GENERAL INFORMATION
Oicial deinition
“Special Economic Zones, hereinafter referred to as SEZ, shall mean zones with certain boundaries within the terri-
tories of the Unitary State of the Republic of Indonesia, and designated to carry out the economic function and are
granted certain facilities and incentives. Zones shall mean areas within SEZ with certain boundaries and are utilized
according to their designated roles.” (art. 1).
“SEZ shall be developed by irst preparing areas having geo-economic and geo-strategic advantages and serving to
accommodate manufacturing activities, export, import and other economic activities with high economic value and
international competitiveness” (art. 2).
A SEZ shall be made up of one or several zones dedicated for export processing; logistics; manufacturing; technology
development; tourism; energy; and / or other economic activities.
Within a SEZ, support facilities and housing for the workers may be constructed; there will be places to conduct micro,
small & medium businesses, and cooperatives as the business players and support for the activities of the companies
operating within such SEZ (art. 3).
The sites which may be proposed to become SEZ must meet the following criteria:
• a. they correspond with the Regional Spatial Plan and will unlikely disturb the conservation areas;
• b. the said provincial/district/city administration supports the SEZ;
• c. situated close to international trading hub or near international ship channel in Indonesia, or situated in an area
with prime resource potentials,
• d. have clear boundaries (art. 4).

growth of 8.39%, whilst the country’s economic growth for 2013 was 6.3%. During the

Abstract of the Law of The Republic Of Indonesia Number 39, Year 2009 Regarding Spe-
cial Economic Zones Chapter 6, Part One):
Art. 30:
(1) Each taxpayer who runs a business in SEZ shall enjoy Income Tax incentive.
(2) In addition to such tax incentives as referred to in paragraph (1), additional tax in-
centives may be granted according to the characteristics of the zone.
(3) The facilities and incentives as referred to in paragraph (1) and paragraph
(2) Shall be given in accordance with the provisions of laws and regulations.
(4) Further provisions regarding income tax incentives as referred to in paragraph (2)
and paragraph (3) shall be regulated under the Government Regulations.
Art. 31:
Tax incentives may also be granted in certain periods to investors comprising Property
Tax reduction in compliance to the provisions of laws and regulations.
Art. 32:
(1) Importation of goods or merchandise into SEZ may enjoy facilities such as:
a. postponement of import duties;
b. excise exempt for direct materials or production support materials;
c. exempt from Value-Added Tax (VAT) and Luxury Sales Tax for taxable goods; and.
import Income Tax not levied.
(2) The delivery of taxable goods from other places within customs areas to SEZ may
enjoy VAT and Luxury Sales tax based on the provisions of laws and regulations.
(3) The delivery of taxable goods from other places within customs areas to SEZ as long
the goods are not intended for the parties enjoying VAT facilities, but are levied VAT or
Luxury Sales Tax in compliance to the provisions of laws and regulations.
(4) Further provisions concerning the facilities granting as referred to in paragraph (1),
paragraph (2), and paragraph (3) shall be regulated under a Government Regulation.
Article 33
(1) Imported goods released from SEZ for consumption as
long as the goods are not intended for the parties enjoying tax exempt or import duty,
excise or tax postponement for import purposes:
a. shall be levied with import duties;
b. their excise must be paid for the excisable goods;
c. subject to VAT, or VAT and Luxury Sales Tax based on the provisions of laws and regu-
lations.
(2) The goods as referred to in paragraph (1) shall be subject to provisions under the
provisions of laws and regulations.
Article 34 Goods released from SEZ for export purposes shall be subject to export pro-
visions in compliance to the provisions of laws and regulations.

Observations Batam is the largest Free Zone of Indonesia located just south of Singapore (12 miles by
ferry).
This makes of this SEZ a very attractive location for Singaporean manufacturing investors
(70% of foreign direct investment in the SEZ), who enjoy the beneits of cheaper land and
competitive labor costs.
Batam is the largest shipbuilding area in the country, with more than 150 major maritime
companies operating in the province.
Batam SEZ includes islands of Batam, Tonton, Setokok, Nipah, Rempang Galang and Ga-
lang Baru.
Batam is with Bintan and Karimun currently had the status as the Special Economic Region
(SER). By this is expected to be able to increase investment in Batam that in the long run is

Evolution of status:
On January 19, 2009, the President of Indonesia oicially declared the Batam-Bintan-Kari-
mun as a Free Trade Zone (FTZ).
In 2016, the Presidential Decree No. 8 of the Zone Council MOOPS (November 29, 2016)
has changed the Status of Batam FTZ into a Special Economic Zone (SEZ).

Observations “Special Economic Zones (SEZ) Sei Mangkei stipulated in Government Regulation (PP) No.
29 of 2012 on February 27, 2012 and was the irst SEZ in Indonesia which was inaugurated
by the President of the Republic of Indonesia Joko Widodo on January 27, 2015.
Sei Mangkei KEK has major activities in the form of industrial downstream palm oil and
rubber. Besides the main activities are supporting activities such as logistics, various in-
dustries and tourism. The products produced by this KEK include fatty acids, fatty alcohol,

Observations “Palu is the irst special economic zone located in the strategic trading channel of Sulawe-
si and the irst designated by the government as the centre of integrated logistics and
mining processing industry in the Sulawesi Economic Corridor. It is prepared to develop a
wide range of industries inculding automotive manufacturing industry, mining industries
and also agro industry consisting of seaweed, rattan, and cocoa processing. Palu SEZ has
a total area of 500 Ha in Palu Bay, Central Sulawesi Province and is managed by the go-

Observations “Bitung Special Economic Zone (SEZ) is newly launched by the Government of Indonesia
in 2014. Bitung SEZ is managed by the provincial government of North Sulawesi and is
designated by the Government as the centre of ishery, distribution, and logistic in Su-
lawesi Economic Corridor. It sits on an area of 534 Ha at Tanjung Merah Bitung Village,
North Sulawesi Province. North Sulawesi is the 3rd largest coconut producer in Indonesia
(270 thousand tonnes on 2013) and the 5th largest isheries producer in Indonesia (281

Observations “Tanjung Lesung is a Special Economic Zone (SEZ) in tourism sector, which is launched by
the government of Indonesia in 2012 and has declared ready for operation by President
Jokowi in 2015. Tanjung Lesung SEZ is also one of the 50 national tourism destinations
stipulated by the Ministry of Tourism.
Tanjung Lesung SEZ is located in Pandeglang, Banten, a part of the western region of the
Sunda strait (170 kms from Jakarta). With total area of 1,500 ha, it ofers natural beauty,

Observations “The 1,201.76 Ha area of Morotai Special Economic Zone (SEZ) was launched by the go-
vernment of Indonesia in 2014. The zone is strategically located in the Halmahera group of
eastern Indonesia’s Maluku islands, on the Morotai Island, North Maluku Province, a 3-hour
light from Singapore and Taipei. Maluku and North Maluku are the largest isheries pro-
ducers in Indonesia (688 thousand tonnes in 2012). Thus Morotai SEZ is designed to focus
on developing its ishery industry amonst its marine tourism and historical attractions of
World War relics. Morotai SEZ is managed by PT Jababeka, Tbk. which has more than 20
years’ experience as a developer including its Jababeka City lagship”.
