(five) Student Hearing Cases and recommended that an Ad Hoc Committee be formed which would schedule and attend the hearings prior to the April 5, 2017 Board meeting, write and submit a report to the full board and use the April 5, 2017 meeting as forum for discussion and decisions.

WNY Board of Education (School Ethics Commission case – docket # c19-14) Next, the Board Secretary proceeded to read aloud the School Ethics Commission’s Resolution of Censure (adopted at its February 28, 2017 meeting) related to the above-stated matter, as required by School Ethics Commission and the NJDOE. Vice President Gonzalez addressed the Board and the public with a proposal to strengthen the district’s existing policies relating to Transgender Students. In keeping with the aforementioned approval, this Board does hereby also approve the submission of the March 2016, Secretary and Treasurer Reports to the N.J. 1.4 Transfers BE IT RESOLVED, that this Board of Education, upon the recommendation of the Superintendent of Schools, authorizes the following line item transfers and certifies that the proposed transfer(s) will not affect implementation of any approved programs and/or services:
1.5 Essex Regional Educational Services Commission - Contracts 2017-18 WHEREAS, the Essex Regional Educational Services Commission (ERESC) will continue to provide both Non-Public and Public School Services during the 2017-2018 school year in conjunction with Chapters 192/193, Home Instruction, and Title I (NCLB). WHEREAS, it is the responsibility of the Superintendent of Schools of the West New York School District to enter into an agreement with the Essex Regional Educational Service Commission for said services.

RESOLVED, upon the recommendation of the Superintendent, the Essex Regional Educational Services Commission will provide the following services during the 2017-2018 school year within the terms and conditions of the contract as embodied within the grant. Chapters 192/193 Title I Public School Home Instruction 1.6 Amendment to the 2016-17 Essex Regional Educational Services Commission (ERESC) Agreement WHEREAS, at its June 8, 2016 Board Meeting, the West New York Board of Education resolved for the West New York School District to enter into an agreement with the Essex Regional Educational Services Commission (ERESC), the latter to provide both Non-Public and Public School Services during the 2016-2017 school year in conjunction with Chapters 192/193, Home Instruction, and Title I (NCLB). WHEREAS, ERESC communicated to the District that the 2016-17 instructional plan has been fully funded with a positive $20,452.93 balance of Title I grant funds remaining un-allocated and proposed that the existing contracts be amended to provide for the remaining balances to be allocated towards purchases of reading books and other supplies / materials for qualifying WNY students. The balances are as follows: St. Joseph School: $12,248.75
St. Augustine: $6,451.14
Mother Seton: $253.04
AOLG: $1,500.00
THEREFORE, BE IT RESOLVED, that upon the recommendation of the Superintendent, that the District's existing 2016-17 Agreement with ERESC be amended via addition of the following qaulification in paragraph 1 (one) of the Agreement: "Funds remaining after instruction is completed to eligible students may be used to purchase reading books and other supplies / materials for WNY students."
1.7 MHS Spring Athletic Bid #02(d)17 WHEREAS, Public Notice was provided in the Jersey Journal on February 14, 2017 informing interested parties of the receipt of sealed bids for the purchase of said supplies, and WHEREAS, on Friday, February 24, 2017, the West New York Board of Education conducted a public bid opening for the award of 2017 Memorial High School (MHS) Spring Athletic supplies which yielded the following consideration:

NOW, THEREFORE BE IT RESOLVED, that the West New York Board of Education award the contract for the 2017 Spring Athletic supplies to Levy’s Inc. in the total contract lump sum of $33,451.56. 1.8 MHS Project Graduation Donation BE IT RESOLVED, that the West New York Board of Education, upon the recommendation of the Superintendent of School and in accordance with West New York Board of Education Policy/Regulation #7230 (Gifts, Grants and Donations), accepts the following donations from the following donors:

WHEREAS, N.J.S.A. 18A:18A-4.6 provides the ability to implement energy savings programs; and
WHEREAS, N.J.S.A. 18A:18A-4.3 et. seq. permits the Board to competitively contract and solicit proposals for goods and services; and
WHEREAS, this Board is permitted to solicit goods and services under both the Request for Proposals process and the Request for Qualifications
process.
NOW THEREFORE BE IT RESOLVED that this Board, upon the recommendation of the Superintendent of Schools, permits the Business
Administrator/Board Secretary to move forward with soliciting for energy savings programs through the competitive contracting or RFP process.

2.3 Professional Development/Travel WHEREAS, the West New York Board of Education, as per policy # 6471 has determined that participation in professional activities, including conferences and meetings requires travel expenditures and that this travel is critical to the administrative and/or instructional needs of the district; and WHEREAS, the West New York Board of Education has determined that the school district travel expenditures to the activities listed below are in compliance with both the West New York travel policy and with stated travel guidelines as established by the Department of the Treasury and within the guidelines established by the Federal Office of Management and Budget, NOW THEREFORE, BE IT RESOLVED, that the West New York Board of Education, upon recommendation of the Superintendent of Schools, approves the attendance of the listed district employee as per the following including all registration fees and statutorily authorized travel expenditures to be charged as outlined below:

For each school day of the second week of said period said employee shall be paid a sick day’s salary (defined as 1/200th of the annual salary) less the pay of a substitute or the estimated cost of the employment of a substitute if none is employed. B. After the expiration of the above 2 week period and with the concurrence of the Medical Director of the Board of Education on the recommendation from the attending physician of said employee that further absence from service is essential, the Board (having in mind the length of employment of such employee) shall grant further leave to such ill employee. C. Upon the exhaustion of the extended sick leave period as herein set forth Employee ID#598 shall suffer full and complete loss of pay until such time that
he is able to return to employment. 6.16 Bonus Sick Days WHEREAS, this Board has determined to grant Employee ID#1134, NJFLA leave beginning March 1, 2017; and

WHEREAS, Employee ID#1134 has made application to this Board for a continuation of paid sick leave pursuant to Article 10 of the Agreement between the West New York Board of Education and the West New York Education Association. NOW THEREFORE, BE IT RESOLVED, this Board grants Employee ID#1134 leave under NJFLA from March 1, 2017. NOW THEREFORE, BE IT RESOLVED, this Board upon the recommendation of the Superintendent of Schools, in keeping with Article 10 of the Agreement between the West New York Board of Education and the West New York Education Association and having considered the request of said employee and having reviewed the supporting documentation and by reason of the special circumstances which exist and for good cause shown, hereby grants additional sick leave to Employee ID#1134 commencing March 1, 2017 for a period not to exceed 64 days subject to the following limitations as enumerated below and pursuant to Article 10 of the Agreement: A. 6.17 Resignation/Retirement WHEREAS, Michael Furlong has advised the District that he is retiring effective September 1, 2017; and
WHEREAS, Mr. Furlong has determined to voluntarily sever his employment with the Board effective immediately and has requested that the Board waive the 60 day requirement. NOW THEREFORE, BE IT RESOLVED, that consistent with Mr. Furlong’s resignation letter, and upon the recommendation of the Superintendent of Schools, the Board hereby accepts Mr. Furlong’s resignation effective March 2, 2017 and waives the 60 day requirement. BE IT FURTHER RESOLVED that this Board wishes Mr. Furlong good fortune in his future endeavors and a long and happy retirement.
