7 Steps to International Property Protection

Since there is no worldwide patent available at this time, the best place to first patent your invention in your country.

This keeps people, particularly competitors, from stealing your work or using your ideas without permission.

You can patent almost any invention, from a recipe for a pie-cake to a blueprint for a new technology.

1. Patent your invention in your country

To file patents in foreign countries within 6 months of filing in the U.S., you first have to get a license from the USPTO.

The license can be used to file for a patent in any country.

If you have already received a patent in the U.S., you may not need a license.

2. Get a license.

Choosing the countries you want to file in may have to do with competition or seeing a need for the product.

Be aware that filing foreign patents can be expensive and time consuming.

Avoid filing unnecessary patent in countries where the product won’t be used profitably.

3. Decide where to file.

If a similar invention has been submitted for a patent, your application will be denied.

You can search for this information using the WIPO search engine called PatentScope.

4. Search for similar inventions.

You can attempt to write a patent application on your own, but you risk making costly mistakes.

A wiser option is to hire an intellectual property attorney or team of international patent specialists.

5. Create a draft patent application

The PCT (Patent Cooperation Treaty) office makes sure everything is in order for your patent and that it doesn’t violate any patents.

Usually a report from the PCT is given to the applicant between 9 and 16 months after the initial application is submitted.

6. Submit to the PCT office

You may officially choose the countries you want to submit a patent to after you receive approval from the PCT.

The countries you choose will receive a report from the PCT to speed up the process. It will be faster because the initial research on the patent has already been completed.

7. File in other countries
