1) INTRODUCTION :

It is proposed to carryout Construction of analyzer room with assoiated Civiland Structural Works for DHT project inside the Refinery as per SOR.

The above jobs will be required to be carried out at BPCL Refinery, Mahul,Mumbai - 400 074. The job will be carried out under instruction/ supervisionof Engineer-in-Charge or his authorised representatives.

EIL is providing PMC services for DHT Project and RCM-EIL shall beEngineer-in-Charge for this work.

2. SCOPE OF WORK :

The broad nature of work/ scope of work involved under this contract ismentioned below but are not restricted to the following :-

2.1 Earthwork in excavation / backfilling for foundations, plinth beam,pavemant, drains, cable trenches etc.2.2 Providing and laying PCC / RCC for foundations, beams, columns,pavements, drains, cable trenches, box culvert etc. including providing andfixing reinforcement / shuttering.2.3 Providing and laying RCC concrete blocks, Brick / Random Rubble Masonryworks/ Pitching including plastering for walls, steps, cross overs, drains,cable trenches, box culvert, chambers etc.2.4 Structural Steel works for pipe supports, guide supports, MS insert forprecast slabs etc.

Scope of work includes all the structural works like supply, fabrication,tranportaion, erection, field welding, bolting, scaffolding, painting etc. inexisting plants /pipe racks inside the refinery. The contractor shall carryout the work as per Schedule of Rates, approved drawings, SOW & as per theinstructions of Engineer-In- Charge.

Development of fabrication drawing is in contractor scope.

QAP Shall be prepared by the contractor and shall be submitted to EIL forapproval.

3. SPECIAL CONDITIONS OF CONTRACT :

Please note that "Scope of Work" will be read along with the 'SpecialConditions' of this contract. Contractor shall be required to abide by theconditions stated in General terms & conditions attached.

3.1. Prior to quote for the job, the bidder will be required to visit the site& clarify all the doubts (if any) from BPCL/EIL . Otherwise it will bepresumed that the party has understood the work in all respect.

3.2 FIRES & SAFETY REGULATIONS

3.2.1 The work shall be carried out in a safe manner as per Refinery norms &work permit condition shall be scrupulously followed.

3.2.2 BPCL conducts an intensive training programme on various aspects of Fire& Safety, on regular basis, at Refinery-Fire Station. It is the responsibilityof the Contractor to nominate all the supervisors/labours (likely to beemployed for this job) for training through BPCL/EIL site engineer. Thesuccessful completion of training is mandatory requirement (in addition toother qualifications/experiences mentioned earlier) for any supervisor/labourto be eligible for working at Refinery work site. Failing which nosupervisor/labour will be deputed for working at Refinery work site.Contractor shall also send all the other workmen deployed at Refinery for thistraining.

3.2.3 Contractor shall arrange all required safety gadgets like safety helmet,

3.2.6 The contractor shall submit daily labour report & weekly progressreport to BPCL/EIL.

3.2.7 EIL Specifications/ standard/ work procedure shall be followed for thiswork.

3.2.8 Material and site work shall be inspected by EIL as per EILspecification.

3.2.8 All matertial shall be procured as per BPCL/EIL approved vendor list.

4. MOBLIZATION.

4.1 Wthin 3 days of issue of contract letter the contractor shall prepare adetailed schedule of activities for completion of the work & shall get itapproved from BPCL/EIL.

4.2 Also within 3 days of Issue of Contract Letter the contractor shallmobilise all necessary manpower & equipments & start the job at site asdirected.

5. TECHNICAL PERSON AT SITE/DEPLOYMENT OF ENGINEER.

The contractor shall depute experienced/qualified(Degree/diploma Holder)Civil/structure Engineers with safety trained supervisors for site job.Contractor shall sufficient manpower during agreed working period to ensureeffective output to meet the agreed schedule/ bar chart.

The Engineer-in-charge/Inspectiondepartment shall have full authority to inspect the works at any time wheneverin progress either on the site or at contractors workshop wherever situated.All the test for e.g. Cube test, test for silt content of sand (as per IS 383,for Zone II & Zone III, as approved by Engineer- in-charge), etc. necessary inconnection with the execution of the works or material or workmanship suppliedby the contractor shall be carried out promptly by the contractor at his owncost from any other approved testing laboratory or at site as per theinstructions of the Engineer-in-charge/ Inspection department/ InspectionAgency appointed by BPCL/EIL.

CEMENT: Cement required for all construction shall be provided by contractoronly. Cement used for ready mix concrete shall be Portland Slag Cement (PSC)conforming to IS 455 or Ordinary Portland Cement (OPC) conforming to IS 1489Part-I as indicated in IS 456:2000. This shall be of approved make viz ACC,L&T,CCI, Gujrat Ambuja or equivalent conforming to IS:455 or IS: 1489 part-I.

Cement used for all other purposes except for Ready Mix Concrete shall beconforming to IS: 12269. This shall be of approved make viz ACC, L&T,CCI,Gujrat Ambuja or equivalent make Ordinary Portland Cement grade 53 (conformingto IS:12269).

CRANE: Crane , JCB , Poclain, dumper ,etc if required shall be arranged bycontractor at their cost. The contractor shall produce validity certificateissued by RTO as well as test certificate for load carrying capacity issued bythe competent authority in Form No. 12.

TOOLS AND TACKLES :

All lifting tools like chain block, sling etc. required to be used at site,shall be tested by the statutory authority & have valid certificate for use.The copy of certificate shall be made available for verification as and whenrequired by BPCL/EIL.

CONTRACTOR's scope of supply includes supply of all consumables like gas,welding electrodes etc.




7. INSPECTION OF CONSTRUCTION MATERIAL & WORKS :

7.1 For execution of the job under this tender, contractor shall be requiredto get clearances from TEIL stage wise. Also, contractor shall be required tosubmit Quality Assurance Plan for execution of the job & the same shall beapproved by TEIL

7.2 All construction works and material brought by the contractor shall be asper the relevant latest ISI specifications. TEIL shall have full authority toinspect the works at any time whenever in progress either on the site or atcontractors workshop wherever situated. All the tests e.g. Cube test, Slumptest, Cylinder test, Brick test, Test for silt content of sand, sieveanalysis, test for chemical composition of steel, test for ultimate tensilestrength of steel, bond test for reinforcement bar etc. necessary inconnection with the execution of the works or material or workmanship suppliedby the contractor shall be carried out promptly by the contractor at his owncost from any approved testing laboratory as per the instructions of theEngineer-in-charge/ Inspection department.

7.3 The contractor shall have to submit relevant manufacturer's testcertificates of all materials under contractor's scope of supply. Thematerials shall be tested as per the relevant IS, BS, ASTM etc. codes. All thetests shall be conducted through laboratories approved by BPCL andconsultants.

7.4 The contractor shall have to maintain at site, Hindrance register & siteinstruction book in format approved by the engineer-in-charge.

7.5 All structural works etc. shall be offered for BPCL/EIL inspection. Allmaterial procured by the contractor shall be offered for inspection &supported with the test certificates of the tests conducted as per therelevant IS, BS, ASTM etc codes. All tests shall be conducted throughlaboratories approved by BPCL/EIL.

All painting materials including primers and thinners procured by contractorshall be accompanied by manufacturer's test certificates.

The painting work shall be subjected to BPCL inspection at all times. Theexecuting department shall offer the work for inspection and approval at everystage before proceeding to the next. Record of inspection shall be maintained.

8. WORK TIMINGS :




Normal working hours for carrying out this job will be morning 07.45 am toevening 03.45pm. Contractor may have to work in extended hours and on holidaysif required to meet the project schedule as instructed by Engineer-in-chargeafter taking all necessary permissions from BPCL.

For execution of this job, contractor shall be required to get clearances fromBPCL. The work shall be carried out in a safe manner as per Refinery norms &work permit condition shall be scrupulously followed. The work should beplanned and undertaken only under the Supervision of a competent person. Noidle time wages or compensation for temporary stoppages of work orrestrictions would be paid and the rate quoted for various items of workshould cover the cost of all such contingencies and eventualities. Substantialstructures and utilities exist both above ground and underground, adjacent tothe work site, Special care is necessary in transportation, storage, workingon equipments and other construction activities to protect the existingfeatures and prevent damage to any facility. Necessary protective structures,barricades etc. have to be erected at various places as directed by Engineerin charge. No extra payment of such protective work will be made. All roadsand open areas adjacent to the work site shall either be closed or suitablyprotected as per the job requirement.

9. HOUSE KEEPING :

The contractor shall maintain good housekeeping on day to day basis at thesite/storage yard. All materials brought by the contractor, cables, steelscrap (like structural steel, reinforcement steel etc.) & other debris (likeconcrete, earth, shrubs, rubbish etc.) generated at site shall be stackedneatly in well defined spaces at no extra cost. Minimum 5 people shall bedaily deployed by the contractor only for housekeeping works inside the plotarea which will execute the work as directed by contractor's safetysupervisor. Additional manpower as & when required for housekeeping shall bearranged by contractor immediately as per directions of BPCL. Record of themanpower deployed for housekeeping shall be maintained by the contractor.Penalty of Rs. 600 per day per person may be imposed on contractor if thehousekeeping manpower is less than the minimum requirement specified above.Contractor shall consider the same while quoting for the job as no extrapayment shall be made for deployement of manpower related to housekeepingworks.Cart away all the debris generated from the work outside the Refinery anddispose it off. Certified copy of gate passes shall be attached with the finalbill. Metal scrap or any other scrap including wooden material shall bedisposed category wise as indicated by the Engineer in Charge. The weighmentslip issued by the warehouse will be attached with the final bill.

All moveable, salvagable, servicable material shall be dismantled carefullyand transported/ stored as directed by Engineer in charge.




The final bill of the contractor shall be linked with the area cleaning in allrespects including disposal of debris/scrap etc. to the entire satisfaction ofEngineer in charge.

10. DEFECT LIABILITY PERIOD:-

Defect liability period shall be 12 months from the date of completion of allthe jobs covered under this contract.

11. PAYMENT TERMS :

For all items: As per the agreed item rates for completed & certifiedquantities of work for respective item against RA bills.

10% of each RA bill shall be withheld as retention monery. In lieu ofretention money, contractor shall submit bank guarantee of 10% of contractvalue alongwith acknowledgement of purchase order valid for defect liabilityperiod of twelve months with claim period six months extra.

11. COMPLETION PERIOD: The overall contractual completion period shall be 05months from the date of LOI or Purchase Order whichever is earlier.

12. LD Clause: LD clause shall be as per clause no. 22 of General ContractCondition (GCC).

LD Clause - In case of delay , 0.5% per week of delay or part thereof upto amax. 5% of the total contract value shall be recovered. ________________________________________________________________________________________________________________________________________
