    Mr. INGALLS introduced the following bill; which was referred

    to the Committee on Science, Space and Technology for a

    period to be subsequently determined by the Speaker, forconsideration of such provisions as fall within the jurisdiction of

    the committee concerned.

    A BILLTo amend the Horse Protection Act to prohibit the shipping,

    transportin g, mov ing, delivering, receiving, possessing,

    purchasing, selling, or donation of horses and other equines tobe slaughtered for human consumption, and for other purposes

    Be it enacted by the Senate and House of1

    Representatives of the United States of America in2

    Congress assembled,3

    SECTION 1. SHORT TITLE.4

    This Act may be cited as the "American Horse5

    Slaughter Prevention Act".6

    SEC. 2 PROHIBITION ON SHIPPING, TRANSPORTING, MOVING,7

    DELIVERING, RECEIVING, POSSESSING, PURCHASING,8

    SELLING, OR DONATION OF HORSES AND OTHER EQUINES9

    FOR SLAUGHTER FOR HUMAN CONSUMPTION10

    (a) DEFINITIONS.Section 2 of the Horse Protection Act (1512

    U.S.C. 1821) is amended13

    1. by redesignating paragraphs (1), (2), (3), and (4) as14

    paragraphs (2), (3), (5), and (6);15

    2. by inserting before paragraph (2) (as redesignated by16

    paragraph 1.) the following:17

    (1) Th e term human consumption means i ngestion by18

    people as a source of food.; and19

    3. by inserting after paragraph (3) (as redesignated by20

    paragraph 1.) the following:21

    (4) The term sl aughter means t he kill ing of 1 or more22

    horses of other equines with the intent to sell of trade the flesh23

    for human consumption..24

    (b) FINDINGS. Section 3 of the Horse Protection Act (1526

    U.S.C. 1822) is amended27

    1. by redesignating paragraphs (1) through (5) as28

    paragraphs (6) through (10);29

    2. by adding before paragraph (6) (as redesignated by30

    paragraph 1.) the following:31

    "(1) horses and other equines play a vital role in the32

    collective experience of the United States and deserve33

    protection and compassion;34

    "(2) horses and other equines are domestic animals that35

    are used primarily for recreation, pleasure, and sport;36

    "(3) unlike cows, pigs, and many other animals, horses37

    and other equines are not raised for the purpose of being38

    slaughtered for human consumption;39

    "(4) individuals selling horses or other equines at40

    auctions are seldom aware that the animals may be bought for41

    the purpose of being slaughtered for human consumption;42

    "(5) the Animal and Plant Health Inspection Service of43

    the Department of Agriculture has found that horses and other44

    equines cannot be safely and humanely transported in double45

    deck trailers;"; and46

    3. by striking paragraphs (8) (as redesignated by paragraph47

    1.) and inserting the following:48

    "(8) the movement, showing, exhibition, or sale of sore49

    horses in intrastate commerce, and the shipping, transporting,50

    moving, delivering, receiving, possessing, purchasing, selling,51

    or donation in intrastate commerce of horses and other equines52

    to be slaughtered for human consumption, adversely affect and53

    burden interstate and foreign commerce;".54

    (c) PROHIBITION.Section 5 of the Horse Protection Act (1556

    U.S.C. 1824) is amended57

    1. by redesignated paragraphs (8) through (11) as58

    paragraphs (9) through (12); and59

    2. by inserting after paragraph 7 the following:60

    "(8) The shipping, transporting, moving, delivering,61

    receiving, possessing, purchasing, selling, or donation of any62

    horse or other equine to be slaughtered for human63

    consumption.".64

    (d) AUTHORITY TO DETAIN.Section 6(e) of the Horse66

    Protection Act (15 U.S.C. 1825(e)) is amended67

    1. by striking the first sentence of paragraph (1);68

    2. by redesignating paragraphs (1) and (2) and as69

    paragraphs (2) and (3); and70

    3. by inserting before paragraph (2) (as redesignated by71

    paragraph 2.) the following:72

    "(1) The Secretary may detain for examination, testing,73

    or the taking of evidence74

    "(A) any horse at any horse show, horse exhibition,75

    or horse sale or auction that is sore or that the Secretary has76

    probably cause to believe is sore; and77

    "(B) any horse or other equine that the Secretary has78

    probable cause to believe is being shipped, transported, moved,79

    delivered, received, possessed, purchased, sold, or donated in80

    violation of section 5(8).".81
