(2) that the Minutes and Reports of the Meetings Df theHousing Services Committee held. on 4t14 April, 1974 (Minutes 249 — 250)and 11th April, 1974 (Minutes 264—277) be received and adopted, subjectto the deletion of vby invitation' from Minute 265, and as follows:—

The Chief Executive reported that the property 8, Warwick Drive,was an isolated property between two parcels of land already in Councilownership.

FECONMENDED i (a) that the recommendation contained in Minute 273 bereceived and adopted.

(b) that, as an exception to policy, and subj,ect to asatisfactory structural survey, to the receipt of all necessary consents,and to contract, the Council purchase at net more than the DistrictValuer's valuation, the property 8 Warwick Drive, Rcchfcrd, the Directorof Administration being authcrised to take all necessary action toconclude the purchase (841).

Competition, eight of the forty-nine entries having been excluded byGarter King of Aims because they bad either been used before or wereso close to existing mottoes that they could not claim to be unique.

Resolved that Councillors L0H. Fudge, CB. Cowlett and Miss E.M.Leggatt be appointed members of a Panel to consider the mottoessubmitted and make recommendations as to the winner of the Competition(833).

342. The Committee noted that in accordance with the decision of theRecreation and .Amenities Committee, a draw had been held to selectanother member of the Council to accompany the Chairman of the Councilat one of the Royal Garden Parties.

The first name drawn by the Chief Executive, in the presence of theChairman of the Council and Mr. Peen, was that of Councillor Hiss E.M.Leggatt. In view of the fact that Miss Leggett had indicated herdesire not to be included in the Draw, a further name was drawn andthis was Councillor LA. Grove. Councillor Grove had indicated hisacceptance of the invitation (854).

343. The Chief Executive reported as follows:—

"At the meeting of the Development Services Committee held. on Thesday9th April, the members expressed interest in an invitation extended

by the Telford Development Corporation to visit the Hypermarket whichis situated in Telford. In view of the fact that a number of membersof the former Rayleigh Urban District Council had visited a similar

development at Caerphilly, the Development Services Committee feltthat this invitation could be of a particular interest to members ofthe Rochford Area.

As instructed at the meeting, the Director of Administration has made

enquiries of the General Manager of the Telford Development Corporationand it would seem that they would not be embarrased if the party wereto number the same size as that made up by Rayleigh on the visit toCaerphilly. It is suggested that the visit be not a Monday as the

Hyperinarket is closed on that day. In view of the distances involved,members might conceinbly have to spend two days on such a visit."

RECOHEI4DEII) (1) that arrangements be made for a delegation of membersto visit the Hypermarkst at Telford, the size of the delegation,nomination of individual members and the date f or a one day visit tobe decided by Council at its next meeting.

345. The Chief Executive reported that the Council had been invited toappoint a representative to serve on the local committee of the Council.The Committee meets four or five afternoons each year at Ohelmafordand the next meeting will be held at 5.00 p.m. on 20th Nay, 1974.

FECONNENDED that the Development Services Committee be authcrised.to appoint a representative to serve on this Committee (564).

NATIONAL PLAflEG FIELDS ASSOCIATION

346. The Committee noted that an invitation had been received for the Councilto take membership of the National Flaying Fields Association.Subscriptions were based on populations and for this Authority wouldamount to £10 per annum.

RECOIINENDED that the Council take membership of the Association1177 (252).

ASSOCIATION OP DISTIECT COUNCILS - ESSEX BRANCH

347. The Committee noted the report of the Chief Executive upon the recentmeeting of representatives of Essex Authorities to consider the settingup of an Essex Branch of the Association of District Councils. It hadbeen agreed to set up an Essex Branch of the Association, and theCouncil was now invited, to appoint the representatives.RECOMMENDED (i) that the Chairman of the Policy and ResourcesConittee, Councillor Offwood, or his substitute, together With theChief Executive, be appointed as the Councils representatives on theEssex Branch of the Association of District Councils.

(2) that an initial contribution of £10 be made tothe Branch.

(3) that, for the purposes of Section 177 of the LocalGovernment Act 1972, attendance at meetings of the Essex Branch of theAssociation of District Councils be declared to be an approved duty inrespect of the Councillor representative named in Recommendation (i)above (1531)G

RAYLEIGH RATEPA'ThIR'S ASSOCIATION

348. The Chief Executive reported as follows:-

1tfi invitation has bean received for an Officer of the Council toattend a meeting of the above Association to explain the calculationof General Rates for 1974/75. This invitation raises the point asto whether or not Officers of the Council should attend outside meetingsto explain Council policy.

Members have in the past been opposed to Officers attending meetings oflocal orgenisations to explain Council policy, holding the view thatthis is a matter for members rather than Officers said in view of thisthe Council is now asked to decide its future policy in this connection."

EECONNErNDHD that officers of the Council be authorised, at their

discretion, to attend meetings of local organisations etc., providedthat the Chairman of the appropriate Committee indicates his approvaland if appropriate, his intention of accompanying the officer onoccasions where explanations of council policy are involved.

351. The Chief Executive reported as follows:—

"The Scheme for the redevelopment of Nalting Villas Estate, Rochfordrequires the demolition of Nos. 10, 12, 54 and 56 Halting Villas Roadto permit the construction of the northern access road. In anticipationof letting the contract for this work, the former Rural DistrictCouncil re—housed the tenants of these four houses on 11th March, 1974,the houses having stood vacant since that time.

Members will, however', be aware that the contractors subsequentlywithdrew and. tint althou&a fresh tenders for the redevelopment workhave been invited it will still be a matter of months before a startcan be made on the site. In the circumstances it was decided by theformer Rural Council to invite separate tenders for the demolition ofthe four dwellings, this work being deleted from the tender documents

The properties are situated in a cul-de—sac, which is an extensionof Essex Close, where the Council already have a considerable estate.The flats are being constructed in three blocks of 2 storeys and two

In initial contacts with the Builders, it has been stressed that theCouncil would only be interested in purchasing the entire developmentand the Builder is prepared to accept this, provided a suitable pricecan be agreed.

The Director of Health and Housing is of the opinion that this purchasewould be advantageous to the Council, as an addition to the alreadyplanned building programme, and is anxious that the purchase be concluded.Circular 70/74 recently received front the Department of the Environment,amplifies the advice given by the Chancellor of the ]tchequer in his

recent Budget speech, concerning purchase of private properties by localauthorities, and in particular, permits Local Authorities to purchasesuch dwellings at the District Valuers valuation, in accordance withthe deemed loan consent provisions of Giroular 2/70, i.e. without theneed. to submit the plans and estimates necessary to obtain housing coat

yardstick approval.

In Circular 70/74 the Secretaries of State stress the importance whichthey attach to reversing the downward trend in Local Authority housingprovision in. recent years. It is considered that the purchase of theseflats would be of considerable value to the Council, particularly inhelping to meet the forthcoming responsibility for re-housing of thehomeless (See Minute 268/74)."

This was a collection of all the old Essex County Council Planning Policieswhen they were the Thcai Planning Authority and was offered with thesuggestion that the District Council might think it worthy of adoption tofill the policy vacuum created by kcal Government Re—organisaticn.

STRUCTIJBE PLAN

Because of the uncertainty over Naplin it was unlikely that this would befinished within three years.

LOCAL PLANS

These were now the responsibility of the District Council.

STRATEGIC PLAN

It was intended that this would be produced by 1981 up to which time thecurrent Development Plan would remain effective.

INTERIM COASTAL PROTECTION POJJICIES

The County Council Officers confirmed that the River Roach up to Rochfordwas now, again, included in the protected area as was the area of Maplin.

CONSERVATION ,&REIAS

(a) General — Concern was expressed by several Councillors as to whether,in some circumstances, the creation of a conservation area was not self—defeating because owners, unable to develop as they wished, allowedproperties to deteriorate. County Council Officers referred to the provisionfor service of Building Preservation Notices requiring the execution of workin the event of the non—compliance with which the appropriate authoritycould compulsorily acquire and carry out the wot themselves.

(b) North Street, Rochford — The Director of Technical Services informed.Members of current discussions with owners and said plans were likely to besubmitted in the next few days covering the dilapidated properties on thewest side.

uII .He also referred to longstanding proposals to provide rear access to shopsin West Street via Roche Close.

(c) West Street — All agreed on the desirability of the closure to all trafficand Councillors again expressed disappointment at the refusal of the CountyCouncil, as Highway Authority, to ban buses as a first stage.

(d) Market Square, Rochford — As a preliminary to the closure of West Streettraffic it was suggested that the Square itself be closed to all exceptdelivery vehicles.

A Member urged a re—think oh the retention within the Belt of areas ofscrubland.

MAFLIN •The opinion was expressed that there should be two Stru.ctutePlans, one with

?kplin and one without, but tins was not thought practicable If Maplinwas proceeded with there would be 300,000 people to accommodate and a langenumber of incidental jobs. The whole pattern and quantity of developmentwould be different if there was no airport.

GENERAL

A Member said there was a need to think on a larger scale and not to besatisfied with piecemeal infalling. The Planning Authonties should beconsidering large developments with associated social and other services

provided concurrently.

CONCLUSION

The Chairman thanked the County Council Officers for attending what hefelt was a useful meebing saying that this seemed to be the right way todeal with such a document0

Development Services Committee

The Rural Council anticipated that the path would be heavily used,being a direct connection between a large housing estate and theCouncil's playing field, and surfaced it with rolled hoggin suitablyblinded with ash and provided a childrens' safety barrier at thenorthern end of the path. The path follows the western boundaryof watercourses throughout almost all cf its length, the fields whichborder the western edge of the footpath being open meadows. Theprincipal landowner concerned has recently submitted his claim forcompensation under Section 31 of the Highways Act, 1959 which includes£941.00 for the erection of a fence along the field side of the

footpath, principally to prevent trespass from the footpath ontothe ield and £775.00, the capitalised cost of maintenance of thefence. These items were included in the landowner's claim, becauseI have so far resisted his request that the Council themselvesprovide the fence0 I have taken this action on the grounds that theCouncil have no obligation, either statutory or moral, to providea fence and also because I do not wish to see the footpath fencedoff from the rest of the field, which would have the effect ofcreating a narrow alleyway along the edge of the field. It is mynow that the question of trespass from the footpath onto the land-owner's open field is surely a matter for him to take such actionas he feels necessary.

The Council are members of the Commons, Open Spaces and FootpathsPreservation Society and, since I was still being pressed on behalfof the Council to provide this fencing, I sought their advice. Thishas recently been received to the effect that, as a general practice,fencing is not normally included in the cost of compensation, althoughit is conceivable that there may be cases where this would be justified,e.g. where a new path passed through an orchard0 Since, however, thefields in question are open meadows, the Secretary of the Societyfelt that there were no obvious grounds for the necessity of fencing0He concluded that the Council should resist the landowner's claim,before the Lends Tribunal if necessary, and argiae that the proper

enjoyment of his adjoining land is not diminished by the provisionof a path without fencing0

Members will be aware of the many public footpaths which pass throughopen fields without being separated from them by fences and, sinceI ant of the view that it cannot clearly be shown that the cost ofsuch fencing could be properly included in the owners claim forcompensation, I oannot recommend the Council to provide it0"

Resolved that the claim for compensation submitted under Section 31of the Highways Act 1959 in relation to the creation of a publicfootppth from Keswiok Avenue to Pooles Lane, Hullbridge on behalfof Mr. R.C. (a) Regard will be had to the demand/supply situation in relation tosand and gravel

(b) Account will be taken of foreseeable effects of the working and.associated activities on the landscape, trees, wild life andfeatures of scientific, historic or archaeological interest0

(c) The Council will also consider the proposed after'use of the site0Where no beneficial after use is proposed or can be obtained, itis unlikely that permission would be forthcoming0 Where theproposed after use is a suitable one, evidence will be required.to show that it can be satisfactorily implemented0 Where fillingmaterials are necessary to obtain a beneficial after use permissionwill not be granted unless the Council are satisfied as to theavailability and suitability of the filling material0

The tenant is in poor hoalth and after inspedtion of the property it wasconsidered that the flat was not reasonably fit for oôoupation0 Inview of this I arranged for a transfer to alternative accommodation andfor the reasonable removal expenses of the tenant to be defrayed0 Sincethe flats are newly acquired the costs of removal may well be chargeableagainst the retention sum".

"By notice dated 1st August 1973, the Essex County Councilcanted planning permission to the former Rural DistnotCouncil's applioation ROC/511/73 for this development whichinvolves the demolition of 8 dwellings and the erection of 138units of new accommodation. The permission is subjeot to 14conditions which refer to carriage*iay and footway widths,accesses to parking areas, hardstsndings, positions of garages,sight splays, external materials, tree and shnth planting, andfencing0 Regarding the fencing, the requirements imposed.included: —

(1) A 1 metre high brick wall approximately 400 metres long alongthe front boundaries of the existing dwellings 18-61 MaltingVillas Road;

(2) The removal of all front boundary and division fences frommost of the now dwellings;

(3) The erection of a 2 metres high constructed fence of at least

4 metres length to the immediate roar of the dwelling unitproperties within the site0

Although it was estimated that the conditions of consent could beftlly complied with at no overall additional cost, the Councildecided to appeal against the planning condition requiring theremoval of all front boundary and division fences from most ofthe new dwllings, so far as concerned those dwellings frontingthe new through road, on the grounds that the requirements, Le0open planning were unsuitable for Council housing and would beseriously detrimental to road safety0

The appeal was duly lodged but the County Council have nowindicated that, since this Council are now the Planning Authorityfor such matters, the matter may be dealt with under the Town and

Country Planning General Regulations 1974, by the Council givingthemselves deemed planning permission by the passing of anoperative resolution0 The County Council have suggested thatthe appeal be withdrawn and the question of fencing be dealt withas a deemed consent0

If members wish to see front boundary and division fencesprovided, it will be administratively most convenient to withdrawthe appeal thus accepting the existing planning condition, andthen promote an application seeking planning permission for theerection of fencing0 This application could! then receive consentunder the deemed consent provisions, after the normalconsultations0 Alternatively, members may feel that such fencesshould not be provided"0

"The Committee are required. to review the rate of interest chargedto borrowers in respect of house purchase loans in May of eachyear, to take effect on 1st October following, or at such othertime as considered necessary0

The 1present rate of interest charged is 9% per annum, effectivefrom 1st April 1974, which was based en an estimated loans poolrate for 1973/74 of 7,8%.

The calculation of the eatimated loans pool rate for any year isfraught with difficulties in so much as you. have to forecast thetrend of interest rates on all ty-pes of money in the coming year6The present national policy of controlling the growth of theeconomy by the oost of money rather than by central governmentcontrol further complicates any assessment of interest ratelevels0

3139. The Director of Finanoe reported as follows:—

"There are two borrowing methods being operated at present. Scheme 1caters for borrowers included in the priority categories, e.g. councilhouse tenants, persons who are homeless, living in over—crowdedconditions, etc., and Soheme 2, a special method designed to assistyoung married couples with the purchase of their first home.

The operation of Scheme 2 was suspended on 26th April 1974 on financialand administrative grounds, and subsequently reported to the Policy andResources Committee on 7th May 1974.

Advances for property outside the district boundaries have generallybeen refused where the Council have no interest0

The present limitation of any advance undr Scheme 2 is 34 times thejoint annual incomes of the husband and wife or 7 times the annualincome of the male partner, whichever is the lower0 With the probableincrease in the interest rate charge, some further limitation should bemade on the maximum advance in order that the monthly repayments do notaccount for an unreasonable proportion of the monthly inoome of theborrowers. I

Whilst Scheme 2 is headed "100% Joint Income", it is not designed to bea 100% mortgage scheme • The advance wifl normally be limited to 90% ofvaluation or purchase price, whichever is the lower, It is proposed inspecial cases that this percentage may be extended, but that theborrowers be required to have an interest in the property of at least£500 and only in exceptional cases would a 100% mortgage be granted0 aThe demand for mortgage facilities in April 1974 on the Council has beenextremely heavy, due to various factors on both the local and nationalfronts, and which was about six times greater than that experienced in1973—74 It is regretted that Scheme 2 had to be suspended so early inthe life of the Council but it was quite apparent that the existingestablishment of the Income Section could net cdpe with the additionalwork load, Before the Scheme 2 is reopened, the Council will have toconsider increasing the establishment of the Income Section by anadditional officer, Grade ADPO3, or as an alternative introduce a quota

o system of leans. The quota could be governed by amount or number of0) advances, but in any evenh would not solve the administrative problemsC\ and is not wholly satisfactory0 It will also be necessary to monitor\ the extenb of any advances made in relation to their effect on the loans

"The Social Services Department of the Essex County Council havemade representations in connection with difficulties in therepayments of this loan0 A loan of £30000 was made in March1973 by Rayleigh Urban District Council to enable the carryingout of esë±.tigl repairs, the monthly repayments being £597The borrower'sionly income is r,ethirement and supplementarypensionsand shç has iTo savingse The.interest on the mortgage is coveredby the supplementary pension, but the repayment of the capital sumis paid out of retirement pension0 It is increasingly difficultto cope with the capital repayments and to enable her to do so sheis spending money which should be used for heating0 Theborrower has poor circulation and curvature of the spine causingslower movement than normal and it is essential for her to havemore warmth than she can afford at presenttt0

ESSEX HOUSING CONSORTIUM - ARCHITECTURAL DISCUSSION PANEL

391 The Director of Technical Services reported as follows:—

"For a number of years past a Consortium existed of theArchitects responsible for provision of Couicil Housing to anumber of Authorities in the north and north east of Essex.The purpose of the Consortium was to provide an easy andeffective meeting place for these Technical Officers to exchangeinformation and discuss problems. Ei—monthly meetings were heldat the Offices of Member Authorities and were confined to

The Consortium received the blessing of the Member Authorities who eachcontributed the stun of £25 at its inception to meet administrative expenseswith a view to a fresh application being made to them when this money hadbeen expended0 At the time of Re-organisation, i.e. after a period of 6to 7 years, the sum of £70 remained in balances.

A mqeting of Chief Technical Officers responsible for house building tothe new District Councils of Essex has been held to discuss the futureand unanimously supported the resolution that a Consortium should oontinue,initially on the same basis as before, i.e. on an exchange of informationand. discussion group basis. It was also agreed that each Authority shouldbe asked to contrftute the sum of £25 to supplement the £70 in balance atthe winding up of the ensting Consortium to meet sundry administrativeoosts as they arise'.

3950 The Director of Administration reported as fellows—

"The Council have been approached by a local &eveloper, enq-,nringwhether the Oouncil would be interested in purahasing 37 three endfour bedroomed houses, the construction of which has not yet beenstarted, which form part of a larger estate in Great Wskering, thedevelopment of which is being undertaken by this Company.

Since the construction of these dwellings'has not yet been started,it appears that this purchase would fall outside the categoriesautomatically approved in Circular 70/74 which permitted the recentpurchase of 24 flats in Essex Close, Rayleigh, but could in fact beconsidered under the provisions of other paragraphs of the sane'Circular, The houses are to be constructed to the stsndard of theNational House Building Council and a copy of the developers'general information about these properties, including a sitelocation plan, is available.

Unfortunately, it is not clear from the Circular exactly whatprocedure should be adopted to obtain the approval of theDepartment of the Environment to such a purchase of dwellings,which have yet to be constructed upon land owned by a developer".

Advice had now been received from the Department of the Environmentto the effect that a negotiated contract between the Council andthe developer would be the most satisfactory method of dealing with

the proposal, provided the negotiated price was approved by theDistrict Valuer and the dwellings were constructed as near aspossible to Parker Morris standards.

"In 1974 it is intended to organise nine Schemes at various centresthroughout the District and planning, including recruitment aridappointment of staff, is already well advanced. One of the largestof these Schemes, (for children between 5 and 11 years, with possiblya Senior Scheme for those between 12 and 15 years), is to be run atthe Village Recreation Ground at Great Wakering from 0930 hours to1630 hours each week-day between 22nd July and 23rd August 1974,

it is proposed by Great Wakening Parish Council to run concurrently,under their own auspices, on the playing field at the rear of the oldPrimary School, a play—group for 5-9 year olds, and this Council hasbeen asked tO make a grant towards the cost, estimated at being in theorder of £200.

In accordance with Council polioy, sponsored Play Leadership has been,and is being steadily developed within the District in anticipation ofa growing public need and an awareness by parents of the benef its,both short and long term, accruing to the children involved.

Broadly speaking, this is an acceptance of the now widely held conceptthat progressive development of the childs' outside interests shouldgo hand-in-hand with development at school, leading at the teen-agelevel, to interests on a team—basis in pports and outdoor activities,involvement in community matters, and for some at least, a link—up tothe National Outward-bound Schemes,

In 1974 the Council plans to take another step towards this end by wider

age-limits and more selective staffing, (giving larger andbettercontrolled Schemes), and increasing the types and numbers of amenitiesand amusements on offer.

To set up a second scheme in Great Wakering, which would compete forthe attendance of the same children, would appear to be financiallywasteful and against the interests of the children in the long-term.On current planning, Schemes are kept extremely flexible and can beadjusted easily to meet any special local requirements, (within setfinancial limits,) by a request in good time to the Council Departmentconcerned, or by suggestions to the Play Leader at the Play Centre,when every effort will be made to meet the need, provi&L'rag of course,that the suggested. course falls within the Council' s concept of goodPlay Leadership. It may be worth noting at this point, that while"Play Groups" are generally aimed at keeping children happily occupiedduring leisure time, planned "Play Leadership" has considerably morefar—reaching connotations.

Last years' Scheme at Great Wakering was successful, with attendancefigures often exceeding 100, and a great deal of ingenuity and initiativewas displayed by the flay Leader and her Staff in keeping the childrenas actively involved as possible within tolerable limits, and inproviding more sedentary amusements when they became tired. With theinclusion this year of the 5-7 year age group and the provision ofextra staff selected. specifically to meet this groups' needs, it wouldappear that little would be gained by any special selective andseparate expenditure."

It was reported that the Essex County Council had now granted permissionto the Great Wakering Parish Council for the use of the former GreatWakering Primary School playing field for a playgroup for children aged5 to 9 years, and the use of the school building in inclement weather.It was felt desirable to separate the younger and older age groups tocater for their differing needs, althou&a flexibility would be permittedto enable children of the same family to attend one scheme, regardlessof age.

Resolved that the Parish Councils proposed arrangements for a playgroup for children aged 5 to 9 years to be operated at the formerGreat Wakering Primary School and playing field be incorporated withinthe Council2 s Play Leadership Scheme at Great 'Wakening, provided sucharrangements can be met within previously autborised expenditure. The site is on ground previously used. as a rubbish tip in Church End andthe Parish Council having acquired the land have cleared and levelledit by means of voluntary help from local residents. The area will bescreened and fenced when completed.

SWIMMING POOL - RAYLEIGH SWEYNE SCHOOL

408. The Director of Finance reported as follows:—

"As in previous years the swimming pooi has been brought into operationby the Council under the normal joint user arrangements each weekendfrom 6th April to 27th October 1974 and for five weeks full time duringthe summer school holidays. The staff re-appointed to operate the pool

for the Council were the regular staff having worked in this capacityin previous years and consisting of a Pool Attendant, Male and Femalecloakroom attendants with standby reliefs to cover shift workarrangements.

During the weekend 11/12th May 1974 the pool was unavoidably closeddue to necessary repairs to the electric motor driving the filtrationplant. Iii past years, in such circumstances, the Rayleigh Council hasauthorised the payment of a retainer to the staff who would otherwisehave been on duty.

The Pool itself has not received the same support as inweviop.s yearsand this may to some extent be due to lack of publicity."

}]C0NNENDED (i) That the staff scheduled for duty at the RayleighSweyne School Swimming Pool be paid a retainer of £1 per day at timeswhen the Pool is out of commission for repairs, etc.

410. The Director of Administration reported as follows:—

'1n connection with housing development at Caversbam Park Avenue, theRayleigh Urban District Council agreed to accept the conveyance of0.2 acres of land for use as a cbildrenVs play area.

Althou.gh the legal formalities of the conveyance have yet to becompleted, the site has been in use as a play area for some time.A petition has now been received from the residents of Nos. 1,3,5 and7 Mantis Way, Rayleigh, whose1 properties back on to this play space,requesting that the Council consider sale of this land to the four

property owners, to permit them to extend the rear gardens of theirpc'operties.

The petitioners point out that the use made of this land by localchildren is negligible, and that it in fact has been used as acasual oar park and picnic area by local farm labour giving rise tocomplaints of lack of privacy and an intrusion into the peaceableenjoyment of these residentsV properties.

Upon completion of the development of this estate, it is proposed bythe developer that a further area of approximately one quarter acre ofland be dedicated to the Council as an extension to the existing playarea. Sale of the present play area to the four residents would leavethis proposed extension without any form of access. It is consideredthat a play area in this location is a necessary facility and theDirector of Technical Services will be taking adequate measures toprevent the use of the play area for the parking of cars."

It was noted that there was no provision in the current estimatesfor installation of playspace equipment and it was pointed out thatsuch equipment ought to be sited well away from adjoining residential

property.

411. The Director of Administration reported and. the Committee noted thatthe Secretary of State for the Environment did not confirm the RuralDistrict Council of Bochford Pulpits Pan (ChilarensPlayspace)Compulsory Purchase Order 1972 and in his decision indicated that thealternative site offered by the objecting landowner was, in his opinion,as well, if not better, located to serve the local needs. The Councilsubsequently accordingly decided to acquits at the District Va3uer'svaluation the approximately l acre site east Of Chestnut Close,Ashingdon for use as a playspace. The area offered at the inquirywas shown in sketch form only and in November 1973 the initial stagesof the purchase were opened with an approach to the landowners agentssuggesting detailed boundaries and asking for agreement to theseboundaries in order that the Di strict Valuer could be instructed0

Agreement to these boundaries was not forthcoming but an alternativesite had recently been suggested. The District Valuer had, accordingly,been requested to value the land and this valuation would be reported,when available (201).

412. The Director of Administration reported as follows:—

"The following letter has been received from Mr. LE.Bishop—Laggett,5 Grove Court, Grove Road, Rayleigh, concerning the 'development of thispublic open space.

"The plans for the Grove Road Open Space Project are of great interestto the residents of Grove Road and surrounding areas. During the lastthree years, effort has been made by residents to obtain relevantinformation from the Rayleigh Council, but what information was madeavailable was very poor and seemed to indicate that all efforts weregoing to be made to out down trees to make way for two or three foot-ball or rugby pitches, and placing a club pavilion and car park asclose to residential areas as possible. We understood that the carpark was in fact actually to be located at the side of Grove Court0

Many of the residents' houses, including my own, back onto the playingfield which is at the end of Grove Road. This field has been used asa rugby pitch for the last two seasons, however, the pitch is usedonly once a week and yet the Rayleigh Council proposed to place afurther two or three pitches on the land, which would seem to be a

complete waste of public open space.

May I suggest that an informal meeting be convened between your

Committee and some of the local residents to discuss the proposeddevelopment of this area.

In my opinion there is enough land here, if intelligently distributedbetween various activities, to make the Grove Road Open Space Projeota benefit to everybody, to include ( as well as perhaps one rugby pitch)temus courts, putting greens, wooded walks, etc. These amenities arevery necessary in these overcrowded times and I feel that public land.must be developed. with the consent of all and not left to a few peoplewho really do not k-now what is best I or'the area.

Please let me have yourviews on the above at your convenience."

Attention was also &rawu to the earlier request of the RayleighWy-vern Rugby Football Club (Minute No.282/74) for assistance in

provision of two rugby pitches and a olub house at this open space;such request having been deferred until further information on the openspace was available. I

The Director of Administration reported that notices to treat bad onlyrecently been served and. the Council would have to deal with claims forcompensation from owners of the various plots. It seemed likely thata period of approximately 18 months or 2 years would elapse before theopen space could be brought into use. The request for a Meeting withlocal residents was consi4ered to be premature and it was also pointedout that consultation with sports clubs and other similar bodies shouldbe undertaken to ascertain potential needs for the facilities to beprovided.

Resolved that Mr. Bishop—Laggett be informed that the Council cone iderhis reqaest for consultation with local residents upon the lay-out ofGrove public open space is premature at this time, having regard to thepresent stage of negotiations with owners, but that full consultationwith interested organisations and perons will be undertaken before theland is brought into use.(6995)

ALLOTMENTS- RAMBNPR SBDT SITE.

413. The Director of Administration reported. as follows:—

"There is a waiting list for allotments and in consequence the formerRayleigh Urban District Council oonsideed the possibility ofextending the Rawreth Shot allotment site by ah acre to provide afurther 35 allotments. Technically it would. appear possible to providethese 35 plots but it would be necessary to give notice to Mr.Glenisterwho has recently been given permission to graze two horses on this acre.

Insofar as a demand is concerned there is a list of at least 30 personswho have expressed a desire to take up allotments on this site.tt

RECOMN[SNDEI) (1) That the Director of Technical Services carry outa survey to establish how the 35 plots shall be laid out and provide aplan, showing plots of not more than 5 rods area.

(2) That in conjunction with the survey in (1) abovethe Director of Technical Services also indicate where the water pointsshall be established. on the site.

ROCBFCBD RESERVOIR - ROCKEtED AMGLING CLUBG

414. The Director of Administration reported as follows:-I

"The present licence permitting the Rochford Angling Club to fish theRochford Reservoir expires on 28th September 1974.

The Reservoir and surrounding land has recently been developed by theRoral District Council as an open space for the use of the generalpublic and there are proposals for the carrying out of further work tomake the public open space more accessible and attractive. It is feltthat the continued exclusive use of the water by the Angling Club willconflict with the increased public use of the open space which isanticipated. The Angling Club have requested that the licence berenewed for a period longer than one year, as has been the custom inthe past, but the Management Team are of the opinion that there shouldno longer be any restrictions upon the use of the public open space,and that the lease should be terminated, it being considered that theAngling Club have had ample tine to find alternative waters to fish.Alternatively, it may be felt best not to permit any 'fishing in theReservoir, the intention being that this area of water should formthe centre—piece of an attractive amenity area."

Members were generally of the opinion that the Angling Club badbeen instrumental in securing the proper management of the Reservoirand also that they had incurred expenditure in keeping the waterstocked with fish. Thirthermore it was appreciated that no provisionwas made in the current estimates for any inprovements to the openspace, and it seemed sensible to extend the Angling OlubVs licensefor a further period pending such improvement works being undertaken.

RECOMMENDED That the licence granted to Roohford Angling Club forthe fishing of the Rochford Reservoir be renewed for a period expiringon 28th September 1976. (133)

416. The Director of Administration reported as follows:—

"At a recent meeting of the Co—ord.inating Committee consideration wasgiven to a scheme for the provision of a centre for all people with aneed of any kind, regardless of age or disability. It is envisagedthat such a centre would provide both creative and leisure activitiesdaytime and evenings and that social services would be in attendance to

give guidance and support as required.

Although the Working Party which looked into this matter was originallyconcerned with the Rayleigh area only, as the Co—ordinating Committeehas now been extended to include the whole of the area of the RochfordDistrict Council, consideration was given at the meeting to provisionof such centres in the whole of the District and. during the discussionmention was made of a possibLe suitable site within the Ashingdon area.The Committee are also making enquiries on their own behalf to obtainthe use of the Old Peoples9 Day Centre at Castle Road, RayLeigh forsuch a purpose.

It is felt that similar facilities are needed in all the residentialareas of the District and it will be the eventual ain of the Committeeto achieve this.

With regard. to financing these schemes, whilst it is anticipated thata certain amount of the money required can be raised on a voluntarybasis, the Committee will look to the appropriate authority, i.e. theEssex County Council, to provide some sort of financial assistance andnow asks this authority to support this scheme and to make appropriaterepresentations on their behalf to the County Council to obtain assistance."

Members felt that the Council shokld be represented on the Co-ordinatingCommittee.

418. The Director of Administration reported and the Committee noted thata Meeting of the Dinner Sub—Committee was held on 28th Febr.ary 1974when Oounoillors Fudge (Chairman), Grove, Harvey and Ives were present.

Alternative dates for the Dinner were agreed subject to the availabilityof the Roy Howard Big Band and the Shaftesbury Windsor Catering Servicewhom it was agreed should be engaged for the evening.

ThL HALL - NOISE NUISANCE.I

419. The Director of Administration reported that complaints had been madeto the Chairman of the Council concerning noise nuisance emanatingfrom the Mill Hall, being due to the ventilating system being out oforder, necessitating windows having to be opened. The Director ofTechnical Services reported that the ventilating system had now beenrepaired, but was not sufficiently effective in very hot weather.

Resolved that the Director of Technical Services report to a futureMeetingof the Committee on the necessary improvements to thisventilating system.

HOCThEY WOODS - CAR xina FACILITIES.:

420. A Member drew attention to the inadequate carparking facilities atHockley Woods pointing out that the attraction of visitors to the Woodswas ever inoreasing and that the existing facilities were beingutilised to their fullest extent, especially on Sundays and. BankHolidays. These conditions constituted hazards particularly tochildren, since insufficient space was available for ears manoeuv'ringin and out of the site and these conditions were aggravated at timeswhen an ice cream van was parked in the area. The Member suggestedthat consideration be given to extension of the car parking facilitieson a long tern basis, or alternttively an immediate solution by use ofthe space adjoining the old cafe at present used for the storage ofmaterials. The Director of Technical Services stated that the areawan unsurfaced and no supervision of parking was possible. Theadjoining area could be used for additional parking but even this wouldbe insufficient to meet the demand.

Resolved that the question of car parking facilities at Hockley Woodsbe referred to the Car Parking Panel for investigation.

to adminster the bye—laws, and. the operation of two different sets ofbye—laws could lead to confusion0 Additionally, it should be saidthat the Southend bye—laws are considered to be fair and just, andappear to be accepted as such by those in the "taxi" business, some ofwhom operate in both districts0

It should at this stage be pointed out that Southend. Council haveadditional bye—laws to control and licence private hire cars, asdistinct from hackney carriages, by virtue of the provisions of theSouthend—on-.Sea Corporation Act l97O Vh.ilst it would be desirablefor iMs Council to make similar bye-.laws, in addition to the hackneycarriage bye—laws, it is not possible for this legislation to applyto this District unless it can be incorporated at some time in theThature in an ssex County Council Act or in a Public General Actpromoted by the Government1

In addition to the bye—laws, the Southend Council has adoptedpre—licensing standards for hackney carriage licances (plates) andfor hackney carriage drivers licences, which deal with such mattersas the age and size of the vehicle, Its availabIlity for hire, itsregular inspection and maintenance, adequate insurance etc and, withregard to driveiis, with their suitability taking account of drivingability, knowledge of the district and. of any criminal conviction;Again it would be necessary for the Council to adopt such standardsand those in operation in the Sout,hend area are considered perfectlysuitable0

However, before -the Council proceed to consider and adopt bye—lawsand pre-lioensing standards it is felt advisable for the officers tomeet representatives of the existing Rayleigh licence holders andinterested persons in the flochford. area to discuss the proposed newservice generally and to give consideration to matters such as thenumbers of plates to be issued throughout the District, the siting ofranks etc0, and the question of phasing in the pre—licensingstandards — one provision of these standards deals with the age of thevehicle and it may be necessary for some operators to renew theirvehicles0 In these circumstances Lt would be unreasonable to requiresuch renewal overnight0 It is also felt that such a discussion, atwhich the officers of the Sou'tbend Council responsible for theoperation of the service would be present, would assist in creatingan a&aosphere of co=operation between the Ootmcils end the taxiproprietors which would be of benefit to the operation of the servicegenerally0

Such a meeting could be followed by further consideration by thisCommittee of any matters raised, to which possibly a deputation of Staxi proprietots could be invited to discuss any difficulties orpoints of dispute0 Thereafter, the Council could proceed to takefinal decisions upon the bye—laws, pm—licensing standards, thesiting of ranks and the number of plates to be issued.

As already mentioned, the Council have ai.rtady agreed to accept theoffer of the Southend Council in relation to the following matters:—

1. Advice on the making of bye-laws20 Advice on the pre-licenalng standards for hackney carriages

and for drivers3° Advice on the siting of tart stands4. The carrying out of mechanical examinations of hackney carriages50 The carrying out of meter tests6Q The carrying out of driving tests

7. Investigations into the suitability of drivers8. llcutine inspection of vehicles9. Maintenance of the necessary records10. Investigation of complaints11. Preparation of cases for prosecution

The cost of this service will be £1,000 per aurtuin, for which noprovision has been made in the Revenue Estimates, which will be thetotal cost to the Council0 In the first years of operation,Southend's erpencliture will be high, levelling out gradually as timepasses and. on this basis the charge is considered to be veryreasonable and quite acceptable0 It will also be necessary toappoint by name the appropriate officers of the Southend DistrictCouncil and to give them authorit, to stop and. inspect vehicles, issuelicences etc0

The Committee will also need to consider, at a later date, theconstitution of a small panel of members to deal with appeals bydrivers where it is proposed to refuse a licence, the power to issuea licence resting with the officers0"

The tern of office of Members is normally four years but thestatutory regulation provides that in the first instance one halfof the Members appointed in each category will serve for a periodending on 30th June 1976 and the other half for the period ending30th June 19780 The North East Thames Regional Health Authorityhave now asked if authorities would indicate which Members theyconsider should retire in 1976 and which in 1978. In view ci' thefact that each authority appoints an uneven number of Members itwould seen desirable to consider this matter in consultation withother constituent authorities,
