Appointments (A/V) 113475 a. Federal Lands Access Program Authorize the executive director to appoint representatives to the Programming Decisions Committee for the Federal Lands Access Program (MO) The Federal Lands Access Program (program) was established by Moving Ahead for Progress in the 21st Century (MAP-21). The program provides an opportunity for state, county, and local governments to implement a variety of transportation projects that provide access to, are adjacent to, or are located within federal lands in the state of Texas. A Programming Decisions Committee (committee) within each state will make recommendations regarding projects to be funded under the program. Each committee will be comprised of a representative from the Federal Highway Administration, the state department of transportation, and an appropriate political subdivision of the state that will represent the interests of the entire state. 113476 b. Grand Parkway Association Appoint members to the Grand Parkway Association Board of Directors (MO) State law requires transportation corporations to have a board in which the powers of the corporation reside. The commission shall appoint each director for a term not to exceed six years. This minute order approves the appointment of two members to the Grand Parkway Association Board of Directors. The members’ six-year terms will expire February 28, 2019. 7. Toll Roads (continued) 113485 e. Various Counties - Consider the approval of a term sheet for a project agreement with the North Texas Tollway Authority (NTTA) to facilitate the development,

financing, construction, operation and maintenance of SH 360 in Ellis, Tarrant and possibly Johnson Counties from I-20 to US 287. The final project agreement will be subject to further commission approval (MO) The department is negotiating a term sheet with NTTA describing the basic terms upon which the agencies will partner to develop the project. The term sheet will be the basis for the final project agreement, which will be subject to further commission approval.

113486 f. Harris, Montgomery, and Chambers Counties - Establish new toll rate tables for portions of SH 99 (Grand Parkway) consisting of the tolled portion of

Segment D in Harris County, and Segments E, F-1, F-2, G and I-2, replacing the rate tables previously set by the commission (MO) This minute order authorizes new toll rate tables for six segments of Grand Parkway, the tolled portion of Segment D in Harris County, and Segment E, Segment F-1,Segment F-2, and Segment G in Harris and Montgomery counties , and Segment I-2 in Chambers County, replacing the current rate tables previously set by the commission with toll rate tables that remove certain tolling points and add new tolling points on the Grand Parkway.

113487 g. Travis, Caldwell and Guadalupe Counties - Approval of additional programs to be funded with payments received from SH 130 Concession Company, LLC under

the SH 130, Segments 5&6 Facility Concession Agreement for the right to develop, finance, design, construct, operate, and maintain the SH 130 toll project from US 183 in Travis County to I-10 in Guadalupe County (SH 130 payments), and the allocation of funds from the SH 130 payments to those programs, and approval of additional projects to be funded from the SH 130 payments and the placement of those projects in work programs established for those payments (MO)

The department has established a separate fund to account for and track projects and project costs funded with the SH 130 payments. This minute order authorizes additional programs and projects to be funded with those payments.

113488 8. Pilot Project (A/V) Authorize the executive director to conduct a pilot project for the procurement of

engineering, architecture, or surveying contracts (MO) (Presentation)The executive director or designee is authorized to conduct a pilot project for the procurement of architectural, engineering, and surveying services for the purpose of improving the efficiency and fairness of the qualifications-based procurement.

9. Promulgation of Administrative Rules Under Title 43, Texas Administrative Code, and the Administrative Procedure Act, Government Code, Chapter 2001: (A/V) a. Final Adoption 113489 (1) Chapter 3 - Public Information (MO) Amendments to §3.12, Public Access (Access to Official Records)

These amendments are necessary to update the title of those individuals who may certify commission minute orders.

9. Promulgation of Administrative Rules (continued) a. Final Adoption (continued) 113490 (2) Chapter 5 - Finance and Chapter 23 - Travel Information (MO) Amendments to §5.42, Definitions, and §5.44, Exceptions (Payment of

Fees for Department Goods and Services); the Repeal of §23.27, Magazine Ancillary Products (Texas Highways Magazine); and New Subchapter D, Promotional Product Program, New §§23.51-23.59; and New Subchapter E, Merchandising Program, New §§23.101-23.105 These rule changes remove the authorization for the sale of goods from the subchapter regarding the Texas Highways Magazine and create new subchapters to establish the policies and procedures for the department’s sale of all ancillary and promotional products. The new language expands the program to include the ability to offer goods for sale at rest areas and travel information centers as recently authorized under MAP-21. In addition, these new rules expand the list of products currently authorized to align the department’s rules with the new federal provisions. The changes to Chapter 5 simply correct the references to Chapter 23.

b. Proposed Adoption 113491 (1) Chapter 5 - Finance (MO) Amendments to §5.107, Award by Commission, and §5.109, Discretionary

Award (Transportation Development Credit Program) The proposed amendments authorize the commission to award transportation development credits (TDCs) in a lump sum to a program or category of projects which support a department goal or initiative. The individual projects, and the exact amount of TDCs to be used for each project, need not be specified at the time of award. This revision will enable the department to utilize TDCs in a manner which maximizes federal funds on eligible projects. In addition, the proposed amendments clarify the process by which the commission will allocate TDCs to support public transit projects each fiscal year.

113492 (2) Chapter 9 - Contract and Grant Management (MO) New §9.40, Contract Under a Pilot Program (Contracting for Architectural, Engineering, and Surveying Services)

This new section provides for the executive director or the executive director’s designee to authorize the execution of an engineering, architecture, or surveying contract that does not comply with the subchapter if the procurement was part of a pilot project approved by the commission for the purpose of improving the efficiency and fairness of the qualifications-based procurement process.

10. Office of Compliance and Ethics Report (MO) (A/V) State law requires the commission to establish a compliance program, which must include a compliance office to oversee the program. The compliance office is responsible for acting to prevent and detect serious

breaches of department policy, fraud, waste, and abuse of office, including any acts of criminal conduct within the department. The compliance office is required to provide a monthly report to the commission regarding investigations and a summary of information relating to trends and recommendations.

11. Regional Mobility Authorities (A/V) 113493 a. Cameron County Regional Mobility Authority

Cameron County - Extend the deadline for beginning construction of the East Loop Project (State Highway 32) as previously approved in Minute Order 112249, which requires construction to begin within 36 months of the date of Minute Order 112249 (MO) Minute Order 112249, dated April 29, 2010, designated SH 32 along a new location and along a portion of FM 1419. Minute Order 112249 provides that in the event construction of the East Loop Project (SH 32) does not start within 36 months of the date of that order, Minute Order 112249 becomes null and void. This minute order extends that deadline to August 31, 2015.

113494 b. Central Texas Regional Mobility Authority Travis County - Consider the approval of the department’s determination to

exercise its option to develop, construct and finance the portion of US 71 in Travis County from east of US 183 to SH 130 (US 71 Corridor); authorize the US 71 Corridor in Travis County, with CONSTRUCT authority; and authorize the executive director to negotiate and enter into an agreement with the Central Texas Regional Mobility Authority (CTRMA) for the delivery of the US 71 corridor project (MO) On February 27, 2013, CTRMA waived and declined to exercise its option to develop, construct, and finance a portion of US 71 in Travis County. S.B. 19, 82nd Legislature, Regular Session, 2011, established a new primacy determination process in new Chapter 373 of the Transportation Code. As a result, the department has 60 days after that date to decide whether it will exercise its option to develop, construct, finance and operate that project, pursuant to Transportation Code, §373.053. The department and CTRMA will negotiate the terms of an agreement for the delivery of the US 71 corridor project.

113495 12. Private Activity Bonds (A/V) Tarrant County - Authorize the Private Activity Bond Surface Transportation

Corporation to take any and all actions necessary for the issuance of the private activity bonds as part of the plan of finance for Segment 3A of the NTE Segments 3A and 3B Managed Lanes Project (MO) In 2008, the commission created the corporation to assist with the development and financing of transportation facilities. In June 2012, the commission authorized the execution and delivery of a Facility Agreement (FA) with NTE Mobility Partners Segments 3 LLC (developer) for the development, design, construction, finance, and maintenance of the NTE Segments 3A and 3B Managed Lanes Project (project). Pursuant to the FA, the corporation will be obligated to issue private activity bonds (PABs), subject to certain conditions precedent, and if PABs are issued, to loan the proceeds to the developer as part of the plan of finance for Segment 3A of the project. The board of directors of the corporation has authorized certain actions relating to the issuance of PABs for the project, and the commission must also authorize such actions in order for the corporation to obtain the approval of the Texas Attorney General’s Office for the issuance of the PABs.

13. Contracts (A/V) Award or reject contracts for maintenance, highway and building construction These proposed minute orders contain information concerning the receipt of bids for highway

improvement contracts. The department may reschedule receipt of bids for those projects where the commission rejects all bids. Those bids accepted by the commission will result in conditional contract awards to the low bidders. Contract award conditions may involve securing funding from other sources, the contractor's ability to satisfy federal DBE subcontracting requirements, or other requirements as outlined in the project bid proposal.

Eminent Domain Proceedings (A/V) Various Counties - Authorize the filing of condemnation proceedings to acquire real property by eminent domain for non-controlled and controlled access highways (see

attached list) (MO) Commission findings, determinations, and authorizations for the state, by motion made in accordance with Senate Bill 18 (82nd Legislature), to acquire by eminent domain, upon the payment of adequate and just compensation, various ownership interests in specific parcels of real property that are needed to develop or improve both non-controlled and controlled access state highways, to include requesting the state attorney general to bring and pursue condemnation suits relating to those specific parcels of real property described in the attached itemized list.

15. Routine Minute Orders (A/V) a. Donations to the Department 113499 (1) Travel Information Division - Consider a donation from the Lubbock

Convention and Visitors Bureau to provide food, beverage, admission and transportation to area attractions, from various sponsors, to the department as part of its hosting the 58th Annual Texas Travel Counselors Conference in Lubbock, Texas on April 22-25, 2013 (MO)

The donation allows the department to exchange information and ideas with those in attendance which will be a great benefit to the department.

113500 (2) Dallas District - Consider a donation from Southern Methodist University (SMU) to provide payment for the costs associated with the installation of

overhead guide signs on US 75 to the SMU Campus (MO) The donation will pay the cost for the installation of overhead guide signs that will guide

the traveling public to the SMU Campus. 113501 (3) Houston District - Consider a donation from HEB Grocery Company, LP,

for the design and construction of a widening of SL 336 to four lanes, including a continuous left turn lane along SL 336 to the donor’s facility at the White Oak Market Commercial site development in Montgomery County (MO)

The donation will ensure the safety of the traveling public to and from donor’s facility.

113509 (1) Calhoun County - SH 35 east of Point Comfort - Consider the sale of surplus right of way to the abutting landowner (MO)

The surplus land was an addition to a roadside park. The park was closed, and the district recommends that the surplus land be sold. The abutting landowner has requested to purchase the surplus land, and it may be sold to the abutting landowner.

113510 (2) Lubbock County - FM 1585 and FM 1730 - Consider the exchange of right of way (MO) The owner of property needed for highway purposes has requested to exchange needed land for the surplus land at the realigned intersection and has conveyed the new land to the state. The district has determined that the surplus land is no longer needed for highway purposes, and it may be exchanged for needed land. The owner will pay the state the difference in value.

removal from the system of segments of both highways and transfer of control, jurisdiction and maintenance to the city. In addition, consider re-designation of the remaining segment of BI 35-L. Also consider the transfer and quitclaim of surplus right of way to the city (MO) Due to growth of the city, the roadways now function as city streets. The district has advised that they do not provide logical connectivity to the existing state system and that it would be mutually beneficial for the city to assume control, jurisdiction and maintenance. The city has requested that the state-owned right of way be transferred to the city in consideration of the cost of future maintenance and that the no record title land be quitclaimed to the city.

c. Finance 113512 (1) Accept the annual continuing disclosure report for the State Highway Fund revenue bonds (MO)

Under provisions of the Supplemental Resolutions to the Master Resolution for the State Highway Fund bonds, the commission agreed to provide annual updates for operating and financial information provided in the official statements. Updates are due within six months of each fiscal year end.

113513 (2) Accept the annual continuing disclosure report for the Texas Mobility Fund (MO) Under provisions of the Supplemental Resolutions to the Master Resolution for the Texas Mobility Fund, the commission agreed to provide annual updates for operating and financial information provided in the official statements. Updates are due within six months of each fiscal year end.

113514 (3) Travis and Williamson Counties - Accept the annual continuing disclosure report for the Central Texas Turnpike System (MO) Under provisions of the Indenture of Trust for the Central Texas Turnpike System bonds, the commission agreed to provide annual updates for operating and financial information provided in the official statements. Updates are due within six months of each fiscal year end.

d. Highway Designation 113515 (1) Hidalgo County - Designate SH 68 along a new location from US 281 in

the city of Edinburg east and southward to US 83 in the city of Donna (MO)

The Commission will consider the designation of a segment of the Hidalgo Loop Project as SH 68 along a new location from US 281 approximately 0.4 mile north of FM 2812 in the city of Edinburg east and southward to US 83 approximately 0.6 mile east of FM 1423 in the city of Donna, a total distance of approximately 19.9 miles.

113516 (2) Kaufman County - Designate SH 34 along a new location in and near the city of Terrell and redesignate the old alignment as SH 34-A Business (MO) The Dallas District has requested the designation of SH 34 along a new location from approximately 2.4 miles north of US 80 in Kaufman County southward approximately 3.3 miles to Airport Road in the city of Terrell. This minute order also redesignates the old alignment as SH 34-A Business.

existing County Road 420 east of the city of Groesbeck (MO) The Waco District requested the designation of FM 1245 be extended from its present terminus at the Navasota River eastward approximately 0.2 mile along an existing segment of CR 420.

113518 (4) Harris and Fort Bend Counties - Designate a segment of US 59 from I-610 West in Houston to north of Spur 529 in Rosenberg as I-69 (MO) The commission will consider the designation of a segment of the state highway system as I-69, concurrent with US 59 from I-610 West in Houston to the US 59 access control approximately 0.2 mile north of SS 529 in Rosenberg, a total distance of approximately 28.4 miles. The Houston-Galveston Area Council, the American Association of State Highway and Transportation Officials, and the Federal Highway Administration have approved the designation of this segment.

113519 e. Release of Access Rights Dallas County - Loop 12, southbound frontage road northwest corner with SH 180 (West Davis Street) - Consider the designation of a location on the highway at which access will be permitted to the abutting property (MO) The designation of a 64-foot break in the control-of-access line will allow the abutting landowner to open a proposed driveway location for access to and from the southbound frontage road. The district has determined that access may be permitted at the designated location.

113520 f. Transportation Planning Various Counties - Approve the Fiscal Year 2012 Annual Report on the Economically Disadvantaged Counties Program (MO) State law requires the commission to report annually to the governor, the lieutenant governor, and the speaker of the house of representatives on the use of matching funds and local incentives and the ability of the commission to ensure that political subdivisions located in economically disadvantaged counties have equal ability to compete for highway funding with political subdivisions in counties that are not economically disadvantaged.

113521 g. Speed Zones Various Counties - Establish or alter regulatory and construction speed zones on various sections of highways in the state (MO) This minute order establishes or alters regulatory and construction speed zones on various sections of highways in the state. 16. Executive Session Pursuant to Government Code, Chapter 551 (A/V) Section 551.071 - Consultation with and advice from legal counsel regarding any item on this agenda

OPEN COMMENT PERIOD - At the conclusion of all other agenda items, the commission will allow an open comment period, not to exceed one hour, to receive public comment on any other matter that is under the jurisdiction of the department.
