recommended the following Stipulation

STIPULATIoN

1 This is an agreement (stipulation) between Justin stewart Noa (Mr Noa)

anil the Executive committee (the Executive committee) of the professional

Standards Commiesion (the Commission)

2 If Mr Noa wishes to agreo to this stipulation he must sign ad return this

stipulation and any attachments toche commission by b00 pm (mountain time)

on February 27 2017 unless he has been granted an exteneion

3 After MI Noa and the Executive Committee agree to and sigrr this

Stipulatiou the Strpulation must be approved by the Commission and the

commission must enter the attached consent older before this stipulation resolves

with a letter that stated in part I unequivocally resign as my role as teacher

9 In that letter Mr Noa also requested to be releaseal from his contract

10 On or about August 13 2014 Mr Noa diil not report for his teachiag

assignment

schooi board fid not approve a release ftom his contract

C Presentation of this Stipulation

18 Once Mr Noa signs this Stipulation and timely returns it to the Commission

and the Executive Committee signs tJris Stipulation the Deputy Attorney General

assigned to the Commission will preeent this Stipulation to the Commission at the

Commissione next bueiness meeting

19 The Commission may accept reject or modify the Stipulation

20 If the Commission modifies this Stipulation it must r-eceive Mr Noas

approval on any modification before the Stipulation is effective

D Waiver of Rights

21 If this Stipulation is approved by the Commission Mr Noa knowingly

intelligently and voluntarily waivos the following rights

a the righc to a hearingb the right to conftont anil crosg-examine witnesses c the right to present evidence or to call witnesses or to testiry at a

hearingd the right to reconsideration ofthe Commisaions ordere e the right to judicial reviow of the Commissions ordere andf other rights accorded by the Idaho Administrative procedure Act and

the law and rules governing teacher certification in the State of Idaho

22 If this Stipulation is approved by the Commission the Conmission may

impoee discipline upon Mr Noas certiicate without furthor process

23 By signing this Stipulation Mr Noa agrees to waive any requirement for a

heariug under Idaho Code g 33-1209(3) to be conilucted within g0 days ofhis

request for a hearing This waiver applies to any hearing request made beforo the

Commission ultimately rejects this Stipulation (if it does) or bofore Mr Noa

ultimately rejects a modified strpulation (if Mr Noa does) If the Commieeion
