SCHEDULE-IV
QUALIFICATION CRITERIA
1. The Bidder should be registered with Tax Departments of the Government. As proof of the same,
attested copies of TIN No. and PAN No. need to be furnished with the technical bid.
2. The proof of the Bidder as Income Tax assessee in the form of Income Tax Returns of previous three years should be enclosed.
3. The Bidder should be in the business of horticulture related activities including supply of planting and other related material and installation of protective structures like poly-houses etc.
4. Bidder should provide customer list of past supplies/ assignments of similar nature.
5. The Bidder should furnish an affidavit on Rs. 10/- Non Judicial Stamp Paper to the effect that his/ her agency is not blacklisted by Central Government/ State Government or any other Government Organization including any university.
6. In case, the tenderer does not qualify the Technical Bid, his/ her financial bid (B.o.Q) will not be opened.
7. Tenderers who do not meet the criteria given above shall be disqualified. If the tenderer has made untrue or false representation in the forms, statements and attachments submitted in proof of the qualification requirements or has a record of poor performance or not properly completing the contract, inordinate delays in completion or financial failure etc, the tenderer will be disqualified.
8. Any additional bid participation criteria / eligibility conditions etc. mentioned in the Technical Specifications sheet shall also form part of the Qualification Requirements along with those mentioned in this chapter. Tenderers not fulfilling any of the above qualifications will be held technically unsuccessful and their financial bid (B.o.Q) will not be opened.
9. All supplies/installations will be F.O.R. Selaqui, Dehradun, Uttarakhand.
10. The Bidder should be having an annual turnover of Rupees One crore or above during the last financial year in the books of account. Adequate proof to support the claim should be submitted.
11. Name and address of the Bankers with Satisfactory Bankers Report regarding Bidder’s financial capacity for doing business worth Rs. 1 Crore or above in a year should also be furnished.
SCHEDULE-V GENERAL TERMS AND CONDITIONS
The offer will be subject to the following terms and conditions: -
1. The Tender offers shall be prepared and submitted online in two parts comprising (i) the EMD and Technical Bid mentioned in Annexure-B, Schedule-III, Annexure-A and all other papers required with catalogues & Specifications of required items (ii) Containing Financial Bid (B.o.Q) as Mentioned in Schedule-VI
2. Downloading and submission of tenders will be done by e-tendering process through the website of Uttarakhad Tenders https://uktenders.gov.in .The tenderers are required to submit Earnest Money Deposit (EMD) of 2% to 5% of the quoted value. The given percentage will depend on the total quoted cost of the goods as follows:-
Up to Rs.1 lakh – 5%
Rs. 1 lakh to 5 lakh – 4%
Rs. 5 lakh to 25 lakh – 3% and
Above Rs. 25 lakh- 2% shall be charged.
Security money should be given in shape of FDR of one year duration in favour of the Comptroller, Uttarakhand University of Horticulture & Forestry, Bharsar. In case the Bidder fails to deposit the same within the specified period, contract may be terminated and the work order may be awarded to the Bidder quoting the next lower rates (L2) and the Bidder may be debarred for a minimum period of 2 years.
3. The terms and conditions of the tenderer should be clearly typed or legibly written, giving the full name and address of the tenderer. The tenderer should quote the rates in figures as well as in words. Alteration, if any unless legibly attested by the tenderer, with full signature, shall invalidate the tender.
4. Tenderer black listed by Central Government/ State Government or any other Government Organisation including university shall not be eligible to submit the tender. If it is submitted, it will be rejected and legal action taken against the Tenderer.
5. The tender should be signed by the tenderer himself/ herself/ themselves or his/ her/ their authorized agent on his/ her/ their behalf. In case the tender is signed by the agent, the authority letter in original, in his/ her favour, should be enclosed with tender documents. The tenderer(s) should take care that the rates and amounts are written in such a way that interpolation is not possible. No blank space should be left, which would otherwise make the tender liable to rejection. Corrections, alterations, deletions should be initialled by the party. Unsigned tender will not be entertained.
6. The stores/ materials are required to be delivered to the consignee concerned and the consignee will carry out inspection and verification of the materials. The work on the project must begin within 45days of the placement of the order and must be completed within a period of 06 months.
7. The materials supplied under the Contract should be fully insured against loss, damage or theft up to the final destination.
8. Any or all tenders can be rejected by the tender committee without assigning any reason which shall not be challengeable in any court.
9. All disputes if any, arising between the University and the Supplier/ Bidder out of or in connection with the terms and conditions contained herein or as to the construction of application thereof, or the respective rights and obligations of the parties there under or as to any clause or thing herein contained or by reason of the supply or failure or refusal to supply
any material or make installation as to any other matter in any way relating to these shall be referred to the sole arbitration of the Vice Chancellor, Uttarakhand University of Horticulture & Forestry, Bharsar, or his nominee. The decision of the sole arbitrator shall be final and binding upon both the parties and subject to adjudication of Pauri Garhwal District Court. Place for arbitration shall be at Pauri Garhwal (Uttarakhand), India.
10. Jurisdiction: The obligations and liabilities arising out of this contract shall be construed in accordance with the laws of Union of India. The Pauri Garhwal (Uttarakhand) District Court Uttarakhand, India shall have the exclusive jurisdiction to try all or any of the disputes.
11. Tenders which do not fulfil any or all of the above conditions or are incomplete in any respect, are liable for rejection.
12. The tenderer shall submit all rates in Indian Rupees only, in case of any difference between the rates quoted in figures and words, the rates quoted in words shall be considered to be correct. The rates should be quoted inclusive of all charges such as Taxes, Duties, Surcharge, & Delivery Charges up to Flower Seeds & Plant Protection Centre, Selaqui, Dehradun, Uttarakhand. No additional payment shall be made by University on this account.
13. In case of any change made in the printed price of the materials/ installation by way of Rubber-stamp or sticker, the material concerned will not be taken into consideration for selection.
14. The University reserves the right to cancel the purchase order or any part thereof and shall be entitled to revise the contract wholly or in part by a written notice to the vendor, if:
a. The tenderer fails to comply with the terms of the purchase order, b. The tenderer becomes bankrupt or goes into liquidation, c. The tenderer fails to deliver the materials in time and or does not replace the rejected
goods promptly, d. A receiver is appointed for any of the property owned by the vendor, e. The tenderer becomes incapacitated to enter in to a contract under the Indian Contract
Act, 1872.
15. Upon receipt of the said cancellation notice, as provided in clause above, the vendor shall discontinue all works of the purchase order and matters connected with it.
16. The University may at its option, remove all defective material at the supplier’s cost.
17. Delivery on time as mentioned in purchase order shall be the essence of the order and no variation shall be permitted except with prior authorization in writing from the University.
18. In the event of delay in supply of material on the part of the tenderer, it will be at University’s discretion to accept delivery with a reduction in price of the material.
19. The tenderer must be dealing in horticulture related activities and have prior experience of installing protective structures and in installation of Poly houses, Poly Carbonate houses and Micro Irrigation System etc. The tenderer must provide the copy of PAN/ GIR Card.
20. The tenderer must submit specifications of all the materials with supply offered under this tender inquiry to University.
21. Force Majeure: 22.1 The Supplier shall not be liable for forfeiture of its performance security, liquidated damages
or termination for default, if and to the extent that, delay in his/her performance or other failure to perform his/her obligations under the contract is the result of an event of Force Majeure.
22.2 For purposes of this Clause, "Force Majeure" means an event beyond the control of the supplier and not involving the supplier's fault or negligence and event not foreseeable. Such events may include, but are not limited to, acts of the purchaser either in its sovereign or contractual capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight embargoes.
22.3 If a Force Majeure situation arises, the supplier shall promptly notify the Purchaser in writing of such conditions and the cause thereof. Unless otherwise directed by the purchaser in writing, the supplier shall continue to perform his/her obligations under the contract as far as is reasonably practical, and shall seek all reasonable alternative means for performance not prevented by the Force Majeure event.
In the event of delay in supply and/or unsatisfactory material, the University has the right to cancel the purchase order as whole or in part without liability for cancellation charges or otherwise.
In the event of rejection of non-confirming material, the tenderer shall be allowed without any extension of delivery time to correct the non-conformities, should however the tenderer fail to do so within stipulated time, the University, may cancel the order.
22. Neither payment shall be made for rejected material nor the tenderer would be entitled to claim for such material. Rejected materials should be removed by the tenderer from the site within one week of the date of rejection at his/her own cost. In case they are not removed they will be auctioned at the risk and responsibilities of the tenderer without any further notice.
23. In the case of not honouring the supply order, the University will have the right to impose penalty as deemed fit to resort to make purchase at the suppliers cost and risk and may forfeit his security.
24. Tenderer must agree to all terms and conditions stipulated in tender document.
25. Legal action may be initiated against such tenderer in case any of the information submitted by the tenderer is found to be false at any stage of the contract.
26. Quantity/Area/Purchase value of the work may be increased or decreased by the University.
27. Payment:
a. No advance payment will be made by the University.
b. Within 15 days after the receipt of order, the Supplier shall furnish Performance Security to the Purchaser for an amount of 5% of the Contract Value, valid up to 12 months after the date of completion of performance obligations including warranty obligations.
c. If the performance security is not furnished within the stipulated time as per above, the supply order shall be deemed terminated.
