In 2008, my partner Ed Ellis and I left Darby & Darby, a large and venerable intellectual property firm in New York City, and established Leason Ellis as a

new kind of boutique IP law firm in White Plains, New York. We invested in the latest technology and hired all-stars from other top IP practices. Today, we are one of the largest IP firms in the state outside of Manhattan and rated among the top New York law firms for our patent, trademark and copyright services.

Our broad array of clients range from Fortune 100 companies, to midsize and small companies, to start-ups, inventors and entrepreneurs. We protect the IP rights of domestic clients in the U.S. and abroad and, in turn, we directly represent many global companies in protecting their rights in the U.S. We also work on behalf of foreign law firms to develop and enforce their clients’ patent, trademark and copyright rights here.

You may be wondering about the meaning behind our apple tree logo. To us, it represents the perfect confluence of the three pillars of our practice. It all starts with a name (or logo, or jingle, or anything else source indicating). At the outset, we provide strategic searching services and opinions on whether a trademark is available for use and registration in the U.S. and in jurisdictions around the world.

To protect those marks, we regularly file applications for registration in the U.S. Patent and Trademark Office and arrange for foreign filing of marks. We endeavor to spot issues and deal with them in advance to reduce future costs and to increase the chances of obtaining registration.

Beyond registration, much can be done to protect trademark rights, including subscribing to a watching service, recording with Customs, and enforcing rights through opposition and cancellation proceedings, as well as through litigation. We identify these strategies for our clients and provide them with the options to maximize the effectiveness of their trademark rights.

These days, the business of trademarks extends to other related areas such as domain names and social media. And since an ounce of prevention is worth a pound of cure, we advise our clients on steps to proactively protect their trademark rights from infringement on the internet and various social media platforms.

The line between trademarks and copyrights is not always so clear (as you can tell by our logo). Whether it is an artistic design, a creative brochure, or a new text, we advise our clients on a wide variety of copyright issues. We encourage our clients to obtain registration quickly and often, as statutory damages are available in the U.S. when registered within three months of publication or before infringement, and the cost of copyright is low.

Our work in the copyright area is as vast as our client base. We work with our clients on copyright matters in fields including advertising, architecture, artwork, entertainment, fashion, jewelry, photography, publishing, software, and toys. In addition to obtaining registration, we also negotiate and draft copyright (and trademark) related agreements such as license agreements, work-for-hire agreements and security interests. The fact that we can identify and deal with such a wide variety of trademark and copyright issues, and the deep bench of our trademark and copyright attorneys and paralegals, plays an important role in distinguishing our practice from lesser ones.

Over the years, our attorneys have obtained thousands of issued patents for individuals and companies. We understand how to frame a patent application to enhance the chances of it being approved by the USPTO and to provide our clients with the broadest possible protection for their inventions.

Every day, along with handling domestic patent applications, we are filing, prosecuting, and managing foreign patent applications for our clients, taking an active role in managing the prosecution conducted by our foreign associates. In doing so, we can manage costs, avoid duplication of effort, and ensure that patent portfolios remain largely consistent across numerous countries.

Patents are not just about procurement, though. Our attorneys are adept at performing freedom to operate studies, conducting due diligence investigations, representing our clients’ interests in post-grant review proceedings, filing re-issue applications, and negotiating and drafting settlement and license agreements. We also analyze entire patent portfolios held by companies to locate gaps in coverage and uncover new opportunities for our clients.

And our work isn’t finished once a client has secured a patent or received a freedom to operate opinion. Our attorneys can continue to monitor developments in a given field or area of technology. We can track competitors’ patent filings and determine if they pose a challenge to a client’s business. We can also track patents and patent applications in technologies of interest to a client and provide updates if they become allowed, rejected, abandoned or expired. Our seasoned litigators have handled thousands of intellectual property disputes for a variety of clients, from multinational corporations (which want the best advice money can buy) to small, local start-ups (who quickly learn that good legal advice is often priceless).

With patent litigation, we have the science and engineering backgrounds to understand almost any patentable technology.

We have represented patent owners and alleged infringers alike in patent infringement and validity litigations in federal courts across the country, securing key wins at every stage of the proceedings, including before the Court of Appeals for the Federal Circuit. Our litigators also strategically employ post-grant patent review proceedings before the U.S. Patent and Trademark Office.

On the trademark and copyright litigation front, our litigation attorneys are equally skillful at making war or peace in furtherance of clients’ needs. We handle all types of trademark infringement, dilution, and unfair competition cases involving trademarks, trade dress, and product configuration. We regularly appear in federal district courts and circuit appellate courts across the country as well as before the USPTO and its Trademark Trial and Appeal Board. Similarly, we have litigated copyright infringement cases successfully on behalf of both plaintiffs and defendants in federal district courts around the U.S.

As a full service IP firm, we also handle related claims such as anti-counterfeiting, gray market sales, false advertising claims, trade secret protection, and domain name disputes. We also champion our clients’ IP interests outside the U.S. and manage international disputes through our global network of foreign associates.

Make no mistake. When settlement is in our clients’ best interest, we work diligently to achieve a favorable resolution. We draw on our experience negotiating and drafting settlement agreements, co-existence agreements, assignments, and licenses to bring disputes to an end so clients can go back to growing their businesses. But when settlement is not possible, we are prepared to go to the mat to protect and defend their interests.
