THIS MATTER was heard by the Florida Elections Commission ("Commission") at its

regularly scheduled meeting on February 24, 2015, in Tallahassee, Florida

Based on the Complaint, Report of Investigation, Staffs Recommendation, and oral

statements (if any) made at the probable cause hearing, the Commission finds that there is

prnbable cause to charge Respondent with the following violations:

Count 1:

On or about February 15, 2013, Respondent violated Section 106.09(l)(a), Florida Statutes, when she made a $100 cash contribution to her campaign; and

Count2:

On or about February 22, 2013, Respondent violated Section 106.09(l)(a), Florida Statutes, when she contributed $50 in cash to her campaign

STAFF RECOMMENDATION FOLLOWING INVESTIGATION

Pursuant to Section I 06 25( 4)( c ), Flotida Statutes, undersigned staff counsel files this written recommendation for disposition of the complaint in this case iecommending that there is probable cause to charge Respondent with violating Section 106.09(1)(a), Florida Statutes Based upon a thmough review of the Report of Investigation submitted on September 5, 2014, the following facts and law support this staff recommendation:

L On April 14, 2014, the Florida Elections Commission ("Commission") received a sworn complaint from TeIIy I ears ("Complainant") alleging that Lisa McDermott ("Respondent") violated Chapter 106, Florida Statutes

2 On or about June 5, 2014, the Executive Director sent notification to Respondent that Commission staff would investigate the following violation:

Section 106.09(l)(a), Florida Statutes: Lisa McDermott, candidate for the Brevard County Commission, District 4, in the August 2014 election, appears to have made cash contributions to her own campaign in the aggregate in excess of the $50 per campaign limit, as alleged in the complaint .1

3.. Respondent was a candidate for the Brevard County Commission, District 4, in the 2014 primary election. Respondent filed her Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates form ("DS-DE 9") with the Brevard County Supervisor of Elections on November 8, 2012 (ROI Exhibit 1)2

4.. Respondent received a copy of the Chapter 106, Florida Statutes, and the 2014 Candidate and Campaign I reasurer Handbook ("Handbook'') 3 Respondent also testified in her August 15, 2014 affidavit that she reviewed the Handbook. (ROI Exhibit 6, page I; ROI Exhibit 4, pages I and 3)

On the report, Respondent listed making a $50 cash contribution to he1 campaign on Februaiy 22, 2013 (ROI Exhibit 2)

7 Respondent filed an amended 2013 QI Report with the BCSOE on July I, 2013 Respondent certified the repo1t was tme, conect, and complete. 8.. Respondent claims that the Handbook states loans made by a candidate to he1 own campaign ate not subject to the candidate contribution limitations .. (ROI Exhibit 4, page 2) Howeve1, Section 106.08(1)(b), Floiida Statutes, provides that contribution limits in "this subsection" do not apply to contributions made by a candidate to her own campaign 6 Section I 06. 08(1 )(b ), Floiida Statues, does not exempt a candidate from contributing moie than $50 cash in the aggregate to her own campaign 7

Contribution Limits for Candidates

IMPORTANT: Except for political parties or affiliated party committees, no person or political committee may make contributions in excess of: (1) $3,000 to a candidate for statewide office or for retention as a justice of the Supreme Court. Candidates for the offices of Governor and Lieutenant Governor on the same ticket are considered a single candidate for the purpose of this section; (2) $1,000 to a candidate for retention as a judge of a district court of appeal; a candidate for legislative office; a candidate for multicounty office; a candidate for county-wide office or in any election conducted on less than a countywide basis; or a candidate for county court judge or circuit judge .. The primary and general elections are separate elections (See Glossary for the definition of "person.")

These limits do not apply to contributions made by a state or county executive committee of a political party or affiliated party committee regulated by Chapter 103, F..S., or to amounts contributed by a candidate to his own campaign. The contribution limits do not apply to individuals seeking election to a political party executive committee because they are not "candidates."

A candidate may not:

• Accept contributions until Form DS-DE 9, Appointment of Campaign Treasurer and Designation of Campaign Depository for Candidates, is filed with the filing officer;

• Accept a contribution in excess of the above limits from any one person per election, provided the candidate is an opposed candidate and the contribution is received

within the timeframe applicable to each election;

• Accept contributions from family members in excess of the above limits per election;

• Accept contributions from a county executive committee of a political party whose contributions in the aggregate exceed $50,000, or from the national or state executive committees of a political party, including any subordinate committee of such political party or affiliated party committees, who contributions in the aggregate exceed $50,000. Polling services, research services, cost for campaign staff, professional consulting services, and telephone calls are not contributions to be counted toward the contribution limits, but must still be reported by the candidate All other contributions are counted toward the contribution limits;

o A candidate for statewide (Governor, Cabinet and Supreme Court Justice) office may not accept contributions from a national, state, or county executive committee of a political party, including any subordinate committee of a national, state, or county committee of a political party, or affiliated party committee, which contributions in the aggregate exceed $250,000; or

• Accept contributions after the date he or she ·withdraws his or her candidacy, is defeated, becomes unopposed or is elected

12 In the questionnaire-affidavit, Respondent was asked what resources, if any, did she review or consult prior to making the cash contributions to her campaign. Respondent stated, "Campaign candidate and treasurer handbook"

13 Respondent's website includes a button titled, "Campaign Contributions" When viewing the "Campaign Contributions" page, a portion of the page reads, "Contribution Laws and Guidelines Lisa McDermott August 26, 2014." Under this heading is a list of laws and guidelines governing campaign contributions Number 5 on the list reads, "Aggregate amount of cash or cashier's check cannot exceed $50 per election fiom the same contributor.. Name and address must accompany the contribution" To review the page from the website, refer to Exhibit 5 ..

14. Respondent was asked about the portion of her website that included information relative to "Campaign Contributions" and the eight items of laws and guidelines governing campaign contributions. In her affidavit, Respondent reported that her husband copied the contribution laws and guidelines from another candidate's website To review Respondent's questionnaire-affidavit, refer to Exhibit 4 ..

15 No record was found to indicate that Respondent has previously violated this section of the election laws

III. FEC History:

16 Respondent has no prior history with the Florida Elections Commission as a Respondent In 2012, she filed a number of complaints with the Florida Elections Commission, and in one complaint, she alleged a violation of Section 106 09(1), Florida Statutes

Conclusion:

17 On September 5, 2014, I interviewed Respondent for the purpose of providing her with a brief synopsis of the case and to afford her an opportunity to comment on the case or to ask questions When asked, Respondent said that she had nothing more to add to the case.

18 In an affidavit, I im Bobanic, Chief Deputy with the Brevard County Supervisor of Elections' office, attested that Respondent was provided with a copy of the Candidate and Campaign Treasurer Handbook as well as a copy of the Election Laws Mr Bobanic stated that it is the policy of the supervisor of elections office to give each candidate the documents from the Division of Elections' website and that the documents are sent via e-mail along with the candidate's financial reporting log-in information regarding their first financial reporting obligation According to Mr Bobanic, Respondent's 2014 campaign was her first campaign for elective office. He had no records of Respondent having ever served as the treasurer for a candidate or serving as the treasurer or chairperson for a political committee To review the affidavit of I im Bobanic, refer to Exhibit 6

19. In an affidavit, Respondent attested that her 2014 campaign was her first campaign for elective office and she has never previously been appointed to serve as a campaign treasurer for a candidate or political committee Respondent acknowledged that she does possess and has read Chapter 106, Florida Statutes, as well as the Candidate and Campaign Treasurer Handbook When asked to explain what action she had taken to determine her responsibilities

Dear Ms McDermott:

On April 14, 2014, the Florida Elections Commission received a complaint alleging that you violated Florida's election laws I have reviewed the complaint and find that it contains one or more legally sufficient allegations The Commission staff will investigate the following alleged violations:

Section 106 .. 09(1)(a), Florida Statutes: Lisa McDermott, candidate for the Brevard County Commission, District 4, in the August 2014 election, appears to have made cash contributions to her own campaign in the aggregate in excess of the $50 per campaign limit, as alleged in the complaint.

You may respond to the allegations above by filing a notarized statement providing any information regarding the facts aJid circumstances surrounding the allegations Your response will be included as an attachment to the investigator's report

When we conclude the investigation, a copy of the Report of Investigation will be mailed to you at the above address You may file a response to the report within 14 days from the date the report is mailed to you.. Based on the results of the investigation, legal staff will make a written recommendation to the Commission on whether there is probable cause to believe you have violated Chapter 104 or 106, Florida Statutes A copy of the Staff Recommendation will be mailed to you and you may file a response within 14 days from the date the recommendation is mailed to you. Your timely filed response(s) will be considered by the Commission when determining probable cause.

The Commission will then hold a hearing to determine whether there is probable cause to believe you have violated Chapters 104 or 106, Florida Statutes .. You and the complainant will receive a notice of hearing at least 14 days before the hearing. The notice of hearing will indicate the location, date, and time of your hearing. You will have the opportunity to make a brief oral
