GENERATION OF MAT4TER
on August 10, 1979, the North Carolina Federation of RepublicanWomen (the Federation) was referred to the Office of General Counselby the Reports Analysis Division (RAD) for failure to register as a'political committee and report as such, in violation of 2 U.S.C. S433and §434.
EVIDENCE
on October 11, 1977, the Federation transferred $1,312.00 to theNorth Carolina Republican Executive Committee -(the Committee), a registeredparty committee. The Federation was notified via a surface violation letterdated October 17, 1978, that they might qualify as a political committee
S under the Act.
This letter elicited a response from Mrs. Glen L. Krumel, treasurerof the Federation. Mrs. Krumel stated the Federation was not a politicalcommittee since the $1,312.00 consisted of contributions from Privateindividuals to the Committee. The contributions were made at the requestof the President of the Federation. Mrs. Krumel also supplied a list ofthe contributors.
PRELIMINARY ANALYSIS
Judging by the statements made by Mrs. Kruxnel, it appears theFederation did not retain any of the money it collected from its membersfor the Committee, nor did it exercise any control over that money. There-fore, it can be assumed that the Federation was merely acting as a collectionagent for the Committee and, as such, would not be considered a political
committee subject to the reporting requirements of 2 u.s.c. S434. (SeeRe: AOR 1976-15)
However, the Federation would be subject to the requirements of11 C.F.R. S102.8 which states that every person who receives contri-butions aggregating in excess of $50 on behalf of a political committeeshall, within five days after receipt, render to the treasurer orauthorized agent of the political committee, an accounting thereof,which shall include: a) the exact amount of the contribution andthe date received; and b) the identification of the contributor and,in the case of a contribution with a value in excess of $100, theoccupation and principal place of business or employment, if any.The Committee would be required to include this information in its nextreport.
In order to insure compliance with the Act, the Federation shouldnot accept any contributions in the form of a check unless it is made outfor the Committee if the Committee is to be the ultimate recipient. (SeeOC 1975-120)
Consequently, as no mention is made to conduit reporting by these"collection agents" in the various advisory opinions on this subject, andsince the Committee is responsible for full disclosure and reporting of, these contributions, this office feels the Federation is not required tofile reports as a conduit.
Pr' It is also the opinion of this office that RAD inform the Committeeof the various requirements that must be met regarding the Federation'sassumption of the role of a collection agent.
It should be noted that these findings are consistent with those ofMUR 1019 which involved the same situation,
RECOMMENDATION
1. Find no reason to believe that the North Carolina Federation of
Republican Women violated 2 U.S.C §433 and S434.

The responses received from each of these committees are somewhatsimilar in nature, and for this reason, the committees are beingreferred in packet form. In addition, we believe that in light ofAO 1978-91, the Office of General Counsel should have the opportunityto review together each of these situations, prior to making a.recommendation on any one individual committee.
In general, the committees have stated that the funds transferredto their State Central Committees were not contributions from them-selves, hut were rather contributions collected by the unregisteredcommittees to be passed on to the State Central Committees. Inseveral oF the cases-, it is known that the funds passed throughthe treasuries Of the unregistered committees, but in other casesthis is not known.
The North Carolinma Democrat icthey were acting as agents forcollection and transmission of
committees, in particular, statethe State Central Committee, inthese funds.
If the Commission Finds these responses to be adequate because otthe "conduit" nature of the unregistered committees, we suggestthat at a minimum thfe intended rec ipient shoul1d be -required t o adioptreporting procedures, similar to those specified in It CFR 110.6,for the reporting of such transfers.
