Media personality and activist Tavis Smiley has been an outspoken and persistent advocate of ending poverty in America, culminating in the radio host and his foundation recently initiating “ENDING POVERTY: America’s Silent Spaces,” a $3 million, four-year nationwide initiative to examine the causes of, and identify solutions for, poverty in the United States. The initiative seeks momentum from two book-end historical commemorations, the 50th anniversaries of President Lyndon B. Johnson’s “War on Poverty” in 2014 and of Dr. Martin Luther King Jr.’s “Poor People's Campaign,” in 2018, to refocus the nation’s attention on the millions who struggle to survive below the poverty line. “The fight to end poverty is not a new one,” Smiley said in a statement. “Our actions must be viewed as part of an ongoing historical effort to exorcise this persistent cancer.

“When Dr. King spearheaded the Poor People’s Campaign, he talked about issues that could have been pulled from today's headlines. Full employment, fair wages, housing and basic human needs will always be relevant and they must be available to all.” Smiley added, “Like President Franklin D. Roosevelt before him, King called for an economic bill of rights to address economic inequality, even proposing a $30-billion dollar anti-poverty package to create a more equitable environment. We must

create our own specific agenda to dismantle poverty, and we must work together to achieve it.” “ENDING POVERTY” will take a grassroots approach, engaging and mobilizing individuals, communities, and organizations to come up with innovative solutions to eradicate poverty, even as it seeks to increase media coverage of the issue.

First up will be a Twitter chat in the coming weeks about the factors that influence poverty. Moderated by Smiley, the chat will include a panel comprising some of the country’s top minds in the areas of poverty, education and philanthropy, including Robert K. Ross, president of The California Endowment; Randi Weingarten, president of the American Federation of Teachers; U.S. Rep. Marcia Fudge (D-Ohio) chairwoman of the Congressional Black Caucus; and Thomas Saenz, president and general counsel for the Mexican American Legal Defense and Education Fund.

As the initiative goes into full swing, the Foundation will host town hall meetings in 25 cities across the country over the four years. Footage from each town hall meeting will be captured for a feature-length documentary about endemic poverty in America to be released in 2018, in conjunction with the 50th anniversary of

the “Poor People’s Campaign.” The “ENDING POVERTY” initiative comes in the wake of Census Bureau reports reports showing negative trends on poverty and incomes. Approximately 46.5 million people lived below the poverty line in 2012, representing 15 percent of the population—a 2.5

percent increase from 2007, the Bureau reported. And, as usual, Blacks and Hispanics suffered disproportionately from falling incomes and increasing poverty, even as the richest Americans claimed an outsized portion of national income.

Last year, the top 1 percent earned nearly 20 percent of all household income, while the top 10 percent earned more than 48 percent of all household income, according to

Bureau data. “It was President Lyndon B. Johnson who emphasized in his 1964 State of the Union Address that, ‘the war against poverty will not be won here in Washington; it must be won in the field, in every private home, in every public office, from the courthouse to the White House,’” Smiley said in the statement. “It was also during that speech that President Johnson famously announced, ‘This administration today, here and now, declares unconditional war on poverty in America.’ 50 years later it’s clear that the war has not been won and unfortunately the battle is being lost.” For additional information about “ENDING POVERTY: America’s Silent Spaces,” visit www.tavistalks.com/endingpoverty.

For decades I have watched cultural event come and go in Dallas, TX. For some reason, events like the Black Family Reunion, Black Expo and Sister to Sister have tried to build a base in the Big D, but for some reason the organizers did not get the traction or support they wanted so they moved on.

Time and time again, I have heard people say that Dallas is a strange beast where it is hard to galvanize the masses.

Well, I remember the masses, to the tune of over 10,000 in the inaugural year of KwanzaaFest and steadily growing to well over 50,000 in recent years. Now the 10,000 number was one that the media reported, based on their calculations of the thousands who made their way to Lincoln High School for the cultural festival, celebrating the seven principles of Kwanzaa. Everyone was surprised at the overwhelming response from the vendors, business community and citizens.

Over the years, KwanzaaFest was a great place to see old friends, pick up unique items, support Black businesses and receive hundreds of dollars in health screenings. I also liked the idea of visiting with the entrepreneurs who present their wares for sale.

Last week, there were reports that after 22 years, KwanzaaFest would not be occurring this year. I know that I was not the only person disappointed.

Actually I was more than disappointed! While there are cities across America that have cultural festivals every month, I didn’t want to hear about another program leaving the city because of apathy, fear, or ambivalence. Sure corporate sponsorship is important, but there has to be the support from the community and thankfully that support has not wavered.

Earlier this week, Dallas County Commissioner John Wiley Price, standing with KwanzaaFest committee members and DeDe McGuire, Lady Jade, Kiki and others from K104 and KRNB, had this to say about KwanzaaFest:

“KwanzaaFest 2013 wi! be held on December 14th and December 15th, because of this community coalesced behind the principles of Kwanzaa.   We anticipate, HealthFest, our lead component, wi! record close to 30,000 screenings at a value of more than one mi!ion do!ars. On behalf of the founding and standing committees, I want to say, “Thanks”!

“We want to begin by expressing our gratefulness for K104 and 105(dot) 7,  Smooth R&B.   Not only have they stepped up their annual commitment and one of our sponsors who has made it possible for KwanzaaFest 2013 to continue, but they have been an integral part of our ability to attract our patrons to the event. Hyman Childs and his team have never lost sight of the need for corporations to reinvest in the community that has made him and so many others successful.  “KwanzaaFest 2013 wi! proceed as previously planned, because this community and especia!y our sponsors are determined to make a substantive difference in the quality of life for the underserved. Despite a! of the financial encumbrances and cha!enges that a! social agencies have experienced over the past few years, news of our intent to cancel brought out the best in Da!as County!   I want to take this opportunity to thank a! of the citizens and organizations who offered to help, regardless of the size of their gi'.

“Inasmuch as the event is less than six weeks away, we have committed to redouble our efforts in order to make this another successful year. “

DeDe and Lady Jade also talked about the many calls they received from listeners expressing dismay over the news. Both ladies, who have been involved with KwanzaaFest over the years, said that the community needs KwanzaaFest and I agree with them.

KwanzaaFest is not about individuals. Malcolm X said that in order for our community to grow, we can’t focus on individuals, we must focus on issues. The issues are the focus at KwanzaaFest and we need to be in attendance!

Appeals Court Allows Unconstitutional

Abortion Restrictions – Planned

Parenthood pledges to continue to fight

for Patients

Austin, TX — A three-judge panel of the U.S. Court of Appeals for the Fifth Circuit granted Texas Attorney General Greg Abbott’s request to lift the permanent injunction entered by a federal district court Monday, allowing a measure that will make safe and legal abortion virtually impossible for one-third of Texas women in need of access.

The requirement that physicians who provide abortions obtain admitting

privileges at a local hospital is expected to cause at least one-third of the state’s licensed health centers that currently provide abortion to stop offering the service immediately.

As a result, abortion will no longer be available in vast stretches of Texas, including areas surrounding Fort Worth, Harlingen, Killeen, McAllen, and Waco.  I

n striking down the measure as unconstitutional, U.S. District Judge Lee Yeakel said the admitting privileges requirement has “no rational relationship to improved patient care” and also “places an undue burden on a woman seeking an abortion.”

The only part of Judge Yeakel’s injunction that remains is allowing the use of medication abortion for a woman between 50 and 63 days of pregnancy if she has a

medical need for that procedure.

Statement from Cecile Richards, President of Planned Parenthood Federation of America:

“This fight is far from over. This restriction clearly violates Texas women’s constitutional rights by drastically reducing access to safe and legal abortion statewide.  If Texans showed America one thing during the historic protests against this law this summer, we demonstrated that Texans value women’s health — and that is why we will take every step we can to protect the health of Texas women in the wake of this ruling.”

The lawsuit, Planned Parenthood v. Abbott, was jointly filed on September 27 on behalf of more than a dozen Texas health care providers and their patients by Planned Parenthood Federation of America, the

Center for Reproductive Rights, the American Civil Liberties Union, and the Texas law firm George Brothers Kincaid & Horton.

These dangerous and unconstitutional provisions were part of a package of legislation signed by Governor Rick Perry on July 18 following a series of special legislative sessions, but opposed by 80 percent of Texas voters, according to a poll by Greenberg Quinlan Rosner Research. Medical experts in Texas and across the country, including the American Congress of Obstetricians and Gynecologists, Texas Medical Association, and Texas Hospital Association, publicly opposed provisions in the law because they provide no medical benefit to women and will actually jeopardize women’s health and safety.

PEPSICO Volunteers Upgrade

Lake Ridge Elementary Playground

    Forty volunteers from Pepsico

worked on various projects on the grounds of Lake Ridge Elementary School in Cedar Hill, Texas on Friday October 25, 2013.  It was all part of a "Day of Caring".  The volunteers worked on updating the playground and schoolyard.

The volunteers completed the following projects:

 · Removed the obsolete garden fence and mowed down the weeds.

·  Fixed up the raised gardens; Replaced missing cinder blocks, weed, paint blocks white, put gravel walkway between gardens.

· Refurbished playground mulch; removed weeds.

· Painted seven foursquare courts.

· Painted three hopscotch courts.

· Built four portable tetherball poles in tires.

·  Painted U.S. Map on concrete.

The school and Pepsico connected through the United Way.  Lake Ridge physical education teacher Myron Courtney won a grant from United Way through the Healthy School Zone program.  As a part of the grant process Courtney had submitted a wish list of things the school wanted for its playground.  When Pepsico called the United Way asking for volunteer projects it selected Lake Ridge Elementary as one of the recipients.

"Lake Ridge Elementary is honored to be chosen as the recipients of such a wonderful gift. As a part of United Way 'Day of Caring Campaign', PepsiCo has

donated funds, equipment, and volunteers to help beautify our

campus," said Myron Courtney.

I have been watching and following all of the integral statistics of the Dallas Cowboys since I was six years old. My uncle, a butcher for a grocery store, took me and my brother to game between the New York Giants and the Dallas Cowboys in 1965.

I remember it well because the historic Cotton Bowl was crazy with the fuel of fans. Children were allowed in the game for one dollar, the stadium was full, and I can remember people then were allowed to bring in their own bottles of liquor. I almost got hit by a man waving a bottle of Cutty Sark.

One of the advantages of those old days, those old 1960-1972 days, was that stadiums and sporting arenas were not places built to make millions upon millions of dollars. They were the dens where sports

fans and sports gladiators just enjoyed the game.

There were some crazy people out there. Some driven by enthusiasm. Some driven by inebriation. But all of them crazy. Funny thing though…everybody was safe there was no reason for real alarm. It was emotion, not commotion.

I guess that's why when the TV camera zoomed in on my man Dez Bryant, who looked to be ranting and raving, I was not at all upset of startled by him. I know firsthand that the “Thrill of victory” or the “Agony of defeat “can drive you crazy especially if you want to win. Most winners are crazy.

That's why I love this Bryant and that's why I'll vote for him for president.

Now to many of you that assertion probably sounds insane. But it’s just because you have short memories or you racially profile black men all the time anyway. I remember how wild and crazy Thomas Hollywood Henderson seemed to most people. I recall how Tom Landry bridled and finally broke Duane Thomas just because he had that kind of spirited athleticism most people don't understand.

I remember how Dallas so easily

tired of a young man from Florida. His name is Michael Irvin. He wore the number 88, was long and lean in body structure and just an amazing athlete.  It seemed as though he kept getting in trouble. But it always seems like that when they televise all of the minuses and minimize all the pluses.

I've been watching Dez Bryant since his days at OK State, and the one thing I love about him is that he is driven to win.  I wish Tony Romo had Dez’ killer instinct. If three of the Cowboys had it…we’d be at least 7-1 for the season and shopping for rings.

If you want to win Super Bowl rings, you've got to have people like Dez Bryant. The kind of athlete that leaves it all on the field. The kind of athlete that makes everybody else feel like they

must give their all or become the subject of his ire and passion.

Not only am I a fan of Dez on the football field, some days I wish he would sit next to President Barack Obama.

Just once I'd like to see Bo on fire, cursing out some Republicans and acting crazy for the sake of the team.

Dez Bryant may be crazy. Hell, I may be crazy. But even the Bible says because you were not cold or hot I spit you out of my mouth.  If God didn't want you lukewarm why would I? For my vote it's Dez for Prez.

Happy 25th Birthday Dez. I want to come see you live, but the prices went way up since the Cowboys were struggling in South Dallas.

The 3rd Annual Holiday Toy Drive & Industry Mixer

On Saturday, November 9th, The Original Cupcakery & The Heads With Hearts Presents: The 3rd Annual Holiday Toy Drive & Industry Mixer, benefitting both Vogel Alcove and Kidscapes Foundation. Now in its third year, the event has moved to an exciting new home at the Dallas Holocaust Museum Center for Education and Tolerance, located in Downtown Dallas at 211 N Record St #100, Dallas, TX 75201. The Dallas Holocaust Museum is dedicated to preserving the memory of the Holocaust, and teaching a moral and ethical response to prejudice, hatred and indifference, for the benefit of all humanity. Because of their mission, this venue serves as a new and outstanding backdrop for a benefit providing much needed donations to two Dallas-based organizations that specifically aid children. Guests will mix and mingle in the event space with professionals and enthusiasts from the beauty and fashion industry, including the artist who established The Heads with Hearts, Dallas photographer Steven D. Hill. Admission for the event is simply a new, unwrapped toy or board game for children between the ages of 1-16; one per guest for entry, though additional items brought by especially generous guests is certainly welcome and would be of great value. The event is sure to include many treats for attendees, including a limited supply of complimentary cupcakes from the event sponsor, The Original Cupcakery. Every toy donated will be given directly to Vogel Alcove, an organization that works diligently to aid children from homeless families in the Dallas area; and Kidscapes Foundation, which uses education, fitness, and art to reach children living with HIV/AIDS and disadvantaged youngsters struggling with obesity. Both organizations are experiencing increased demand for resources, so events and drives including this one are vital to help fulfill a growing need. Over 300 toys and games were provided through the last Holiday Toy Drives and this year its hosts have a goal of doubling that amount. Join The Original Cupcakery & The Heads with Hearts between 6:00PM and 8:00PM on November 9th at the Dallas Holocaust Museum for a memorable evening and venue, all for a wonderful cause and to get a head start on spreading some holiday cheer.

When you begin to examine God’s faithfulness, if you look closely, you’ll find there are too

many references in the bible to quote on this subject.

I was trying to figure out a way to reference this in writing and found my spirit being moved by a quote I’ve used often.

It’s not mine so let me declare that now. “God is not schizophrenic.”

Life tends to bring that uniquely human characteristic out of us, but God is consistent in His unwavering faithfulness to us.

He actually keeps His promises and believe it or not, in His unpredictability, He is predictable.

To put it candidly, He loves us no matter what. That means you. No matter how hard we try to deny this, no matter how unworthy we believe ourselves to be, we cannot deny or change this truth because the truth never changes.

Warts, flaws and faults, God loves you.

The problem we have with God’s consistency is our own inconsistency. When you come to grips with that and put it alongside God’s steadfastness, our fickleness screams at us with a bizarre kind of laughter. I mean really.

Our behavior might and often does become sinfully shaky, but our faith should not. Then in the context of our faith, God’s promise within His covenant with us should indeed flourish.

So when you become erratic in your walk, your peace of mind, your order, your return to spiritual balance should come from your belief in God’s faithfulness and His unconditional love for you. People, we’re not dealing with trick questions, sleight of hand or spiritual illusions when it comes to the promise of eternal life and everlasting salvation in the kingdom. With mustard seed faith,

comes the understanding that God is not schizophrenic.

Someone once told me that in life, there should be things and people you can count on.

The point was being made as we referenced the many things in life that you can’t count on; those things and people who will let you down.

Friends will let you down. Family will let you down. You might think your fate is inconclusive, going nowhere and we all know fame is fleeting.

Yet and still, God is. Being a Christian does not exempt anyone from the challenges of daily life. They can be severe. Tests and testimony are real. Yet and still, God is. He does however, demand and require the discipline of faith. Unfaithfulness, schizophrenia, relapse, back sliding is what gets all of us into trouble. Faith is what gets us out. Why? Because God is good all the time; always was always will be. He is not lost. He is not moved. As a matter of fact, He is at the same place where you originally found Him. Through all your messes, look there and you will find Him again and again.

My bible says faith proves itself by obedience. The more we accept this, the clearer our messes become. It becomes obvious as to how we got into them and how we can get out.

When all is said and done, what more do you need? Once you understand where home is and that it will always be there, you are never lost, no matter what or who you encounter. It’s the kind of knowledge that never leaves you wanting.

“Be strong and bold; have no fear or dread of them, because it is the Lord your God who goes with you; He will not fail you or forsake you.” Deuteronomy 31: 6.

May God bless and keep you always. James

Parkland leader named CFO of the

Year for health care

Walter “Ted” Shaw has been named Dallas Business Journal’s CFO of the Year for health care. Shaw, who has served as Parkland Health & Hospital System’s Executive Vice President and Chief Financial Officer since July 2012, received the honor Oct. 24. Shaw was honored for his work at Parkland which includes responsibilities beyond finance. He serves as Parkland’s representative as anchor for Region 9 under the Texas Medicaid 1115 Waiver, which involves all large health care provider systems in Dallas, Denton and Kaufman counties. The program has the potential to bring more than $1 billion in health care funding to North Texas through innovation and transformation projects that involve all hospitals in the area.

In addition, Shaw oversees the construction of the largest health care project in the nation, the new Parkland Hospital. The $1.3 billion, 2.5 million square-foot project will replace the current facility that has been operating since 1954. “It’s quite an honor to be recognized with this award,” Shaw said. “But it’s a team effort and I’m fortunate to be surrounded by a group of very talented individuals.” In his work at Parkland, Shaw has emphasized team-building, targeting performance, quality and growth. Drawing on his extensive prior experience as a health care consultant and leader at four academic medical centers, Shaw has implemented a results-driven approach at Parkland, building stakeholder alliances internally and among county, state and community partners. “This honor for Ted Shaw is a well-deserved acknowledgment of his enormous contributions not only to the financial health and operational stability of the Parkland system, but also to health care for communities throughout North Texas. “We are extremely proud of his accomplishments during his tenure at Parkland and grateful for his sound and solid leadership during challenging times,” said Robert L. Smith, Parkland’s interim CEO. Shaw is a graduate of The University of Texas at Austin where he received a Bachelor of Business Administration (BBA) degree in Accounting.

Ask Gwendolyn

BainesMarried Three

Times Still No Love!Dear Gwen:I recently got married for the third

time.  My first two marriages ended in divorce merely because of me.  They were both nice men.  This is the problem:  My mother wanted me to marry a man who could take care of me and give me things like luxury house, luxury car, luxury furniture and money in the bank.  I didn’t fall in love with them so I filed for and got a divorce.

Two months after my second divorce I met another man.  He said he loved me and I pretended to be in love with him as well.  You see…People say love takes time to grow.  But up to now (six months later) I still have not fallen in love with my husband.  I hate to keep having to get married, but Gwendolyn I can’t keep staying.  Even my third husband is nice and just a great person.  Do you think I will ever fall in love with my husband?

Gladys

Dear Gladys:Possibly not. You have been

brainwashed to believe first of all that love takes time to grow.  Not necessarily.  Two people should have that strong feeling of care for each other before marriage.  Yea, I have heard the stories.  In fact a lady told me when we discussed the subject of love that “you will fall in love eventually.”  Also, my aunt told me that “You don’t have to like a person to marry.”  Gladys, I don’t know which statement is the more stupid of thinking.  When you marry for money, you pay the price.  There is one thing about being married to a man of money.  When the marriage fails, he wants to keep his money.  You see – I look at real life crime stories.  Usually the woman meets with tragedy when money is involved.  Few men are willing to half everything and walk away.  They want to keep it all.

The life and times of Ray Charles came to life, at 10 a.m. on Wednesday, October 30. Postal officials, students, and musical icons unveiled the Ray Charles stamp at Dallas Booker T. Washington High School.

This event will take place in the Montgomery Auditorium on campus. Roger Boykin, a national jazz recording star, and others shared their experiences of the musical icon - Ray Charles. The BTW Jazz Combo 1 set the mood, and performed under the direction of Bart Marantz – www.bartmarantz.com.

The contributions of Ray Charles cannot be defined or contained by one musical style. His work has spanned, almost the entire breadth of American music and brought him 17 GRAMMY Awards; the Kennedy Center Honors in 1986; an award for lifetime achievement in 1987; the National Medal of Honor of Arts in 1993; and, his induction into the Rock and Roll Hall of Fame.

Such a tribute to Ray Charles was held in a school, which has graduated seven recording artists, who have earned 31 GRAMMYS. Booker T. Washington High School has a long, and rich tradition in Dallas, TX, for preparing students to pursue a career in the field of performing and visual arts.

Advocates call to extend SNAP Bene"tsCongressman John Conyers,

Jr. (D-Mich.) hosted a press conference with Congressional and outside advocates on the upcoming reduction in Supplemental Nutrition Assistance Program (SNAP) benefits this Friday, November 1st.

On that day, the temporary benefit boost provided for in the American Reinvestment and Recovery Act of 2009 stimulus is scheduled to expire and households across the country participating in SNAP will see their monthly benefit sharply reduced.

This substantial reduction on November 1st will leave many Americans unsure of how they will put food on the table, and will aggravate the problem of hunger in our nation, making it that much harder for millions of Americans—fathers and mothers, children, veterans and active duty military, to provide for their loved ones.

At the press conference, Rep. Conyers delivered the following statement:

“It is with great urgency that my co!eague Representative Barbara Lee

and I join with fe!ow Democrats and representatives (om Food Research and Action Center (FRAC), Share Our Strength, Feeding America, and United Way for Southeastern Michigan to discuss an important concern.

On Friday, November 1st, households participating in the Supplemental Nutrition Assistance Program (SNAP) wi! see their monthly benefit sharply reduced. The temporary benefit boost provided for in the 2009 Recovery Act is scheduled to expire, leaving many Americans unsure of how they wi! put food on the table.  This cut wi! severely a+ravate the problem of both hunger and economic growth in our Nation.

“The SNAP benefit increase provided in the Recovery Act passed in the depths of the Great Recession to provide an increase in benefits through Fiscal Year 2016.

However, the funding increase was quickly reduced while a portion of it was used to cover the cost of education jobs and Medicaid and the reauthorization of Child Nutrition programs. As a result, beginning on November 1, 2013, SNAP funding wi! be reduced by approximately $5 bi!ion for FY 2014.  Additiona!y, a

family of four wi! lose up to $36 a month and an average benefit per person, per meal wi! drop to less than $1.40.  Instead of purchasing (esh (uits and vegetables parents wi! have to choose cheaper and less healthy food options that lack nutritional value.

In my home state of Michigan, $183 Mi!ion wi! be cut (om SNAP benefits causing 1,775,000 SNAP recipients to be impacted and parents wondering if they’! have enough benefits le' over near the end of the month for Thanksgiving. This is heartless! SNAP is designed to help eliminate hunger but this cut wi! only increase it.

“I am urging my co!eagues to avoid exacerbating hunger in our Nation and to join your co!eagues in supporting H.R. 3353, the ‘Extend Not Cut SNAP Benefits Act.’ This bi! provides for a one year extension of the 13% benefits increase contained in the Recovery Act through the 2014 Fiscal Year.

Without an extension of the 2009 Recovery Act’s temporary boost to SNAP, our economy wi! be worse off and our children wi! face a hunger that they do not deserve.”

NEW YORK- The children of the late Marvin Gaye has responded in US District Court to the lawsuit that was filed against them by Robin Thicke, Pharrell Williams and Clifford Harris, Jr., according to Mark Levinsohn, the NY entertainment attorney who represents Nona and Frankie Gaye in transactional matters. In that initial suit, filed on August 15, 2013, Thicke and his "Blurred Lines" collaborators sued to stop any claims they thought the children of Marvin Gaye may or would have against their intentional

copyright infringement of the Marvin Gaye song "Got to Give it Up." As Zoe Chace for National Public Radio stated on the NPR website on August 19, 2013: "Robin Thicke's Song Sounds Like Marvin Gaye. So He's Suing Gaye's Family."

The "Blurred Lines" trio rushed to file their case soon after their song began attracting overwhelming attention from critics and fans about the substantial similarities that surpass the realm of coincidence to "Got to Give it Up."  On August 8, 2013 Rob Hoerburger in the New York Times  wrote "But what I keep coming back to is the song's choice DNA...And that bass line came right from Marvin Gaye's No. 1 hit from the summer of '77, 'Got to Give It Up'." In the August 23, 2013 issue of Rolling Stone Magazine, Contributor David Ritz wrote, "When I first heard Robin Thicke's 'Blurred Lines,' my reaction was the same as millions of other R&B fans: Hey, that's Marvin Gaye's "Got to Give It Up."  Thicke and company not only copped Gaye's distinct bass line, but the defining funk of the cowbell accents. I wasn't entirely surprised, since some years earlier Thicke's 'Love After War' was a virtual lift of Marvin's 'After the Dance' ..."  A quick review of the internet reveals these comments are far from alone in this respect.

Indeed, the three writers filed their lawsuit against Gaye's children shortly after the numerous "Got to Give it Up" similarities started surfacing and just weeks after all the online chat rooms were abuzz with discussions of the two songs, including fan postings of musical mash-ups that

demonstrated the overlapping comparisons. As music critic Paul Cantor pointed out on Vice Magazine's website in July 2013, "You probably don't feel guilty for liking 'Blurred Lines.' Maybe that's because it was originally a Marvin Gaye song ("Got To Give It Up") and Marvin Gaye is ... awesome."

Initially Gaye's children assumed that Thicke and Williams had obtained the proper license from EMI/SONY to use their father's song "Got to Give it Up" when they decided to deliberately recreate the very essence of the song with "Blurred Lines", but they were sadly mistaken.

Although representatives for the parties had ongoing discussions about the copying and possibility of a settlement, there was never any monetary offer made by Robin Thicke, Pharrell Williams or their representatives to the Gaye family for use of the copyright, as erroneously reported by Billboard Magazine in August 2013.  Instead,

Thicke decided to wage a very contradictory public denial about his creative intentions and file a preemptive strike against any claims by the family.  On July 9, 2013 he told Billboard Magazine, "Pharrell and I were in the studio making a couple records,

and then on the third day I told him I wanted to do something kinda like Marvin Gaye's 'Got To Give It Up,' that kind of feel 'cause it's one of my favorite songs of all time. So he started messing with some drums and then he started going 'Hey, hey hey..' and about an hour and a half later we had the whole record finished."  However, by September 2013 Thicke back peddled and did a one-eighty, telling TMZ that even though he's a big fan of Marvin Gaye, the Motown legend is not in his head when he writes songs, including "Blurred Lines."

When Gaye's children raised their concerns to EMI/SONY, they were told that no license was granted, nor was any license needed. The initial lawsuit filed by the Blurred Lines writers not only asks that any copyright infringement claims be rejected, but also challenges the family to prove that they (and not their publisher) have the right to sue.  According to the Gaye children, "EMI/SONY publishes and administers our father's catalog so contractually, it would be for them to file the countersuit.  However, when we requested that they take action, they refused. They also refused to assign to us the right to file for ourselves." It is because of this and other factors outlined in the countersuit that the family is reluctantly suing EMI/SONY for breach of contract and failing to perform their fiduciary duties. Coincidently EMI/SONY also represents Pharrell Williams."We have put a lot of effort into this matter, investigated it thoroughly, and believe we have a strong case," says Richard S. Busch of Nashville and San Diego-based King & Ballow, who is litigation counsel for the Gaye children. He adds, "The counterclaim and

court filing speak for themselves, and I look forward to presenting this case to the court and ultimately to a jury who will be able to listen to the songs themselves."

Marvin Gaye's children respond to lawsuit filed by Robin Thicke, Pharrell Williams and Clifford Harris, Jr.

No Place for Race:  Making Leadership

Accountable for Economic and Social

Factors Impacting Our Communities

Viewers of CBS' reality show, Undercover Boss know that CEOs and company owners learn valuable information when working undercover within the ranks of their business.  By the same token, spend 24 hours with veteran homicide detective, Rodney Demery and chances are the gut-wrenching scenes will haunt you forever.  Frustrated at the lack of action by our nation's leadership to keep our communities safe, Demery sites real-actionable solutions in his book, No Place For Race:  Why We Need to Address Economic and Social Factors That Are Crushing Us Every Day.

Demery believes that we need to stop sensationalizing racial division in the media and get to the root of the problem.  He challenges our leadership to take responsibility and to stop the racial rhetoric – which only promotes fear.  The truth is that racial profiling is an irrational assumption when the police policymakers and management are increasingly black.  He further confirms that, "The most likely threat to a black man is another black man; not a white man as the media and black leaders would often have you believe.”

"This isn't a race thing,” says Demery. "I know because I am at the crime scenes when the yellow "crime scene” tape is put up.  I am with the coroner when the autopsy is performed.  And I am

one of the detectives who hears the excruciating wails of the grieving family when I tell them that their child has been murdered.  We must take action to stop these senseless killings … and the time is now.”   Demery admits civil rights have come

a long way.  We've overcome denial to attend top universities, as well as the right to vote.  Blacks are heading police departments, serving on the Supreme Court and even serving as the POTUS.  One wonders, then, with so many black leaders, why are there so many blacks dying in the streets?   "Leadership and politicians have done a disservice to our communities,” says Demery.  "Simply put, our so-called leaders are not leading.  It's a fact that

94% of black people are killed by black people, but what is being done about this?  Nothing – only finger pointing and accusations stemming from things that happened more than 40 years ago. Worse yet, many leaders (both black and white) in our police departments and government choose not to speak up for fear of repercussion.  The question we need to ask is what are we doing to change these statistics today?”     A decorated veteran of the United States Navy, Detective Rodney Demery has served the public as an officer of the peace for 25 years. Demery, who served in both Operation Desert Storm and Operation Desert Shield, attended Louisiana State University and earned a Bachelor of Science in Criminal Justice. Throughout his career as a police officer, he has worked in three states. Rodney Demery is the author of 2011 Amazon Kindle Best Seller, Things My Daughters Need to Know: A Cop and Father's View of Sex, Relationships and Happiness.

Political analysts, both mainstream and Black news

media and intellectuals around the country have given their

grade evaluation on President Barack Obama’s first 100

days in office, marked on April 30. Here’s how several

people from the local front graded the new president.

Congresswoman EddieBernice Johnson

Grade:A“I am deeply impressed with the progress that

President Barack Obama has made during the first 100days of his administration. Already we are seeingevidence of the administration’s plan to dig our countryout of recession and develop long-term, sustainable pros-perity. President Obama has made two trips abroad, proving to us and to the world that he intends to

repair our frayed alliances and restore ourinternational leadership.

Finally, the Obama adminis-tration’s code of ethicshas broughtmuch-neededtransparency andaccountability to theWhite House.

President Obamais delivering on thechange that hepromised.”

Senator Kay

Bailey HutchisonGrade: C

“In just 100 days, we’ve seen an alarming accel-

eration of policies that will take America down the

wrong track. The administration has proposed

trillions of dollars in new spending, which will

result in higher taxes on Americans, while sharply

raising our indebtedness to foreign creditors. On the national security front, I am

very concerned aboutthe President’s intention toclose Guantanamo without aworkable plan to relocatedetainees. It is mysincere hope that, movingforward,

theadminis-

tration willadopt the productive,

responsible approach to ournation’s challenges thatAmericansdeserve.”(The office of John Cornyn of

PROPOSITIONS

1 AND 2

Dallas is abuzz at theelection issues beforethem on May 9 whencitizens are asked tovote on the controver-sial ConventionCenter Hotel that isbeing backed byMayor

Leppert. But what doesvoting “no” and voting“yes” mean?It is important to

remember that thepropositions are toamend the Dallas CityCharter which, amongother things, gives thecity the power to acquireproperty for any publicpurpose. The propositionsare worded to prohibit thecity from acting on thesebefore stated powers. Therefore, if a citizen wouldlike the city to maintainthose powers, they are tovote NO and vice versa.
