Report on Public Consultations of the Land Acquisition and Resettlement Action Plan

for the Contract 3B.1:

Flood protection Sandomierz

implemented within the

Odra-Vistula Flood Management Project

The draft of Land Acquisition and Resettlement Action Plan (RAP) for the Contract

3B.1 Flood protection Sandomierz was subject to the public consultation carried out in

accordance with the World Bank Operational Policy (OP 4.12.) requirements. Public

consultations were to enable the public to become familiar with the document and to ensure a

possibility of submitting comments, questions and suggestions to its contents.

After completion of the draft of RAP and obtaining acceptance of the World Bank to

start the public disclosure procedure, on 18.11.2016 an electronic version of the document (in

Polish and in English) was published on the websites of the Świętokrzyski Board of

Amelioration and Hydraulic Structures in Kielce (www.szmiuw.kielce.com.pl, Fig. 1),

Sandomierz Municipality (www.sandomierz.pl, Fig. 2) and Project Coordination Unit

(www.odrapcu.pl, Fig. 3).

Information on a possibility of reading the draft RAP and submitting suggestions and

comments, including contact person (e-mail address, address of a place where it was possible

to read the document, office hours, telephone number) were published in the local press. The

Announcement was published on 18.11.2016 in the local supplement to Gazeta Wyborcza

(Fig. 4). The announcement was also made public by placing it on the notice board of

ŚZMiUW in Kielce (Photo 1), local branch of ŚZMiUW in Sandomierz (Photo 2),

Koprzywnica Town and Commune Office (Photo 3), Samborzec Commune Office (Photo 4)

and City Hall in Sandomierz (Photo 5), as well as on the websites of the above mentioned

institutions. The published Announcement included also information on the planned

consultation meeting within public consultations of LARAP (jointly with providing a date,

time, location and purpose of the meeting).

Individual invitations were sent to the Marshall of Świętokrzyskie Voivodeship,

Świętokrzyski Voivode, Starost of Sandomierz Poviat, Mayor of Sandomierz, Mayor of

Koprzywnica Town and Municipality, Head of Samborzec Commune, City Council of

Sandomierz, Town Council in Koprzywnica, Commune Council of Samborzec, Director of

RZGW in Kraków, Member of the Board of Świętokrzyskie Voivodeship, Director of the

Rural Areas Development and Environment Department, Head of Koćmierzów village, Head

of Sośniczany village, Head of Szewce village, Head of Zajeziorze village and Club of

Sandomierz Fans.

Hard copy of the document was also provided and made available to all interested

parties in the period between 18.11.2016 and 09.10.2016 (21 calendar days) at the offices of

ŚZMiUW in Kielce (ul. Witosa 86, Kielce) and at the offices of the ŚZMiUW in Kielce,

Sandomierz Department (ul. Staromiejska 14, Sandomierz). During the public disclosure

period there were no persons who were interested to become familiar with a copy of the

document at the indicated locations. However, downloading of the files from the indicated

websites, was observed.

After the end of the 21 calendar day public disclosure period of draft RAP, there was a

meeting open to all the interested parties. Meeting took place on 12.12.2016 at the seat of the

Sandomierz District Governor’s Office (Mickiewicza Street 34), at 4:00 p.m. 23 people

attended the meeting (List of participants of the meeting in Sandomierz, Fig. 5 and Fig. 6).

The meeting was opened by the Consultant, who, presented purpose and plan of meeting, and

then presented (in the form of multimedia presentation) the rules of developing and

functioning of Land Acquisition and Resettlement Action Plan during the implementation of

the projects co-financed by the World Bank as well as detailed information on the draft RAP

for the Contract 3B.1 Flood protection Sandomierz.

Upon completing a presentation, the representative of the Consultant encouraged the

public to ask questions and submit any suggestions and doubts concerning the document

which was subject to public consultations. During the debates, participants asked a few

questions that were answered directly during the meeting. The participants drew the attention

to the following issues related to the draft RAP and the implementation of the construction

works.

1. There was a request to specify the term of construction works implementation within

the 3B.1 Contract.

In reply the representative of ŚZMiUW in Kielce informed that physical entry to the

site is planned for 1st/2nd quarter of 2017, whereas completion of construction works

is planned for 1st/2nd quarter of 2020.

2. There was a request for information if the flood gate at Glassworks is within the scope

of 3B.1 Contract Flood Protection Sandomierz.

In reply the representative of ŚZMiUW in Kielce informed, that rebuilding of the

surrounding embankment of Glassworks jointly with the flood gate performance on

the channel is an element planned for implementation within 3B.1 Contract Flood

Protection Sandomierz (facility: Extension of the surrounding embankment securing

against flood waters the Glassworks and residential district in Sandomierz jointly with

extension of flood embankment of the Vistula River from Lwowska Street to the

connection with Koćmierzów embankment), and therefore it is planned for

implementation.

3. There was a request for explanations as to the grounds of having public consultations

of Land Acquisition and Resettlement Action Plan for 3B.1 Contract in the situation

when the status of compensation payment for permanent occupancy is already 96%?

In reply the representative of PCU Kraków replied that the LARAP project concerns

not only payment of compensations for permanent occupancy already before the

commencement of construction works, but also includes numerous issues such as:

permanent limitation of property use manner, a possibility to lodge motions for

acquisition of remaining parts of the property left after division (so called “remaining

parts”), temporary occupancy, mitigation and compensation actions, complains and

motions lodging mechanisms in the scope of the implemented contract and

information issues. Relevant information on the above mentioned issues which are

valid during the contract’s implementation are included in the LARAP subject to

consultations.

4. There was a request for information on the guarantee of funds for the implementation

of 3B.1 Contract.

In reply the representative of ŚZMiUW in Kielce explained that 3B.1 Contract Flood

Protection Sandomierz is implemented within the Odra-Vistula Flood Management

project and it is co-financed by the International Bank for Reconstruction and

Development (World Bank - WB), Council of Europe Development Bank (CEB), state

budget and European Union funds within the Operational Programme Infrastructure

and Environment (OPIE). The task is on the non-competition list OPIE, the loan

agreement with WB was signed on 10th September 2015, whereas frame loan

agreement with CEB on 24th May 2016, therefore the funds for the implementation of

the Contract are already secured.

5. The attention was paid to the problem of flooding, during heavy rainfalls, of a

residential district located between the surrounding embankment and the Vistula

embankment in Sandomierz.

In reply the representative of ŚZMiUW in Kielce explained that under 3B.1 Contracts

there are works planned in relation to taking over flood water from Atramentówka

water course in order to prevent it from entering the area. Therefore, the embankment

water gate shall be rebuilt, a channel discharging water to the planned pumping station

in Koćmierzów shall be built. As a consequence flood water from Atramentówka

River shall not flow into the area of the residential district and the Glassworks.

6. Towards the end of the debate the significance of Glassworks, as an employer, for the

local community and the need to ensure its proper protection against flood was

underlined.

In reply the representative of ŚZMiUW explained that the works included under 3B.1

Contract are to improve flood safety of the area where not only Glassworks but also

dense residential developments of Sandomierz are located. Moreover, the planned

works concern other areas of Sandomierz and its surroundings (among others the

embankments of the Koprzywianka River, areas along Sielecka and Wielowiejska

Streets, pumping stations in Nadbrzezie, Szewce and Zajeziorze). Nevertheless, the

protection of the industrial area of Glassworks is also an essential purpose for the

implementation of 3B.1 Contract.

After providing the above clarifications, the participants were thanked for attending

and for active participation in the meeting. The meeting was adjourned. Comments submitted

by the community, does not result in making changes to the contents of this RAP.
