    I n November 2006, Mont ano pur chased a house i n Oakl and, Cal i f orni a

    ( t he Proper t y) . To obt ai n f i nanci ng, he cont act ed a mor t gage

    br oker who, accor di ng t o Mont ano, col l ect ed hi s f i nanci al

    i nf or mat i on i n a conver sat i on over t he phone and t hen l at er

    i ncor por at ed i t i nt o a Uni ver sal Resi dent i al Loan Appl i cat i on

    ( For m 1003) ( t he URLA) . The r ecor d i s not cl ear when t hi s

    t el ephone conver sat i on t ook pl ace, or how WMC Mor t gage Corporat i on

    URLA, t he not es f or t he two l oans, and separ at e deeds of t r ust

    secur i ng each l oan. Si gni f i cant l y, Mont ano i ni t i al ed each page of

    t he URLA, except f or t he page whi ch cont ai ned speci f i c i nf or mat i on

    r egar di ng t he i ncome he pur port edl y recei ved f r om wages and sel f -

    empl oyment .

    The par t i es agr ee t hat t he URLA cont ai ned i ncor r ect

    i nf ormat i on about Mont ano s i ncome. The URLA st at ed t hat Mont anor ecei ved a t otal of $8, 090 per mont h, $3, 500 of whi ch were wages

    he ear ned wor ki ng as an aut o det ai l er at a l ocal deal er shi p, and

    t he remai nder as i ncome generated f r omhi s supposed busi ness,

    Mont ano Movi ng Ser vi ces. Al t hough Mont ano was i n f act empl oyed at

    pur chase t he Propert y, Mont ano mai nt ai ns t hat he was never sel f -

    empl oyed, nor t hat he recei ved any i ncome f r om Mont ano Movi ng

    has f i l ed schedul e C t ax i nf o f or t he bor r ower f or t he l ast 3

    year s. The second f or m r el at es t o empl oyment ver i f i cat i on. Cobb

    supposedl y spoke wi t h t he human r esour ces manager f or t he aut o

    deal er shi p and ver i f i ed t hat Mont ano was empl oyed t her e. Ther e i s

    payment s on t he l oans, he def aul t ed on t he pr i mary l oan and, on

    J ul y 17, 2007, WMC f i l ed a not i ce of def aul t t o f or ecl ose t hef i r st pr i or i t y deed of t r ust . A t r ust ee s sal e occur r ed, and t he

    Proper t y was sol d on Oct ober 22, 2007. The now- unsecured second

    l oan note was pur chased by Her i t age on J anuary 20, 2009.
