It is noted that proposal is for setting up of molasses based Distillery Unit (60 KLPD) along with Cogeneration Power Plant (2.0 MW) at Village Jangraulipul Tehsil Pilibhit District U.P. by M/s L H Sugar Factories Ltd. Total plot area is 29.0 acres of which greenbelt will be developed in 9.5 acres. Devha Nadi and River Apsarya are flowing within 10 km distance. It is reported that no national parks/reserved forests/protected forest/wildlife sanctuaries/biosphere reserves are located within 10 km distance. Distillery will be operated for 330 days per annum: Cost of project is Rs. 61.0 Crore. Rs. 12.5 Crore and Rs. 1.2 Crore are earmarked towards capital cost and recurring cost per annum for pollution control measures. 3.0 Bagfilter alongwith stack of adequate height will be provided to biomass/biogas fired boiler to control particulate emissions within 50 mg/Nm 3 . Fresh water requirement from ground water source will be 597 m 3 /day. The spent wash from molasses based distillery will be evaporated in MEE and concentrated spent wash will be incinerated in the incineration boiler to achieve 'Zero'discharge. No effluent will be discharged outside the factory premises and 'zero' discharge concept will be maintained. 2.0 The Ministry of Environment, Forest and Climate Change has examined the application. 4.0 Public hearing/public consultation meeting was held on 19thSeptember, 2014.

5.0 All molasses based distilleries are listed at S.N. 5(g) (i) under category 'A' and appraised atCentral level.

6.0 The proposal was considered by the Expert Appraisal Committee (Industry) in its meetingsheld during 20th - 21st February, 2014, 20th_21stJanuary, 2015 and 20th_21stApril, 2015 respectively.Project Proponent and the EIA Consultant namely M/s J M EnviroNet Pvt. Ltd., have presented EIA IEMP report as per the TOR. EAC has found the EIA / EMP Report and additional information to besatisfactory and in full" consonance with the presented TORs. The Committee recommended theproposal for environmental clearance.

7.0 Based on the information submitted by the project proponent, the Ministry of Environment andForests hereby accords environmental clearance to above project under the provisions of EIANotification dated 14th September 2006, subject to the compliance of the following Specific andGeneral Conditions:

A. SPECIFIC CONDITIONS:

i) Distillery unit shall be based on molasses based only and no grain based distillery unit shallbe operated.

ii) As proposed, bagfilter alongwith stack of adequate height should be provided tobiomass/biogas fired boiler to control particulate emission within 50 mg/Nm3. Bagfilter shallbe provided to incinerator boiler (25 TPH) to control particulate emissions. At no time, theemission levels shall go beyond the prescribed standards. In the event of failure of anypollution control system adopted by the unit, the respective unit shall not be restarted untilthe control measures are rectified to achieve the desired efficiency. Efficiency of pollutioncontrol device shall be monitored regularly through online (24x7) monitoring system. Stackmonitoring report shall be submitted to the Ministry's Regional Office at Lucknow.

iii) In plant, control measures for checking fugitive emissions from all the vulnerable sourcesshall be provided. Fugitive emissions shall be controlled by providing closed storage,closed handling & conveyance-of chemicals/materials, multi cyclone separator and watersprinkling system. Dust suppression system including water sprinkling system shall beprovided at loading and unloading areas to control dust emissions. Fugitive emissions inthe work zone environment, product, raw materials storage area etc. shall be regularlymonitored and records shall be maintained. The emissions shall conform to the limitsprescribed by Uttar Pradesh Pollution Control Board (UPPCB).

iv) Pucca approach road to project site shall be constructed prior to commencing constructionactivity of the main distillery so as to avoid fugitive emissions.

v) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB guidelines. Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution.

The company shall upload the status of compliance of the stipulated environmentalclearance conditions, including results of monitored data on its website and shall updatethe same periodically, It shall simultaneously be sent to the respective Regional office ofMOEF, the respective Zonal office of CPCB and the UPPCR The levels of PM1o, PM2.5,

S02, CO, NOx and HC (Methane) in ambient air shall be monitored and displayed at aconvenient location near the main gate of the company and at important public places.

Total fresh water requirement from ground water source shall not exceed 597 m3/day fordistillery and cogeneration unit and prior permission for drawl of water shall be. obtainedfrom the CGWAlSGWA.

Spent wash generation from molasses based distillery shall not exceed 8 KI/KI of alcohol.The spent wash from molasses based distillery shall be evaporated in MEE andconcentrated spent wash will be incinerated in the incineration boiler to achieve 'Zero'discharge. Spentlees, Evaporator Condensate and Utilities effluent shall be treated andrecycled/reused in process. No effluent shall be discharged outside the premises and 'Zero'discharge shall be maintained,

No effluent from distillery shall be discharged outside the premises and Zero dischargeconcept shall be adopted.

Automatic /online monitoring system (24 x 7 monitoring devices) for flow measurement andrelevant pollutants in the treatment system to be installed. The data to be made available tothe respective SPCB and ln the Company's website ..

Process effluent/any wastewater shall not be allowed to mix with storm water. Storm waterdrain shall be passed through guard pond. .

Molasses shall be transferred through closed tankers and no spillage shall be done whiletransporting.

xiii) Spent wash shall be stored in impervious RCC lagoon with HOPE lining as per CPCBguidelines and should be kept in proper condition to prevent ground water pollution.Storage capacity of spent wash lagoon should be for .10 days.

xiv) Adequate numbers of ground water quality ·monitoring stations by providing piezometersaround the project area should be set up. Sampling and trend analysis monitoring must bemade on monthly a basis and report submitted to SPCB and this Ministry. The groundwater quality monitoring for pH, BOD, COD, Chloride, Sulphate and total dissolved solidsshould be monitored. Sampling and trend analysis monitoring must be made on monthlybasis and report submitted to the Ministry's Regional Office at Lucknow and UPPCR

xv) Bagasse/biomass storage shall be done in such a way that it does not get air borne or flyaround due to wind.

xvi) Fly ash shall be stored separately as per CPCB guidelines so that it shall not adverselyaffect the air quality, becoming air borne by wind or water regime during rainy season byflowing alongwith the storm water. Direct exposure of workers to fly ash & dust shall be.avoided, Bagasse ash and coal ash shall be stored separately.

Fire fighting system shall be as per the norms and cover all areas where alcohol isproduced, handled and stored. Provision of foam system for fire fighting shall be made tocontrol fire from the alcohol storage tank.

Risk Assessment shall be carried to assess the fire and explosion risk due to storage ofalcohol and report submitted to the Ministry and its Regional Office at Lucknow within sixmonths.

Occupational health surveillance programme shall be undertaken as regular exercise for allthe employees. The first aid facilities in the occupational health centre shall bestrengthened and the regular medical test records of each employee shall be maintainedseparately.

Dedicated parking facility for loading and unloading of materials shall be provided in thefactory premises. Unit shall develop and implement good traffic management system fortheir incoming and outgoing vehicles to avoid congestion on the public road.

As proposed, green belt over 33 % of the total project area shall be developed within plantpremises with at least 10 meter wide green belt on all sides along the periphery of theproject area, in downward direction, and along road sides etc. Selection of plant speciesshall be as per the CPCB guidelines in consultation with the DFO.

All the commitments made during the Public Hearing/Public Consultation meeting held on19th September, 2014 shall be satisfactorily implemented and adequate budget provisionshall be made accordingly.

At least 5 % of the total cost of the project shall be earmarked towards the EnterpriseSocial Commitment (ESC) based on local needs and action plan with financial and physicalbreakup/details shall be prepared and submitted to the Ministry's Regional Office atLucknow. Implementation of such program shall be ensured accordingly in a time boundmanner.

The Company shall submit within three months their policy towards Corporate EnvironmentResponsibility which should inter-alia address (i) Standard operating process/procedure tobeing into focus any infringement/deviation/violation of environmental or forestnorms/conditions, (ii) Hierarchical system or Administrative order of the Company to dealwith environmental issues and ensuring compliance to the environmental clearanceconditions and (iii) System of reporting of non compliance/violation environmental norms tothe Board of Directors of the company and/or stakeholders or shareholders.

Provision shall be made for the housing for the construction labour within the site with allnecessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobilesewage treatment plant, safe drinking water, medical health care, creche etc. The housingmay be in the form of temporary structure to be removed after the completion of the project.All the construction wastes shall be managed so that there is no impact on the surroundingenvironment.

B. GENERALCONDITIONS:

i. The project authorities shall strictly adhere to the stipulations made by the U.P. PollutionControl Board and the State Government.

ii. No further expansion or modifications in the plant shall be carried out without priorapproval of the Ministry of Environment and Forests. In case of deviations or alterations inthe project proposal from those submitted to this Ministry for clearance, a fresh referenceshall be made to the Ministry to assess the adequacy of conditions imposed and to addadditional environmental protection measures required, if any. .

iii. The National Ambient Air Quality Emission Standards issued by the Ministry vide G.S.R.No. 826(E) dated 16th November, 2009 shall be followed.

iv. The locations of ambient air quality monitoring stations shall be decided in consultationwith the U.P. Pollution Control Board (UPPCB) and it shall be ensured that at least onestation is installed in the upwind and downwind direction as well as where maximumground level concentrations are anticipated.

v. The overall noise levels in and around the plant area shall be kept well within thestandards by providing noise control measures including acoustic hoods, silencers,enclosures etc. on all sources of noise generation. The ambient noise levels shall conformto the standards prescribed under Environment (Protection) Act, 1986 Rules, 1989 viz. 75dBA (day time) and 70 dBA (night time).

vi. The Company shall harvest rainwater from the roof-tops of the buildings and storm waterdrains to recharge the ground water and use the same water for the process activities ofthe project to conserve fresh water.

vii. The Company shall obtain Authorization for collection, storage and disposal of hazardouswaste under the Hazardous Waste (Management, Handling and Trans-boundaryMovement) Rules, 2008 and its amendment time to time and prior permission from SPCBshall be obtained for disposal of solid! hazardous waste including boiler ash.

viii. During transfer of materials, spillages shall be avoided and garland drains be constructedto avoid mixing of accidental spillages with domestic wastewater and storm water drains.

ix. Usage of Personnel Protection Equipments by all employees! workers shall be ensured.

x. Training shall be imparted to all employees on safety and health aspects of chemicals.handling. Pre-employment and routine periodical medical examinations for all employeesshall be undertaken on regular basis. Training to all employees on handling of chemicalsshall be imparted.

xi. The company shall also comply with all the environmental protection measures andsafeguards proposed in the project report submitted to the Ministry. All therecommendations made in the EIAIEMP in respect of environmental management, riskmitigation measures and public hearing relating to the project shall be implemented.

xii. The company shall undertake CSR activities and all relevant measures for improving thesocio-economic conditions of the surrounding area. I(

xiii. The company shall undertake eco-developmental measures including community welfaremeasures in the project area for the overall improvement of the environment.

xiv. A separate Environmental Management Cell equipped with full fledged laboratory facilitiesshall be set up to carry out the Environmental Management and Monitoring functions.

xv. The company shall earmark sufficient funds toward capital cost and recurring cost perannum to implement the conditions stipulated by the Ministry of Environment and Forestsas well as the State Government along with the implementation schedule for all theconditions stipulated herein. The funds so earmarked for environment management/pollution control measures shall not be diverted for any other purpose.

xvi. A copy of the clearance letter shall be sent by the project proponent to concernedPanchayat, Zila Parisad/Municipal Corporation, Urban local Body and the local NGO, ifany, from whom suggestions/ representations, if any, were received while processing theproposal.

xvii. The project proponent shall also submit six monthly reports on the status of compliance ofthe stipulated Environmental Clearance conditions including results of monitored data(both in hard copies as well as bye-mail) to the respective Regional Office of MoEF, therespective Zonal Office of CPCB and the U. P. Pollution Control Board. A copy ofEnvironmental Clearance and six monthly compliance status report shall be posted on thewebsite of the company.

xviii. The environmental statement for each financial year ending 31st March in Form-Vas ismandated shall be submitted to the U.P. Pollution Control Board as prescribed under theEnvironment (Protection) Rules, 1986, as amended subsequently, shall also be put on thewebsite of the company along with the status of compliance of environmental clearanceconditions and shall also be sent to the Bangalore Regional Offices of MoEF bye-mail.

xix. The project proponent shall inform the public that the project has been accordedenvironmental clearance by the Ministry and copies of the clearance letter are availablewith the SPCB/Committee and may also be seen at Website of the Ministry athttp://envfor.nic.in.This shall be advertised within seven days from the date of issue of theclearance letter, at least in two local newspapers that are widely circulated in the region ofwhich one shall be in the vernacular language of the locality concerned and a copy of thesame shall be forwarded to the concerned Regional Office of the Ministry.

xx. The project authorities shall inform the Regional Office as well as the Ministry, the date offinancial closure and final approval of the project by the concerned authorities and thedate of start of the project.

8.0 The Ministry may revoke or suspend the clearance, if implementation of any of the aboveconditions is not satisfactory.

9:0 The Ministry reserves the right to stipulate additional conditions, if found necessary. Thecompany in a time bound manner will implement these conditions.

10.0 The above conditions will be enforced, inter-alia under the orovisrons of the Water(Prevention & Control of Pollution) Act, 1974, Air (Prevention &. Control of Water Pollution) Act, 1981,the Environment (Protection) Act, 1986 Hazardous Waste (Management, Handling and Trans-boundary Movement) Rules, 2008 and the Public Liability Insurance Act, 1991 along with theiramendments and rules.

11.0 Environmental Clearance is issued to M/s L H Sugar Factories Ltd. for molasses baseddistillery unit (60 KLPD) along with Cogeneration Power Plant (2.0 MW) at Village Jangraulipul TehsilPilibhit District U.P.
