I. INTRODUCTION

The productive rural infrastructure development project in the central highlands is funded by ADB. Ministry of Agriculture and Rural Development (MARD) is the project investor. This project will be implemented in the 5 provinces (Lam Dong, Dak Nong, Dak Lak, Gia Lai and Kon Tum) of the Central Highlands.

The long-term purpose of the project is to contribute to hungry alleviation and poverty reduction programs of the Government through sustainable development of the society, ecology and environment at community level by developing infrastructures for production, improving socio-economic conditions and living standards of people in the area. The short-term objectives of the project are (i) to rehabilitate and upgrade deteriorated or damaged irrigation system and rural roads; (ii) to strengthen management capacity and implementation of ODA projects, infrastructure management at community including province, district and commune levels to gradually improve living standards and conditions of the poor in the project area in the Central Highlands; (iii) to build models, institutional policies on "water saving irrigation technology for strategic and economic valuable plants" and "management and exploitation of irrigation schemes sustainably with the participation of all economic sectors ".

One sub-project of the project is “repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province” that will be implemented in three communes including Nam Dong, Dak Drong and Cư Knia, Cu Jut district, Dak Nong province. This Initial Environmental Examination (IEE) of the subproject is prepared to meet the requirements of environmental safety of ADB and the Government of Vietnam. It includes 11 parts:

II. POLICY FRAME, LEGISLATION AND MANAGEMENT

2.1 ADB policy

ADB safeguard policy statement (SPS) 2009 imposes safeguard requirements for all its funded projects. The SPS 2009 clarifies reason, scope and contents of the environmental assessment. Safeguard policy statement emphasizes on environmental and social sustainability in progress of economic growth and poverty reduction in Asia and the Pacific, therefore the objectives of SPS focus on:

i. areas Avoid adverse impacts of projects on the environment and affected people, where possible;

ii. Minimize/mitigate and/or compensate for adverse impacts on environment and affected people when avoidance is not possible; and

iii. Help borrowers/clients to strengthen their safeguard systems and develop the capacity to manage environmental and social risks.

SPS requires preparing environmental safeguard documents in the process of preparing a project including environmental management plan (EMP). The borrower/client needs to monitor EMP implementation. The monitoring will identify outstanding issues of EMP implementation and propose appropriate mitigation measures. Periodic monitoring report on EMP activities will be submitted to ADB every semi-annual during construction of the project.

Moreover, all subprojects under the loan 3032-VIE need to follow the specific guidance on environmental assessment as stated in the Environmental Assessment Review Framework (EARF) of the project, prepared by the project owner and approved by ADB. The subprojects under loan 3032-VIE only categorized as Category B or C will be included in the list of eligible subprojects for possible funding under the proposed Project. It is anticipated that all eligible subprojects will fall into Category B, whereby some adverse environmental impacts are expected, but of a lesser.

The subproject ““Repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province” is selected based on the project’s EARF that may cause the insignificant environment impacts and ranked as categorized B because: (i) It is not close to any preserved areas; (ii) there are not any households whose houses will be affected due to land acquisition to the subproject implementation;;(iii) it estimates there are about 36 households whose land will be acquired to implement the subproject but not any households will lose more than 10% their land. (iv) some environmental adverse impacts but these impacts will take place within subproject sites but can be controlled by mitigation measures. Thus an IEE needs to be prepared with an enclosed EMP.

2.2 Environment regulations of Vietnam government

The project must also comply with the environmental regulations. The Vietnam legal framework comprises of the following items:

- The Law on Environmental Protection adopted by the National Assembly of the Socialist Republic of Vietnam dated January 01, 2015. The law regulates general environmental protection requirements, policies and resources for protecting the environment;

- The Law on Labor adopted by the National Assembly of the Socialist Republic of Vietnam dated June 18, 2012 that regulates general requirement on safety and occupational health;

- The Law on Water Resources adopted by the National Assembly of the Socialist Republic of Vietnam dated June 21, 2012 that regulates general requirements on water resources management;

- Law on Biodiversity (No. 20/2008/QH12) (Requires proposed investment projects within buffer zones of conservation areas to have an approved EIAR );

- Law on Cultural Heritage (No. 28/2001/QH10) Law Amending and Supplementing a Number of Articles of the Law on Cultural Heritage (No. 32/2009/QH12) - Prohibits illegal construction or expropriation of land at historical-cultural sites or scenic landscapes.

- Law on Construction(No.50/2014/QH13)- Basic principles to uphold in all stages of

construction projects include environmental protection, coping with climate change,

public/workers’ safety, and prevention of, and responding to, fire and explosion;

- Decree No. 18/2015/NĐ-CP on April 01, 2015 of the Government that regulates on environmental protection planning, strategic environmental assessment, environmental impact assessment (EIA) and environmental protection commitment (EPPs);

- Decree No. 179/2013/NĐ-CP on November 14, 2013 of the Government that regulates on administrative violations in the domain of environmental protection;

- Decree No. 38/2015/ND-CP on June 15, 2015 of the Government that stipulates on waste and disposal management;

- Decree No. 127/2014/ND-CP on December 31, 2014, of the Government that stipulates environmental monitoring service activities; Decree No. 179/2013/ND-CP on November 14, 2013 of the Government that stipulates administrative fines for environmental protection;

- Decree No. 201/2013/NĐ-CP on November 27, 2013 of the Government that details the Law on water resources;

- Circular No. 27/2015/TT-BTNMT on May 29, 2015 of the Ministry of Natural Resources and Environment (MONRE) that guides details on strategic environmental assessment, environmental impact assessment and environmental management plans;

- Circular 36/2015/TT-BTNMT on June 30, 2015 of the Ministry of Natural Resources and Environment (MONRE) that stipulates on Hazardous waste management;

- Circular 27/2013/TT-BLDTBXH on November 18,2013 of the Ministry of Labor, War invalids and Social Affairs that guides training on labor safety and hygiene;

- Decision 3733/2002 /QĐ-BYT on October 10, 2002 of the Ministry of Health that promulgates 21 labor hygiene standards, 5 principles and 7 labor hygiene measurements;

- TCVN 4118:2012: National technical standard for irrigation works/systems and design requirements;

2. Components of the subproject

Repairing and upgrading three irrigation works system and interconnecting road in Cu Jut district include following components:

(i) Irrigation works of Cu Pu reservoir at Nam Dong commune; (ii) Irrigation works of Dak Dier reservoir at Cu Knia commune;

and (iii) Irrigation works of Dak Drong reservoir at Dak Drong

commune.

2.1. Irrigation Cu Pu reservoir in Nam Dong commune

a. Reservoir: Technical parameters of Reservoir

Reservoir Grade : Grade 3

Catchment area : 1.3 km2

Design flood frequency : 1.5 %

Irrigation supply assurance frequency : 75 %

Normal water level (NWL) : 510.00 m

Wide of dam : 5.0 m

Technical proposal

* Soil dam: raising the elevation of dam crest increased from 509.7 m to 510.8 m. Solving existing permeability problem by bentonite clay (GCL) on upstream slope, and covered by reinforced concrete slab M200 with 10 cm of thickness. . The wide of dam crest B=5m is utilized for transportation with road category of A, and wave-wall with 0.8 m of height and made by reinforced concrete M200 in upstream side. The downstream slope will locate drains; * Spillway: repair existing spillway with width of 3.2 m. Threshold

Elevation 510.00 m with regulation. Flood discharge is 3.65 m3 / s.

b. Irrigation canal and its works: Repairing, upgrading works on the canal, the damaged sections of the canal will be demolished and reconstructed with the cross section the same with the existing one.

c. Interconnecting road: 2.725 km of interconnecting road from the residential area to the headwork and the production area will be constructed per the grade A rural road. The road is 5.0 m of width in which, road surface is 3.5 m and made by reinforced concrete M250 with 16 cm of thickness, layered by 12 cm crushed stone;

2.2 Irrigation Dak Dier reservoir in Cu K’Nia commune

a. Head-works: No construction.

b. Irrigation canal & pump station:

- Constructing 655 m irrigation canals N1, N2, N3, N4, N5, which are behind of the irrigation sluices on the main canal KC1; and extend further 450 m of irrigation N6 to supplement irrigation for Dak D’rong. The bed of canals is made by reinforced concrete;

- Completing irrigation canals and works, including 3,765m of canals of T, T1, T2, T3, T4, T4-1, T5 and T5-1, to ensure irrigation capacity for 60 ha of supplementary irrigation area;

- Building 01 pump station to get water at the end of the main canal KC1 and completely build the irrigation canal and works on the canal to supply irrigation water for 60 ha at high area (at the end of main canal KC1);

c. Interconnecting road:

- 3.6 km of interconnecting roads from the residential area to the head-works and the production area will be constructed per the grade A rural road. The roads are with 5.0 m of width, in which road surface is 3.5 m and made by reinforced concrete M250 with 16 cm of thickness and layered by 12 cm of crushed stone;

- 4.3725 km of the irrigation bank roads will be reinforced per the grade C rural road to serve agricultural production. The roads are with 3.0 m of width, in which road surface is 2.0 m and made by crushed stone with 10 cm of thickness;

2.3 Irrigation Dak D’Rong reservoir in Dak

D’Rong commune

- Soil dam : is still good quality, only need to treat penetration at elevation of 374.10 m ( small penetration flow)

- Raising wave-wall up to 0.3 m with 0.2 m of thickness and made by reinforced concrete M200;

- Building 145 m2 of operational office as grade IV of infrastructure;

b. Irrigation canal:

- Concreting the last 697 m of main irrigation canal N2-2 by reinforced concrete with rectangular shape 50 x 70 cm;

- Construct new irrigation canals: N1-2 canal with 473.0m long, canal N2-1 from the irrigation sluice at K2 +025 on canal N2, canal N1-2-1 with 144m long on the canal N1-2-1. Canals are made by reinforced concrete with rectangular shape, in which the first two canals are in size of 40 x 50 cm, while the canal N1-2-1 is in size of 30 x 40 cm;

c. Interconnecting road:

- Repairing and upgrading 10.552 km of interconnecting roads from the residential area to the head-works and the production area with the grade A & B of rural road. These A roads are with 5.0 m of width, in which road surface is 3.5 m, made by reinforced concrete M250 with 16 cm of thickness and layered by 12 cm of crushed stone. While the B category is 3 m of width (in which road surface is 2.0 m), made by reinforced concrete M250 with 14 cm of thickness and layered by 10 cm of crushed stone;

Quantity of drainage culvert

Sub-project will remain almost drainage culverts on the road systems, and several culverts will be repaired and new constructed as following:

On the road surrounding the reservoir in Cu Knia commune there are 8 culverts at Km0+235, Km0+535, Km0+758, Km0+982, Km1+283, Km1+307, Km1+385, Km1+566. All the culverts were available and will be repaired and reused. There are also three newly built culverts at Km1+240, Km1+935 và Km2+350.

The road on main bank of canal KC2, there are three old culverts and one old intake culverts at Km2+707.55 will be repaired and reused.

Quantity of bridges Interconnecting roads in the subproject area will be upgraded on the existing roads or along the canal. Thus subproject will not construct or upgrade bridges on the roads.

Irrigation and drainage structures

The existing irrigation structures include reservoir, soil dam, spillways, intakes and irrigation canals. The outdated and deteriorated sections of irrigation systems will be repaired and upgraded as mentioned above;

The drains, which are located on dam and road slopes, and existing irrigation canals are working as drainage function. In addition, some roads in Dak D’rong have existing longitudinal drainage structures. Therefore, no longitudinal drainage structure will be built in this sub-project;

Some inter-commune roads intersect with the subproject road is (i) Nam Dong road; (ii) Dak Rong road and some other inter-village roads.

- The entire of rivulets and streams in the subproject area is in basin of Serepok River flowing from South to North through the boundaries of two provinces of Dak Nong and Dak Lak and going to the Kingdom of Cambodia.

- In the subproject, there are 03 reservoirs: Cu Pu reservoir, Dak Dier reservoir and Dak D’Rong reservoir.

- There are some streams flowing through communes such as: Ea Gang, 1.5km from Cu Pu reservoir, stream flowing Nam Dong and Tam Thang communes; Dak Dier stream at the southwest of Dak Dier reservoir; Dak D’Rong stream at the Southwest of Dak D’Rong reservoir. Around the reservoirs, there are also a lot of swallow brooks.

Number of hills and mountains

All areas of reservoirs as Cu Pu, Dak Dier and D'Dak Rong and their neighboring area have a complex and fragmented mountain and hill system with altitudes vary from +320 m to + 425 m. Only the production field is relatively flat.

Will the construction take place in rainy seasons?

For upgrading of head-works of Reservoirs

In rainy season, there could be some activities such as site preparation, materials gathering , building camps., operational houses and dam slopes, planting grasses on slopes diversion flow canal etc X The main construction activities will be implemented in the dry season, however, it will consider the cultivation periods of local people into construction plan to avoid cultivation period of local people (See more detail in construction method below).

Construction of Cu Pu head work, Dak DRong dam: withdrawing water from reservoir during 5 months: from December to April for repairing whole head-works. From May reservoir will be stored again to supply water for agricultural production.

During construction months of Reservoir head-works , construction flow diversion will be implemented to supply water for agricultural production . So that construction of works will avoid to cause affects to cultivation

Construction of canals: the same time with repairing /upgrading dams, head-works when withdrawing water from reservoir

Other components: construction road, rural road, operational house will be constructed in remain months of the year.

Temporary location and area occupation and material source

- Source of materials:

a. Works of Cu Pu reservoir and interconnecting road

- Waterproof and embankment materials for Cu Pu dam:

+ Waterproof membrane GCL is purchased from Ho Chi Minh City then transported to the work site by road.

+ Embanked soil: will be taken in upstream of reservoir, distance about 25 meters from dam foot (this land area belong to Cu Pu reservoir area )

+Rubble stone: will be used from stone peeled at the roof of upstream of dam.

- Soil for embanking canal and leveling road: will be taken from canal & road excavated soil as well as from excavation soil in Cu Pu reservoir;

- Construction materials such as iron, cement, stone, sand are bought at the center of Cu Jut district then transported approximately 8 km to the site;

b. Works of Dak Dier reservoir and interconnecting road:

- Embanked soil: The embankment soil for roads and banks of canals will be taken from soil mine in Dak Dier, this mine has been planned and with plenty of capacity. This soil mine is operated

since 2010 under Dak Nong irrigation exploitation & management Company with potential reserves & the soil mine is compensated since 2010

- Construction materials: iron, cement, stone, sand, ... are bought at center Cu Jut district then transported about 20km to the site.

c. Works of Dak Drong reservoir and interconnecting road:

- Embanked soil: The embankment soil for roads and banks of canals will be taken from soil mine in Dak Drong, about 300 – 500 m to the site . This soil mine is large knoll & public land & agreed by Dak Drong CPC

- Construction materials: iron, cement, stone, sand, ... are bought at center Cu Jut district then transported about 20km to the site.

The subproject will not need to exploit the material but only utilize excavated soil for embankment in which, the excavated soil is 50,815.89 m3 while embankment volume is 47,522.03 m3

- Material gathering yard:

The temporary yard for store the material will be defined by contractors during construction with households (renting) or CPC.

Balance : 3,293.86 m3

Discarded soil quantity: 7,622 m3 (about 15 % of excavated soil)

Disposal site is downstream of Dak Dier dam, about 100 m in Cu Knia Commune. This disposal site is old one and is compensated & approved by Cu Knia CPC

Disposal site is about 200 m to the spillway. This disposal site is old one and is compensated & approved by Dak DRong CPC

The subproject will employ 5 Bulldozer 110CV; 5 excavators <= 1.25m3; 4 crane 16T; 21 compactors; 12 cutting machines; 7 concrete mixer 250L; 03 generators 50KVA; 3 hoists 0.8T; 7 saws 2.7 KW; 3 water pumps 20CV; 3 compressors 240m3 / h; 3 self-operation hammer drill D105-110mm; 8 concrete drill 4.5 KW; 7 electric welding machines 23kW; 10 trucks & vans.

Such vehicles and equipment will be in good conditions and have periodical verifications.

IV. DESCRIPTION OF EXISTING ENVIRONMENT

Baseline environment data of the subproject has been collected from secondary data and field trip could be summarized as following

4.1 PROJECT LOCATION

Town The subproject locates at 03 communes Nam Dong, Cu Knia and Dak D’Rong.

Geographical position The sub-project is in the North of Dak Nong province and in the Southwest of Highlands. The coordinates of the subproject (coordinates VN2000) is as follows:

4.2 NATURAL ENVIRONMENTAL CONDITIONS

Air quality

The subproject is located in the mountainous area. There is no industrial or mining activities are taking place.

Center of Technology & Environment and Natural Resources Management - University of Agriculture and Forestry Ho Chi Minh City took 3 samples at Cu Pu irrigation works, 3 samples at Đăk D’Rông irrigation works and Đăk Diêr irrigation works in September 17, 2014. 7 parameters including noise, dust, SO2, NO2, CO, temperature from each sample were analyzed. The analysis results showed that air quality around the project was quite good, all the parameters are within limits of National technical standards for ambient air quality QCVN 05 : 2013/BTNMT. (See more details of ambient air quality analysis in annex 4)

Noise and vibration

The subproject is located in mountain area with low traffic density and opened green space. Moreover, it is found that Industrial/mining activities are underdeveloped in the area, therefore noise level is very low.

The measurement of noise level in comparing with National Technical standards on noise level, QCVN 26:2010/BTNMT indicates that sub-project area is in good condition without noise pollution, noise level in the Cu Pu reservoir area: 49.5 – 61.0 dBA (See more details of ambient air quality analysis in annex 4)

Climate and natural disasters

The subproject area is influenced by the tropical monsoon and plateau tropical monsoon climate. The year is divided into two distinct seasons:

- The rainy season is from May to October (accounting for approximate 90% of annual rainfall).

- The dry season is from November to April of the next year (accounting for approximate 10% of annual rainfall). May and June are the transitional months (beginning of rainy season).

Air humidity:

� Humidity average /year: 82.9%

� Sunshine hour:

� Total average number of sunshine hours each year is 2,304.2 hours.

� The highest number of sunshine hours per month is 272.6 hours.

� The lowest number of sunshine hours per month is 81.7 hours.

Wind: According to the meteorological data at the Buon Ma Thuat station (the closest station) in 30 years (1979 - 2008), the wind speed corresponding to its frequency and direction is determined as follows:

- Average wind speed is 2.7m /s. Maximum wind speed is 20m/s.

- Major wind direction is Northeast (NE), West (W) and East (E).

Natural disasters: A report by Dak Nong – Department of Agricultural and Rural Development (DARD) said that there are typically natural disasters in Dak Nong in recent years (i) sweeping floods; (ii) landslides; (iii) Floods; and (iv) droughts

- Sweeping floods took place in Dak Nong in recent years. In which one on September 14,15 and 16, 2012 in Dak Glong and Tuy Duc districts. It swept away 14 bridges and three persons. According to local people, this is a fiercest sweeping flood in 10 recent years through the province. Another one on October 07, 2013 in Quang Tan commune, Tan Duc district, it swept away temporary bridges, trees and farms and two persons died.

- Land slide often has taken place in the southern districts as Dak Song, Dak Dlong, Dak R Lap, Tuy Duc and Gia Nghia town. From 1992 to present, this phenomenon has happened with different extents and has risks, but not clarified reasons. In recent years land slices often takes place (i) in constructing the national highway No14 due to too high slope talus development; (ii) Gia Nghia-Quang Khe road; (iii) and bauxite mining areas etc..

- Flood phenomenon often takes place in the northern districts including Krong No and Cu Jut where have rather flat terrains. Like other provinces in the central highland, rivers and streams in Dak Nong do not have dykes so when it rains a long time, water from rivers, streams will flow to lower areas. Some typical floods in

Dak Nong was (i) on October 10, 2006, a flood in Dak Nong river has sunk hundred houses as heavy rain in days in upstream areas. As a result water level has risen up 2-5m and caused the flood. (ii) On September 10-28, 2012, a flood caused flooding for produce farms at Dak R’moan, Gia Nghia. (iii) on December 29-30, 2013, water on rivers and streams of Dak Nong reached peaks and had risks to happen sweeping floods in areas in Ea Krong river, Cu Jut district but luckily it did not happen.

- Drought, climate in Dak Nong has two clear seasons, rainy season is from May to October and dry season from November to April. Since deforestation for agriculture takes place commonly while rainy volume is reduced, rainy season finished sooner so surface and ground water has reduced significantly.

In Spring -Winter Crop of 2004-2005 , Dak Nong Province is damaged heavily by drought, ten thousands crop plants are dried & complete loss, mostly coffee with approximately 30,000 ha, about 3,000 ha of pepper, 2,000 ha of wet rice are damaged with value of approximately 2,000 billion VND ( Source : Study on Drought assessment of Dak Nong – Phan Thi Thanh Hang – Institute of Vietnam Geography & Science –Technology)

Topography and soil

- The subproject area is dominated by tectonics of plateaus; the terrain is relatively complex, only irrigated areas of the reservoirs are relatively flat. The topography is lower from West to East, from South to North; the average elevation is about 330m. The topography is with alternate valleys, rivers and streams.

- Sub-project is located on an area with 4 main categories of soil as follows: Yellow land on clay, black soil on basalt and Jail, red-brown soil on basalt and converged sloping valleys.

Surface water resource - The entire system of rivulets and streams in the subproject area is in basin of Serepok River flowing from South to North through the boundaries of two provinces of Dak Nong and Dak Lak and flows into the Kingdom of Cambodia.

- In the subproject, there are 03 reservoirs: Cu Pu reservoir, Dak Dier reservoir and Dak D’Rong reservoir.

- There are some streams flowing through communes such as: Ea Gang, 1,5km from Cu Pu reservoir, stream flowing Nam Dong and Tam Thang communes; Dak Dier stream at the southwest of Dak Dier reservoir; Dak D’Rong stream at the Southwest of Dak D’Rong reservoir. Around the reservoirs, there are also a lot of swallow brooks.

The above water resources are for domestic usage and agricultural activities of the local people.

Underground water Groundwater in subproject area is without pressure and located at the depth of 5 m - 30 m. Local people exploit it for domestic purposes.

Water quality

The 6 samples of surface water had been collected and analyzed with 10 parameters in 3 areas of subproject. The results of analyses have been compared with National technical standard for surface water quality QCVN 08:2009/BTNMT proves that almost

parameters are in limits except Fe-total in 3 samples (NM 4 in Dak Drong; NM 5 & NM 6 in Dak Dier).

There is 9 parameters of groundwater quality at 6 wells of households around 3 reservoirs (Cu Pu, Dak Dier and D'Rong) were sampled and analyzed by the Centre of Technology & Environment and Natural Resources Management-University of Agriculture and Forestry Ho Chi Minh City in September 2014 showed that all parameters were within the allowable limits of QCVN 09: 2008/BTNMT. Coliform indicator in the groundwater samples exceeded the threshold from 50 to 3,600 times (Coliform = 150 – 11,000 MPN / 100 ml of 02 groundwater samples of two households living in Cu Pu reservoir area)(Annex 4).

Flooding Flooding occurs only at cultivation area in valleys or adjacent to streams where altitudes are lower than residential areas and roads. Flooding occurs rarely, which takes place when heavy rainfall continues several days.

Terrestrial fauna and flora

+ The main flora in the subproject area includes agricultural crops (paddy, cassava, maize, beans, coffee, pepper, rubber...);

+ Terrestrial fauna in the area includes cattle, pigs, chickens, etc.;

+ No protected wild animal has been found in the area.

Aquatic fauna and flora + Aquatic fauna: fish, shrimp, eels and snails ...

+ Aquatic plants: algae, duckweed, grass ...

+ No aquatic fauna & flora species listed in the Red Data Book of Vietnam

Protected areas No ecological/protected area is within or near the subproject area. The closet protected area to sub-project is National Park of Yok Don, but really distance towards south-west of Dak Drong commune;

4.3 ENVIRONMENTAL AND SOCIAL CONDITIONS

Unexploded bombs, mines

The construction activities will be taken place at 03 reservoirs, irrigation canals and connecting roads to reservoirs.

However, almost construction places are in existing foundations, which had been built and used in recent years (Dak Drong – 2002; Dak Dier – 2011 and Cu Pu – 2001), therefore no need for checking UXO in those places. Only areas of expanded canals, roads and soil mines will be checking UXO, but in small areas and those places have been cultivated for long period;

Land use

Land adjacent the sub-project area includes: (i) agriculture and forestry land; (ii) non-agricultural land, distributed in the communes as follows:

- Agricultural land: Paddy, corn, cassava, 2 crops / year; - Forestry land: Perennial and industrial trees such as

rubber, coffee, etc.

Land use in three communes of the sub-project as following:

- Nam Dong comumne: Total natural land area is 3,967.31ha. In

which argricultural land is 3.502,7 ha (88.3%) including (i) land for industrial tree e.g coffee, peper, rubber of 46,34%; (ii) land for annual trees and rice of 51.6%.

- Dak Drong commune: Total natural land area is 5,889ha. In which argricultural land is 4,424.9ha (75.14%) including (i) land for industrial tree e.g coffee, peper, rubber of 25.17%; (ii) land for annual trees and rice of 74.25%.

- Cu Knia commune: Total natural land area is 2.965ha. In which argricultural land is 2,097.65ha (70.75%) including (i) land for industrial tree e.g coffee, peper, rubber of 47.8%; (ii) land for annual trees and rice of 51.2%.

Residential area near the sub-project

Residents in the subproject area mostly concentrate at the center of the commune or areas along the roads. The smallest distance from residential areas to the roads is 1.5 m. The Cu Pu reservoir is close to residents of villages 12 and 15 of Nam Duong commune. The Dak Dier reservoir is close to villages 5, 6 and 8 of Cu Knia. Dak Drong reservoir is close to villages 11, 12 and 19 of Dak Drong.

Rural infrastructures

The road network connecting among villages and communes is almost soil road, except intersection with gravel district road in Cu Pu. Those roads are from 3 – 5 m of width (from 1 – 2 m in canal banks), in degrading situation and difficult for travelling especially during rainy season:

- Cu Knia: The commune has 4 schools, 46 classrooms, 1 clinic.

- Nam Dong Commune: The commune has 8 schools, 116 classrooms, 1 clinic.

- Dak D'Rong: The commune has 7 schools, 135 classrooms, 1 clinic.

In the sub-project are, there is a low-voltage power system parallel to the upgraded road. However, according to observation, this power line is at least 3 m from the edge of the road, so this power line will not be affected by the sub-project construction activities.

Agriculture and aquaculture

+ Annual crop of the subproject area are paddy, cassava, maize and perennial crops such as coffee, rubber.

+ The total annual aquaculture area of communes are as follows:

- Cu Knia commune: 29.26 ha

- Nam Dong commune: 125 ha

- Dak D'Rong commune: 20.65 ha

V. ENVIRONMENTAL IMPACT SCREENING

5.1 Positive impacts

Constructing the subproject "Repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province" will bring positive impacts on environment and society as follows:

- It will ensure water to irrigate initiatively for 532 hectares of wet paddy, 285ha of coffee, pepper and 216 hectares of maize, 400 hectares of cotton and crops.

- It links the traffic from residential areas with production areas and works so that transporting materials and fertilizers for production as well as agricultural products will be more convenient. It creates favorable conditions for mechanizing agricultural production, bringing scientific advances into production, intensive cultivation to increase crop yields. The sub-project also reduces cultivation and labor costs and improves income of local peoples in the subproject area.

- It contributes to early completion of criteria No.2 - on transport, criteria No.3 - on irrigation, criteria No.10 - on incomes, criteria No.11 - on poverty rate of the new rural criteria in construction plan of new rural areas, which have been approved and are deployed at the locality.

5.2 Negative impacts

However, the subproject could also create several negative impacts, especially during construction phase, which need to be managed through appropriate mitigation measures. The negative impacts from subproject could be summarized in the following table.

HHs due to site clearance (land acquisition)

The acquisition of agricultural land will affect 36 HHs of 180 peoples, in which 10 of them are minorities. However, as described above, because the scattered of sub-project activities, the acquired land of each household is limited with small amount for permanently acquisition, while temporary acquired land will be returned after completion. Even though, the acquired of productive lands, though not much, of local people could slightly burden on their economic situation. Therefore, compensation plan need to be prepared and implemented.

In addition, this impacts has been informed to local people through public consultation, and all affected households have agreed to development of sub-project as well as voluntarily donate their land.

Objects : Affected peoples to be land acquired in Nam Dong, Cu Knia and Dak Drong Communes.

Affected level: Thus, social impact due to land acquisitions is minor due to these affected HHs will get beneficiary from upgraded road that it creates favorable condition for travelling from resident area to the agricultural production area & surrounding areas. In Highland Region, including Dak Nong, where to be affected at least in competition with other areas in Vietnam, forecast is an increase about 0.9 - 3% (0.9% for Dak Nong) compared to 1980 – 1990 period.. In general, the dry season rainfall would decrease while rainy season rainfall would increase. However, with medium emission scenarios (B2): by the end of the century, maximum one day rainfall in the North Region would increase by about 50% compared to 1980 - 1990 period, about 20% in the Central North Region. Otherwise, maximum one day rainfall would decrease in the Central South & High Land, the South Regions about 10% to 30 % (10% in High Land Region). However, it may occurs extraordinary one day rainfall, which 2 times bigger than compared to current record in different regions

However, the affected flora is invaluable. In addition, during construction of canals, soil and rock can slide down the canals and affect aquatic ecological environment. However, the extent of construction is small and fragmented in many places, therefore it will not significant impact on canal aqua-ecology. Furthermore, the construction of Cu Pu & Dak Drong reservoirs required to withdraw all water, this could result in disappearing of aqua-species available in reservoir currently, and take time to recover after completion of construction. However, the site assessment has indicated that the aqua-ecology in Cu Pu and Dak Drong is very poor and this reservoir is almost out of water storage function because of penetration.

Impacts by solid wastes

- Abundant volume (approximate 3000 m3) has

to be regularly removed to 03 dumping sites agreed with Cu Knir, Nam Dong and Dak D’Rong communes CPCs. In addition, local residents have agreed to reuse this discard soil for land yards and leveling, therefore the disposal amount is reduced;

- The transportation of abundant soil will be reused by local resident, but impacts during transporting need to be avoided ;

- Equip dustbins and mobility septic tanks to work sites (it is proposed that there will be 06 dustbins and 03 mobility septic tanks provided at each construction site);

6.3 Building capacity for EMP implementation

The relevant stakeholders need to ensure the EMP implementation as their responsibilities. All CPMU, Dak Nong PPMU, CSC, CC need to appoint officers/staffs to in charge of environmental management. However, most of these officers/staffs are also assigned for other works and they are not specialized in environmental management. Thus, to ensure EMP is implemented in compliance with sponsor policies and Vietnamese legislation, these officers/staffs must be guided /trained on EMP implementation capacity building. Training on EMP implementation must be held for different groups with different requirements.

- Dak Nong PPMU and CSC: The staffs that are in charge of environment will be trained (at least once in the first 3 months of the project) on monitoring and preparing environmental reports.

- Construction contractor: Will be trained (immediately after contract signing) on implementing mitigation measures and preparing reports.

VII. IMPLEMENTATION RESPONSIBILITY AND REPORTING

7.1 Implementation responsibility

Three agencies, which are related directly to EMP implementation, are PPMU, CSC and CC. The responsibilities of relevant stakeholders in EMP implementation are presented as table below.

- Publicly post EMP information at CPC where the project goes through;

- Integrate environmental requirements, including sanctions for failure to comply EMP into bids / contracts with CC and CSC;

- Instruct and approve site EMP prepared by construction contractor;

- Review SEMP prepared by contractors and submitting it to Dak Nong PPMU to get approval.

- Beside monitor construction quality, CSC also implement compliance monitoring on environmental safeguard of construction contractors every day as stipulated in SEMP;

- Report monitoring results and findings to Dak Nong PPMU monthly;

Construction contractor

- Appoint staffs to monitor environmental issues of the construction. This staff can be a concurrent staff if the workload of environmental is not heavy.

- Base on the EMP, CC will prepare a SEMP;

- Implement mitigation measures to minimize potential negative impacts as instructed in the EMP;

- Closely coordinates with local communities to perform environmental mitigation measures during construction process;

- Ensure that all construction activities have complete documents from the relevant authorities;

- Implement all measures to minimize negative impacts and to protect environment;

- Ensure that staff and employees understand the process and their duties in the EMP;

- Report to PPMU the difficulties and problems, if any;

- Report to stakeholders the environmental issues and coordinate with them to solve those issues;

Dak Nong PPC/DONRE

- Monitor any violation under policies on environmental management and protection of Vietnam;

- Evaluate any change of the design which can cause environmental impacts;

DPC/DONRE

- Approve EMP of the subproject in accordance with the provisions of Vietnamese laws;

- Monitor EMP implementation through internal monitoring system of the DPC.

Social organizations, women union and other associations

- Play a key role as a bridge between local community and PCs;

- Community Monitoring;

- Mobilize community participation in subproject implementation;

- Combine with the PPMU and contractors to perform road measures to prevent public services from damage;

- Participate in resolving environmental problems.

Local community

- In Vietnam, the community has the right and responsibility to regularly monitor environmental activities in the construction process to ensure that the rights and their safety is protected fully and mitigation measures are implemented effectively;

- In case of problems, they will report to community team, contractors or PPMU.

7.2 Report system

Besides monitoring on EMP implementation, stakeholder is also responsible for periodic report

EMP implementation. Table below shows the system of monitoring and reporting.

VIII. PUBLIC CONSULTATION AND INFORMATION DISCLOSURE

Public consultation and information disclosure of the subproject have to be implemented continuously from the design phase to the construction phase. It is to collect community ideas/ as well as encourage local people’ participation in preparing and implementing the subproject/EMP. Public consultation till the point of preparing IEE of the subproject.

IX. GRIEVANCE REDRESS MECHANISM

9.1 Purpose of the mechanism

During the deployment of the subproject, local people are disseminated environmental protection activities such as EMP. Negative impacts on the environment may occur during the construction and operational phases. Any comments/ suggestions of local people will be solved quickly, transparently and protected by law, particularly for affected people by the subproject. Complaint handling mechanism was classified by level and responsibilities of involved parties.

9.2 Grievance redress mechanism

Per the environmental management frame, there are 03 steps to redress complaint as below:

Stage 1: If a household has any complaint he/she can submit a complaint to the CPC-community monitoring board. CPC will work with CSC and CC to solve complaints.

Stage 2: If the complaint is not resolved, the complainant will submit an application to the Cu Jut DPC to resolve the complaint.

Stage 3: If more than 15 days but no response from Cu Jut DPC, the complainant may submit a complaint to the Dak Nong PPC (through Dak Nong DONRE). Dak Nong PPC will require Cu Jut DPC to solve the complaint. In case the complaint is still not resolved, Dak Nong PPC will require environmental police to investigate and requested stakeholders to resolve the complaint. See the mechanism in figure 1 below:

X. CONCLUSION, COMMITMENT AND RECOMMENDATION

10.1 Conclusion

The results of environmental screening and environmental impact assessment show that the subproject may cause some environmental impacts. But the impact is insignificant. However, the appropriate mitigation measures have also proposed to manage the negative impacts and maximize the benefit of the subproject. The responsibility of implementation, monitoring of the stakeholders have also identified to ensure environmental compliance.

10.2 Commitment

Dak Nong PPMU of the subproject repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province, commit:

- Implement requirements of environmental safety as stated in IEE via information dissemination, integrating environmental safety as stated in this IEE in bidding documents, in construction contracts and in the CSC contracts; mobilize human resources and monitor internally the IEE compliance.

- Report environmental safety implementation to Dak Nong DONRE and CPMU periodically as specified in the IEE.

- Compensate and resolve environmental pollution if there are any problem during operation of the sub-project.

- Handle complaints if any.

10.3 Recommendations

Base on the IEE report, Dak Nong PPMU recommends:

- No further environmental assessment is needed because the impacts on environment is insignificant.

- Based on IEE, Dak Nong PPMU would like to request functional Authority to give approval of IEE for Upgrading of Cu Jut Irrigation work system to create basis for next implementation steps, ensuring the implementation progress, effectiveness and benefits of the project .

ANNEX 5: ENVIRONMENTAL REQUIREMENT IN THE BIDDING DOCUMENT

- Cover material storage areas when raining is

longer than 24 hours.

Noise/ vibration

- Construction vehicles, machines and

equipment need to meet standards of exhaust,

noise, and vibration as regulated by the

Government. The Contractor needs to submit

the Engineer documents proving that all

construction vehicles, equipment, and

machines are checked and meet requirements

concerning noise and vibration generation of

the current Vietnam standards;

- The travelling of trucks, which serve for

transporting materials and waste, will be

scheduled to reduce accumulation of noise

sources;

- All noise and vibration generation activities

shall be restricted at rest time of local people

(12-13h and 20h to 6h) on road items, as: (i)

along the upgraded roads (approach road of

Cu Pu dam, roads around Dak Dier, Dak

D’Rong reservoirs); (ii) road connecting

between village 11 and village 12, roads of

villages 2,16 and roads on the main canal N2

in Dak D’Rong commune; (iii) pump station in

village 8 of Cu Knia commune.

- Construction schedule needs to be publicly

announced to local people.

On all construction sites of all civil work components under this subproject

4 Air pollution

- Watering sector under construction and

related road in dry & low humidity days ,

increasing the frequency of watering when

passing through communities

- All trucks must be covered when transporting

pollution materials as well as waste;

- Equipment/ vehicles have to be verified and

licensed. In addition, they are required

regularly maintained to ensure emitted gases

are in thresholds;

- Equipment and machines will not be allowed

to move outside of construction sites to ensure

control of emission sources;

- All vehicles must be washed cleanly before

going out construction sites;

- All material/ waste storages shall be located

away from any households and sensitive

areas;

them falling into water flows in irrigation canals

as well as blocking intakes and culverts;

- Regularly checking flow situation of canals,

intakes, culverts and implementing digging if

materials/waste block water flow;

- Placement of washing instruments/ vehicles

next to the rivers, streams, existing canals will

not allowed such as Ea Gang, Dak Drong,

Dak Dier streams and Cu Pu, Dak Drong, Dak

Dier reservoirs;

- Monitoring the compliance of construction

contractor with mitigation measures;

In Cu Pu reservoir, water intakes, culverts along upgraded roads and irrigation canals;

Impacts by solid wastes

- Abundant volume (approximate 3000 m3) has

to be regularly removed to 03 dumping sites

agreed with Cu Knir, Nam Dong and Dak

D’Rong communes CPCs. In addition, local

residents have agreed to reuse this discard

soil for land yards and leveling, therefore the

disposal amount is reduced;

- The transportation of abundant soil will be

reused by local resident, but impacts during

transporting need to be avoided ;

- Equip dustbins and mobility septic tanks to

work sites (it is proposed that there will be 06

dustbins and 03 mobility septic tanks provided

at each construction site);

- Weekly collect solid waste at 03 worker camps

with a local solid waste collection and dumped

in disposal sites of Cu Knir, Nam Dong and

Dak D’Rong communes. The sanitary

measures need to be done, including covering

lime and soil layer over the solid waste;

- Disposal of solid wastes into canals, stream,

other watercourses, agricultural field and

public areas shall be prohibited;

- Burning of construction and domestic wastes

shall be prohibited;

Impacts to existing infrastructure

- Work with existing infrastructure owners

(electricity, water...) to identify locations of

underground items if any;

- Load capacity of trucks do not exceed local

- A recruitment priority should be given to local

- The construction planned need to be

consulted with local DARD and communes

and announced in notice board of Nam Dong,

the withdrawing water plans of Cu Pu

reservoirs, and blocking canals during

construction;

- Construction of roads need to be completed

section by section to ensure travelling ability

on upgraded roads;
