AdultCare is specifically designed for adultplacement carers who have been approvedby local authorities’ social servicesdepartments or other authorised bodies, toprovide care for adults on a full daily or apart-time basis, or to provide residentialcare; or for adult carers who are suitablyqualified and experienced to provide suchservices under the direct payment scheme.

AdultCare applies whether you provide carein your own home or in the home of theperson being cared for. Cover is notrestricted to the home. It also applies if you,as part of your role, take the person in yourcare out on trips or to the shops – anywherewithin the UK.

Public LiabilityLimit of Indemnity £3,000,000(higher limits available on request)

If, as an approved, qualified or experienced adultplacement carer, you are held legally responsible foran injury (including death) to an adult in your care orthird party, or for damage to a third party’s property,then you will be required to pay damages. PublicLiability insurance covers these damages and anyresulting legal expenses, up to the limit of indemnity.

Automatically Included• cover for up to three named relief carers, while

you are ill or on holiday, for a maximum of 60days in any one period of insurance

• exhibitions, meetings and outings run for andon behalf of approved, qualified orexperienced adult placement carers

• food poisoning

• incorrectly administered first aid treatment

• administration of prescribed medicines anddrugs in accordance with policy conditions

• administration/provision of oxygen, gastrofeeding, naso-gastric tube feeding, cleaning andchanging of feeding or tracheostomy/tracheotomy tubes and emptying/changing ofstoma bags in accordance with policy conditions

• liability arising whilst caring for adults outsideUK, for a maximum of 60 days in any oneperiod of insurance – i.e. holiday cover

• contingency motor liability - this does not replaceor include ordinary motor insurance and it doesnot cover the motor vehicle or its contents. Itdoes provide cover if you use someone else’svehicle (with their permission) on adult caringbusiness and a motor accident occurs for whichyou are legally responsible, but the vehicle ownerdoes not have the necessary business cover inplace. However, you must take all reasonableprecautions to ensure that any vehicle used hasthe appropriate motor insurance.

Territorial Limits• anywhere in Great Britain, Northern Ireland,

Isle of Man or the Channel Islands.

Main Exclusions• liability for accidental bodily injury to any

minded adult not in your direct andimmediate personal care, custody or control(except in an emergency)

• property belonging to you or your family or inyour custody or control

• liability arising out of asbestos or itsderivatives

• terrorism, war and similar risks

• fines, penalties or liquidated, punitive orexemplary damages

• treatment (other than first aid treatment,the administration of drugs/medicines inaccordance with policy conditions, and theadministration/provision of oxygen, gastrofeeding, naso-gastric tube feeding,cleaning and changing of feeding andtracheostomy/tracheotomy tubes andemptying/changing of stoma bags inaccordance with policy conditions)

• liability for bodily injury sustained by anymember of your family being cared for by you

• liability for bodily injury sustained by anyperson employed by you

• liability arising while you are caring for more thanthree adults at any one time, unless advised toand agreed in writing by Morton Michel.

Legal ExpensesLimit £50,000 any one event

Cover, which is provided by DAS Legal ExpensesInsurance Company Limited (DAS), will pay yourlegal costs including solicitors’ and barristers’fees, court costs, expenses for expert witnesses,attendance expenses and accountants’ fees.

Automatically Included• a legal representative to support you if you are

asked to go to the police station for a matterrelating to your work as an approved, qualifiedor experienced adult placement carer

• legal defence in the event of a criminalprosecution arising from your business activitysuch as alleged abuse of the adult(s) in your care

• taxation disputes with HM Revenue and Customs

• support for contract disputes of over £100, if aclient breaks with your contract terms

• support for the recovery of a debt of over £100,if a client fails to pay for your services.

Main Exclusions• costs and expenses incurred before the written

acceptance of a claim by DAS

• any civil claim which does not offer areasonable prospect of success.

Helplines

Helplines, provided by DAS, that give professionaladvice and support are automatically included withyour policy. They are available 24 hours a day, 365days of the year.

Advice is given on:

• Tax: including VAT, self- assessment, incometax and HM Revenue & Customs audits.

• Health and medical information: includingfood allergies, medication, illnesses,vaccinations, nutrition and exercise.

• Legal matters: including employment andcontract disputes. You can also get adviceon the legal issues involved when preparingfor your risk assessment.

Help is provided through:

• Emergency repair support: giving access toapproved contractors for plumbing,electrical, gas and roofing repairs (you willbe responsible for the cost of the repair).

• Confidential counselling: a valuable supportservice to help you through those difficulttimes whether because of stress, anxiety,depression, relationships, bereavement orhealth problems. It includes onwardsreferral to relevant voluntary and/orprofessional services where appropriate.

Does this policy cover me to look after an adultfamily member?

No. The AdultCare policy is not designed to providecover for your legal liability to members of yourown family.

What is the minimum & maximum age of an adultreceiving care?

Minimum 18, no maximum age.

Does the policy cover a carer taking an adult outsideof the home (for example shopping; day trips etc)?

Yes. Cover applies anywhere in the UK whilst youare engaged in your duties as an adult carer.

Am I covered for administering medication?

The administration of non-prescribed drugs ormedicines, prescribed oral medication or asthmainhalers, and the administration of othermedication is covered strictly in accordance withconditions stated in the policy.

What is the maximum number of adults coveredunder the policy?

The policy allows for a maximum of three adults tobe cared for at any one time. If you care for more,please provide full details to Morton Michel.

How many ‘Relief Carers’ are covered under the policy?

The policy automatically allows for three reliefcarers to be covered, but cover for relief carersapplies for a maximum of 60 days in any oneperiod of insurance.

Do I need to notify you of any ‘Relief Carers’ beforethey provide the care?

Yes. We must have their full details (name,address, age, qualifications, experience etc) andthey must provide the answers to all of the relevantquestions on the proposal form.

Does the policy automatically cover mypartner/spouse/or any other adult family memberto provide care?

Only if they are a specified “relief carer”.

Am I covered to take my cared adult on holidaywith me?

Yes. If holidays are outside the UK, cover can onlyapply for a maximum of 60 days in any one periodof insurance.

Am I automatically covered if I move home?

Yes, but you should advise Morton Michel of yournew address as soon as possible.

Am I covered to take on work experience students?

No. The AdultCare policy does not provide anyEmployers’ Liability cover.

Am I covered to take a cared adult in my own car?

Your AdultCare policy will not cover you for usingyour car in connection with your adultcarebusiness. You will need to check with your currentmotor insurers to arrange adequate cover. So, what is contingent motor liability then?

Contingency motor liability does not replace yourordinary motor insurance and it does not cover themotor vehicle or its contents. It provides cover if youuse someone else’s vehicle (with their permission)on adult caring business and a motor accidentoccurs for which you are legally responsible, but thevehicle owner does not have the necessarybusiness cover in place. However, you must take allreasonable precautions to ensure that any vehicleused has appropriate motor insurance.

What if my care work occasionally exceeds eighthours a day?

Unless you have selected Residential care cover, itis assumed that you work a maximum 8 hour day. Ifyou regularly work longer hours, you must letMorton Michel have full details.

2. Disability Discrimination Act 1995

In accordance with the Disability Discrimination Act1995 we are able to provide upon request atextphone facility, audio tapes, large printdocumentation and braille documentation. Pleaseadvise us if you require any of these services to beprovided so that we can communicate in anappropriate manner.

3. Law applicable to the contract

We propose to choose English law as the lawapplicable to the contract unless we agree anotherchoice of law with you prior to the start date.

4. Premiums

Premiums are payable annually to Morton Michel.Insurance premium tax, as imposed by currentlegislation, is incorporated into all premiums.

5. Promise of satisfaction and service

We are confident that your AdultCare policy willbring you complete satisfaction. We undertake torefund the premium in full if you are not satisfiedwith the cover provided by your policy if it isreturned within 14 days of issue, but if there hasbeen an incident which has resulted or could resultin a claim you must reimburse the Company for anyamounts we have paid or may be required to pay,in respect of that incident.

6. Duration of contract

The first period of insurance under your AdultCarepolicy will be 12 months unless otherwiserequested by you and agreed by the Company.

7. Financial Services Compensation Scheme

We are covered by the Financial ServicesCompensation Scheme (FSCS). You may be entitledto compensation from the scheme if we cannotmeet our obligations. This depends on the type ofbusiness and the circumstances of the claim.Further information about compensation schemearrangements is available from the FSCS.

8. Notification of a claim

If you have a claim, or are aware of an incident thatcould result in a claim, please contact MortonMichel on 0845 2570900 or Sterling InsuranceCompany Limited on 0845 271 1300.

9. Enquiries or complaints

If you have an enquiry or complaint regarding:

• the suitability of this policy for your needs; or

• the information and advice you received whilstit was originally being discussed; or

• the operation or administration of the policy
