1. Introduction

1.1. Project Background and Description

1. The Asia De elop e t Ba k ADB is suppo ti g Assa Po e Sector Enhancement

I est e t P og a AP“EIP th ough a ulti-tranche financing facility (MFF) to support

continued investment in the state power sector, which is necessary to support economic

growth and poverty reduction. The investments under the program are intended to (i)

facilitate increased power transfers to accommodate increased demand and economic

growth; (ii) improve supply-side energy efficiency by system de-bottlenecking and reducing

technical losses; (iii) reduce the intensity of greenhouse gas (GHG) and other emissions via

improved system efficiency; (iv) support expanded private sector participation in

distribution system operations and other energy services; and (v) facilitate poverty

reduction via improved electricity services and economic growth.

2. The impact of the investment program will be a sustainable state power sector with

increased T&D capacity to support inclusive economic growth. The outcome will be

enhanced quality and expanded service delivery of electricity through improved technical,

commercial, and financial performance and capability of power utilities.

3. The Government of India and Government of Assam have requested ADB to provide

the state power sector, which is necessary to support economic growth and poverty

reduction. The proposed investments are necessary to:

i. Facilitate increased power transfers to accommodate increased demand and

economic growth;

ii. Improve supply-side energy efficiency by system de-bottlenecking and reducing

technical losses;

iii. Reduce the intensity of greenhouse gas (GHG) and other emissions via improved

system efficiency;

iv. Support expanded private sector participation in distribution system operations and

other energy services; and

v. Facilitate poverty reduction via improved electricity services and economic growth.

4. GOA and APDCL are the Executing Agencies (EA). The field units of APDCL are the

Implementing Agency (IA) for the ongoing MFF.

5. In Tranche-3, a total of 29 new sub-stations will be constructed for which 620.30km of

33kV and 307 km of 11kV new distribution line is being laid. The sub-projects (Tranche 3)

have been bundled into six contract packages i.e. Part-A, Part-B, Part-C, Part-D, Part-E &

Part-F. These sub-projects are spread in different districts of the Assam state. The details of

sub-projects identified under Tranche-3 are in Annexure 1. The Tranche-3, APSEIP is

1.2. Purpose of the Report

6. The report capture overall social safeguards implementation progress in compliance

to p oje t s ‘esettle e t F a e o k a d egulato e ui e e ts. The a ious so ial safeguard related issues addressed during the reporting period has also been covered, with

reference to the progress achieved and current status of reporting period

7. The current report covers the implementation progress of social safeguard during the

3rd

and 4th

quarters of 2015.

1.3. Social Safeguard Categorisation

8. As per the Resettlement Plan prepared for the T3 project, Tranche-3 components is

categorized as B fo I olu ta ‘esettle e t I‘ a o di g to ADB s “afegua d Poli Statement, 2009 (SPS).

9. As per RP prepared for T3, there will be no impact on Indigenous peoples except one

scheduled tribe household losing small portion of land for proposed 33/11kV substation.

Construction activities will not have any impact on Indigenous Peoples or Scheduled Tribes

of that area. Therefore, Tranche-3 is categorized as 'B for Indigenous Peoples.

2. Project Implementation Status

2.1. Overview of Social Impacts

10. The Resettlement Plan (RP) prepared (June, 2011) for the project has identified

social impacts due to acquisition of land, damages to crop, and other losses, due to sub-

station construction and stringing of transmission line. The RP has indicated that sub-

stations were proposed on 17 government land and 13 on private land (including 4 on tea

estate).

11. The implementation status of various RP measures was gathered from the

implementing agency and has been compared with those recorded in the original RP (Table

2.1). During implementation stage, changes of sub-project sites and land area required for

sub-stations were minimized, which resulted to reducing impact on land area. Hence, the

number of affected persons has decreased.

12. In Tranche – III, construction of 29 sub-stations and 927.3km length of distribution

lines is in progress. The acquisition of private land for 9 substations is through direct

negotiations and is completed. The tea estates have gifted or has given consents for the

construction of 4 sub-stations i.e. Harchurra, Dibrugharh II, Daflagarh & Nowboicha. The

Dharapur and Nehru Stadium substations has been shifted to Bijaynagar community land

and Kahilipara AEGCL own land. In case of Distribution line, no impacts have been reported

within the right of way till this reporting.

2.2. Affected Persons

13. The acquisition of private land for 9 sub-stations and four tea estates has affected 17

entities, which include 13 individual private owners. No Non-title holders are affected due

to acquisition of land. The details of affected persons are in Table No. 2.2.

14. No persons has been affected due to stringing of 927.3km length of distribution lines

(33kV & 11kV), till this reporting period. In case of any incidence for loss of

trees/crops/bamboos/tea plants etc. if identified with the right-of-way of distribution lines,

measures suggested in the Resettlement Framework will be adopted.

2.3. Impacts on Land

15. The construction of 29 sub-stations has impacted an aggregate area of 8.02ha, which

includes private agriculture (1.27ha), tea estates (1.72ha), community (0.08ha) and

government (4.95ha) land.

16. In case of 33kV & 11kV distribution line, the concrete pole foundation does not involve

heavy designed and area of 0.487m2 (0.75m x 0.65m) is required for each concrete pole.

Hence, the damage to land is very significant.

2.4. Impacts on Structure

17. All sub-stations site identified are vacant land and do not impact any structure. In case

of distribution lines, no impacts on any kind of structure identified till this reporting period.

2.5. Crop Damage

18. The sub-stations sites are all vacant land and do not impact any standing crop. In case

of distribution line, the stringing is done post harvesting and has avoided damage to

standing crop. However, few incidences of damaging standing crop reported and details are

being sought from the implementing agency.

2.6. Impacts on Tree

19. No trees are affected due to the sub-station and stringing of distribution line.

2.7. Impacts on Livelihood

20. The persons affected due to acquisition of land are economically displaced. However,

impact on land has been reduced due to design modification in sub-station design layout.

Consequently, impact on livelihood has also been minimised (Table 2.1).

2.8. Impacts on Common Property Resources

21. The sub-stations site identified do ot i pa t a CP‘ s. In case of distribution line

also no such impact has been identified till December 2015.

3. Compensation

3.1. Land Compensation

22. The land for 13 sub-stations is identified at tea estate and individual private land. All

the four tea estates have given their consent/NOC for sub-station construction. Base on

status provided by Implementing Agency, an amount of Rs. 73, 61,386.50/- has been

disbursed to private land acquisition for nine substations.

3.2. Structure Compensation

23. No impact on structural has been identified under the project.

3.3. Crop Damage Compensation

24. No impact due to sub-stations sites. Few incidence of damaging standing crop is

reported during stringing of distribution line. The details are being collected from the

implementing agency.

3.4. Tree Compensation

25. No trees are affected due to the sub-station and stringing of distribution line.

4. Consultation and Disclosures

4.1. Consultation

27. The implementation of R&R activities is a multifaceted task demanding constant

monitoring during various stages of implementation. Engagement of stakeholders during

various stages of project is necessary due to dynamics at different stakeholder level that

might create more challenges for the program implementation. A continuous engagement

with affected persons is necessary to ensure their participation, identify problems, creates

ownership on program and for smooth sailing of the project.

28. The site visit during this reporting was postponed due to pending extension of

consultancy service contract. As a result no consultation was conducted during this

reporting period.

4.2. Disclosures

29. To ensure transparency in planning and active involvement of APs and other

stakeholders, the project information, Resettlement Plan report is uploaded in the official

website of the EA

(http://www.apdcl.gov.in/irj/go/km/docs/internet/ASSAM/webpage/PDF/RPforADB.pdf) and ADB.

The summary of the final RP will be made available in Assamese language. The official of IA

will continue interacting with affected persons and information dissemination through

consultation will continue throughout Investment Program implementation.

32. The GRC provide the platform to affected persons (APs) to first bring their grievances

to the attention of the Project head of the PIU. Grievances not redressed by the PIU will be

brought to the Grievance Redress Committee (GRC) set up at circle level to monitor

subproject Implementation for each subproject affected area. The GRC will determine the

merit of each grievance, and resolve grievances within an outer time limit of three months

of receiving the complaint. The AP has the right to refer the grievances to appropriate

courts of law if not satisfied with the redress at any stage of the process. The set up GRC has

the system of records keeping, contact details of complainant, date of the complaint

received, nature of grievance etc. if any for the ongoing project and taking the necessary

action against the complaint.

6. Institutional Arrangements

34. The implementation of the Resettlement Plan requires the involvement of various

institutions at different stages of the project. The primary institutions involved in the project

are:

Assam Power Distribution Company Limited (EA and IA)

Project Management Unit (PMU)

Environment and Social Management Unit (ESMU) at PMU Level

35. The Assam Power Distribution Company Limited (APDCL) is the executing agency

(EA) for the Tranche-3. The APDCL also function as the implementing agency (IA) for the

project with a dedicated Project Management Unit (PMU). The PMU in APDCL has been set

up with overall responsibilities for planning, coordinating, implementing and financing all

resettlement activities. The PMU is assisted by an Environment and Social Management Unit

(ESMU) to deal with the environmental and social safeguards issues.

36. The Environment and Social Management Unit (ESMU) has been set up within the

PMU/APDCL, along with other engineering units, to address all environmental and social

issues of Tranche-3. The ESMU is headed by an Assistant General Manager, who works

closely with other staff of the PMU and assists the PMU in getting all necessary clearances

and in the implementation of the resettlement activities prior to the start of any civil works.

The ESMU coordinates safeguard activities both at headquarter and PIU level. All safeguards

activities are managed and supervised by the Assistant General Manager based at the Head

Office.

37. At field level, field units of IA are responsible for independent implementation of

sub-project that includes all social safeguards related requirements and RP implementation.

The field units maintain all databases, works closely with APs and other stakeholders and

monitors day-to-day resettlement activities.

38. To support the ESMU in the PMU has appointed a Social Safeguard Consultant with

responsibility to review and update RPs, based on the Resettlement Framework (RF) agreed

for this MFF a d i o plia t to ele a t ADB poli ies. I additio , the Co sulta t s responsibilities also include advising and assisting the EA/IA in mitigating Social and

Environmental issues and administration and Implementation of measures in RP, as

required. During the reporting period, Social Safeguard Consultant has been deployed on

intermittent basis.

7. Monitoring and Evaluation

39. Monitoring of RP implementation is the responsibility of APDCL through its

PMU/ESMU. APDCL is required to implement safeguard measures and relevant safeguard

plans, as provided in the legal agreements, and to submit periodic monitoring reports on

their implementation performance. APDCL and PMU is required to:

establish and maintain procedures to monitor the progress of implementation of

safeguard plans,

verify the compliance with safeguard measures and their progress toward intended

outcomes,

document and disclose monitoring results and identify necessary corrective and

preventive actions in the periodic monitoring reports,

follow up on these actions to ensure progress toward the desired outcomes,

submit periodic monitoring reports (bi-annual) on safeguard measures as agreed

with ADB,

40. RP implementation is monitored through internal monitoring arrangements, to

assess resettlement progress and identify potential difficulties and problems. Internal

monitoring is undertaken by the PMU/ESMU with assistance from the PIU.

implementation and RP completion reports will be provided bi-annually by the PMU to ADB

for review.

8. Conclusion

43. The acquisition of 9 private lands is completed and consent from 4 tea estate has

been obtained for construction of 13 sub-stations. The requisite compensation amount has

been disbursed to affected persons. Various activities are in progress for both sub-stations

and distribution line. The project has minimal social impact, by minimising land area and

proposing sub-station on government land. No impact is reported at distribution line sub-

projects.

44. Executing Agency is closely monitoring and coordinating with respective

departments to expedite RP activities implementation and resolving of any social issues and,

to complete all social safeguard activities by loan closing date i.e. June 30, 2016.
