ORDER

CONSOLIDATED ARTISTS B.V. ("Opposer") filed on 06 September 2013 a Manifestation stating that further to its Manifestation dated 04 September 2013, Opposer encloses a copy of Respondent-Applicant's request for disclaimer addressed to the Director of Trademarks, which provides that:

"To avoid the possibility that the subject application will be opposed by an interested party, applicant voluntarily disclaims the word MANGO apart from the mark sought to be registered. Accordingly, it is respectfully prayed that the certificate of trademark registration to be issued for MERRY MANGO MEDLEY reflect the said disclaimer."

In view of the foregoing, Opposer voluntarily withdraws its opposition to Respondent-Applicant's trademark application for MERRY MANGO MEDLEY and requests that the present case be closed.

With the express withdrawal by the Opposer of its opposition to the subject trademark application, there is no more factual or legal basis to proceed with this case.

WHEREFORE, premises considered, the instant case is hereby DISMISSED. Let the filewrapper of Trademark Application Serial No. 4-2012-00012385 be returned, together with a copy of this Order and the Opposer's Manifestation, to the Bureau of Trademarks for information and appropriate action.
