Sourcing and production To import beef meat into the EU from the USA, a company must contract to purchase product produced in one of the EU approved slaughter and deboning facilities in the USA. The list of these facilities is included below and can be consulted at:

§  https://webgate.ec.europa.eu/sanco/traces/output/US/RM_US_en.pdf Beef meat produced in the USA destined to the EU market has to be produced from cattle born, raised and slaughtered in the USA and that have been traced throughout their lives in the non-hormone treated cattle (NHTC) programme. In practice when a US facility is producing for the EU, the plant must segregate the cattle and the beef carcasses and cuts from all other product. At time of production the plant has to operate in what is termed “EU mode.” For example, in addition to water or steam, the use of a diluted (2%-5%) lactic acid rinse is the only antimicrobial treatment authorised by the EU and such a rinse can only be used on carcasses and half carcasses and not on cuts of beef. As a consequence of operating in EU mode and the associated costs thereof and of the premium paid to the farmer to obtain NHTC, the US packer will seek to sell as high a proportion of the total carcass to the EU as possible. Generally this means that the EU importer is required to buy about 80% of the total carcass, which can be between 20 and 27 of the primal muscle cuts in their natural fall/weight proportions.

Importing into the E.U. To be able to enter the EU at zero custom’s duty the beef must be in conformity with the HQB definition laid out in the EU regulation that opened the duty free quota. That definition can be consulted at:

  The duty free quota is currently for 48,200 MT per year, and runs from July 1st to June 30th each year. It is managed by DG Taxud on what is called a first come, first served basis (FCFS) and the total quantity is made available by quarters. So at the beginning of each quarter 12,050 MT are made available and if at the end of a quarter there is some quantity left unused that unused quantity is carried over and made available in the following quarter in addition to the next 12,050 MT. At present this quota is being fully used, but EU importers have so far been successful in balancing their purchases to match the quota availability and have thus been able to import almost up to the end of each quarter duty free. In the event that the duty free quota is fully used importers of US beef could have the possibility to import the beef under the Hilton quota paying 20% ad valorem customs duty on the cost and freight invoice price as long as the beef meat complies with the definition of HQB under that regulation. the-EU-09.24.13.pdf It is therefore important that purchasers check with their US suppliers that beef produced is in accordance with the definitions of HQB in both EU regulations. In practice, if a container arrives towards the end of a quarter and it is clear that there will be no more duty free quota available then importers simply hold the container until the first day of the next quarter. No import license is required. The importer simply presents the shipping documents and most importantly the certificate of authenticity (COA) that has been signed by the US veterinary service FSIS that states that the product is in conformity with the requirements of the quota under which the importer wishes to import the beef. The beef can be imported as chilled or frozen and ground beef is also eligible.
