cfn May 25, 1999 Officer Roman was scheduled for a Traffic Court Hearing at 1: 30 PM; Officer Roman failed to ·appear in court as directed by a subpeona he received and signed for on March 12, 1999.

By not appearing in court, Officer Roman is in violation of Rules and Regulations 2.3.15.2, which holds the officer accountable.

Comments:

It was explained to Officer Roman the importance of attending any and all court cases that is required of him. And, that it is his responsibility to keep track of his court dates, and to be present when it is ordered. he stated that he understood and ensured that it would not happen again.

On March 3, 1999 Officer Roman responded to 288 Kelsey Park Circle for an assist to Lake Park police department. Officer Roman was instructed via Lake Park dispatch to detain a subject that was involved in a motor vehicle accident in that jurisdiction.

Officer Roman made contact with the subject Jane Patterson. Without requesting any further information fi·om Lake Park personnel Roman delayed Patterson from leaving until a Lake Park police officer arrived.

Officer Roman was counseled on requesting more factual information before taking action for an incident that occurred in another jurisdiction. Roman's actions did not reflect the reasonableness and responsibility that would coincide with department and statutory guidelines concerning enforcement action.

Officer Roman was further counseled on his limitations and capabilities when assisting another agency or acting on other's requests.

Officer Roman realizes that by soliciting additional information prior to acting he may have been able to reduce Mrs. Patterson's displeasure with the police and he assures me this type of incident will not be repeated.

Officer Roman received this counseling for Rule and Regulation violation 2.3 .17 Duty requirement 2.3 .17 .2 Competency- The expectation that members possess a reasonable knowledge of their

responsibility and perform their duties within the guidelines of the department.

On Saturday, December 7, 1996 at approximately 2107 hours, you advised communications that your assigned vehicle 306 had a flat tire. Public Works was notified and Kauffs Towing service was dispatched. Approximately ten minutes later you requested Sgt. Leffler respond to your location on Tournament Drive, within Frenchman's Creek.

You advised Sgt. Leffler that you were traveling approximately 35-40 mph during a rainstorm on a brick constructed road which was obviously excessive due to inclement weather. Sgt. Leffler advised that he observed the right front rim to vehicle 306 dented and the tire partially off the rim.

You advised Sgt. Leffler that you were responding to an armed robbery which had just occurred at the Dunkin Donuts located at the intersection of Northlake Boulevard and Military Trail. You further advised that your response was not authorized, nor did you advise communications that you were enroute. While the significant distance between Frenchman's Creek and the Dunkin Donuts made your decision to respond a poor one, the subsequent accident rendered your ability to respond impossible.

You have been involved in two previous vehicular accidents which in one instance you again failed to promptly notify a supervisor per rules and regulations. You received a one (1) day suspension without pay for that incident.

I find you in violation of the following rules and regulations:

As a result of the aforementioned, I am recommending that you receive a five (5) day suspension without pay. This recommendation is in accordance with Articles 11 and 16 contained within the collective bargaining agreement between the City and P.B.A. Any future violations of this nature shall result in progressive discipline, including termination.

I have scheduled a pre-determination hearing concerning this matter on Monday, January 27, 1997 at 1400 hours in my office. Please advise me in writing, no later than Friday, January 24, 1997, your decision concerning attendance at the hearing and the name of your representative, if one is desired.
