I herein acknowledge receipt of correspondence dated 08/09/2004, in response to the IPC Licence application submitted 10 August 2004, on behalf of Kerry Pig Producers Ltd.

Under Article 10 of the Regulations, I herein respond to each of the issues raised. 1. The last grant of planning permission issued by Kerry County

Council, in respect of this facility, was attached to the IPC Licence application submitted. This planning application when submitted did not include an EIS.

2. The site notice has been amended, (see copy included as Attachment 1). The public notice was amended and published in the Irish Examiner on 20th October 2004, (see copy included as Attachment 2).

3. A site map, with the site boundary outlined in red, amended to incorporate SW1, SW2, SW3, and the septic tank and percolation area, is being prepared and will be submitted under separate cover, on or before 10 November 2004.

4. A description of the slurry transfer procedure, with controls, and a map showing the slurry movement on site, with tanks, channels, sluice gates, and extraction points, is being prepared and will be submitted under separate cover on or before 10 November 2004.

5. The rainwater flow, for this facility, including all piped roof water, and general storm-water from yard areas, will be identified on the site map currently being prepared, and referenced in 3 and 4 above.

6. A farm structures table will be included with the site plan which will be submitted on or before 10 November 2004,

7. The used fluorescent tubes from this facility are delivered to Chemcar Ltd, who collect hazardous waste for Kerry County Council in their area. They will collect from Tralee twice a year, and deliver to Irish Lamps Recycling Ltd. These movements will be recorded on site as they occur, and will be available for inspection.

8. Kerry Pig Producers Ltd, supply pig manure to customer farmers, as a fertiliser source, the details of which were submitted to the Agency with the application in a confidential format. Kerry Pig Producers have consulted with their customer farmers, as the owners of the information concerned, which the Agency wish to put on public file, and have been instructed by said customer farmers not to present their information to the Agency for placement on public file. The necessary detail is attached in a file marked “CONFIDENTIAL”.

9. The general refuse from this facility is regularly removed by Killarney Waste Disposal Ltd (KWD). The details of collection agreement and necessary permits are included in Attachment 3. The veterinary waste generated on site is removed by Healthcare Initial Ltd, and delivered to Sterile Technologies Ltd for disposal. A copy of the necessary permits and licences are included as Attachment 3. The pig carcasses generated on site are regularly collected by Wards Ltd, and a letter of agreement is attached.

10. In the event of a Class A disease outbreak, the Dept of Agriculture will be the controlling Authority. I have attached for your attention a copy of correspondence issued by the Dept of Agr, to Mr Ger McCutcheon of Teagasc, in respect of this matter. This correspondence is included as Attachment 4.

11. The location of the well on site is identified on a map included in Attachment 5.

12. A map is being prepared identifying the location of dwellings within 700m of this facility, and cross referenced with the EPA published document “Odour impacts and Odour Emission Control Measures for Intensive Agriculture”. This map will be submitted under separate cover on or before 10 November 2004.
