

on campus to receive a meningitis and hepatitis B vaccine, or submit a

waiver stating that they have made an informed decision not to be

vaccinated (if the student is under 18, a parent or guardian must sign the

waiver).

14. Incorporation of Rules and RegulationsCollege and Residence Hall Rules and Regulations: The College rules

and regulations appearing in the most recent edition of the Community

Guide and/or Student Handbook and others that from time to time may

be promulgated by the College are made a part of this Contract and

incorporated herein. Students wishing to review any of these rules and

regulations prior to signing this contact may contact the College and

request the respective publications or refer to the online version on the

College web site. In the event of a conflict between said rules and

regulations and this Contract, the provisions of this Contract shall

control.

Other Laws, Rules & Regulations: This Contract shall be governed by

the laws of the United States, State of Florida, the rules and regulations

of the Board of Trustees of FKCC, and the rules and regulations of the

College.

15. Payment of Housing FeesThe student agrees to pay to the College housing fees and charges for the

assigned residence hall space and all other charges as provided in this

Contract. Other charges include security deposit, residence hall activity

fees and miscellaneous charges for items, including, but not limited to,

early check-in fees, room condition fees, improper room change fees,

lost key charges, and damages.

Housing fees are established for the entire academic year, pending

FKCC approval and may be adjusted pursuant to that approval.

Amounts due are payable as provided below. In addition, a daily rate

may be charged for approved occupancy prior to or subsequent to the

contract period or during periods when Lagoon Landing is otherwise

closed.

Housing Security Deposit.

The $250.00 refundable Housing Security Deposit will be applied to pay

any damages assessed to the student pursuant to the inspection process

described herein. If no damages are assessed against the student upon

expiration or termination of this Contract and no other fees or charges

are due and payable by the student the Housing Security Deposit will be

refunded to the student. Payment of the housing fees reserves a room

assignment and is due prior to move-in.

Activity Fee.

All residents are required to pay a $10.00 per semester Lagoon Landing

activity fee, which is allocated to fund programs and services in Lagoon

Landing.

It is the student's responsibility to be informed of all fee assessments and

due dates. Students are encouraged to review their FKCC online account

on a regular basis in order to receive timely billing notifications and

information.

Payment of Fees by a Parent or Guardian.

If the student is under 18 years of age, his/her parent, guardian or other

guarantor agrees to guarantee to the College that the student will pay all

housing fees and other charges as provided in this contract. The parent,

guardian or other guarantor further agrees that if the student for any

reason fails to make such payments, the parent, guardian or other

guarantor shall make all such payments to the College. This agreement

between the College and the parent, guardian or other guarantor is an

undertaking that is separate and distinct from the College's agreement

with the student, which is contained in this Section 15.

16. Housing FeesAll housing fees and charges must be received on or before the dates

indicated below but in no case later than the move-in date. The College

reserves the right to prohibit move-in until and unless payment of the

balance of fees under this Contract is made by the student.

17. Termination of ContractRequests to terminate an executed Contract must be submitted on the

Petition to Cancel Housing Contract form to the College. Simply

checking out of the residence hall and turning in your room key does not

constitute a Housing Contract termination.

Students who fail to claim their room assignment and key prior to the

first official day of classes will forfeit their reservation for the current

semester and will not be eligible for any refund of fees already applied

to their account.

A $1,500.00 CANCELLATION FEE SHALL BE APPLIED TO

CONTRACT CANCELLATIONS MADE WITHIN TWO WEEKS

PRIOR TO THE PUBLISHED MOVE-IN DATE.

NO REFUNDS WILL BE GRANTED FOR HOUSING

CONTRACT CANCELLATIONS ON OR AFTER THE

PUBLISHED MOVE-IN DATE.

Spring Term Withdrawal or Non-enrollment: Students committed to

an annual contract (fall/spring) who are not enrolling for the spring term

due to graduation, FKCC withdrawal, or non-enrollment must complete

and submit a Petition to Cancel Housing Contract form by November 1,

or they will be accountable for full payment of their housing contract.

Students canceling their contract for the Spring term may not be enrolled

in any FKCC classes during any remaining portion of the contract.

Contract terminations that are not subject to the termination guidelines

will be considered for the following circumstances only:

Military Deployment. Military deployment is defined as deployment

or other required relocation as an active member of the U.S. Armed

Services to a location not within the geographic limits of Key West,

Florida. Enlistment or enrollment in a branch of the U.S. Armed

Services is not a sufficient basis for waiver of cancellation fees based

upon military deployment. The student must provide activation,

deployment, travel, or assignment orders to the College. Military

deployment or other required relocation terminates this agreement after

the deployment date, and the College will refund a portion of the

housing fees for the semester the Student deploys, based upon the

Student’s move-out date.

Medical Withdrawal. The Student must provide a medical withdrawal

request that has been accepted and approved by the College. Medical

withdrawal terminates this agreement after the medical withdrawal date,

and the College will refund a portion of the rent for the semester the

Student withdraws for medical reasons, based upon the Student’s move-

out date. Medical conditions that do not require medical withdrawal

from the College are not grounds for termination of this agreement, or

for waiver or reduction of cancellation fees.

18. TerminationThis contract shall terminate at the end of the selected academic term.

The student may terminate this Contract if the student withdraws as an

enrolled student at the College and gives proper notice through

submission of Housing Contract Cancellation form.

The College may terminate this Contract at any time without notice if it

is determined that:

the student has been arrested or charged (whether or not convicted) with

a crime involving a felony or moral turpitude or where the circumstances

suggest that the student or other students may be at risk in some way by

the student remaining in the room; or

the student has not complied with the federal, state and local laws and

ordinances, and with the College Policy regarding the possession, use or

distribution of illicit drugs or alcohol.

The College may terminate this contract at any time with twenty-four

(24) hours written notice delivered to the student if it is determined that:

the student ceases to be enrolled in and/or attending a minimum of 12 on

-site credits at the College; or

the student is not in good standing with all tuition, fees and charges paid;

or

the student is dismissed from the College for any academic, or

disciplinary, or other reason; or

the student withdraws from the College or if the student shall vacate the

room for one week or longer other than during a vacation without written

permission of the College; or

the student or the student’s guests have violated College rules and

regulations as set forth in the Community Guide and Student Handbook.

NO REFUNDS WILL BE GRANTED FOR HOUSING

CONTRACTS THAT ARE TERMINATED BY THE COLLEGE

FOR ACEDEMIC OR DISCIPLINARY REASONS.

19. Collections and/or Attorney Fees

The student shall be responsible for payment of any and all collection

costs and attorney’s fees incurred by the College in collecting any

amounts due under this Contract.

20. College Remedies

The student’s breach of any of the obligations established by this Con-

tract authorizes the use of any remedy available by law or in equity.

Additionally, if the student, student’s parent, guardian or other guarantor

fails to pay housing fees or other charges as required by this contract, the

College is authorized to use any or all of the following remedies: termi-

nation of this contract; removal of the student and student’s belongings

from Lagoon Landing housing; cancellation of the student’s enrollment

at the College; restriction of the ability of the student to register for clas-

ses; and withholding of the student’s transcript of grades, diploma, or

other records maintained by the College.

The College’s failure to enforce at any time any of the provisions of this

Contract, or its failure to utilize any remedy which is authorized herein,

shall in no way be construed as a waiver of such rights or in any way

affect the validity of this contract or any part hereof or the right of the

College thereafter to enforce each and every such provision.

21. SeverabilityIf any provision of this Contract is ruled illegal or invalid, such ruling

shall not affect the validity or enforceability of the remainder of the

provisions of this Contract.

22. Entire AgreementThis Contract, together with the Room Condition Report completed at

check-in, the Community Guide and Student Handbook, constitute the

entire agreement of the parties. There are no promises, terms, conditions

or obligations other than those contained herein, and this Contract shall

supersede all previous communications, representations or agreements,

either verbal or written, between the parties hereto.

STUDENT FINANCIAL RESPONSIBILITY Terms and Conditions

Financial Liability Statement

I agree to pay all Florida Keys Community College and Florida Keys College Campus Foundation (hereinafter collectively referred to

as FKCC as representation of both entities) student account balances and charges pursuant to FKCC policies. I understand that FKCC

is advancing value to me in the form of educational services and residential accommodations, and that my right to live in the dorms

is expressly conditioned upon my agreement to pay any and all institutional costs including, but not limited to, dorm rental fees,

dorm incidental charges, tuition, fees, books, and any additional costs, when those charges become due. It is my responsibility to

view and pay fees by established fee due deadlines posted on FKCC website and catalog. It is my responsibility to pay my student

account balance either in FKCC’s student portal (referred to as “MyFKCC”), by credit (or debit) card over the phone, or in-person at

the office of Business Services located at Key West main campus.

I understand that a past due student account balance will result in a financial “hold,” which prevents future accommodations, regis-

tration and other services being offered in accordance with college and dorm policy. A delinquent student account balance may be

reported to a credit bureau and/or referred to collection. I agree to pay any cost associated with the collection of unpaid charges,

including collection fees up to 30.0% of the total past due balance or reasonable attorney fees and court costs associated with the

collection, including those incurred upon appeal. This agreement shall be governed by the laws of the state of Florida, and I hereby

stipulate, agree, and consent to any court of competent jurisdiction in Monroe County, Florida exercising personal jurisdiction over

me in any lawsuit brought by FKCC, or its agents, to collect any and all unpaid fees and other charges and assessments, regardless

of my domicile at the time of such action.

Financial Aid, Third Party, and Scholarships

I agree to pay FKCC remaining student account balances due after financial aid awards, third party payments, and scholarship

awards have been applied to my account by established fees due deadlines posted on FKCC website and catalog. Even though a

third party is paying my tuition and dorm fees, I am responsible for making sure my debt is paid by established deadlines. I under-

stand that by submitting requests for financial aid, third party payments, and scholarships do not automatically extend established

fees due deadline. If payments are not received by fees due deadline, a formal request to Business Services at busi-

[email protected] is required for extension approval. Approval of extension is available when extenuating circumstances war-

rant an extension (in FKCC’s sole discretion) and such approval is expressly contingent upon proper completion of the foregoing

extension request at Business Services.

Suspension of Services

I understand and agree that FKCC will withhold grade reports, transcripts, diplomas, and other services if I fail to pay tuition, fees,

books, and any and all additional costs or if I otherwise fail to abide by the provisions of this agreement. Additionally, FKCC will

prevent me from further registration activity until all outstanding balances on my student account and/or to third party vendors

have been satisfied in full.

Change in Name, Address, or Phone Number

I am responsible for updating my FKCC records with any changes in my name, address, or phone number within seven (7) days of

any such change. Personal information should be updated in person at Key West main campus, Upper Keys Center, or Lower Keys

Center.

Communications

I understand that emails from MyFKCC account are FKCC’s primary and official means of communication, and serve to provide the

means for delivering the College’s official notices. I am responsible for reading the information and notices that are sent to me

through my assigned FKCC email and hereby accept email transmissions from FKCC as providing actual notice under this Agree-

ment.

I further acknowledge and understand that FKCC and/or third parties may contact me regarding outstanding debt via my FKCC

email, regular mail, home and mobile phones. By accepting and agreeing below, I consent to FKCC and/or third parties doing so. By signing below, I am entering into a legal and binding contract with Florida Keys Community College and I hereby acknowledge that I have read and understand the Terms and Conditions of this housing agreement.
