    DECEMBER, 27, 2012

    Mr. REAGAN introduced the following bill; which was referred to

    the Committee on Education and Workforce for a period to be

    subsequently determined by the Speaker, for consideration of

    such provisions as fall within the jurisdiction of the committeeconcerned.

    A BILLTo provide for the equality of all votes in presidential elections

    through adding a 28th amendment to the United States

    Constitution

    Be it enacted by the Senate and House of1

    Representatives of the United States of America in2

    Congress assembled,3

    SECTION 1. SHORT TITLE.4

    This Act may be cited as the "Electoral Equality5

    Amendment".6

    SEC. 2.7

    The following sections shall be removed from the Constitution8

    of the United States Constitution (hereafter referred to as the9

    Constitution) upon the passing and ratification of this10

    Amendment:11

    The language that has been removed from the Constitution per15

    the directive of the preceding section shall be replaced by the16

    following language upon the passing and ratification of this17

    Amendment:18

    Article II, Section 1, Clause 2: Each voter in each State19

    shall vote for President and Vice President of the United States20

    on the same ticket (President and Vice President together). On21

    Election Night, the States are permitted to engage in live22

    reporting of election results only after all polls have closed in23

    their own state, and a winner may be determined on Election24

    Night.25

    Article II, Section 1, Clause 3: The votes in each State26

    shall be counted, tabulated, and reported by the Secretary of27

    State and proper electoral officials in each State according to28

    currently used processes in each State. The results must then29

    be certified according to each states current practices30

    (excluding timelines). Once counted, tabulated, reported, and31

    certified, each state must report their results to the Federal32

    Election Commission within 14 days of the election.33

    Article II, Section 1, Clause 4: Once the States have34

    counted, tabulated, reported, and certified their results, as well35

    as having reported them to the Federal Election Commission,36

    the Chairman and Vice Chairman of the Federal Election37

    Commission must then certify the results of the election38

    according to a process that adheres to the best practices of the39

    States within 14 days of receiving all results from all States and40

    immediately publish those results upon certification by the41

    Federal Election Commission. Legal action concerning election42

    results affected by this Amendment may commence in any/all43

    states after that state has counted and tabulated its results, but44

    before certification by the states and reporting to the Federal45

    Election Commission. If legal action commences within this46

    window, such action shall conclude within 30 days of47

    commencing, and certification and reporting must be48

    suspended. All legal proceedings shall take place within United49

    States District and Appeals Courts, and, if deemed necessary,50

    in the United States Supreme Court. If more time for such51

    legal action is required, the United States Supreme Court may52

    issue a time extension for conclusion of legal action for up to 2053

    days. Only after the conclusion of all legal action concerning54

    the election results may the individual states and the Chairman55

    and Vice Chairman of the Federal Election Commission certify56

    and officially publish the results of the election. The final,57

    certified results reported by the Federal Election Commission58

    shall be considered the final authority concerning the results of59

    United States Presidential elections. The Congress shall have60

    power to enforce this article by appropriate legislation.61
