NOTICE IS HEREBY GIVEN in accordance with an Order of the Office of the Governor issued March 16, 2020; the City Council of the City of Humble will conduct its Regular Meeting scheduled for 10:00 a.m. on September 01, 2020, in person and open to the public. In order to advance the public health goal of limiting face-to-face meetings (also called "social distancing") to slow the spread of the Coronavirus (COVID-19), seating will be limited to 50% Fire Codecapacity or 24 people. Overflow into the hallway is allowed, but there will not be video or audio enhancement in this area. The meeting will not be available via telephone or videoconferencing. Citizens who wish to attend the City Council Meeting in person must abide by the following requirements:

• Do not enter the building if you are having symptoms. Go home.• Maintain a minimum distance of 6 feet from other citizens.• Families or persons traveling together may sit together, but maintain social distancing from

1. Call to order.

With a quorum present, the Regular Meeting of the Humble City Council was called to order by Mayor Aaron at 6:30 p.m. on Thursday, August 13, 2020 in the Council Chamber of the City of Humble City Hall, 114 West Higgins, Humble, Texas 77338. In accordance with an Order of the Office of the Governor issued March 16, 2020 regarding Covid-19 health concerns, the City Council of the City of Humble conducted its Regular Council Meeting practicing social distancing, limiting seating to 25% Fire Code capacity, and encouraging face coverings and good hand hygiene.

3. Hear Visitors: During this time a citizen may address the City Council on any item which does not appear on

the posted Agenda. Registration forms are available at the meeting and on our website. This form should be completed and returned to the City Secretary no later than ten (10) minutes prior to the beginning of the meeting. Upon stepping to the podium the speaker must state their name, and city of residence. Each speaker’s remarks are limited to three (3) minutes. The City Council will listen and receive the information presented by the speaker, ask staff to look into the matter, or place the issue on a future agenda. Topics of operation concerns shall be directed to the City Manager. Comments should not personally attack other speakers, Council Members or staff.

15. Executive Session;

Personnel Matters (Gov’t Code Section 551.074); possible action. The City Council may deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer(s); to wit:

• Police Chief Mayor Aaron recessed into Executive Session at 6:41 p.m. Mayor Aaron reconvened into Regular Session at 7:13 p.m. and announced there was no action to take regarding the Executive Session.

16. Community Announcements. The City Council will have an opportunity to address items of community interest, including: expressions of thanks, congratulations, or condolence; information regarding holiday schedules; an honorary or salutary recognition of a public official, public employee, or other citizen; a reminder about an upcoming event organized or sponsored by the City of Humble; information regarding a social, ceremonial, or community event organized or sponsored by an entity other than the City of Humble that was attended or is scheduled to be attended by a member of the City Council or an official or employee of the City of Humble; and announcements involving an imminent threat to the public health and safety of people in the City of Humble that has arisen after posting the agenda. Council Member Pierce announced Music on Main would be held this Friday night.

17. Adjourn

With no further business to discuss, Council Member Pierce moved to adjourn. Mayor Aaron adjourned the meeting at 7:14 p.m.

Problems with Tax Notice Language Under S.B. 2

It’s recently been discovered that required tax rate notices under last session’s S.B. 2 may require some smaller cities to announce that citizens may petition for a rollback election, or that a city may be required to hold a rollback election, even though the city is not actually subject to either requirement under the bill. The glitch appears to be the result of a technical drafting error in S.B. 2 and how that bill interacts with previous Tax Code provisions, which isn’t surprising because S.B. 2 was a large, complicated bill that was amended frequently right through the end of the process. Specifically, cities under 30,000 population are permitted a “de minimus” tax rate adjustment that always allows them to raise an additional $500,000 in a given tax year without triggering a rollback election (one bill sponsor called this the “firetruck exception”, which was designed to allow small cities to make necessary large purchases without triggering elections). Whether the proposed tax rate of any particular city under 30,000 population triggers the de minimus exception depends on several factors such as the proposed rate, levy, and the relative size of the $500,000 allowance compared to the overall proposed levy. So we can’t answer here for sure if your city is affected. But for cities that do intend to use the de minimus exception, state law appears to require them to say things in their tax rate notice that literally aren’t true under the bill—a difficult situation given that the notice is required to be given.

The League is working with various stakeholders including the bill authors and the Comptroller’s office to try to find a workaround that might mitigate this discrepancy. House Land and Resource Management Committee: League Submits Comments

Last month, the League reported in its Coronavirus Update email that the House Land and Resource Management issued a notice asking for written input on annexation reform and eminent domain law (including the “Landowner’s Bill of Rights”):

Due to the ongoing pandemic and the uncertainty as to scheduling interim hearings, the Committee requests written submissions from interested parties and the public in regards to the assigned Interim Charges below. All submissions are due on August 14, 2020, by 5pm (CST).

The League submitted a letter conveying information related to annexation. Specifically, the letter speaks to: (1) the need for legislation to fix a minor, apparently-unintended consequence caused by H.B. 347 (“crossing a road” to make petitioning landowner contiguous); (2) the prohibition against forced annexation; and (3) the continuing need for extraterritorial jurisdiction (ETJ). With regard to eminent domain, the League is currently part of a coalition of entities with eminent domain authority called the Coalition for Critical Infrastructure (CCI). CCI and its many members worked diligently with bill authors and landowner groups last session to provide more transparency in the process and appropriate compensation to landowners. They have continued that effort this interim, and submitted comments on eminent domain related to the “landowner’s bill of rights (a document explaining the process that a condemnor must provide to a landowner)” and the right of a property owner to repurchase land if it isn’t used for a public use within a certain period of time. The Texas Mayors of Military Communities also submitted comments, which encourage the committee to retain and protect all existing local land use authority in the areas around Texas military bases.

Senate Finance Committee Releases Interim Report The Senate Finance Committee released its interim report studying issues under the committee’s jurisdiction. Of particular interest to cities are the charges related to the business personal property tax and disaster funding.

Charge: Study the economic dynamics of the current business personal property tax. Consider the economic and fiscal effects of increased exemptions to the business personal property tax, versus its elimination. Following such study, make recommended changes to law. Committee Recommendations: Texas remains a national leader when it comes to establishing a hospitable environment in which businesses can succeed. The Legislature should evaluate the following ways to strengthen Texas’ competitive advantage:

Consider adjusting the current $500 exemption to account for inflation and the cost of administering the tax.

Streamline the process for compliance. Reduce reliance on the business personal property tax as the state budget allows.

Charge: Review federal, state, and local eligibility and receipt of disaster funds from Community Development Block Grants – Disaster Relief and the Federal Emergency Management Agency. Identify any barriers to the effective utilization of those funds and recommend any changes to statute, rule, or practice to promote the efficient deployment of those funds and expedite recovery by affected citizens, businesses, and communities. Committee Recommendations:

Work with the federal government to streamline federal disaster aid and reduce confusion among the public about where to seek assistance.

Discourage federal pass-throughs to cities and counties with the state bearing financial responsibility without strengthened tools to prevent misuse of those funds.

Continue to provide strong oversight of disaster and infrastructure funding approved last session to avoid duplication of effort, fraud, and waste.

Require agencies to work with TDEM to seek federal aid for FEMA-reimbursable costs and work with the LBB to streamline agency cost reporting for future disasters.

National Coalition Files FCC Collocation Lawsuit In September of last year, the Wireless Industry Association (WIA) and the Communications Technology Industry Association (CTIA) filed petitions with the Federal Communications Commission to further limit local oversight of wireless towers and pole attachments. As with other recent FCC preemptive orders, the League is participating in a national coalition that filed

comments and reply comments with the FCC. In addition, the coalition filed a court challenge to the order this week.

TML Municipal Policy Summit Wraps with Eyes on Recovery Leaders from cities across Texas gathered virtually last week to discuss legislative priorities for the 87th Texas Legislative Session. The Texas Municipal League (TML) Policy Summit met for two full days to discuss priorities for cities which included preserving the tools to meet the needs of Texas taxpayers, bridging the digital divide and increasing rural broadband connectivity, pay as you go financing options for critical infrastructure projects, and the importance of community advocacy before the legislature. NLC Releases City Fiscal Conditions Report Yesterday, the National League of Cities (NLC) released its report on the Annual City Fiscal Conditions survey. In its 35th year, the survey has become the nation’s most trusted barometer of the financial well-being of cities, towns, and villages across the country. It has become an annual snapshot of city fiscal conditions, with a firm grasp on trends over time. This year, NLC collected information from 485 cities varied in population and region. NLC predicts that the toll on city finances is set to be more severe than that experienced during the Great Recession. Some highlights of the report include:

Nearly 90 percent of cities will be less able in FY 2021 than in FY 2020 to meet the fiscal needs of their communities. This widespread sentiment about lack of fiscal capacity has not been reported since the low point of the Great Recession;

Current estimates for FY 2020 put year-over-year general fund revenue growth at near zero;

All major local tax revenue sources slowed in FY 2020 with a severe year-over-year decline in sales receipts (-11%);

On average, cities anticipate a 13 percent decline in FY 2021 general fund revenues over FY 2020.

Big Three Unveil Police Budget Proposal On Tuesday, Governor Greg Abbott, Lieutenant Dan Patrick, and Speaker Dennis Bonnen held a press conference in Fort Worth unveiling their proposal on police funding. The Governor indicated that the proposal will be introduced during the 87th Legislative Session in 2021. The plan states that “any city that defunds police will have their property tax revenue capped at current levels.” At the time of publication, there was no other information on what the legislation will look like other than the short statement. Some cities have asked the League if the proposed law, if enacted, would mean they can’t make very modest reductions in public safety spending either next year or in some future year (the proposal was purportedly in response to a city that was said to be cutting their police budgets by one-third). For instance, could a city suffering the financial effects of Coronavirus that makes an across-the-board budget cut of three percent find themselves penalized under such a law for having “defunded” law enforcement? While we don’t know the answer until we see the details, there is some evidence from state leaders’ actions on their own budgets that suggests the answer should be no. The state budget that was passed during the 2017 legislative session, for example, cut general revenue spending on the state’s law enforcement agency—the Department of Public Safety—by five percent (almost $100 million) from fiscal year 2016/17 to 2018/19. Federal Appeals Court Issues Opinion: Upholds FCC Cap on Small Cell Right-of-Way Fees

On August 12, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit issued its opinion in City of Portland v. the United States of America/Federal Communications Commission. The opinion is in response to several consolidated lawsuits relating to FCC orders preempting municipal authority over small cells and related equipment. The League is participating in the City of Portland-led national coalition. The opinion was a mixed bag for cities, with most issues decided in favor of the cellular industry. Most of those issues are important, but very technical. They won’t be covered here. The most important issue involves a cap on right-of-way rental (a.k.a., “franchise”) fees for small cell deployment. The panel upheld the provision in the FCC’s “small cell order” that limits a city’s right-of-way fees to “an amount needed to recover administrative costs.” The FCC ordered a presumptively reasonable recurring fee to be $270 per site, per year. Cities are expressly prohibited from recovering any cost not directly related to rights-of-way maintenance, charging fees above cost recovery, or recovering “unreasonable” costs, such as excessive contractor or consultant fees. The federal court challenge is part-and-parcel with a separate state court lawsuit brought by a coalition of Texas cities. That lawsuit claims that 2017 Texas legislation capping small cell rental fees at $250 annually per node, and 2019 legislation eliminating a portion of video franchise fees or telephone access line fees, violates the Texas Constitution’s “donations” provisions. The FCC order and the Texas legislation, if left unchecked, could lead the way to either substantial erosion or the complete elimination of all franchise fees in the future. Some estimates show future revenue losses to cities rising into the hundreds of millions of dollars annually. That’s why the lawsuits, and the League’s support of them, are so important to Texas cities. Legislative Budget Board Releases Budget Instructions for State

Agencies The Legislative Budget Board (LBB), along with the Governor's budget office, issued instructions to state agencies this week directing them to submit their Legislative Appropriations Request (LAR) with a base funding amount equal to their adjusted 2020-2021 base. Last month, Comptroller Glenn Hegar estimated that the Legislature will have $4.6 billion less to spend than originally projected for the 87th Legislature. Despite revenue uncertainty leading up to the legislative session, state agencies will not be required to request less money for 2022-2023 than what is currently budgeted for in the 2020-2021 biennium.

ORDINANCE NO. 20-878

AN ORDINANCE OF THE CITY OF HUMBLE, TEXAS, PROVIDING FOR THE VACATING, ABANDONMENT, AND CLOSING OF A PORTION OF THE SIXTY FOOT (60’) ISAACKS ROAD RIGHT-OF-WAY.

WHEREAS, the City of Humble (the “City”) is a Texas home-rule municipality organized under the Constitution and laws of the State of Texas, located in Harris County, Texas; and

WHEREAS, the City’s Charter provides that it may exercise all powers of local self-government and

powers granted to home rule cities by State Law; and WHEREAS, the Texas Transportation Code provides that a home-rule municipality may vacate,

abandon, or close a street or alley; and WHEREAS, the City Council of the City of Humble, Texas finds that a portion of the sixty foot (60’)

Isaacks Road Right-Of-Way, more or less depicted in the metes and bounds survey attached hereto as Exhibit A, lying east of Wilson Road and situated between the terminus of the existing improved portion of Isaacks Road and Block 1, Lot 2 of Humble Place Sec. 1 consisting of 1.416 acres of land (49,729.80 square feet), was never opened or improved as a public road; and

WHEREAS, the City does not intend to pave or otherwise use the said portion of the sixty foot (60’)

Isaacks Road Right-Of-Way; and WHEREAS, GEH Properties, LLC is a privately owned Texas Limited Liability Corporation operating

in the State of Texas; and WHEREAS, GEH Properties, LLC has requested that the City abandon a portion of the sixty foot (60’)

Isaacks Road Right-Of-Way so that GEH Properties, LLC may construct a private road to provide access to Track 21 of the G H Hermann Subdivision, Abstract 484 of the J.B. Jones Survey, which abuts the stated portion of the sixty foot (60’) Isaacks Road Right-Of-Way; and

WHEREAS, GEH Properties, LLC has provided an Easement Agreement to the Estate of W.E. Sarver

to provide for free and uninterrupted vehicular and pedestrian access to Track 21C of the Herman GH Subdivision, Abstract 484 of the J.B.Jones Survey, which also abuts the stated portion of the sixty foot (60’) Isaacks Road Right-Of-Way; and

WHEREAS, the City has obtained an appraisal determining the fair market value of the stated portion

of the sixty foot (60’) Isaacks Road Right-Of-Way and agrees to convey the stated portion by Special Warranty Deed to GEH Properties, LLC upon adoption of this ordinance; and

WHEREAS, the City provided notice by Certified United States Postal Service to all adjoining property

owners that may have an interest in the Right Of Way; and

WHEREAS, the City Council finds that abandoning the portion of the stated sixty foot (60’) Isaacks Road Right-Of-Way will cause no detriment to the rights of the citizens of Humble, Texas; and

WHEREAS, the City Council finds and declares that it is in the best interest of all of the citizens of

Humble, Texas that the part of said sixty foot (60’) Isaacks Road Right-Of-Way be vacated, closed and abandoned; and

WHEREAS, the City intends to terminate its interests only, if any, in the part of the said sixty foot (60’)

Isaacks Road Right-Of-Way and does not intend to convey or terminate any property interest of any person owning property abutting the sixty foot (60’) Isaacks Road Right-Of-Way or any other property in the Herman GH Subdivision, Abstract 484 of the J.B. Jones Survey; now therefore

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF HUMBLE, TEXAS, THAT: Section 1. The facts set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The City’s interest, if any, of the part of the sixty foot (60’) Isaacks Road Right-Of-Way

lying east of Wilson Road and situated between the terminus of the existing improved portion of the Isaacks Road Right-Of-Way and Block 1, Lot 2 of Humble Place Sec. 1 consisting of 1.416 acres of land (48,729.80 square feet) is hereby vacated, abandoned and closed to be conveyed to GEH Properties, LLC for and in consideration of $10.00 and other good and valuable consideration. A survey showing the metes and bounds of the property to be abandoned is attached as Exhibit "A.”

Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance or the

application of same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part of provision hereof other than the part declared to be invalid, unconstitutional; and the City Council of the City of Humble, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
