H.R. 16To Secure The Southern Border

Mr. CAPOZZI introduced the following bill; which was referred
to the Committee on Foreign Affairs for a period to be
subsequently determined by the Speaker, for consideration of
such provisions as fall within the jurisdiction of the committee
concerned.

A BILLTo Secure The Southern Border
Be it enacted by the Senate and House of1
Representatives of the United States of America in2
Congress assembled,3
SECTION 1. SHORT TITLE.4
This Act may be cited as the "Border Security5
Act".6
SEC. 2. Purpose7
The purpose of this Bill is to secure the border between8
the United States of American and the United Mexican States9
while stopping the flow of illegal drugs, weapons, and10
immigrants across the aforementioned border.11
SEC. 3. Military Redeployment12

This bill will move 100,000 soldiers from around the13
world to control the entirety of the border. 20,000 of these14
soldiers will be transferred from Okinawa; 20,000 of these15
soldiers will be transferred from Afghanistan; 10,000 of these16
soldiers will be transferred from Kuwait; 40,000 of these17
soldiers will be transferred from Germany; 5,000 of these18
soldiers will be transferred from the United Kingdom; 5,000 of19
these soldiers will be transferred from Italy; and all other20
appropriate support, command, and intelligence assets shall21
likewise be transferred. The United States Military Command22
will be given the authority to execute these measures.23
SEC. 4. Border Fortifications24
a. Whereas the United States-Mexico border is 1,96925
miles long, a military facility will be built every 25 miles along26
the border with the appropriate barrack houses, office27
buildings, defenses, and roads to connect the aforementioned28
facilities. Each facility shall be required to contain at least 5029
soldiers at all times, though the remaining military assets may30
be deployed as seen fit by the United States Military.31
b. Connecting the military facilities created in Section32
4a, a continuous barbed-wire fence will be constructed along33
the entire length of the United States-Mexico border. In front of34
this, a ten foot-wide ditch shall be dug in front of the35
aforementioned ditch. The fence shall contain a guard tower to36
be staffed by at least 2 soldiers constantly every quarter mile37
along the entirety of the constructed fence. The United States38
Military and the Central Intelligence Agency shall cooperate to39

implement the most modern and sophisticated detection40
technology to easily identify any attempts to cross the border.41
c. The National Guard Units currently stationed along42
the United States-Mexico border will be redeployed across the43
country to more quickly respond to domestic natural disasters.44
SEC. 5. Border Command Structure45
a. The United States-Mexico border will be divided into46
four zones of military command under the authority of United47
States Military. The Texas-Mexico border zone will be named48
The Rio Grande Military Sector under the command of the Rio49
Grande Military Command. The New Mexico-Mexico border zone50
will be named the Apache Military Sector under the command51
of the Apache Military Command. The Arizona-Mexico border52
zone will be named the Sonoran Military Sector under the53
command of the Sonoran Military Command. The California-54
Mexico border zone will be named the Baja Military Sector55
under the command of the Baja Military Command. The sector56
Military Commands will be responsible for the deployment of57
military assets within their individual zones. Cooperation58
between zones is encouraged, and may be mandated by the59
United States Military if necessary.60
b. The border zones created in the Section 5a will61
extend from the United States-Mexico border 30 miles into the62
interior of the United States of America. Within these zones,63
soldiers or domestic police forces shall have the right to64
demand proof of citizenship from any individual within the zone65

without having to justify said demands. Outside the military66
zones, current laws shall continue to apply.67
SEC. 6. Handling of Illegal Border Crossers68
United States military assets are hereby authorized to69
take whatever steps deemed necessary to stop the illegal flow70
of weapons, drugs, and immigrants across the United States-71
Mexico border. Crossing individuals may not be fired upon72
unless they open fire first; if crossing individuals do fire upon73
United States military assets, deadly force is then authorized74
and appropriate. In all other cases, individuals crossing the75
border illegally shall be captured, processed into a database,76
and immediately deported. If an individual is caught illegally77
crossing the border more than once, they shall be put in front78
of a United States Military Tribunal, and, if found guilty,79
imprisoned for 2 years and then exported. Any confiscated80
drugs, weapons, or other goods will immediately become the81
property of the United States Federal Government.82
Funding83
The cost of maintaining the United States military along84
the United States-Mexico border shall not increase current85
costs, as assets are merely being redeployed, rather than86
expanded. The following laws will create funding for the87
construction of border defenses:88
a. The United States Federal Government will no longer89
regulate the recreational or medicinal use of marijuana, but will90
rather grant the States the right to make their own laws91
concerning the recreational/medicinal use of the drug within92

their borders. Funds will be transferred from the so-called War93
on Drugs to fund the Border Security Act.94
b. The retirement age will be raised two years in this95
country, effective beginning in January 2016.96
SEC. 8. NULL AND VOID97
All conflicting laws that conflict with the new system are98
hereby declared null and void99
