Sharma, who took charge on Tuesday, told The Indian Express that he would be in charge of modernisation of the police force. Sharma retired on De- cember 31 last year as Direc- tor General of Police (DGP) in the Bureau of Police Re- search and Development (BPR&D) in Delhi, where he went on deputation after the Gujarat government denied him a promotion and posted him as managing director of the Gujarat Sheep and Wool Development Corporation, a post always held by an IAS officer. In Gujarat, for over two years, he fought a bitter battle against the state government for promotion as DGP. He approached the Central Ad- ministrative Tribunal (CAT) demanding that his grades in the Annual Confidential Re- port (ACR) be improved. The state government had also sanctioned criminal proceedings against Sharma in a 28-year-old case filed by an alleged smuggler, which was stayed by the Gujarat High Court. Barely two months before his retire- ment, the Delhi High Court cleared the way for his pro- motion as DGP. Sharma’s younger brother, Pradip Sharma, an IAS officer, was arrested in an alleged land scam case, and is now out on bail. MHA picks Modi baiter as advisor KULDIP SHARMA EXPRESS NEWS SERVICE NEW DELHI, APRIL 3 THE Tourism Ministry has in- troduced a time-bound process to deal with approval and classification of hotels and restaurants and put in place an online system for the pur- pose in order to bring in more transparency in these proce- dures for the sector. Tourism Minister K Chi- ranjeevi on Wednesday launched this web-based ‘pub- lic service delivery system’ that will enable the hotels and restaurants to track the progress of their applications online, on a real-time basis. “By putting this system in place, there will be pressure on the officers of the ministry to deliver on time and an increase in accountability. Now on- wards, all applications will have to be examined within 15 working days from the receipt for completeness,” Chiran- jeevi said. He said in the next 15 days, inspections to the ap- plying hotels would be sched- uled. “The recommendations of hotel and restaurants ap- proval and classification com- mittee will be communicated on the spot to the applicant and these recommendations will also be put on the web with final decision within 10 days of the inspection,” he said. “This measure will bring in more transparency, make officials more accountable and enable the applicants to access information and check status of their applications,” he said. The ministry plans to move to- wards an ‘e-regime’ and accept ‘e-applications’ and proposals. It also plans to put in place sim- ilar systems in other spheres of functioning, a statement by the ministry said. Time-bound process for approval to hotels, restaurants OSHUBHAJIT ROY NEW DELHI, APRIL 3 FRANCE has assured India that the UN Arms Trade Treaty — which was passed by a massive majority of the United Nations General As- sembly (UNGA) on Tuesday night — will not affect the de- fence relationship between the two countries. Although the French gov- ernment voted in favour of the resolution, it has said that India’s concerns are legiti- mate and has given firm and public support to the Indian position on “contract protec- tion”, sources said. New Delhi has been upset with the US and UK for not accommodat- ing Delhi’s concerns. India abstained at the UNGA on the resolution on the ATT, which was passed by 154 votes, as it felt that the treaty was tilted grossly in favour of arms-exporting countries. As one of the biggest arms importers, New Delhi felt that it may face the brunt of the treaty if major arms-exporting countries in- voke the treaty’s provision of unilateral termination of de- fence contracts. Paris, which is a major supplier of arms — and is part of the recent multi-billion dollar deal on Rafale jets — has been quick to assuage concerns on the Indian side. Sources said French inter- locutors had worked very closely with Indian officials in New York and Geneva as ne- gotiations were carried out on the text of the treaty. In fact, it was due to close coordination between New Delhi and Paris that the draft text of the treaty — in its final stages — was earlier going to accommo- date India’s concerns. Sources said that it was New Zealand that had come up with a compromise formula- tion in the final stages of nego- tiations that was acceptable to the India-led arms im- porters group as well Ameri- can-led arms exporters group. However, on March 27, US interlocutors diluted the draft text of the treaty and brought in “unpredictability” and “instability” in the de- fence contracts. This sur- prised many, including French and Indian officials, who had worked very hard for the treaty’s text, which would have “balanced obligations”. France, which had initially told its European partners that the treaty must have a “good balance”, finally went along with the final text as it felt that the text was good, al- though not perfect. Along with India, China, Russia, Egypt, Indonesia, Myanmar, Sri Lanka, Saudi Arabia, Qatar, Oman, Cuba abstained in the vote on the resolution. Pakistan, Afghanistan, Bangladesh, Nepal, Maldives and Bhutan voted in favour. The treaty will be open for signature at the UN Headquarters in New York from June 3, 2013 until it is put into force. The treaty is subject to ratification, ac- ceptance or approval by each state that is a signatory and will come into effect as an in- ternational law once at least 50 states ratify it. UN arms treaty won’t hit ties with India: France K CHIRANJEEVI Why should state pay for security to those with criminal cases: SC UTKARSH ANAND NEW DELHI, APRIL 3 AS the Supreme Court set its scan- ner on the contentious security cover for VIPs and VVIPs across the country, an affidavit from Uttar Pradesh on Wednesday threw up a list running into 393 pages that names only such persons who have been given security although they had criminal antecedents. Some of them even faced charges like mur- der and attempt to murder. The list, submitted in a sealed cover in the court, included MPs, MLAs, minis- ters and a Vice-Chancellor of an agricultural university of Uttar Pradesh. Not only this, Uttar Pradesh deploys policemen for security of not only 527 MPs and MLAs but also 155 former MPs and MLAs. As many as 76 others, compris- ing district and panchayat heads and mayors, have also been given protection, besides chairman of Sangeet Natak Academy, chair- man and vice-chairman of state Women Commission, chairman of UP Seat Distribution, vice-chair- man of Unification Commission and chairman of UP Commerce and Tax Advisory Committee. A separate list of “other public functionaries” included additional advocate generals, government ad- vocates, V-Cs and doctors. Reading out from a note com- piled after receiving affidavits of various states, senior advocate Har- ish Salve told a Bench led by Jus- tice G S Singhvi that Uttar Pradesh has cited no rules for providing se- curity cover but general statements that it is given in cases of emergency or to maintain law and order. Salve also cited the data of Gu- jarat government and wondered why suspended IPS officer D G Vanzara, who faces serious charges in connection with the Sohrabuddin fake encounter case, and former minister Mayaben Kodnani, who has been jailed in a riot case, were still being given security cover. In Punjab, around 1,300 pub- lic functionaries and private per- sons have been provided security. Out of these, 65 persons, including six MLAs, face criminal charges. Bihar and Madhya Pradesh gov- ernments also provide security to a large number of businessmen. Salve told the Bench that it was inevitable to evolve a mechanism where a defined category of non- constitutional authorities should be given security on a need-based sys- tem, subject to periodical reviews. He also referred to a report by the the Bureau of Police Research and Development, saying available strength of police personnel was “shockingly” less than the total strength because of deployment for VIPs and VVIPs. Salve said the situ- ation was so bad in some states that less than half the police strength was actually available for common man. “How can in such a situation we expect them (police) to provide secu- rity to all the citizens? We once said Delhi has become unsafe but nobody seems to be taking the argument seri- ously. The problem emanates due to the three letters (VIP) and now they have added a fourth letter to it (VVIP),” observed the court. “Why should state bear the ex- penses of giving security to those with criminal cases? If they want they can have their own security. If somebody is facing serious criminal charges like murder, are we to assume they are absolutely falsely implicated? Simi- larly, businessmen and corporates should spend their own money if they need security...,” observed the bench. “We are not concerned about pro- viding security to a particular person but about the availability of police personnel for protecting citizens.” Salve said the issue could be dealt under three major headings — whether use of beacons and sirens by persons other than constitutional authorities was lawful; whether secu- rity to such persons without a sound system of review was lawful; and whether closure of roads for VIP movements was lawful. The bench decided to begin with the first issue. ASG Siddharth Luthra, who appeared for the Delhi government, said 27 categories of people have been identified for us- ing beacons and sirens by the Cen- tral rules whereas Delhi govern- ment has identified 11 authorities. “Forget about the rules and you tell us how many people de facto use red lights on their vehicles? Why do you only challan those using it un- lawfully and not confiscate their ve- hicles? We assume children and other family members of these au- thorities also use beacons...,” said the court. It will continue hearing the matter on Thursday. It is the government’s mismanagement of the econ- omy which has brought the country to this pass. Another year of this kind of mismanage- ment will be disastrous for In- dia. I am, therefore, appealing to Sonia Gandhi to take a call,” Sinha said in a statement. “Her team of economic managers has let down the country. She must, therefore, ask them to quit so fresh elec- tions could be held and a new government could initiate steps necessary to bring the economy back on the rails,” it said.
