H.R. 21To Establish the Defense Research Realignment Commission

Mr. JENCUNAS introduced the following bill; which was referred
to the Committee on Foreign Affairs for a period to be
subsequently determined by the Speaker, for consideration of
such provisions as fall within the jurisdiction of the committee
concerned.

A BILLTo Establish the Defense Research Realignment Commission
Be it enacted by the Senate and House of1
Representatives of the United States of America in2
Congress assembled,3
SECTION 1. SHORT TITLE.4
This Act may be cited as the "Defense Research5
Realignment Commission Creation Act".6
SEC. 2. (a) PURPOSE.--The purpose of this part is to provide a7
fair process that will result in the timely closure and8
realignment of weapon systems research, development, and9
purchasing.10

(b) ESTABLISHMENT.--There is established an independent12
commission to be known as the "Defense Spending13
Realignment Commission".14

(c) APPOINTMENT.--(1) The Commission shall be composed of16
eight members appointed by the President, by and with the17
advisement and consent of the Senate.18
(2) In selecting individuals for nominations for appointments to19
the Commission, the President must consult with--the Speaker20
of the House of Representatives concerning the appointment of21
two members from the House of Representatives minority22
party; the majority leader of the Senate concerning the23
appointment of two members from the Senates majority party;24
the minority leader of the House of Representatives concerning25
the appointment of one member from the House of26
Representatives minority party; and the minority leader of the27
Senate concerning the appointment of one member from the28
Senates minority party.29
(3) At the time the President nominates individuals for30
appointment to the Commission, the President shall designate31
one such individual who shall serve as Chairman of the32
Commission.33

(d) MEETINGS.--(1) The Commission shall meet for a period of35
one calendar year.36
(2) All the proceedings, information, and deliberations of the37
Commission shall be open, upon request, to the following: The38

Chairman and the ranking minority party member of the39
Subcommittee on Readiness, Sustainability, and Support of the40
Committee on Armed Services of the Senate, or such other41
members of the Subcommittee designated by such Chairman or42
ranking minority party member. The Chairman and the ranking43
minority party member of the Subcommittee on Military44
Installations and Facilities of the Committee on Armed Services45
of the House of Representatives, or such other members of the46
Subcommittee designated by such Chairman or ranking47
minority party member. The Chairmen and ranking minority48
party members of the Subcommittees on Military Construction49
of the Committees on Appropriations of the Senate and of the50
House of Representatives, or such other members of the51
Subcommittees designated by such Chairmen or ranking52
minority party members.53

(e) VACANCIES.--A vacancy in the Commission shall be filled in55
the same manner as the original appointment, but the56
individual appointed to fill the vacancy shall serve only for the57
unexpired portion of the term for which the individual's58
predecessor was appointed.59

(f) PAY AND TRAVEL EXPENSES.--(1)(A) Each member, shall be61
paid at a rate equal to the daily equivalent of the minimum62
annual rate of basic pay payable for level IV of the Executive63
Schedule under section 5315 of title 5, United States Code, for64
each day (including travel time) during which the member is65

engaged in the actual performance of duties vested in the66
Commission.67

(g) STAFF.--(1) Subject to paragraphs (2) and (3), the69
Director, with the approval of the Commission, may appoint70
and fix the pay of additional personnel.71
(A) There may not be more than 6 persons, including the72
director, on the staff at any one time.73
(B) The staff may perform only such functions as are necessary74
for the administrative efficacy of the commission, they are not75
to take testimony during meetings or proffer opinions about the76
substantive matters pending before the committee.77

(h) FUNDING.--(1) There are authorized to be appropriated to79
the Commission such funds as are necessary to carry out its80
duties under this part. Such funds shall remain available until81
expended.82
(2) If no funds are appropriated to the Commission by the end83
of the second session of the 113th Congress, the Secretary of84
Defense shall transfer, for fiscal year 2013, to the Commission85
funds from the Department of Defense. Such funds shall remain86
available until expended.87

(i) TERMINATION.--The Commission shall terminate on89
December 31, 2013.90

(j) MISSION. The Commission shall be tasked with92
reviewing all ongoing and proposed weapons systems93
procurement contracts and research contracts awarded by the94
Department of Defense to outside contractors. The Commission95
shall generate a list of contracts that are wasteful: either96
costing to much, lacking a reasonable chance of yielding97
significant benefit, or otherwise harmful to the United States98
national interest. Using the mechanisms established in the99
DEFENSE BASE CLOSURE AND REALIGNMENT ACT OF 1990 (As100
amended through FY 05 Authorization Act) these101
recommendations will be subject to an up-or-down vote in both102
chambers of Congress.103
