The coaaission found that Ruggles: while an officer of two investment COIIpaniesandtheir investment advisor, engaged in a practice of scalping the investment coapanies'purchases of securities for the benefit of a relative and three friendss violated Section 206(2) of the Inv$staent Advisers Act of 1940 by failing to disclose his prac-tice of scalping to the investment COIIpanies and the investment advisor, and violated Section 10(b) of the Securities Bxchange Act of 1936 and Rule 10b-S by aisappropriat-ing the confidential non-public information of the investment cOllpanies and their advisor regarding their securities trading activity.
