judiciaryand thegovernment, theSupremeCourtThursdaysaidthattheCBIdidnotrequirethesanctionofthegovernment to pursue a court-moni-toredinvestigationsuchasthe2Gcase.
Whya sanctionis requiredto in-vestigate? It is a court-monitored in-vestigatio n, you can go ahead andprobe, said a bench of Justices G SSinghviand KS Radhakrishnan,refer-ringtothe2Gcase.
You dont need permission any-more...It ismadeclearthattheCBIisconducting investigation... under thesupervisionof thiscourtandhencere-
quirementofsanctionwillnotcomeinthewaywithrespecttoinvestigationofanyone... In a court-monitored inves-tigation, you are not required to getsanctionunder Section6A.
The courts position may have adirectbearing ontheCentresbattleinthe coal blocks case to hold on to itspowerto decidewhethertheCBIcanbeallowedtointerrogatetopofficers.Thegovernmenthasrefusedto makeany exception to the rule which re-quirestheCBItoapproachitforsanc-tionto investigateofficersat thelevelof joint secretary or above, as pro-

THE recent bump in tradi-tionally smooth ties betweenIndia and Bhutan has esca-lated into a war of words be-tween the petroleum and ex-ternal affairs ministries, withthe former blaming the for-eign office for issuing an ex-plicitdirectivethatledtoacutinthesubsidyon keroseneandcooking gas sold to the Hi-malayan kingdom.
ButtheMEAhassaidthatthe petroleum ministry hadmisinterpreted its communi-cation andjumpedthegun oncuttingthesubsidy.
The communication re-
ceived from MEA (on May23) was very clear and there
was no scope for ambigui ty,saysa petroleumministrylet-terofJuly31totheMEA.

THE Cabinet Thursday ap-proved amendments to theRight to Information Act(RTI) to ensurepoliticalpar-ties are not categorised aspublicauthorities,a movethatnullifies the directive of theCentralInformationCommis-sion (CIC) to bring them un-derthe transparencylaw.
TheCIChadinJuneheldthatsixnationalparties theCongress, BJP, NCP, CPM,CPIandBSPweresubstan-tiallyfundedindirectlyby thegovernmentandhadthechar-acter of a public authority,compelling them to share in-
formationundertheRTI.It had directed parties to
appointpublicinformationof-ficersforthesame.TheorderhadmadeIndiaonlythethird
country in the world afterPolandandNepaltobringpo-liticalpartiesundertheambitofthetransparencylaw.
TheCabinetobservedthattheCIChadmadealiberalin-terpretation ofSection 2(h)oftheRTIAct,leadingtoanerro-neousconclusionthatpoliticalpartieswere publicauthorities.It was also pointed out thatbringing political parties un-der the Act was never visu-alisedwhenthelawwasmade.
The Department of Per-sonneland Training,the nodaldepartmentforimplementingthe RTI Act, in consultation
with the law mini stry, movedthe amendment, which nowspecificallysays thedefinition
of public authority does notapplytopoliticalpartiesregis-tered under Section 29A ofthe Representation of thePeopleAct, 1951.
